Holiday Harbor How the grinch almost stole Christmas... Lights festival set for December B y S t e fa n i e D o n a h u e

s Blaine police officer Jake Farrer questions James Patrick Kelly for allegedly attempting to steal crab pots at Blaine Marine Park.

B y S t e fa n i e D o n a h u e Not even a grinch could stop local volunteers from decking Blaine in holiday decor last week. On November 17, James Patrick Kelly, 51, was arrested on suspicion of theft in the third degree after he dismantled and attempted to drive away with crab pots that had been used to build a Christmas tree at Blaine Marine Park. Volunteers had spent hours building

the holiday tree that day after approximately 70 of their crab pots had been stolen the night before. In preparation for the Holiday Harbor Lights festival in December, volunteers wanted to construct the tree out of 130 crab pots that were donated by the Washington Department of Fish and Wildlife to the city of Blaine last year. On November 16, the crab pots were moved from an offsite location to Blaine Marine Park so volunteers could get an early

Blaine man hospitalized after hit and run B y S t e fa n i e D o n a h u e Washington State Patrol (WSP) is asking the public for information about a hitand-run collision that happened in Blaine, seriously injuring a man and sending him to the hospital. According to WSP trooper Heather Axtman, 26-year-old Spencer Riddle was struck by a passing car at approx-

imately 7:30 p.m. on November 11 at the intersection of Peace Portal Drive and Bayview Avenue. Riddle sustained significant injuries and was transported to St. Joseph Medical Center in Bellingham where he received surgery for multiple fractures on his left leg. He’s now recovering at his home in Blaine, Axtman said. The suspect’s vehicle is likely a 2009-

2013 gray or silver Toyota Corolla or Toyota Prius, based on a mirror that was left at the scene, Axtman said. The passenger side of the vehicle is likely missing the mirror and would have visible signs of damage, she said. Anyone with information about the incident is asked to contact WSP detective Craig Cardinal at 360/757-2008 or craig.cardinal@wsp.wa.gov.

start, said volunteer Debbie Harger. When the group of volunteers arrived at the park on November 17, already about two thirds of the pots had been stolen the night before, she said. But despite the setback, they proceeded to construct a small crab pot tree out of what remained. Hours after it was complete, Kelly arrived in a silver truck and began dismantling it. He had loaded about half of the pots onto the (See Tree, page 4)

Blaine’s annual Holiday Harbor Lights festival is just around the corner and this year organizers are planning a slew of events and activities that are sure to get locals in the holiday spirit. The fun begins on Friday, December 1 with a homemade arts and crafts Christmas bazaar at 674 Peace Portal Drive next to the Peace Arch City Cafe; doors will be open from 5 to 7 p.m. on Friday and 10 a.m. to 6 p.m. on Saturday, December 2. Also starting on Friday is a book sale at the Blaine Public Library, 610 3rd Street, from 10 a.m. to 5 p.m. on Friday and Saturday. It wouldn’t be the Holiday Harbor Lights Festival without the “land of sweets” Christmas village display at the G Street plaza; during the event, passersby are encouraged to snap a photo of the artful scene. On Friday and Saturday, musical performers will set the stage at the H Street Plaza and at the arts and crafts Christmas bazaar to fill the air with holiday cheer. On Saturday, the following bands are slated to play at the arts and crafts Christmas bazaar: Allie Ryser from 11 a.m. to noon, Blaine Ukulele from noon to 1 p.m., Senior Center Jam Band from 1 to 2 p.m., Matt Audette with country Christmas music from 2 to 3 p.m., Mike Bonson with holiday jazz music from 3 to 4 p.m. and Lord Knapp from 5 to 6 p.m. The Blaine school choir and band will play at the H Street Plaza from 4 to 5 p.m. on Saturday. Starting at 3 p.m. on Saturday, all are invited to participate in the sixth annual Holiday Lights Dash, a 1.5-mile obstacle course, which begins in H Street Plaza

trailer before Blaine police officer Jake Farrer arrived at the scene and arrested him. The following day, a handful of volunteers returned to the scene and spent about four hours reconstructing the tree, said Blaine Birch Bay Park and Recreation District 2 program manager Heidi Holmes. “We were really discouraged,” she said. “We were determined to put it back together again.” A resident of Deming, Kelly was arrested and issued a ticket, said Blaine Police Department administration manager Lisa Moeller. Since then, he’s helped the police department find and return to the city 40 of the 70 missing crab pots, which are worth about $40 to $50 apiece, she said. “We are continuing to investigate,” she said. “We want to recover them all.” Kelly is due in Blaine Municipal Court on Wednesday, December 6, she said.

