Grand marshals lead the parade

erry and Merrillyn Stone have a lot to celebrate this year, from new family members (one arrived just last week) to their 60th anniversary together. To top it off, the couple will usher in the 98th annual Maxwelton Beach 4th of July Parade as the grand marshals. Parade-watchers may recognize the couple from their many years of participating in the parade and living at Maxwelton. The Stones were chosen for their strong support of the Maxwelton beach and the South Whidbey community. “We haven’t missed a parade in at least 30 years,” said Merrillyn Stone, 80. For many years she owned and operated a specialty glass and collectible store in Langley called The Glass Knight. Terry Stone, 78, enjoyed his time golfing at Useless Bay Golf and Country Club. Since moving to the area they have witnessed many adjustments to the beach. “The beach has undergone a lot of changes and there is a tremendous amount of traffic now,”

Merrillyn said. “It’s still the most beautiful beach on the island.” The Stones moved to Maxwelton beach in the early 1950s. Their love for the beach began with visiting Terry’s father every summer. They grew to enjoy the area and ended up moving from Seattle. They could have lived anywhere and they chose Maxwelton, said Terry. One of Merrillyn’s favorite memories of the parade is dressing her family in various “Stone” outfits, referring to their last name. They have attended the parade broken and bandaged as the “SplintStones,” and rockin’ and rollin’ as the “Rolling Stones.” In other years she
sold parade buttons on a bicycle and Terry helped with parking. The Stones have a family of four children, 16 grandchildren and seven great-grandchildren to share their love of the beach. Terry said he still enjoys walking on the beach, collecting agates, clamming and of course attending the parade with his family. Each family member has their own agate collection from the beach. Their family bubbled with excitement for them, Merrillyn said. “It’s quite the reunion for us, we are far flung and all over the world now,” she said. Both said they are appreciative
that they were asked to be the grand marshals by the Maxwelton Community Club. Terry said he would like to thank all the people who put their hard work into the parade. Parade-goers can catch the Stones at the front of the parade. Merrillyn will be wearing the red hat that she wears every year. “We love the beach and live here because we want to,” Terry said. “It’s the most beautiful place in the world, even when it’s not nice outside.” That shouldn’t be a problem this July 4, when sunny skies and warm temperatures are expected.

A three-year dispute between Island County Commissioner Kelly Emerson and the planning department may be nearing an end. On Monday, Emerson announced that she and her husband, Ken, had agreed to a settlement. The agreement stipulates additional action and a continuance of their previously rejected building permit but brings the matter of their outstanding fines to a close. “In many respects, our story of our painful dealings with local government over land use issues is a story that has been repeated many times by many individuals who have been subjected to pressure from a powerful government,” said Emerson, reading from a prepared statement. “We are relieved that our

Langley searches for city attorney By BeN WataNaBe Staff reporter Legal work in Langley will have new authors this fall. The small South Whidbey city is looking for a new contract attorney after little more than a year with Issaquahbased firm Kenyon Disend. Mayor Fred McCarthy, who was appointed by city council in late February to replace Larry Kwarsick, informed council members he terminated the city’s legal contract. In the brief boiler plate termination letter dated June 5, no reason is given for the city to end its contract with Kenyon Disend. “My understanding was that there was concern by
the council about continuing the relationship,” McCarthy said. “The city council wanted to select new legal representation for the city and requested that I undertake this process shortly after my appointment.” The decision to part ways with the attorneys, or at least the way the termination was carried out, was not unanimous among council members. Councilman Hal Seligson, who served as mayor pro tem after Kwarsick resigned and sought council appointment to the mayor’s office, said he wanted the process to be more thorough than a termination letter. “I felt, quite frankly, that it would have been appropriate to have discussed the
circumstances with the attorneys prior to the decision or announcement of the decision,” Seligson said. Council did not officially vote on the termination, however. The mayor said it was a general consensus that he was tasked with finding new legal representation for Langley. Kenyon Disend was paid $45,093.97 by Langley for its legal services from April 2012 to June 5 this year. Part of that year included the period when former Mayor Larry Kwarsick was forced out of office for tampering with a public document while serving as planning director. Langley went through the attorney search process in January 2012. That came
after the city terminated its contract with Weed, Graafstra & Benson, Inc. The next firm, McCarthy said, should be one with experience serving small cities like Langley, which has a population of about 1,200. Its contract will run three years without automatic renewal. Other than minor language changes, such as the addition of McCarthy’s name, the RFP was the same one used last year. Interviews are tentatively scheduled for July 15-27. All bids are due to Langley by July 12. The new firm is scheduled to assume the workload by early August.

