everal members of the community filed complaints about the Seafair Pirates’ loud cannon explosions that, they say, frightened children and dogs during the annual Fourth of July parade. Men dressed in pirates’ costumes engaged the crowd as they acted the part by adorning eye patches as they swung fake pirate swords. But as soon as the cannons blew, some say the

fun turned sour. “Kids were screaming and dogs were howling,” said Dean Jones, who submitted a complaint to the city on July 10. “People were leaving the parade, they were just so distressed.” Jones, who lives in California but was visiting friends in Kirkland, said his little dog “relieved himself at both ends” and the driver of a mini-horse in the parade couldn’t get it under control for at least one minute. Jones was at the corner of Central Way and First Street when

the cannons went off. He said the cannon explosions reminded him of the recent Boston Marathon terrorist attacks and that it ruined his and his family’s Fourth of July. Another parade-goer had a similar experience, but was seated farther down the parade route. “People all around me were complaining about the loud noises,” said Jerry Forell in an email to the city of Kirkland on July 8. “I still had minor discomfort in my ears an hour later.”

Forell was sitting at the intersection of Kirkland Avenue and Main Street and said the pirates spouted their cannon three times when they passed that area. Sudie Elkayssi, the city’s special projects coordinator, said in a reply to Forell that the city received “a handful of complaints” about the cannons and that it would be discussed at a later meeting. “I was standing at the corner of Market and Central, so I too experienced the [ more CANNON page 3 ]

After a 20-day investigation that included 18 student statements, a Lake Washington High School biology teacher was suspended last month for taping a student to his desk on May 29. The Lake Washington School District investigation found that Jennifer O’Hara violated the district’s human dignity policy, as well as the staff conduct policy, as she encouraged public ridicule and bullying in her classroom. Investigation documents state O’Hara admitted to wrapping clear packaging tape once around a male student’s upper body to the back of his desk chair because he continued to walk around her second period biology class without permission. During a June 11 meeting with district officials, O’Hara said the students were studying for an end-of-semester test and she wanted to “infuse humor to lighten the mood in the classroom.” “She jokingly attempts to wrap me in packaging tape (I thought it was funny, I was OK with it),” the male student said in a written statement. “But then it seemed almost instantly that many students appeared around me and

were actually trying to tape me to the chair I sat in.” According to many witness statements, several students taped his arm, drew lines on his ears and a smiley face on the back of his neck. But the boy said he was even slapped on the face and neck, which he said hurt but did not cause injury. He said his football was also temporarily stolen. “At this point, I was frustrated and it was not a joke at all,” the boy said, who added students also drew on his Spanish school work, ruining it. During the taping and harassing, the boy estimated between 10 to 15 students took photos or filmed the incident on their cell phones. Frustrated and angry, the boy freed himself from the tape and walked out of the classroom to wait in the hall. “He went from laughing to being mad in a matter of seconds and after he left, the class was confused,” said a student witness, who was in the biology class that day. Another student said O’Hara tried to get the boy to return to class but he did not. As the boy walked into his fourth period English class, English teacher Amy Sullivan overheard him talking to his friends who were “visibly [ more TAPE page 3 ]

n Issaquah man was charged with firstdegree robbery on July 10 for allegedly robbing, at gunpoint, the Subway store in the Kirkland Totem Lake neighborhood on July 7. Ryan Arthur Mashek, 30, had bail set at $250,000 in King County Superior Court. At about 6:45 p.m. on July 7, Kirkland police responded to an armed robbery call at the Subway store, located at 11613 124th Ave. NE, but were redirected to the Fred Meyer in Totem Lake when a witness said three suspects had fled the scene. Probable cause documents state Mashek, described to be a white male wearing a black hoodie sweatshirt, and red and gold sunglasses, walked past the Subway entrance a few times before finally entering. A Subway employee said in the documents that Mashek approached the counter, opened his sweatshirt and displayed a black handgun. “… Mashek [allegedly]

the suspects were arrested, the documents continue. The witness and Subway employee “100 percent” confirmed Mashek was the robber during a field show-up. The 21-year-old men disclosed to police Mashek was in possession of a loaded black Beretta Elite II air-soft pistol during the time of the robbery and that he had put the gun under the front seat when police arrived. They also said they knew Mashek was arrested for robbery in the past. Upon getting a search warrant for the Audi, police found $166 rolled up inside a bag. A black hoodie and a pair of gold rimmed, red sunglasses were in the back seat and the gun was under the front passenger seat. Mashek was convicted of three counts of second-degree robbery in 2008 and in one case threatened a victim with a gun. He has also been convicted of a hit and run, negligent driving in the first degree and reckless driving within the last nine years. Mashek’s arraignment is scheduled for 8:30 a.m. on July 24 at the King County Courthouse.