As part of the agreement, Nature’s Path commits to local investments B y S t e fa n i e D o n a h u e Local organic food manufacturer Nature’s Path will invest approximately $30,000 to help the city of Blaine restore and purchase land along Cain Creek as part of a settlement agreement reached with the Washington State Department of Ecology (DOE) in late October. The agreement stems from 39 water quality permit violations recorded between November 2014 and October 2016 at the company’s facility in Blaine. The DOE issued a formal warning in December 2015 and in November 2016 proceeded with an or-

s Cain Creek. der to comply and a $22,000 fine for eight violations of discharging acidic wastewater into Blaine’s water treatment system.

What is the Cain Creek Project? CITY OF BLAINE NOTICE OF PUBLIC HEARING CITY COUNCIL Notice is hereby given that the 2018 Preliminary Budget was filed with the Blaine Administrative Services Director/City Clerk on November 1, 2017. ANNUAL LISTING OF VACANCIES AND ANTICIPATED VACANCIES THE CITY OF BLAINE IS CURRENTLY SEEKING MEMBERS FOR THE FOLLOWING COMMISSIONS, BOARD, AND COMMITTEE:

In 2014, the effort to clean up Cain Creek kicked off with a grant from the DOE to improve water quality and encourage shellfish production. Cain Creek runs directly into Drayton Harbor, which has been plagued with pollution from fecal bacteria for decades. According to a 2008 DOE study, Cain Creek required a 95 percent reduction in fecal bacteria to meet water quality standards for shellfish harvest and recreation. As part of the initiative, the city has partnered with other local agencies to improve water quality monitoring in the creek as well as identify corrective, long-term actions. All restorative work is required to comply with the city’s Cain Creek Park Plan, which has been in the works for years. Once constructed, the park will be located adjacent to the Salishan neighborhood and in later phases, may stretch to south Boblett Street. According to preliminary plans, the city wants the park to include interpretive signage as well as parking stalls, doggie stations, a picnic table, benches, trail improvements, a boardwalk, a small climbing structure and more. An adopt-a-park program would be created to allow residents to maintain the park with help from the city. “Blaine has a rich history dating back well over 100 years with numerous references to Cain Creek,” read a statement in the preliminary plan. “With the creation of a new park this piece of the community’s history can be memorialized in a natural setting allowing new generations the opportunity to learn about how the original settlers and Native Americans utilized the creek.”

Nature’s Path is headquartered in Richmond, British Columbia and manufactures its products in two locations in the US, including its facility in Blaine at 2220 Natures Path Way. The company’s wastewater is treated in Blaine’s Lighthouse Point Water Reclamation Facility. Per state standards, the company is limited in the amount of pollutants it can discharge into the city’s sewer system. After receiving the order DOE, representatives from Nature’s Path stated the pH monitoring probe used to sample the wastewater was providing inaccurate data and installed improvements to its pre-treatment system for wastewater discharge. Last December, they appealed the fine to the state’s pollution control hearing board and by October 27, DOE and Nature’s Path had signed a settlement agreement. “We’re pleased to see this excellent progress at the Nature’s Path facility and these valuable enhancements for the city,” said director of the DOE northwest regional office Tom Buroker in a statement. “We value this partnership, because the assistance to the city goes above what our penalty assessed and, more importantly, beyond what’s required to comply with the permit.” In a statement, Nature’s Path vice president of operations, Peter Dierx, said, “Nature’s Path is (Continued on next page)

(Continued from previous page) very pleased that the Department of Ecology dismissed our case and accepted our 2016 appeal that enables us to make significant environmental improvements to Blaine […] We’re excited to see the positive changes we are helping make in Blaine.” Per the agreement, Nature’s Path has committed to helping the city of Blaine build a park along Cain Creek, which is located adjacent to the Salishan neighborhood and runs into Drayton Harbor. It will also help enhance the creek’s water quality to restore shellfish harvest and recreation in the area. In a memorandum signed with the city in September 2017, Nature’s Path agreed to commit: — $20,000 toward the purchase of two undeveloped land parcels along Cain Creek to create a new park. — $5,000 to enhance the creek’s water quality by funding a city-led stormwater treatment project at the creek’s outfall into Drayton Harbor.

Two people detained at Peace Arch border crossing Last week, US Customs and Border Protection (CBP) officers detained two men at the Peace Arch border crossing due to outstanding warrants. A 39-year-old man from Las Vegas was detained on November 13 after CBP officers discovered an outstanding warrant for his alleged involvement in an armed robbery in California. According to CBP, the man said he was taking a Greyhound bus to Nevada to visit family and

provided officers with a Canadian passport and US social security card. After the warrant was confirmed, the man was transported to Whatcom County Jail to await extradition. On November 16, a 23-year-old man from Tacoma was detained by the Canadian Border Services Agency (CBSA) at the Peace Arch border crossing, escorted back to Blaine and detained by CBP officers due to a felony warrant that was out for his arrest. The warrant

was issued by the Washington State Department of Corrections on November 13 for second degree robbery and escape from community custody. The man, a US citizen, arrived without a shirt to the primary lanes to Canada and told officers he was heading to Toronto to visit friends. Prior to escorting him to Blaine, CBSA searched the man’s rental vehicle and found small amounts of meth. He was later transported to Whatcom County Jail.

s Mt. Baker.