Former Langley boy drowns in river RecoRd staff Elijah Gene Spratt was cooling off in the Stillaguamish River on Sunday when he was swept downstream and drowned. Elijah was 10. The former Langley boy grew up on Whidbey Island. He played football for the South Whidbey Falcons in the South Whidbey Youth Football League. Elijah recently completed fourth grade in Arlington. According the Daily Herald in Everett, while on a summer outing with his foster family at Twin Rivers Park in Arlington Elijah was swimming in the river without a life jacket. Just before 4 p.m., he was swept downstream for about a half mile. About an hour later he was found by the Snohomish County Sheriff’s Office from a helicopter and recovered by rescue divers. He was taken to Cascade Valley Hospital in Arlington where he died. The foster family assumed custody of Elijah when he was about eight.
Smith claims regulatory success stories RecoRd staff
State Rep. Norma Smith, R-Clinton, claimed success in streaming the business permit process before the Washington State Legislature adjourned last weekend after going into two special sessions. At the beginning of the 2013 session, Smith authored and introduced a package of four bills she said would improve the business and regulatory climate in Washington. She later partnered with Sen. Sharon Brown, R-Kennewick, who introduced them in the Senate. “This legislation is long overdue and has been a difficult and hard-fought process,” said Smith in a news release. “It provides a framework for reducing and streamlining the duplicative and confusing regulations facing our job creators and provides a one-stop portal within our state bureaucracy for them.” Senate Bill 5718/House Bill 1757 requires the Office of the Chief Information Officer to provide the Legislature with a plan for establishing performance benchmarks and for measuring the results of implementing a one-stop portal. It also requires the Department of Revenue, the Department of Labor and Industries, the Secretary of State, the Employment Security Department and the Department of Commerce to collaborate with the OCIO in developing and tracking these
benchmarks and performance measures. Senate Bill 5679/House Bill 1591 directs three agencies – Ecology, Labor and Industries, and Health — to develop a formal review process of existing rules or adequate streamlining processes. They have until the end of the year to bring their plan back to the Legislature. Smith said all four of the measures are based on recommendations from the state auditor and Economic Development Commission.

Whidbey Audubon Society will join Seattle Audubon this year to participate in the Puget Sound seabird survey. Both Audubon chapters need citizen science volunteers for monthly bird surveys on Whidbey Island. The surveys take place on the first Saturday of each month and last for 30 minutes. The first survey is scheduled for July 6. Each survey site has at least two trained volunteers to help gather data on seabird populations. Volunteers must be confident in their ability to identify seabirds. There are seven monitoring sites on Whidbey Island: Deception Pass State Park, Moran Beach, Joseph Whidbey State

An outspoken baptist pastor and an activist for atheism went head-tohead over the issue of public prayer on a radio show Wednesday. The result was not what most Americans would expect from talk radio. The two men gently and respectfully explained their positions to each other. There was no righteous anger or sarcasm, just good humor and intelligent conversation. It was a perfect example of what WhidbeyAIR is aiming for, volunteer producer Gwen Samelson said afterward. “You guys were amazing. I got choked up a couple of times because it was so respectful,” she said. “It’s important work that you did here.” WhidbeyAIR, which stands for All Internet Radio, is an all-volunteer, public radio station online at kwparadio.org. The purpose of the station, Samelson said, is to provide Whidbey-related
programming that’s thoughtful and adds to the community dialogue; she’s not looking for politics as usual. The station, formerly KWPA, gave up its spot on the FM spectrum last year to broadcast solely on the internet.

