A
s we head into June and the summer season, the word that comes to mind that best describes the activity level in Guilderland right now is “busy”. There are many, many things happening in our community this month, and I’m pleased to have the chance to share some of them with the readers of Our Towne. 2012 is the 40th anniversary of the Guilderland Chamber of Commerce, an organization that was founded or and continues to serve the thriving and diverse business community within our Town. The Chamber has worked with the Town in many ways to advance the shared goals of a prosperous and livable community, and I’d like to congratulate them on this milestone. The Chamber’s Annual Dinner will be held this year on June 14th, and a number of area businesses and business owners will be recognized at the event for either their work in beautifying their business premises, or for their outstanding service to the business community, and to the overall quality of life here in Guilderland. More information on this event is available at the Guilderland Chamber website, www.guilderlandchamber.com, or by calling the Chamber office at 456-6611. On Saturday, June 16, the Guilderland community will honor our veterans by holding a Veteran’s Memorial Service at 2:00 P.M. at Prospect Hill Cemetery, located at 2167 Western Avenue. Prospect Hill Cemetery, chartered in 1854 and the final resting place of numerous veterans, is an impressive location for this special ceremony, which will honor those who have served their country from the War of 1812 through current conflicts. This service has been arranged by the Trustees of Prospect Hill Cemetery. Parking will be available at Guilderland Elementary School, with a shuttle provided to transport attendees to and from the site of the service. I hope you will consider attending to join in paying tribute to the Town’s many veterans. The Altamont Free Library is now open in its new location at the refurbished Altamont Train Station on Main Street in the Village. The restoration of the facility and the relocation of the library operation has been a long-term project, but the result is a wonderful example of the transformation of an underutilized historic structure into a true resource for the community. You can find more information, including the hours of operation, on the website, www.altamontfreelibrary.org. The 33rd season at the Guilderland Performing Arts Center will open on Friday, June 15 with the Nervosity Concert, a battle of high school bands. The Thursday evening concert series will kick off on June 21 with a performance by the Guilderland Town Band. Bring your lawn chairs and blankets and enjoy the music on the hill by the vale at Tawasentha Park. A full list of this summer’s shows can be found on the Town website, www.townofguilderland.org. Tawasentha Park will also host Guilderland’s second “Mud Mania” event on Saturday, June 16. This family fun event will feature plenty of mud, no matter what the weather. Multiple races over the obstacle course will be held, starting with a Fun Run for kids under 12 at 11:30 A.M. Refreshments and free post-race hosedowns will be available. As you tend to your lawns and gardens, remember that the Town Highway Department trucks circulate throughout our neighborhoods all summer picking up bagged yard waste and bundled brush. Please be courteous to the crews by bagging and bundling properly, and to your neighbors by placing materials for pickup in a way that does not obstruct the roadway. Guilderland’s summer camp program will begin on Monday, June 25. A wide variety of sports, adventure, and enrichment programs are offered. There are still openings in most programs at this time, but a good many of the programs do fill up. You can register on-line at www.guilderlandrec.com, or stop in at the Parks and Recreation Office on Route 146 opposite Tawasentha Park to register in person. The weather has been kind to the landscape at Guilderland’s Western Turnpike Golf Course. Playing conditions are excellent, and pricing is attractive. Please remember that Guilderland residents are eligible for discounted rates when they present Town I.D. cards, which they can obtain at the golf course with proof of residency. Please call the Pro Shop at 456-0786 for information on greens fees and specials, playing conditions, or tee time reservations. As I said at the beginning, June is a very busy month here in Guilderland, and I hope everyone has the opportunity to get out and enjoy some of the things that are going on around the community. I have highlighted some of them, but I encourage residents to check the websites for both the Town (www.townofguilderland.org) and the Village of Altamont (www.altamontvillage.org) for others. Important Information on the Library’s Upcoming Building Referendum
W
hen the community celebrated the opening of the Guilderland Public Library in 1992 no one could have anticipated the town’s growth, nor how use of the Library would increase in just two short decades. Visits more than doubled from just over 153,000 when we opened to 326,444 in 2011. Attendance at programs increased over 1,000% while the number of programs shot up 400%. Additionally, circulation more than tripled. Activity at the Library continues to grow. The actual building, however, has not.
