The heart of carving By Cali Bagby Weekly editor
Bob McCabe started carving when he was 30. Now many years later he still gets lost in the art form. It’s a passion, he said, that keeps him going. “They say the symptoms of Parkinson’s disappears when you do something that you love,” he said. McCabe was diagnosed with the disease in 2000, but that has not kept him from carving. According to Mayo Clinc staff, Parkinson’s disease is a progressive disorder of the
nervous system that affects your movement. Over the last eight months McCabe has devoted his free time to creating a King salmon out of old growth red cedar that came from the Olympic Peninsula. “Everyone should have something they are passionate about,” McCabe said. “Everyone has something they could do well if they started and repeated.” McCabe also builds driftwood furniture. He created the outdoor driftwood altar and two benches that are now an integral part of the

A few weeks ago McCabe came into the Colin Goode Art Gallery in Lopez Village and asked if the gallery would show his salmon. “The gallery is mainly committed to showing wall art but I thought the salmon was so ‘Lopez’ and so wonderfully carved that I couldn’t resist showing it,” Goode said. The piece was installed in the gallery last week with the help of Paul Dolan, McCabe’s New York cousin. Beyond woodwork, McCabe enjoys whitewater rafting, traveling, shrimping and fishing. He chose the King Salmon as the subject for his latest carving because
of his love of fish. “If I can’t catch them, I carve them, “ he said. “That’s my motto.” He has a whole wall of wood fish at his Davis Head home that he shares with
his wife Pamela. He has also presented each of his seven grandchildren with a carving. In the future, McCabe wants to make more bowls and carve different types of fish like halibut.
He describes his Parkinson’s symptoms as a general malaise. “I don’t feel good and that goes away when I’m carving,” he said. “Any shaking at all definitely stops.”
Lopez native finishes sixth in race Brian Pal, of Lopez Island, recently completed the Tour Divide self-supported, single-stage mountain bike race. He finished sixth overall and as the first American, on July 1 after completing 2,859 miles in 17 days, nine hours and 28 minutes. “Every person who has followed the race has been capti-

vated by the sense of adventure and the amazing character qualities it takes in order to compete,” said Tammy Pal, who is Brian’s mom and a Lopez resident. Normally the race is 2,745 miles but this year there were two detours around forest fires, which extended the route to 2,859 miles with 200,000 feet of elevation gain. Starting in Alberta, Canada, and ending in Antelope Wells, New Mexico, riders go through five states. The route is a mixture of forest service roads, single track trails, ATV trails and pavement. There are rivers to cross and a wall to climb, along with every kind of terrain imaginable. According to the Tour Divide website, the theme of the race is “to keep moving and be moved; exist well outside one’s comfort zone in tackling a cross-continent bike packing odyssey; finish as fast as possible without cracking.” See Race, page 8

A look at Lummi’s stance on the coal terminal By Lopez No COALition
The news that the Lummi Nation stood firm to “unconditionally and unequivocally” oppose the ill-considered Gateway Pacific Terminal project has brought us joy and humility. The Lummi’s July 30, 2013 letter to the Army Corps of Engineers brought joy because the tribal opposition to the plan to export 50 million tons of coal
from Cherry Point could potentially stop the project by invoking treaty rights. Because Cherry Point is within the Lummi’s Usual and Accustomed grounds and traditional areas, the tribe has a very strong legal case against the project due to its likely interference with treaty guaranteed fishing rights. This legal case is an entirely separate process
from the Environmental Impact Statement process which is underway and led by the Corps in joint collaboration with Whatcom County and the WA State Department of Ecology. Though independent of each other, the two processes are inter-linked and one may delay or impact the other. In a recent press conference, a Corps official stated that the Lummi posi-
tion might influence the agency to stop processing the GPT permit. In the past, the Corps has refused to process permits on other projects that tribes said would violate treaties. The Lummi signed the Treaty of Point Elliot with white settlers in 1855 to trade vast amounts of their land and resources in exchange for rights including reserved areas of land (Indian reser vations), sovereignty and protection of hunting and fishing rights in their Usual and Accustomed grounds and traditional areas. The treaty is legally binding despite the long passage of time. Treaty fishing rights were reaffirmed and interpreted to mean equitable allocation between the treaty tribes and other WA citizens by the “Boldt decision” in 1974. It is a common misperception that treaty rights are “special” rights given to native people by the US government because of their racial status, but this is not the case. The govern-

ment does not “give” treaty rights to anyone – native people reserved them when they signed treaties in a government-to-government relationship. The Lummi’s firm stance not only protects their own fishing rights and economic benefits, but also ours. Their letter and action are part of their determined efforts to “preserve, promote and protect their Schelangen, “way of life”, in which “everything is connected,” as are the lives of all the plants, animals and people of the Salish Sea. It is with great humility and grati-
tude that we applaud their leadership and stewardship, yet again, in defending the seventh generation of not only their people but also ours, against potential global harm by GPT coal exportation. With the Lummi’s courageous lead, it is our turn to do our part. Write letters to editors to publicly recognize the Lummi’s leadership. Write to politicians and local governments of all levels to urge jurisdictions and authorities to give the Lummi Nation the needed acknowledgment and support they deserve.