The employee opened the cash register and handed over several $5 and $20 bills before Mashek allegedly fled to the AM/PM across the street and got into a silver Audi A4, which drove away. Just before the vehicle fled, a witness saw the encounter, got back into his vehicle and followed the suspects, then he obtained their location - at Fred Meyer - and the car’s license plate number. In court documents the witness said that he could see the suspect with two other suspects. The other suspects later turned out to be a 21-year-old driver and a 21-year-old passenger, both of whom haven’t been charged because they claim to have not known about the robbery, according to the King County Prosecutor’s Office. Once Kirkland police arrived at Fred Meyer, the witness described the whereabouts of the Audi and officers “converged on the vehicle and performed a high risk vehicle stop” and

Rick LaValley also complained to the city, stating the pirate ship scared a lot of children and adults. And one Kirklander Shaun Kelly said the cannons were too loud and too frequent. “I’m not pleased to hear that people may have felt compelled to leave a function due to our presence,” said Lance English, a Seafair Pirates Captain, who was at the parade. “We pride ourselves on being a family friendly organization and our goal is to enhance an event with a high energy performance, not detract in any way.” English said for every parade the Seafair Pirates attend, they send a letter with an advertisement explaining the noise level is high with recommendations for parade placement. Additionally, the Pirates work with the city guidelines in place and they trigger a siren before firing the cannons as a way to alert spectators. “We may be pirates but a healthy degree of professionalism is a necessity,” English said. “It is our desire to be responsible and thorough in our efforts.” Deputy director of Parks and Community Services Michael Cogle said the Kirkland Police Department received verbal complaints as well, and he expects the issue will be discussed at an event debrief meeting near the end of July. The city’s special events policy states that noise must be kept to a reasonable level, but Cogle acknowledges that “reasonable” could be up for interpretation. “That’s something we’ll work with Cel-

ebrate Kirkland! volunteers for next year,” Cogle said. Kirkland City Councilwoman Penny Sweet, the organizer of the Celebrate Kirkland! Fourth of July parade, said complaints about the parade come every year but there hasn’t been much about the pirates’ cannons. “I got three complaints about the noise of the cannons,” Sweet said. “I don’t think three complaints out of 30,000 is overwhelming.” But Sweet did say they could have done a better job of alerting the parade volunteers about the Seafair Pirates’ cannons. “I think we’ll ask them to tone it down next year,” Sweet said, noting she also received overwhelmingly positive feedback about the parade. Sweet said the last time the Seafair Pirates participated in the Kirkland Fourth of July parade was in 2002 because they had gone over to Bothell, but because many of the pirates now live in Kirkland, they wanted to bring it back. And there are Kirklanders who agree. “It was so great to have a longtime Seattle tradition in our parade,” said Rochelle Nelson Haberl in a Facebook comment to the Kirkland Reporter on July 11. “I thought it was exciting. That’s how they roll and that’s part of the pride of Seattle.” Others such as Dawn Moeller Jeske, Storey Ballard Hahn and Kelli Jonakin said they love the pirates. “[I] loved having the Pirates there,” said Jonakin in a Facebook comment on July 11. “For those who thought the cannons were too loud, cover your ears and say ‘AARGHH!’” The Seattle Seafair Pirates have been the “Pirate Kings of the Northwest” since 1949 and continue to make appearances around the Puget Sound area every year.

The boy told her what happened and showed her the red smiley face on the back of his neck to confirm the story. “I told him that she cannot be doing that to students and I said it was wrong that he was treated that way,” Sullivan said. “I told him that I would have to tell about what she did, by law. He asked me not to.” But after Sullivan’s students began an assignment, a pass came for the boy to come to O’Hara’s room. “When [the boy] got back, he was just as upset,” Sullivan said. “He said she apologized, but said it was ‘interesting’ and his tone of voice suggested something else may have been talked about that didn’t actually resolve the situation.” It was later discovered that O’Hara had individually called some of her students to her room so that she could request they delete all photos or videos related to the incident, as well as request they apologize the next day. In a letter to O’Hara written on June 17, the district’s Human Resources director Patricia Fowler-Fung said that O’Hara’s “efforts to remediate the situation by attempting to have videotape and photographs deleted,

July 19, 2013 [3] while possibly well-intended, could be viewed as self-serving and an attempt by [O’Hara] to cover [her] misconduct by asking students to destroy the evidence.” Fowler-Fung continues to say that O’Hara’s excuse that she was not in her right mind, due to personal issues, was not an excuse and that it was “incredulous” to believe she would allow the bullying to happen in her classroom. “Your failure to immediately grasp your serious breach of professional conduct is astounding,” Fowler-Fung said in the letter to O’Hara. “Based on your own statements, not only did you totally abdicate all authority and supervision of a professional teacher, your actions were insensitive, demeaning and unprofessional.” The district placed O’Hara on suspension with pay until June 19 but the teacher has since resigned her position at Lake Washington High School for the following school year. The Kirkland police investigation into this incident is still ongoing.