WE WANT TO DO MORE, BUT WE DON’T HAVE THE SPACE. Our collections’ growth is zero sum—for every item we add, we have to remove an item because of limited shelf space. We have to say no to community groups who would like to use the Library’s public meeting rooms—we’re booked solid month after month. We have to limit our own program offerings, such as Children’s Storytime which promotes pre-reading skills, because demand outpaces space. Space constraints are not just limited to overcrowded shelves. Between 1,100 and 1,600 tutoring sessions for Guilderland students take place at the Library every year. Because we have only three quiet study rooms, these sessions take place in the main adult section of the Library making it difficult to enjoy quiet reading. Our teens have no place of their own, and our tweens don’t want to go to the children’s room for their books, DVDs, CDs and other materials. On Tuesday, June 26th, you will be asked to vote on a $12.95 million bond to expand the Guilderland Public Library to meet growing community needs. The Library’s Board has engaged the community in discussing what they want to see in their Library and how they’d like it to expand. Their response was simple—more programs, more collections, more meeting space and separate spaces for children, tweens, teens and adults.
Highlights of the program include:
• Increased building footprint —from 27,650 sq. ft. to 47,660 sq. ft. • Larger, quieter Adult Reading Room • Enlarged Children’s Room • Center for Local History and Genealogy • Small Business Development Center • Noise proof Teen Library • New space for Tweens • Full ADA compliance throughout the facility • Comfortable public seating and workspace • Increased meeting room space • More Study Rooms • State-of-the-art technology that will be able to keep pace with future change • Increased energy efficiency with geothermal heating and cooling, energy efficient lighting and other green elements • Flexible space to allow the Library to change based on community needs

Thirty year mortgage rates under 4% and prices at 2004 levels are final enough to bring some increased buyer activity. However there are many, many, homes that continue to languish on the market. The question becomes how to you move from “old” inventory to “sold” inventory? After working with thousands of buyers and sellers over the past two decades, one thing is apparent. Wills and Trusts – Part 1 of 3 Conventional wisdom dictates that any person with assets should have a properly-drafted will in place to provide for the distribution of his/her assets upon death. However, in our experience, there is often confusion surrounding which assets, if any, will pass through a will. Generally speaking, a will distributes any assets that don’t already have a distribution plan based on account ownership and/or beneficiary designations. Examples of assets which will not pass through a will include: • Assets owned in joint tenancy, an arrangement which is dissolved when one tenant dies with the title passing automatically to the surviving joint tenant(s). • Accounts registered with a Transfer on Death (TOD), Payable on Death (POD), or In Trust For (ITF) provision. • Life insurance proceeds, unless the insured’s estate is the beneficiary. • Individual retirement accounts, employer-sponsored retirement plans, annuities, etc. with named beneficiaries. • Trust-owned assets. Understanding the above is an important consideration in drafting a will, else you may find that there aren’t assets available to meet your wishes! For example, let’s assume that Ruth owns only two assets: 1) an individual retirement account worth $200,000 with her son named as beneficiary, and 2) a bank account worth $100,000 owned jointly (with rights of survivorship) with her son. Ruth also has a will specifying that upon her death, she would like $50,000 to be donated to her favorite charities, with the remainder of her estate passing to her son. When Ruth passes away, how much will her favorite charities receive? Under the above plan, Ruth’s favorite charities will receive $0 from her estate, because both of Ruth’s assets will pass directly to her son without passing through her will. While Ruth’s son may elect to honor his mother’s wishes by gifting $50,000 of his inherited assets to her favorite charities, he is certainly under no obligation to do so. Many people may find that it is possible and even preferable to distribute their estate outside of their will. When a will is used to distribute assets, it becomes public record, and the assets being distributed become subject to the probate process. While the probate process varies by state, it generally involves greater cost, delays, and complexity compared to alternative distribution methods. Although a will should still be in force to cover any assets that may be forgotten about, we suggest that most estate distribution plans can be accomplished by some combination of the following strategies: 1. 2.
Beneficiary designations and/or joint ownership of assets. The creation and funding of a Revocable Living Trust and/or Irrevocable Trust. In Part 2 of this series, we will discuss Revocable Living Trusts.

