More than 30 years ago, the Kirkland couple’s mysterious deaths were front page news - a sensationalized story with some inaccuracies. s Aug. 1 looms, Kirkland city officials urged the Surface Transportation Board to make a decision on the pending Cross Kirkland Corridor suit before the city looses money and good weather for rail removal construction. If the board grants the injunction, it would prevent the city from removing the railroad tracks and its assets along the 5.75-mile-long corridor until the board makes a decision on the pending petitions the Ballard Terminal Railroad Company LLC filed on April 2. The city planned to remove the rail tracks and ties in April but plans came to a halt when they were served a federal lawsuit. But if the Surface Transportation Board rules in favor of the city, the petitions for the Ballard company to obtain the right to reactivate rail service from Woodinville to Bellevue would be moot. After months of hashing out the details, subpoenas, testimony and legal minutia the city needs a decision now. “Kirkland asks that the board rule by Aug. 1, so that Kirkland can commence rail salvage and development of an interim trail on the rail-banked Cross Kirkland Corridor during the 2013 construction season,” according to court documents filed July 10 by the city’s attorney, Matthew Cohen with Stoel Rives LLP. “The motion has been fully briefed since early June and Ballard has had ample opportunity to explain to the board why a prelimi-

nary injunction is warranted.” The city believes the Ballard railroad company’s strategy is to stall for time, the court documents continue. “For Ballard, no decision equals success,” the documents state. Executives from A&K Materials, the contractor that would remove the railroad, said they would likely be able to remove the railroad for an interim trail during the 2013 construction season if they were told by Aug. 1 to proceed. Court documents state it would be difficult for contractors to complete the project if notice was delayed because the fall rains in the Pacific Northwest “close the window for construction work,” therefore pushing the interim trail back another year. In a June 4 statement, City Manager Kurt Triplett said grant funding for rail removal and construction of the interim trail expires after 2014. And delaying the project for the next season would cost the city $175,000 in interest rates. If the contractor does not complete the project in the next six months, Triplett said nearly $107,000 worth of salvaged tracks would also potentially be lost. Rebidding the project would cost around $1,500 and maintaining the corridor’s overgrown plants and shrubbery, with the risk of floods, would cost the city $211,000 for ditch excavation labor and equipment. “Kirkland staff concluded that removing the rails and leaving the rail bed and bal[ more RAIL page 6 ]

Time to bring balance back to city’s zoning process

he bad news: Kirkland is a magnet for developers. The good news: Kirkland is a magnet for developers. It is an odd state of mind that our community finds ourselves in. As we embrace the benefits that development brings, we agonize that it threatens what many of us hold dear; Kirkland’s intimately scaled, small-town vibe. For evidence, we need look no further than the serial controversies suffered by several of our most recent redevelopment proposals: Park Place, Lake Street Market, Bank of America, Portsmith Condos, Houghton redevelopment plan and Potala Village. Each brought unprecedented levels of building height and density. Each triggered significant levels of community backlash. That there should be this level of controversy over redevelopment is not normal. It is indicative of a community whose expectations are fundamentally out of kilter with what the zoning code allows. This is contributing to an ongoing cycle of citizen ambivalence regarding zoning approvals and subsequent anger about ever-larger buildings that continue to be approved. This troubles me greatly and should also trouble you, dear reader. Our great location, diverse population and developer-friendly zoning have made us attractive to development, a fact that we ought to embrace. Unfortunately, our collective assumptions about Kirkland’s built environment are far removed from the reality of what our downtown will eventually become through the current zoning. The fact is, under current zoning policies, nearly all of our downtown’s small scale buildings will be replaced by larger multi-story mixed-use buildings. Even Park Lane - that iconic Kirkland street filled with intimate boutiques and shops - will eventually be lost to redevelopment. However, for those of us living in areas outside the downtown business district (Houghton, Totem

Lake, Finn Hill and other newly annexed areas), the opportunity still exists for engaged, well organized and motivated communities to control how much and what kind of redevelopment occurs. Without development at some level, neighborhoods and cities stagnate and eventually decline (Detroit being the extreme example). Redevelopment in an existing city is, in essence, the city being renewed. Redevelopment brings a lot of desirable benefits. Old buildings are renewed or replaced, public amenities are added, new businesses come in, jobs are added and tax revenues increase. Theoretically, a “win, win, win” outcome. Re-development, properly incentivized and regulated, occurs continually over time and allows the conflicting interests of developers and citizens to be reconciled fairly and intelligently. In the process, citizen concerns are recognized in zoning and development codes and developers make a reasonable profit.