City should have warned residents about cannons

A

pair of young Bald Eagles is safe and sound at Heritage Park after a day of loud fireworks in downtown Kirkland on July 4. A Kirkland group, led by Kirkland Councilwoman Penny Sweet, decided to shift the position of the fireworks barge farther away from the eaglets’nest to reduce the risk of disturbing the birds that have not yet fledged and cannot fly. We applaud this decision. Kirkland is an animal-friendly place. The city cares about its critters and the environment too. But what about its citizens? The city did not warn Fourth of July parade attendees that for the first time in in more than 10 years, Seafair Pirates would land in downtown Kirkland. And when the pirates rode through on their Moby Duck float and blasted loud cannons, people jumped and covered their ears. Some animals, including reports of a dog and a miniature pony, even relieved themselves. Several people filed complaints with the city over the loud noise. Some say the explosions were reminiscent of the Boston Marathon bombings – loud booms at a crowded, popular event. The city should have extended the same courtesy it gave to the baby eaglets and warned parade attendees of the loud noise. There were many vulnerable people at the event, including

Law behind George Zimmerman verdict immoral I’m not expert enough to address whether the George Zimmerman/ Trayvon Martin verdict was legally correct but feel confident in saying that if the verdict is correct, the law behind it is morally wrong. It cannot be okay for a person to start an altercation for non-urgent, non-necessary reasons (such as the bias evidenced by Zimmerman’s racial slur, as recorded on a 911 tape), and then to pull a gun and shoot when they start to lose the fight.

Cannons have no place in Kirkland parade I just read the online article about the cannon noise created by the Seafair Pirates. I’m no fan of the Seafair Pirates for all kinds of reasons. Pirates have never been the “good guys.” Playing as pirates may be fun for these adult men but I think it’s just an excuse to dress up and act brashly. But that’s not my point in writing. Given the Boston Marathon disaster and other reasons why people in public places might be afraid and scared about sudden loud noises, I see absolutely no good reason for the Seafair Pirates to go firing cannons. Further, as “pretend” weapons (of war), I think the cannons have no place in a city parade.

It seemed like everyone in Kirkland was either in the parade or watching it and the full day of community celebration, up to and including the fabulous fireworks display, kicked off our summer in style. II vets, as many of them told me after the parade that they could not believe that the people in the city of Kirkland treated them with such respect. These World War II veterans are our heroes as it was they who set the bar on how the military should act in a conflict. I will admit to you that a couple of them told me that their eyes got a little misty at all the attention they received. Thank you for recognizing this greatest generation with dignity. I know the work and time it takes to put together an event like this and I’d like to again say thank you very much to you and all your Kirkland staff.

City needs to address limited disabled parking In response to the recent letter, “Outraged at UPS truck blocking disabled parking spaces.” I know the area well. The parking spots shown in the picture are in front of the Urban Coffee Shop. Those are my back-up slots when the other spot is occupied. In front of Starbucks, 150 feet northwest of the photo, is one spot. Often, we get a senior center bus parking and blocking while the driver picks up coffee and goodies for the center. I have mentioned this to Starbucks personnel several times, and the last time I saw the van, he parked across the street. Yes, he is placarded for handicapped but that only works when he has handicapped people on board. Folks are always trying to get in or out of parking places while he is blocking. There used to be two handicapped slots in front of Starbucks, one on either side of the striped area. A couple of years ago, the property manage-

ment did a re-stripe and eliminated the easterly slot. That was the spot for wheelchair vans to drop their ramps. I know a guy who has a wheelchair ramp and cannot get out of his van at Starbucks as there is no striped area. I talked to the city of Kirkland, they looked it up, and said the builders knew what they were doing, as they are not required to have any handicapped slots. All the way down both sides, from the main intersection in front of Starbucks to the park, there is only one slot. We park anywhere, hang the placard on the mirror, as city of Kirkland allows us to do, but how long until the complexes private parking enforcement folks decide to ignore city laws and start writing us tickets? The new section heading down towards Bank of America has one more slot. So, for all the businesses on both sides of the street, there are now two disabled parking spots. You can go down to the barber shop and have two more, or across from Wells Fargo and have two more, or all the way to the other side of Walgreens for two more. But the whole purpose of these slots is for limited mobility, so you don’t have to walk a long way. The fun part is the idiot drivers who park in the striped areas. There is a $250 fine for doing so and they just head into whatever business and stay, blocking access for not only the handicapped but anyone else who wants to walk across the street. There’s always the federal Americans with Disabilities Act folks, but that’s a long process. The city needs to take a look at this situation. When Kirkland police has a break and shows up, surprise, nobody does anything wrong, so the assumption is they know it’s wrong and do it anyway.