Car crash sends three to hospital

A perpendicular car vs. car crash Saturday sent three people to Whidbey General Hospital. Mike Cotton, deputy chief of South Whidbey Fire/EMS, was the duty officer on scene and said the three peoples’ injuries were minor. The crash occurred about 11:45 a.m. at the intersection of Woodard Avenue and Highway 525 in Freeland. A car traveling south on the highway was struck by a car crossing on Woodard Avenue damaging its front passenger side panel. Cotton described it as a “glancing blow” that was minimal enough to not warrant
Meerkerk Gardens is recruiting volunteers to handle a sticky situation. With rhododendrons mostly done blooming for the season at the sprawling woodland gardens in Greenbank, volunteers are needed to help remove the withered flowers. Joan Bell, operations manager at Meerkerk Gardens, guesses there are thousands of rhodies on the grounds’ 53 acres. However, the focus will be on the 10-acre display garden. There is a reward for becoming one of the gardens’ “Grateful Deadheaders.” Committed volunteers will receive a free Meerkerk tie-dyed T-shirt. Volunteer work parties gather from 9 a.m. until noon on Thursdays year-round at Meerkerk Gardens with lunch provided afterward. However, volunteers may also work at other times. Try being sane over the Fourth The Fourth of July is among our favorite holidays, coming when summer finally arrives and providing an excuse to celebrate the founding of this great nation. Fireworks have always been part of the celebration, but it’s getting out of hand on Whidbey Island. With its proximity to Indian reservations and their wealth of explosives, some private fireworks shows rival tonight’s Celebrate America show in Freeland Park. The mortars aren’t so big, of course, but in terms of total rounds fired and poundage of gunpowder expended, residents’ fireworks no doubt exceed our beloved community show. Nobody’s being a party-pooper here. Have fun with fireworks, but be safe. The hot weather is drying fuels in a hurry. Don’t shoot your illegal fireworks into the trees, grass or toward neighboring houses. Don’t drive your neighbors and their pets crazy by making noise all night long. Don’t spend so much money on fireworks. If you’ve got that much to blow, give some of it to Good Cheer or some other charity. You’ll get a bigger bang for your buck in the long run. Shun the reservations, which sell fireworks under liberal federal laws. Buy the “safe and sane” kind available, for example, at the Kiwanis Club stand at Ken’s Korner. At least your money is going for a good cause. Kids love fireworks, but make sure they’re under total supervision when they’re playing with them. And always keep a bucket of water nearby in case something or someone catches fires. Environmentally, fireworks are no friend of our beaches. The morning of July 5 requires tons of cleanup by neighbors and Beach Watcher volunteers, but they can’t get it all. Wire and paper waste can be found for weeks. Who knows what is does to the intertidal sea life. Is it scary if you’re a clam or mussel and a firework explodes inches from your shell? Never forget our volunteer firefighters who have families of their own. They don’t want to leave home at night to battle a blaze caused by careless use of fireworks. And give a thought to the tremendous pain and suffering caused by burns, which can ruin a good day, cause a lifetime of misery or simply end a life in a gruesome fashion. Be safe, be sane and be careful. Then have a happy Fourth of July.
Letters Golf course is a good investment
To the editor: A public golf course is not a new idea for South Whidbey Parks & Recreation District. It is and has been a part of their long-term comprehensive plan because they recognize that this form of recreation is inter-generational, as well as one that could expand the golf program at our high school. Your June 30 editorial sounded accusatory, suggesting that the sewer district was trying to foist off on some other entity the responsibility for maintaining the effluent disposal area. The original arrangement between golf course and sewer treatment plant was a simple one in which each carried a portion of the burden of expense. Soils here would