Who’s involved Three parties participate in this process: Developers, citizens and government. Developers seek maximum financial returns. If you’ve ever seen the show “Shark Tank” (or the better Canadian version, “Dragon’s Den”), you’ll have a good idea of who I’m describing. Developers are eminently predictable; they seek to maximize their financial return on property. As a result, they push hard to pack as much square footage as possible onto any property. Because financial returns on property flow to the developer in the form of “rent”, the bigger the building, the more rent the developer can collect. In the developer’s world, a big building and big money are complementary notions. Like the capitalists on the TV show, developers think primarily in terms of hard issues like cost and profit. Soft issues like aesthetics, human scale or walkable streets only resonate with a [ more ZONING page 6 ]

Kirkland drives away citizens with parking tickets Welcome to downtown Kirkland; welcome to Kirkland Uncorked. I am steaming. I got a $45 parking citation for parking behind Heritage Hall along the long grass strip. I did see signs about trailer parking but there also was car parking and I parked, for the first time ever, with all the other cars. After spending money on Kirkland Uncorked festivities, I returned and found this ticket. At least 10 other cars had tickets also. I wasn’t maliciously breaking the law. Good job Kirkland for driving away your good citizens; you made a lot of money last weekend. I cannot imagine how many cars got citations in that parking area during the weekend. I won’t be eating or shopping anytime soon in downtown, which hurts the businesses. I feel sorry for them.

If the Lake Washington School District bond passes next February, you’re all gonna go. Does the city of Kirkland really want to lose its last year-round public pool? Unfortunately, the way

the bond to rebuild Juanita High School is currently written, Juanita will get a new school, but the pool will not be rebuilt. At the June 24 Citizens Advisory Committee meeting, district Superintendent Tracy Pierce explained that the pool would be closed if the bond option being put forward passes in February 2014. I know this is a time of critically tight budgets, but how many times have the citizens of Kirkland voted to support the bonds (as evidenced by all the new school construction popping up all across the city)? How many times have parents stepped up to pay for “the extras” (busing, sports) to ensure more funds would go for the basics? This is also a time of limited gym classes, less recess and more childhood obesity. It is time for us to remind the district that we are not going to lose Juanita pool or we might not be so quick to support the bond in February. I encourage everyone to come to the next school board meeting at 7 p.m. on Monday, Aug. 5 at the L.E. Scarr Resource Center, located at 16250 NE 74th St., Redmond. Unsafe to exit driveway on Lake Washington Boulevard It seems from the robust participation in a recent

citizen petition (at www.ipetitions.com) that many feel it is the city of Kirkland’s duty to correct dangerous traffic conditions. I am noticing comments about collisions that have already happened. How many more? How serious will they be? Why is the city not getting better traffic studies and fixing a problem they’ve heard about loudly from the citizens? Please help us make Lake Washington Boulevard and Lake Street South safe for all, and accessible for land-locked driveways. The city has received numerous citizen communications about dangerous traffic conditions on the boulevard and has received reports of unsafe maneuvering due to insufferably long traffic queues. And now some property owners find that traffic has become so bad that those who only have one driveway that exits onto the boulevard no longer have any “safe gaps” in traffic for ingress or egress. Since video tapes, photos, letters, emails, and testimony under oath all have failed to get the city to act, we have summarized the steps that have been taken to show that the city has received more than ample notice of the dangerous traffic conditions. Let me first state that this is a problem with, or without, the enormous Potala Village project. On the east side of the boulevard there are no safe gaps to get out of one’s driveway if it exits onto Lake Washington Boulevard. This goes on for hours in the summer and a bit less in the winter. (required by the city in 1977 when they first acknowledged vehicular ingress/egress issues due to massive traffic), 111 cars per hour will be coming off a driveway onto Lake Street, according to the proposal. This huge addition of cars and turning maneuvers will dramatically increase conflicts. Potala Village developers have been advised that driveways onto arterials are not generally allowed. It is uncertain how the developer anticipates having two cars enter the roadway each minute when there are no gaps. Likely the cars will idle long periods of time parked across the sidewalk, impeding both pedestrian traffic and bicyclists. Again more, unavoidable conflicts on our major pedestrian and bicycle pathway. I believe that the city is responsible for planning and maintaining safe ingress and egress from the side streets and from our driveways. Lack of safe ingress and egress and the traffic conditions on Lake Street South and Lake Washington Boulevard have been ignored too long with citizens being given the deaf ear. Will the city wait until something really bad happens or take the steps required to maintain safe gaps, so that people can enter and exit the roadway safely? Isn’t this a duty of the city? We certainly have told them of this issue repeatedly so they will never be able to say that they weren’t made aware of the problem. How many of us will be available when asked to comment as to whether a tragedy was avoidable and who was to blame?

