very year we anxiously await the spring and summer months, looking forward to spending more time outdoors. Our yards become an extension of our home, where we cook, play, and relax. We plant flowers and vegetables, mow the grass, add compost and fertilizer, and water it all. We do this against a backdrop of increasing concerns about water shortages in our communities.

That means fines will resume on all properties that fail to adhere to the rules and regulations in the community. In a nutshell, the current process for imposing a fine on a member can be quickly summed up as follows:
Please join me in changing the relationship you have with our yards, by attending a Landscaping Summit that has been specifically catered to our community on Saturday, May 28, 2022, at 10am in the Rec Center located at 1220 Lago Vista Court (old sales building). This summit is an educational session to help our members better understand how the landscape affects the community. The Landscaping Committee has provided a setting for all residents to participate in this important topic that affects all homes.
Once it has been determined that a member is in violation of the Governing Documents, the first step is to provide the member a warning and the opportunity to cure the violation within a reasonable time, so please read the notice of violation letter. If the member fails to take corrective action, then the BOD must hold a duly noticed meeting to vote whether to impose a fine and set the amount of the fine not to exceed $100 per violation. After the BOD votes to impose a fine or fines against a member and the amount to be levied, the fine

is not considered valid and enforceable until the HOA provides the member with 14-days’ notice that the BOD has voted to impose a fine against the member and that the member has the opportunity to be heard before the HOA’s Violation Committee. This notice must clearly state the date, time, and place of the hearing and the reason for the hearing.

the association within 90 days of assessment, the association may suspend the member or guest’s right to visit common areas or use facilities until the fee is paid in full.
VOTING RIGHTS The HOA may suspend the voting rights of a member who hasn’t paid fees or fines that are over 90 days delinquent. A suspended member won’t have the right to participate in voting during an election to the board, approve an action, or form a quorum until he or she has remitted full payment of all financial obligations due to the association.
At the violation hearing, the Violation Committee shall review the evidence presented and the testimony of the parties in deciding of whether to impose a fine or not. In order to impose the fine(s) on a member, the Violation Committee must vote to approve the fine(s) by majority vote. If the Violation Committee votes to impose the fine(s), then the fine payment is due 5 days after the date of the committee meeting at which the fine is approved. The Statutes require that the HOA provide written notice of the imposed fine to the member after a finding is complete.
LIENS A housing association typically has a right of lien on each parcel within the property to secure the payment of fines and assessments. Associations cannot file a claim of lien for fines or outstanding debts of less than $1,000. Once the claim is filed, the lien may be used to secure any unpaid assessments as well as interest, late charges, and reasonable costs incurred in the collection process.
FINES An association is allowed to charge reasonable fines of up to $100 a day, per violation against a member—or any member’s tenant, guest, or invitee—for the violation of provisions in the association bylaws or regulations in the governing documents.

Our priority is to make sure that every visit from our residents and their guests is an opportunity to create new memories that will last forever. In an effort to make sure that we provide excellent service and make sure that we are complying with the rules and regulations, when visiting the club facilities, we all need to make sure that we remember that: »

Every resident must sign in and have their Bellalago ID with them (adult and/or consent ID) when they visit our club facilities. Residents are allowed to bring four (4) guests ONLY. Residents 16-17 yrs. with consent ID are not allowed to bring guests or sign in any other resident. Our staff will kindly ask to check all coolers as residents come in. No outside alcohol beverages are allowed in our pool deck.

No food or drinks are allowed on the edge of the pool deck. Only noodles and arm floaties are allowed to be used inside the pool. Our team will constantly supervise the pool deck, making sure that residents are complying with the pool rules. To avoid any injuries or accidents, we ask you kindly to avoid moving the pool furniture from their current location.

Violation Process

ummer is upon us and with the warmer weather and rain comes an abundance of life and vegetation growth. During summer months maintenance of yards have to be done more frequently. These are the months that the majority of landscape violations are sent. Just like any other violation there is a process, notices are sent and there is a timeframe (14 days) before escalation occurs. Most of the time, upon receipt of violation, homeowner and/or resident takes care of violation(s) ASAP. We do, however, have some homeowners/residents that take a little longer (due to unforeseen circumstances) and/or negligence so we place the home on Self-Help (after proper notifications). Self-help is when the association maintains the homeowner’s property (due to maintenance negligence) and back charges the homeowners account.
Most common violation for the summer months is Landscaping violations including overgrown grass, weeds, trimming of dead fronds, garbage bins left out and parking violations. As a general reminder notices are posted at the Bellalago amenities with the time, date, and location of the “violations committee” meetings (third Wednesday of the month). In this meeting the committee reviews violations that have reached level two and vote to keep or remove the fine(s) approved by the board. This is the time where a homeowner can explain and/or make a case of why the fine should not be imposed. The committee members will hear the case and inspect any documentations brought forth by the homeowner. The committee will then make a final determination weather the fine is applied or not.
Animals are a big part of Bellalago and with the warmer weather we see more birds, gators, and other animals more frequently. As a reminder, please don’t feed wildlife; feeding wildlife can cause nuisance problems around the community and is also not allowed by State/Local laws. Alligators are common in Florida and a big part of the wildlife in Bellalago; naturally their instincts are to run from people. If they are fed they lose fear of humans, and alligators that are not afraid of humans are a danger to the community, so please don’t feed the alligators. B EL L A L AG O B E AC ON