not perk so septic systems were not an option, therefore property owners were happy to pay for treatment plant operation, and owners of the golf course were content to maintain the irrigation system and drainage in return for receiving cost-free treated water while they served their paying customers. In trying to re-establish this shared obligation, the Holmes Harbor Sewer District has brokered what could be a sweet deal for some individual or organization: the lease for these acres is $1.00 (one dollar!) per year and comes with free water; all the water any golf operation could possibly use. Parks has presumably crunched the numbers and come up with a need to ask for tax money. County employees are more costly than those employed by private businesses, so that may be one reason. The editor cites other forms of recreation that Parks is currently and successfully

operating, many of them focused on young people, and all apparently meeting with the editor’s approval but discounts the fact that each of those sports or activities have at any given time an appeal for the “single user group.” And what about those fishermen, birders and hikers who would love to have another interest they could share with their kids and grandkids, as well as house guests and visiting relatives of all kinds? private nightmare is coming to an end, but we remain concerned about what happens to other property owners in the county in similar circumstances.” The settlement largely absolves the Emersons from all but a fraction of their $37,000 fine. According to her statement, Island County will return $2,000 in filing fees to the couple and in return, the couple has agreed to pay $5,000 “to acknowledge that we made some mistakes in the permitting process,” Emerson said. According to Island County Commissioner Jill Johnson, the board was not involved in hammering out the details of the settlement but she believes the outcome was a good one and not uncommon in such situations. Johnson said the goal has always been one of compliance and to treat the Emersons as any other citizen. “This a good thing for Island County as it allows us to move forward,” Johnson said. “I think most people just wanted this to be resolved and a settlement is much preferred over a long dragged out process.” In late 2010, during Emerson’s bid for the District 3 commissioner’s seat, the couple began building a patio at their Camano Island home without a permit. Word spread quickly and their “mistakes in the permitting process” mushroomed into a political firestorm. Emerson successfully unseated incumbent Democrat John Dean at the polls, but the controversy continued on for nearly three years. The Emersons sued the county early on but most of the time was spent debating whether a wetland exists on the property. Former planning Chief Bob Pederson, who was

named in the Emersons’ suit, stepped down earlier this year but not before denying the couple’s building permit and ordering them to pay $37,000 in fines. The Emersons appealed both decisions. One of the issues was to be heard by the county commissioners and the other by Michael Bobbink, the county’s hearing examiner, but the settlement eliminates the need for action by either body, according to Justin Kasting, a special deputy prosecutor with Snohomish County. Kasting served as the county’s legal counsel in this matter. He said he could not go into the details of why the fine was reduced but did say returned filing fees — about 80 percent of the total paid — was consistent with county policy upon a withdrawal of an appeal. “The reasoning is the appeals will not be going forward,” he said. As for their building permit, Emerson said in her statement that a third hydrogeologist is evaluating their property to determine the existence of a wetland and that a report should be submitted to county officials soon. “Two previous reports from licensed qualified hydrogeologists found no wetlands on our property and we fully expect that the third report will reach the same conclusion,” Emerson said. She added that the two previous reports cost “in excess of $50,000” and that the Emersons will not be reimbursed. “Never mind all the facts, corruption and abuse of power, what really mattered to the media and the dissenters, was that apparently the Emersons were destroying the planet and expecting to get away with it,” Emerson said. “So here we are, almost exactly three years and $50,000 later, being forced to provide a third study and pay $5,000.” According to Kasting, only one report was conducted. It was reviewed by a second professional, however, who agreed with the initial findings, he