By Oliver Lazenby If or when Mt. Baker eventually erupts, its effects won’t necessarily be constrained by international borders. To prepare for that awkward fact, the latest in a series of emergency response exercises focused on cross border communication in the event of a natural disaster on the active volcano. The exercise on November 15 and 16 allowed agencies on both sides of the border to test equipment and procedures for communicating in the event of a lahar or volcanic debris flow crossing into Canada after an eruption. The exercise was led by the U.S. Department of Homeland Security Science and Technology Directorate and the Defense Research and Development Canada Center for Security Science. “It went very well,” said John Gargett, deputy director of emergency management with the Whatcom County Sheriff’s Office, which was involved in the exercise. “Here in the sheriff’s office we were able to test our new com-

munications equipment, which did work as expected and that’s helping to augment our response capability,” he said. The exercise tested wireless communication capabilities and the ability to move resources and people across the border, among other things, according to a joint press release. The U.S. Geological Survey helped develop the emergency scenario to ensure that it would be realistic. In the scenario, the Sherman Crater wall near Mt. Baker’s summit collapses after an eruption, sending a lahar down valley that causes extensive damage in both Washington and B.C. Debris flowing from Mt. Baker would most likely put communities along the Nooksack, Baker and Skagit rivers in danger, but it’s possible that a large lahar in the Nooksack River valley could cross a divide near Everson and reach the Sumas River, according to Natural Resources Canada. The Sumas River flows into the Chilliwack River at Barrowtown, B.C., which then flows into the Fraser River and reaches the Salish Sea at Richmond, B.C., part of

the Metro Vancouver area. The exercise was the fifth in a series called Canada-United States Enhanced Resiliency Experiments (CAUSE), which began in 2011. The exercises focus on different aspects of disaster response. Past CAUSE exercises have emphasized the logistics of transporting patients across the border and the compatibility of techniques and equipment for responding to emergencies, among other things, Gargett said. “Whatcom County and the Lower Mainland are, by their geographic makeup, somewhat isolated compared to other border regions, so we have a common interest in supporting each other,” Gargett said. “Since 2011 when the experiments began we have made a very concerted effort to make sure we are working together and jointly with Canadian agencies.” Other agencies involved with last week’s exercise include the cities of Abbotsford, and Langley, B.C., Canada Border Services Agency, Whatcom County Sheriff’s Office and U.S. Customs and Border Protection.

s Approximately 5–10 gallons of hydraulic fluid leaked from a sunken commercial crabbing boat owned by Lummi Nation tribal members at the Blaine Harbor marina on November 17, said Washington State Department of Ecology (DOE) communications manager Ty Keltner. With help from the Port of Blaine and the DOE, the boat owners were able to recover some of the spilled fluid and lift the boat out of the water to transport it for repair. “The weather conditions were definitely a factor,” said DOE spill responder Zach Gaston.

A Blaine man was arrested on November 13 on allegations that he raped a 44-year-old Bellingham woman. Ruben Barrios Ibarro, 52, was booked into Whatcom County jail on suspicion of second-degree rape after an October 27 incident at a Birch Bay house. Ibarro arranged for the Bellingham woman to pick him up and take him to a friend’s house in Birch Bay where other people were hanging out, according to a statement from Whatcom County undersheriff Jeff Parks. After drinking a couple of alcoholic drinks given to her by Ibarro, the woman passed out. She

later woke up in a bedroom to find Ibarro having sex with her, she told detectives. She became ill and said she wanted to go home. She did not remember some details but said she did not give consent and did not intend to have relations with the suspect, according to the statement from the sheriff’s office. She left the house and told her family she’d been raped. Detectives contacted her at a hospital, where she was undergoing a sexual assault examination, and developed probable cause for a degree rape charge. Ibarra was released on bail on November 15. A trial is scheduled for January 29, according to court documents.

All-conference teams chosen Three Blaine fall athletes have been selected to 2A Northwest Conference all-conference teams. For volleyball, senior Camryn Vosloh was named to the all-conference first team and senior Josie Deming made the second team.

Burlington-Edison senior Afton Field was named the conference player of the year. In soccer, sophomore Maya Ball made the all-conference second team. All-conference athletes are nominated to teams by their coaches.