There Is No “normal” Headache. By Dr. Jennifer L. Noonan,

requently on a patient’s first visit when we are reviewing their health history, they will say they experience “normal headaches”. Lets clear this up. There is no “normal” headache. Pain anywhere, of any kind is your body’s way of communicating with you that something is wrong. This is true of headaches as well. According to the World Health Organization there are over 14 types of headaches. The most common types are tension type headaches, migraines, cluster headache and the chronic daily headache syndromes. Not only are headaches painful but can often be debilitating for some sufferers. The type of headache most commonly treated by chiropractors is the “cervicogenic headache” or muscle tension headache. They can be caused by upper cervical subluxations, which is when the the joints have lost proper alignment, creating nerve irritation. Other causes include trauma, postural strain, myofascial trigger points, TMJ syndrome, and tension. Often these headaches can be exacerbated by emotional stress, fatigue, noise and eye strain. The most common cause is due to a combination of dysfunctional cervical joints and prolonged contraction of the suboccipital muscles, which sit just under the base of the skull and attach to the cervical vertebrae. The result is a ‘band’ or ‘vise-like’ pain compression around the scalp. The chiropractic treatment of muscle tension headaches targets these muscles and the joints of the upper cervical spine to decrease tissue tension and improve joint range of motion. Chiropractors also counsel their patients about the importance of maintaining proper posture, and give them exercises to perform at home to support optimal posture and body alignment. Frequently I’ve had patients come in highly distressed from disabling pain and fear from that pain, not knowing why they were getting such terrible headaches. After other causes were ruled out, these patients were found to have spinal subluxations in their cervical spine causing the headaches. Although results can never be guaranteed, I do know this; over the counter medications have serious side effects including bleeding and death and still only mask symptoms. Chiropractic addresses the cause. Chiropractic care is incredibly safe and effective for this type of headache and migraine type headaches as well. Top 3 reasons to avoid a “DIY” separation agreement
Y
ou need a separation agreement. The economy is bad and attorneys can be expensive. No problem. Google has an answer for everything. Why not just jump online, do some quick research, and handle it all yourself? Or if things seem complicated, try one of the many advertised services that claim to provide a divorce for $99 or less. Representing yourself, or acting pro se, in any separation or divorce proceeding may seem like the way to go. Unfortunately, even when the involved parties can set emotions aside there are often issues to consider that aren’t necessarily obvious or easily anticipated. 1. Termination of a marriage brings with it many financial concerns relating to child support, spousal support, and property distribution - If the agreement (i.e. contract) is prepared by individuals who do not consider the potential financial implications, you may end up paying, or losing, a lot of money. 2. Court processes are often complicated and usually require forms, agreements, procedures, etc. to be presented in a certain way. If things are done incorrectly, you may be required to redo them and/or pay an attorney to correct mistakes. 3. A separation agreement is a contract. This means it is legally binding and you must do what it says. Once signed it cannot be undone unless both parties agree or exceptional circumstances are demonstrated. Exceptional circumstances can include fraud, duress, overreaching, or that the agreement is otherwise unconscionable. All of these are extremely difficult to prove. Any legally binding agreement, including separation agreements, needs to be written with a full understanding of the overall impact it will have on the people agreeing to the terms. If the agreement is prepared by you, your significant other, or a document preparation service working for $99, there is a high potential for disastrous and costly mistakes that are likely to be irreversible. I have seen “simple” errors or oversights that in the end cost the client tens of thousands of dollars. As with many things, cutting costs on the front end of an endeavor will often lead to more expense and problems later on. If you are in need of a separation agreement, or any other legal services, it is important to seek the expertise of an experienced attorney. Working with an attorney does not necessarily mean there will be acrimony. We don’t hesitate to go to a doctor when we are sick or a mechanic when our car doesn’t start, yet many think they should handle the most significant legal issues of their lives without even consulting a lawyer. Let the professional do his/her job so you can focus on getting through this difficult time in your life.

Q. When was your organization started? A. Guilderland Pop Warner (GPW) was started 50 years ago in 1962 by a gentleman named Vick Riley.