and joggers leave no litter, and the dog walkers leave no residuals. The area that I am referring to is the wooded acreage bounded by Juanita Drive on the east, Holmes Point Drive on the north and 72nd Northeast on the west. The area needs no “improvement” or meddling either by King County or by the city of Kirkland. It is just fine the way it is now. I have heard rumors of a picnic area in there with a maintenance road. There are plenty of picnic areas now at both St. Edward State Park and at Juanita Beach. I can’t imagine anybody picnicking there over the two previously named sites. With picnic areas, garbage cans are needed. Animals will surely get into them. In no way do any of us in the neighborhood want a maintenance road into a proposed picnic area. If a road were put in there I wouldn’t be surprised if some upset neighbors would do what they could to cog such a road. Don’t do it. I heard that a trail has been proposed with some apple trees so people can pick apples. Who wants apples with worms in them? I’m sure that every apple in our area is wormy. That was the reason that I cut my apple trees down two years ago. I couldn’t get rid of the worms. And the city wants to get rid of blackberries because they are invasive. Yes, they are invasive and they are all over western Washington. You will never get rid of them. Many jars of jam, jelly and many blackberry pies are a result of blackberries in the late summer. None go to waste. We in the neighborhood are happy to pick them. Leave them alone. We do love our park just the way it is, so please stay out of it. You cannot improve it. You will only create problems and piss off many of us living in this beautiful area. Take your money some place else and do something good with it. Feed some homeless people or take it to probably a multitude of areas that could use it.

developer if they attract tenants. Unregulated, developers would eventually turn our streets into canyons of faceless, hulking monoliths. If you doubt me, visit downtown Bellevue. Citizens don’t like change. Most Kirklanders (myself included) prefer the city stay the way it is, thank you very much. We value “soft” issues like walkable streets, good landscaping and human scaled buildings. In fact, were Kirklanders given sole discretion on the issue, the model for development downtown would likely be something akin to Park Lane: A narrow, tree-lined, single-story street filled with boutiques. Politicians want tax revenue. They also need to be sympathetic to citizens’ needs, but the revenue imperative can distort the judgment of any elected official. So here’s how the process works. The council uses the Comprehensive Plan to establish zoning requirements that vary by location. These requirements set the three-dimensional boundaries for buildings, essentially locking in the maximum physical size of the structures. Different areas of the city have different limits based on the need to preserve views, etc. Usually, the zoning process incorporates public hearings where interested parties are given the opportunity to provide input on proposed regulations. Failure by either party to successfully have their concerns incorporated into the zoning code, before it is formally adopted by the council, will greatly limit future efforts to fundamentally influence the shape of future buildings in that zone. The reason for this is simple. Developers make substantial investments in developing property based on the maximums allowed by zoning codes. Without an assurance on this, they would have little confidence to invest in redevelopment. A process that would allow for changing the code after the fact would be unworkable. Conclusion: Zoning code approvals are the critical element of the

www.kirklandreporter.com process and the one most at risk of imbalance between citizen and developer interests. With a piece of property in hand and guided by zoning and development requirements, the developer submits his proposal to the Planning Department. The department works with the developer and other city departments to ensure minimum standards are met. The process can end with an administrative approval, after which the building can be permitted and constructed. However, in key areas of the city (primarily downtown) the city requires review by the Design Review Board. The board (composed of citizen volunteers), using the zoning code as a reference point, then holds public hearings seeking to modify the proposal with respect to those “soft issues” I mentioned. What the developer submits in the first board meeting is what you would expect; a building “maxed-out” to the limits of what the zoning code will allow. The board, being subject to the same zoning codes as the developer, is stuck with that maxed-out envelope and works to mitigate the worst and promote the best aspects of the ultimate building. So what is allowed by the zoning code is approved, albeit with architectural revisions to mitigate impacts or enhance features. Design Review Board decisions can get appealed, usually by citizens that rightly feel their interests have not been adequately addressed due to building height and mass. Sadly, most appeals don’t succeed because the basis of citizen appeals are typically about the two issues that the board cannot substantially alter: Building height and mass. So, what’s the problem? Developers are formidable counter parties in this process. They are well coordinated, well funded, politically active and understand the arcane intricacies of the process. Citizens are ill-equipped to participate in this process for all the opposite reasons. We are not well organized, cannot easily hire