In spite of a Friday rainout, the annual Lopez Open tennis tournament was a great success, drawing players from Friday Harbor, Orcas Island and the mainland, as well as players from Lopez. The tournament pot luck draw party was held Thursday evening August 1st in wonderful Lopez weather. Only a few games were played on Friday before the rare summer rains swamped play for the day. However, ingenious restructuring and rescheduling by Tournament Director Audrey Wakefield allowed all of the roundrobin brackets to be completed and the tournament was back on schedule by Saturday evening. Sunday’s finals were initiated with Dave Hall defeating Pat Howe in a nail-biting three setter that
was decided by a 7-5 tiebreaker in the final set. The first two sets were 0-6 and 6-4. Dave also won the “Iron Man” award for playing more games (by far) than any other player in the tournament.
In women’s doubles Melissa Beckman and Annette Alling defeated Linda Vint and Becky McKee in two sets 7-5, 6-1. The men’s doubles found Scott Jamieson and Tom McDaniel edging Tom Pal and Mark Collingwood also in two sets 7-6 (7-3), 6-3. In the grand finale mixed doubles Jill Dann and Dave Alexander of Orcas Island
topped Laura Geniuch and Timothy Maxon in two sets 6-2, 6-3. It is interesting to note that all the winning doubles teams were composed of a right hander paired with a southpaw.

Skatepark and the Retreat comes to Lopez Richlite Company, a family-owned, Tacomabased manufacturer of paper-composite materials popular in the architectural, marine, commercial food and action sports industries, announced it is in the process of building a new skate park at the Lopez Island Community Center that the company will donate to residents of Lopez Island on August 17. The concept for the new park was developed by Shawn O’Day, Richlite’s president, who has boated around and vacationed on Lopez with his family every summer for decades. In August 2012, he walked past the current skate park
at the community center and noticed it had a large, quality concrete platform but few features, limited to two quarter pipes and a rail box. Richlite manufactures Skatelite that is one of the world’s most popular skate ramp surfaces used in the X-Games and by the majority of professional skaters and BMX athletes on their personal ramps. Due to O’Day’s affection for the Island, he discussed the idea of building a new park on Lopez Island with his executive team and plans were put into motion. “Lopez Island is such a beautiful and unique part of the world,” O’Day said. “It’s a special location for all of

Richlite has commissioned California RampWorks, the designers behind the X-Games halfpipe and mega air ramps, to build the Lopez Island park. Richlite, celebrating its 70th anniversary this year, will dedicate the skate park to island residents on August 17 with a day of skating, food, music and entertainment called The Retreat. Several of the world’s top skaters and BMX riders, including Bob Burnquist, Bucky Lasek, Ryan Nyquist and others who will have just competed in the X-Games a few days prior will be on hand to demonstrate their latest tricks and get up close and personal with fans on the island. In the days leading up to the event, Richlite is holding its annual international sales meeting on Lopez with more than 80 distributors, customers,
VIPs and their families. Guests who participate in the free event on August 17 can skate and ride with the pros during open sessions, and enjoy music, films and food. Festivities begin at 9:30 a.m. with the dedication of the new skate park. To complement the skate park, California RampWorks, will bring up their vert ramp directly following the X-Games in Los Angeles for the athlete sessions during The Retreat. Music begins at 6 p.m. with live performances by The Good Husbands, several DJs and a special guest that alone is worth the trip. United Way helps kids in the community Why does United Way of San Juan County fund Kids’ Summer Workshops? The local United Way’s focus is to help meet vital needs in San Juan County, and one of the most important issues facing children and youth is how to avoid risky behaviors and find positive role models and growth experiences. Last spring, the entire Lopez Island Elementary School took a field trip to the Fidalgo Pool in Anacortes. Once there, students’ swimming capabilities were screened. Students who could swim a short

distance across the pool (about 12 yards) were allowed access to all parts of the pool. If they could not pass this test, they were relegated to the roped off shallow end of the pool and required to wear a floatation device. When Marvin Snapp, the only fifth grader who didn’t pass the swim test, he had to spend the day with the younger kids (mostly kindergarten through second graders), clad in his life jacket, wishing he could be with his peers. Last summer, Marvin received scholar-

Lack of permits prompts $1.6 million settlement By Steve Wehrly Journal reporter
In the first of what may become many legal battles about the Gateway Pacific Terminals Cherry Point coal port proposal, RE-Sources for Sustainable Communities settled in U.S. District Court its lawsuit claiming that Pacific International Terminals illegally cleared, bulldozed, drilled and filled 1.2 acres at the site of the proposed coal port.

PIT, a subsidiary of SSA Marine of Seattle, agreed to pay $1.6 million in penalties and fees, including a payment of $825,000 to the Rose Foundation for Puget Sound restoration projects, $775,000 to RE Sources attorneys, and a 2.9-acre wetlands set aside to mitigate impacts of un-permitted activities at the site. PIT’s work at the Cherry Point site was part of a geotechnical investigation project, authorized by PIT on property currently planned for the Gateway Pacific Coal Terminal. director of RE Sources, SSA Marine, the corporate parent for PIT, knew what they were doing, including the fact that the Lummi Nation identified some of the land in question as archaeological or tribal burial sites. Hoyer noted in a press release that SSA has decades of experience developing marine port facilities, including building new operations and providing engineering, port design, terminal construction and project management services. According to RE Sources attorney Richard Smith, “PIT acknowledged that they knew beforehand that permits or authorizations were required not only from the Army Corps, but also from Ecology and Whatcom County. They could offer no explanation for why they didn’t get these, except that following the law ‘fell through the cracks.’” Philip S. Lanterman, a Re Sources consultant on largescale construction project management, stated “In my opinion, it is probable that PIT intentionally chose to proceed with the geotechnical investigation without necessary permits to obtain the expected economic benefit of securing the geotechnical information early in the project timeline, and PIT has actually received such benefit.” SSA Senior Vice President Bob Watters countered in a press release: “This is what we call a ‘nuisance’ lawsuit. We thought we had the permits we needed. As soon as we found out we did not, we stopped the work. Even before the Corps, Ecology and Whatcom County came out with their findings, we began to develop a plan for restoring any affected habitat.”