Q. What is the purpose of your organization? A. The purpose of our organization is to provide a safe and enjoyable learning environment for children, ages 5-14, wanting to develop football and cheerleading skills. We develop football players and cheerleaders from a beginner level to an advanced level. Children that have gone through our program have proven to be successful, with their gained experience from GPW, by playing at the higher levels of cheer and football offered by the Guilderland School District. Our hand picked coaches go through extensive training consisting of the rules and regulations enforced by our parent corporation, National
Pop Warner. We also require and encourage our coaches to do an additional online certification program developed by Positive Coaching Alliance. This program teaches our team leaders the importance of their roles and how they can leave a positive impression on our kids. All of our 15 Board Members are CPR & First Aid Certified. We also require at least 2 coaches from each team to be CPR certified as well. This is extremely important to us as safety, as in any sport, is always a high concern. We offer various levels of cheerleading where kids move to new levels based on age and ability. We offer those same levels in football, but have stricter rules governed safety purposes. Kids ages 5-7 play flag football. Kids ages 7-14 are placed on teams governed by weight and age. Q. How many people has your organization served? A. Our organization has served over a couple thousand of children from the Guilderland, Voorheesville and Altamont area. We also like to think that we not only serve the children of our community, but also our parents as well. Here at GPW, we offer a great opportunity for parents to learn how to coach and be apart of their community while getting to be apart of their kids and other kids sporting experience.

Q. What else do you want the community to know about your organization? A. We would like our community to know that we offer high quality coaching and believe that Guilderland Pop Warner is a great place for kids to learn how to play football and cheerlead. We would also like our community to know, that we are always looking to improve our services and encourage parents to contact our board with any concerns or questions. We would also like to inform and invite you to our 2nd Annual Golf Classic at Western Turnpike on September 28th. Also, we will be holding our 50th Anniversary Celebration at our Family Fun Night August 30th that you are more than welcome to attend as well.
The 2011 Guilderland Junior Pee Wee Team won the Capital District Pop Warner Super Bowl. Q. What are the challenges your organization faces? A. The biggest challenge our organization is facing is low enrollment. Our numbers for both cheer and tackle football have dropped significantly over the past few years. We attribute some of this withdrawal to the additional opportunities offered by other sports, our mid-summer begin date and also to the growing concern of football’s demanding physical requirements on children.
B. Please note that summer practices are on Mon, Tues, Wed, and Thursday 6-8:30pm. Weekends are yours!!! Our 5-7 year olds only practice on Tues and Thursday 6-7:30pm. Practice schedules change to Tues ,Thursday and Friday 6-8pm, with a game on the weekend once school starts. C. Q. How are you prepared to meet those challenges? A. We have prepared ourselves in many ways. First of all, practices do not start until Monday AUGUST 6th. We know that summers are very short and valuable around here, so we delayed our start date from the 1st to the 6th. We wanted to give families that extra long weekend. We have also increased our public relations within the community by joining the Guilderland Chamber of Commerce. We are in the process of upgrading our website and online registration. This service will enable us to have better communication with our parents and to also offer monthly “hot topics” that may hold interest to our parents and players. We OurTowneGUILDERLAND.com

BLACKBELT FOR LIFE I dedicate this month’s article to the accomplishments of our newest Blackbelts. They completed their evaluation at an all day test on May 19th. Becoming a Blackbelt in a martial art is more than just learning the physical techniques required. It is about understanding that the dedication to enhancing those techniques and the discipline required to develop the muscle memory to execute the techniques applies to every aspect of our lives. I have begun to demonstrate that to you by the writing of these simple little articles that you are so kind to read. I have told you stories of how the different character qualities that are acquired along the road to becoming a blackbelt apply to our everyday lives as adults and children. I sometimes have challenges ( by the way, this can occur as a high school teacher and parent of three). If I look at a picture in which I am breaking concrete at a test, I realize: if I can break through that challenge, then I can easily overcome this current simple challenge. We have used the breaking metaphor repeatedly including on Good Morning America and at Relay for Life. The eleven students below are like family to me; we have been through a lot together. I am very pleased that they now have a picture of themselves breaking concrete to look at and the character inside to help them overcome challenges. You may see them around town committing acts of great character and kindness, for that is the true sign if a great Blackbelt.
Master Rice owns Guilderland Martial Arts and holds a 5th degree Black Belt in Taekwondo. Master Rice is also a Math teacher at Guilderland High School.