The decision completed a sevenmonth public process. Goings began her position on July 1, replacing Sharon McGavick, who served as interim president since November 2012. The college’s late president, David Woodall, 67, died in September 2012 of a heart attack. Before Goings began her community and technical college career, she worked as deputy director in the Legislature for retired Congressman Norm Dicks. During this time, she helped the Bates Technical College legislative committee to better understand how federal legislation impacted students. She began her career at Bates, and later joined Clover Park Technical College, working as vice president of operations and college relations. “But my personal and professional commitment is really to advancing workforce education,” Goings

said. “So when the opportunity presented itself to come here, I was just so thrilled because this institution is really a leader statewide … and especially an inspiration to other technical colleges because Lake Washington was the first to be granted the opportunity to offer a fouryear applied baccalaureate degree.” She said she was also attracted to Lake Washington Institute of Technology because the school is “partnership oriented.” She said many of the career training programs at the school have industry partnerships locally, regionally and even internationally with such partners as Microsoft, Boeing, EvergreenHealth and DigiPen. “I just really look forward to continuing to build upon the great work that’s already taken place here in establishing community partnerships with area businesses to bolster our programs,” Goings said. “When we’re connected to the community that means that our employers have the workforce that they need and it means that our students are successful in getting familysustainable jobs.” This partnership collaboration is part of the “five-Cs” approach she brings to her position: Community, communication, collaboration, capital and completion. She said community is important to her and she moved with her husband and 8-year-old son from Puyallup to downtown Kirkland last week. She also plans to become a member of the

Redmond Rotary. As for “communication,” Goings will continue to get out on campus regularly to speak with students and faculty. The school will hold a meet and greet event this fall when the college community and community-at-large can meet with Goings. For “completion” she said she will work to ensure that students continue to have a “seamless pathway” as they complete their goals. She said the college’s No. 1 challenge currently is funding. “All of the two-year colleges have been through the Great Recession,” Goings said. “Fortunately, we’re grateful that we did not receive any additional cuts [through the Legislature] because two-year colleges have sustained cuts since 2008.” She is also pleased students will not see another tuition increase, thanks to the state budget the Legislature recently passed. “Going forward we’ll be able to steadily rebuild and restore those state funds that we’ve lost over the Great Recesson but also do so in a way that we’re really continuing to

Grace Jones-Faulkner

Grace Jones-Faulkner, the youngest of 8 children, was born near Sundance, WY on August 8, 1923. She was a young teenager when she moved to Kirkland, WA. She attended Kirkland High School and graduated in 1941. Grace went to work for the Army Air Corps at Paine Field in Everett doing sheet metal work on Pursuit airplanes. In 1943 she joined the ranks of “Rosie the Riveter” as an Arc Welder at the Kirkland shipyards. It was here she became queen of her shipyard and the top-ranking war-bond sales girl. After WWII, Grace married her first love, McAdoo Jones on November 18, 1943 in Kirkland. In 1947, she gave birth to twins. McAdoo died in 1970 and Grace worked as a teacher’s aide for special needs children at the Lake Washington Technical Vocational Center from 1973 to 1983. Grace married Russell H. Faulkner on July 1, 1983. Russell died in 1999. Grace was a life-long member of the Rose Hill Presbyterian Church. It was her honor to become a deacon of this church in her later years. This active woman loved the outdoors and believed that gardening helped keep her spirit alive. It was a proud day for her when she became a Master Gardener. Her 5 grandchildren were a source of pleasure as were the trained dogs and cats that moved with her through the years. Grace passed peacefully on July 5, 2013 in Wenatchee, WA. Her extended family will remember her with affection. Survivors include Michael Jones of Portland, OR, Marnie Cox of Wenatchee, Nancy Faulkner of Redmond, Lincoln Kaiser of Kirkland and Duane Kaiser of Sumner. 832891

Kirkland, Bellevue and Redmond firefighters responded to the small exterior fire at the business located at 12669 NE 85th St. in Kirkland within four minutes, according to Kirkland battalion chief Larry Peabody. NORCOM officials received a call about the fire at around 10:27 a.m. Peabody said no injuries were reported, as Pegusus Pizza hadn’t opened for the day. Firefighters used a saw to cut open a side door to extinguish potential flames from the inside but the fire was contained to the exterior east side of the building. “Anytime there’s an exterior fire, it requires a longer investigation,” Peabody said, noting he could not confirm whether it was arson or not. The cause of the fire is under investigation.