said. The terms of the settlement allow for a second examination of the property by a qualified professional of the Emersons’ choosing. “Hopefully, this new wetland delineation will put the issue to rest for good,” Kasting said. Keith Higman, interim director of the planning department, added that the agreement gives the county the right to a third-party review of the results if the quality of the work is in question. “It’s not the county’s place to dictate who the Emersons hire, but the quality of the work will be determined when they submit,” he said. Higman, one of the primary negotiators of the settlement, said his goal was to “find an end point” to the issue that resulted in compliance. The planning department’s responsibility is to assist the public with development applications that meet county and state standards. But while Higman and Johnson are hailing the settlement as a step forward, not everyone is so happy with the agreement. Neil Colburn, a former Langley mayor and vocal Democrat, called it “unfair” and believes the Emersons got off the hook too easily. “I resent it,” Colburn said. “But I’m more outraged that she would sue the people she was about to represent.” “I really believe Kelly Emerson has shown she has no understanding of what public service is really about,” he said. Contrary to Colburn’s comments, Emerson said in her statement that “a large majority of Americans nationwide do not trust our government at any level” and that she is working to “build renewed confidence in our own public institution.” “My own difficult experience is nearly over now, but I have learned a lot, and I want to put those lessons into action to protect our citizens – our customers,” Emerson said.

intersection. “The whole goal is to keep the streets open enough so the fire trucks can get through,” Heston said. Vehicle traffic will be closed in Langley on First Street from Wharf Street to Anthes Avenue, and on Second Street from Cascade Avenue to Anthes Avenue. Heston reminded vendors to secure their booths and remove any valuables each night, despite night security. On his 10th year working with Langley and patrolling the festival, the police chief said his department was ready for business as usual. “It’s worked out for years,” Heston said.

The South Whidbey Little League 9/10 All-Stars pummeled North Whidbey in a 10-0 game Monday. Winning the cross-island game also kept South Whidbey alive in the District 11 tournament with a re-match against Anacortes on Tuesday after The Record went to press. “We’re not thinking about the loss any more,” said Aidyn Frederick, 11, who started as South Whidbey’s catcher. South Whidbey surged early on pitching problems by North Whidbey. Thomas Simms opened the game taking a pitch to the leg, which evidently didn’t bother him much – he stole second and third bases on the passed balls. Ethan Petty was walked, then promptly stole second base; Thomas scored on the throw to second base. Langley will buzz with busy bodies Sunday morning. Up to 300 people are expected to participate in the sixth annual Langley Half Marathon and 10K walk and run July 6. Race organizer Matt Simms said about 150 people were registered as of July 1 and he anticipated another 150 by the race’s start. “My experience, people play it by ear and if the weather is decent they’ll come out,” Simms said. Racers can register up to the start of the race at 8:30 a.m. Sunday. Registration begins at 6:30 a.m. on the corner