experts to advocate for us and are limited in our ability to participate on the same level as developers, simply because we all have regular jobs to attend to. Aggravating this very lopsided dynamic is an approval process so burdened by technical jargon and arcane concepts, it cannot help but be tilted in favor of developers. Against this, no one citizen has a chance of completely understanding the implications of a proposed zoning change, let alone standing in opposition to a proposal that a developer wants to push forward. The result is a disenfranchised citizenry. In its current form, the city’s zoning update process is failing to synthesize a community vision for the future and is biased in favor of developers, who are prevailing on issues of profit over the needs of our citizens. The zoning and development approval process fails to engage us at the right time with meaningful information. It is hurried, confusing, opaque and structured to favor much better resourced and organized developers. It is riddled with technical jargon, obscure concepts, and uses outdated and ineffective methods to engage the public. As a result, our zoning approval processes are predisposed to discount citizen concerns and favor developer interests. The one advantage that citizens theoretically have are our elected politicians, who we should reasonably rely on to account for these inherent imbalances and compensate for them in how they develop and implement zoning policy. In reality, city officials are not acting as “fair arbiters” between developers and citizens. Instead, they are treating each group as if they were equally resourced parties to the issues at hand – a hopelessly imbalanced approach. Next week, I will offer a handful of practical ideas to help bring balance back to the process.

But in the Ballard railroad company’s reply, which was filed on July 15 by attorney Thomas C. Paschalis with Fletcher and Sippel LLC, they said the city was exaggerating. With an emphasis on “rails and trails,” the company states that Kirkland officials can construct a trail whenever they want. However, because the city aims to remove the rails, the move would deal a severe blow to the restoration of rail service, causing the company to spend $10 million to reinstate it. Because the approximately $107,000 is a “credit,” Ballard contends the city would alternatively not be harmed by an economic loss, “whatsoever.” The documents continue that the city’s hundreds of thousands of dollars in potential loss are only a “maybe” and that even if those monies were lost, it would not constitute substantial harm for the city. “Kirkland can start building its trail now, so it suffers no harm based on lack of use,” the documents state. “… To the contrary, if Ballard loses the injunction in a decision issued prior to Aug. 1 but later prevails on the merits of the petition, it will enjoy a hollow victory.” The railroad company asks instead the Surface Transportation Board wait for comments and replies for the petitions, which the board is expected to deliver a decision on by January 2014, before deciding on the temporary restraining order Ballard currently seeks. “The board need not, if it so chooses, make a hasty decision on the injunction that could render the decision on the petitions meaningless,” the court documents continue. City spokeswoman Marie Stake said as of Monday there has been no indication from the board whether it will rule by Aug. 1.

Terry McLlarky dies at 76

Kirkland. McLlarky moved to Kirkland in 2003 to live closer to his daughter Jennifer Wittenberg and her family. From 1995-2002, McLlarky was active as a civic volunteer in the town of Hudson, N.H., where he served on the sewer utility, conservation, and budget committees. He retired from careers in material control and management information systems. McLlarky

received a bachelor’s degree in computer science, graduating cum laude from New Hampshire College, now called Southern New Hampshire University. County Executive Dow Constantine appointed McLlarky to the authority’s board of commissioners in 2010. McLlarky also served as a member of King County Housing Authority’s resident advisory committee since 2005.

A broken van led Bob Rorabaugh to a special moment. The former Northshore Baptist Church pastor had organized a “Hike on Wheels” event in 2002 that more than 30 people in wheelchairs attended. A care facility’s van broke down, so Rorabaugh and his daughter stayed with three passengers who awaited a ride back home. During the wait, they wheeled the passengers to the top of “Kite Hill” at Magnuson Park. Rorabaugh recalls a warm breeze blew, so he pulled a kite out of his backpack, lofted it into the air, then placed the kite string on a stick under one of the passenger’s arthritic hands in her lap. The woman named Ruth rolled her bent neck around and, almost startled by the

kites tug, looked up. “A slow smile dawned across her face, as if she had never flown a kite,” Rorabaugh recalled. “It took a broken van for me to have that time with Ruth in a wheelchair at the top of Kite Hill. It took me that long to realize I could have a friend and contagious laughter that I hadn’t known.” Now, Rorabaugh still organizes the event with the same heartfelt intentions - but with a wacky twist. The 13th annual Wacky Wheelays – an all-inclusive community field day - will be held for the first time in Kirkland this Sunday, July 28 at Lake Washington High School, 12033 NE 80th St. The free community event kicks off at 12:45 p.m. with registration and a potluck lunch, with games from 2:154 p.m. Rorabaugh said the event was previously held at Bothell

www.kirklandreporter.com High School, but due to field maintenance, they are moving the event to Kirkland this year. “This event levels the field of play for those who, in our organized sports culture, cannot run, hit, jump, throw or catch,” said Rorabaugh. “The games of inclusion are goofy, hence wacky, sometimes created on-the-spot …” And, of course, wheels are strongly encouraged. “Bob gets shopping carts and piles people in,” recalled Janelle Cornelison, event coordinator, who has been involved with the event for four years. Other modes of wheeled transportation have included strollers, pedal toys, battery operated cars, real cars, grocery shopping carts from competing grocery stores, tricycles, bicycles, golf carts, wheelbarrows and more. “The day of the event is so fun because you will have access vans coming and going all day and dropping people off from group homes and different facilities,” Cornelison said. “It’s fun to see people with big smiles in electric wheelchairs boogying

around the tracks.” She said the event has also been eye-opening for her family members. Cornelison has taught special needs children with moderate to severe disabilities at Sherwood Forest Elementary in the Bellevue School District for the past 15 years. “That’s been pretty neat for me as far as my family members, who don’t know what I do, and they come help and get out of their comfort zone.” Rorabaugh stressed the event is for people with all abilities. One of his favorite Wacky Wheelays moments was when he watched a 5-year-old boy who was sitting in the lap of a woman with cerebral palsy and reaching for her hand. “I finally figured out he wanted to give her a high-five,” he recalled. “He was so intent upon his task that he didn’t see her face. I saw her face. It looked as if she thought she was being touched by an angel. We get those kinds of stories coming back from parents who are not only pleased the day of the event, but what happens

This year, members of the Kirkland Fire Department will roll in on a fire truck and an aid car. Cash donations

Rorabaugh noted that while many churches host mission trips to faraway countries, there is work to be done right here in the community. “Why can’t we cross the street and mentor a child with mental or physical challenges?” he said, noting the event also aims to bring awareness of those people who are “differently-abled.” “We’re trying to say, look around because every fifth person in your life has a disability. You’re missing the joy of friendship.”

After years of unanswered questions on the case, which is now “cold,” the author was able to meet with an anonymous FBI agent in 2002 – 16 years after his parents’ deaths. He recounts the meeting in his book: “’Kerry told me that she and Gary had been having sex,’ [the FBI agent] said. ‘It probably began before they left San Diego. Possibly even earlier than that, when Gary returned from the Army.’” The book details the meeting in which the FBI agent said Kerry Edwards confided in him and claimed she had a sexual relationship with Gary Edwards, her half-brother, and the reason he allegedly sexually assaulted her that fatal night was because she wanted to stop the “sexual tryst.” “He came to her one night and wanted to have sex and she refused and [allegedly] said ‘this is over, we’re not doing this anymore,’” said Larry Edwards, which is further detailed in his book. “This is when she said he attacked and raped her. Her moaning and cries awoke my parents and, shortly after, they were

Another peculiar fact the author noted: Gary Edwards signed a movie contract before he returned to the U.S., after his parents’ death. The U.S. attorney never prosecuted Gary Edwards due to the lack of forensic evidence – the bodies were dumped overseas – and it could put the case in jeopardy. Larry Edwards continued to have hope, as there is no statute of limitations for

murder. But he had even more questions after Kerry Edwards got her memory back. “My sister testified under oath that my brother [allegedly] assaulted and raped her,” said San Diego resident Larry Edwards in an email, “and her subsequent comments to me directly contradict many things she and my brother said in the days and weeks following our parents’ deaths.” The conflicting information compelled Larry

Larry Edwards said whenever he’s tried to speak with his brother about what happened, he’s been met with sarcasm or he’s simply ignored. The two have not seen each other since a 2007 family funeral. “I have no idea if my brother knows about this book,” Larry Edwards said. The Reporter attempted to contact Gary Edwards but received no reply. The author emphasized the importance of delivering all of the facts in his story because other published stories, such as a true crime book written by Ann Rule and an online book that his niece wrote, simply “made things worse.” But the author has more hopes for the book than just to “get the record straight.” Larry Edwards, along with many others who experience violent death, suffers from Post Traumatic Stress Disorder, only realizing it about five years ago. “I’ve bottled this up for years. I never talked about it,” Larry Edwards said. “A lot of my friends, my wife’s family, had no idea. I’m not sure I understood it completely. But these are intense emotions and they never really go away.” He said that by sharing his story, it helps release built up tension. “Sometimes I think ‘Why did I say or do that?’” Larry Edwards said. “I can trace it back to the anger I still feel over what happened to my parents and their death and what I perceive as a lack of justice for them. “My goal is that other people who’ve had a similar tragedy in their life understand they are not alone and that there are people out there who will help them.” For information, visit www.dareicallitmurder.com.