Island grown comic plays at ‘Club Clyde’ Brian Moote, a comedian who hails from South Whidbey, will present his late-night comedy act July 5 at 10 p.m. at the Clyde Theatre in Langley.
The Clyde Theatre will be turning itself into Club Clyde for a few late-night shows this summer, starting with an evening with stand-up comedian and former South Whidbey High School basketball star Brian Moote at 10 p.m. Friday, July 5. “It stays light so late in the summer,” said Clyde owner Blake Willeford in a news
release, “that we thought we could extend ‘Whidbey midnight’ from 9 p.m. to 11 p.m. or even midnight a few times during the season. He also worked his way to third engineer while working on various commercial fishing vessels in the Bering Sea. Jacob loved life and the people in it, from the lower 48 to the Bering Sea. He enjoyed the outdoors and loved hiking, swimming, fishing, adventures and getting others motivated. He enjoyed helping others. He just liked being Jake. He will be missed and never forgotten. How about the barista who makes your morning latte, or the person passing you on the jogging path? Even on rural Whidbey, you may be in better hands than you think. On Labor Day weekend two years ago, Cliff Hagglund wasn’t thinking about where help would come from either, but he found out. After dinner with friends, he remembers sitting in a chair and leaning back against the wall when his heart stopped. Alex Campion, a friend and offduty firefighter and EMT went into action, starting cardiopulmonary resuscitation (CPR), as 911 was called and others arrived to help. Hagglund was transported to Whidbey General Hospital by paramedics while he received medication to help stabilize his condition. He needed more CPR as his heart stopped and started again, and he was flown to St. Joseph’s Hospital in Bellingham for heart surgery. Across Whidbey Island, there are approximately 100 cardiac arrests reported
to ICOM-911 each year. Highly trained to help in medical emergencies, ICOM dispatchers are certified through the National Academy of Emergency Medical Dispatchers, and once they know your location, they can send help. They will guide you through the steps of CPR for loved ones, friends or strangers. Callers are coached to open the airway to assess breathing and then provide quality compressions to help push the blood through the body and keep the brain oxygenated. According to one dispatcher, people on Whidbey have always been willing to help each other during an emergency. In addition to the more than 100 volunteer firefighters who live on the island and respond locally when 911 is called, thousands of other residents and visitors have taken part in the Hands on Whidbey program, an island-wide education program started by Whidbey General Hospital’s EMS department. Whidbey General Hospital paramedic Robert May works with fire departments and other island agencies to reach and encourage everyone to participate in a 10-minute, hands-only CPR program.
“One of the biggest factors that determines if a person survives cardiac arrest is whether someone recognizes the emergency, calls 911, and pushes hard and fast in the center of the chest,” May said. To date, the program has trained more than 2,000 people in this simplified version of CPR, the majority on Central Whidbey, where the program is most widely taught. May also teaches children in school programs and adults at various work sites. Blood and oxygen flow continues with CPR, but a defibrillator is needed to shock the heart out of an ineffective rhythm. A federal grant helped place more than 50 automatic external defibrillators in schools and at other public places on the island. Paramedics from Whidbey General Hospital respond from the closest station and continue care with advanced airway support and medications. They carry the Medtronic Lifepack 15, a state-of-the-art cardiac monitor that measures blood pressures, measures oxygen levels during treatment, and evaluates 12-lead EKGs, similar to the EKGs done in the hospital emergency department. Patients having life-threatening cardiac arrhythmias or who have suffered cardiac arrest but are resuscitated may be taken directly to cardiac units in Everett or Mount Vernon after consulting with a physician. Hagglund, 50, is thriving and has reclaimed his life after a harrowing five days in the hospital and months of rehabilitation. He has a defibrillator and pacemaker in his chest. In hindsight, he

It was only a matter of time, he says, before something worse happened. He knows that everyone around him played an important role in his survival, especially friends who recognized the situation and were quick to respond. “When I woke up in the hospital after surgery, the doctor told me that I had received CPR for a very long time, and it was good that I was in a community where everyone knew me — but just as important, knew CPR,” he said. “They really worked to save my life.”

Entertainment includes a Celtic band, Maggie’s Fury, at 6 p.m. Reptile Man Scott Peterson shows off his collection of reptiles and amphibians at 7:20 p.m. A student-led worship band from Kirkland’s Northwest University plays at 8:40 p.m. Then, the bombs-a-bursting night sky show takes flight at 10 p.m., starting with a performance of the national anthem sung by a barbershop quartet called Under the Radar. International group meets to empower youth

International members from the program Partners in Youth Empowerment convene on Whidbey Island through July 7 to collaborate on ideas for youth engagement.
Minds from around the world have convened on South Whidbey for Partners for Youth Empowerment’s first international gathering called “Catch the Fire.” The event began Tuesday and will continue through Sunday, July 7 at the Whidbey Institute in Clinton here 90 artists, educators and youth workers collaborate on ideas for youth engagement. The program works with people in Uganda, South Africa, India, the United Kingdom and Brazil to train people and implement programs to support youth. Following the international gathering, the program is hosting a youth camp from July 10 to 17. The program aims to strengthen a movement around youth engagement based on understanding and tapping into creative power, said Charlie Murphy, chief execu-
tive officer and co-founder of the program. The program trained 1,300 people last year from 400 organizations who are working with about 200,000 young people. Having the event on South Whidbey is a homecoming for Murphy, who started a similar program called Power of Hope on the island. Power of Hope led the way for the international program, Partners for Youth Empowerment, he said. “To be able to bring our program back to where it started in this community is really meaningful to us,” Murphy said. “We’ve gotten a lot of volunteer support from people on the island.” For more information or to volunteer for the program, call 360-221-8332 or visit http://pyeglobal.org.
