TRANSVERSAL TABLES OF PUBLIC POLICIES FROM THE ENERGY SECTOR
I hereby that, Oil and Gas Alliance is well to deliver the final document of the transversal tables of public policies from the energy sector, of the oil, services and electric sub sectors. From activities that we have been carrying out together with the members and allies that responded the call to integrate with the most relevant companies in the Mexican energy sector. Presenting initiatives and solutions for activities within the sector, in response to the invitation made by the owner of the executing power of Mexico, AndrĂŠs Manuel LĂłpez Obrador to CONCAMIN ()and in conjunction with Oil and Gas Alliance.
METHODOLOGY Sub-sector tables to establish a definition by an industrial policy. In this methodological proposal for the work of the tables from the sub sectors, the 8 steps for the development of public policies by the Prof. M. Bardach from the perspective of an industrial engine; nevertheless, an approach of origin of the industry is maintained, with participation and linkage, both to the academy and to the government, seeking to include in the guidelines the insertion with institutions and public programs for the sector.
PETROLEUM SUB-SECTOR LEGAL AND REGULATORY FRAMEWORK
It is important in the regulatory framework, to simplify the reports among several regulatory bodies, this generates many additional expenses and is not efficient. The regulatory framework must be unique and there must not be two organizations requesting two different versions of the same requirement which it is advisable to propose a review and comprehensive redesign of the regulation, which should only be subdivided by subsections / topics to review / approve by each of the regulators according to their area of competence. The national content is a relevant issue that significantly impacts the economy and the hundred co-technological developments of the country. This should be treated, at least according to the economic amount of the investment by the technical team which participates in the operations to be carried out and if this work force is not contracted in the country. The amount not contracted should be recorded by an equivalent percentage, perhaps the income tax gives that percentage to training and development of their own technologies, since otherwise there is no economic benefit, learning, experience or professional and technological development. On the other hand, companies that do invest and promote the training / hiring of Mexican specialists should be encouraged to include them in social service programs and tax incentives.
In the regulation of national content it is necessary to have a catalog of goods and services as detailed as possible, and this must be the same for the SAT (Service Tax Administration), FMH (Mexican Hydrocarbon Fund), Economy, CNH (National Hydrocarbons Commission) and SENER (Secretary of Energy). This would facilitate the control of the national content report and the administration of public supplier development policies. Within the areas of a legal framework from the energy sector, a clear law of social impact is needed in which the right of way and surface use is facilitated. Within a law of local content, it lacks clarity to the transfer of technology and relationship with universities for oil operators. In the regulation of content, there must be reformulated and more weight given to the investments made in the universities in technology transfer, infrastructure and training, since these items in the current formula are diluted in the calculation, so there is no incentive to invest socially, but the social impact is very large and tangible with society. Greater agility in the responses of regulators on the issue of energy and oil (CNH, ASEA, CRE, COFECE). Do not apply to PEMEX the regulatory asymmetry that puts it at a disadvantage to compete when bureaucracy and budgetary limitations are added.
The surface occupation laws in the Hydrocarbons Law should be repealed. Or leave them as they are and see how it is for all development, or remove them to allow development to continue its course. Now everything is on pause due to this issue. These laws must be modified in order to be more efficient. It has to return to the premise that a right-of-way agreement is an agreement between two private parties and the government does not have to be involved in the process, unless there is a dispute between the parties.
TAX REGIME Mexico should reduce taxes on income and value-added tax at competitive levels worldwide, a tax on income of 24-26%. The US recently lowered this tax to levels of 20%, leaving it more competitive than Argentina, Brazil and Mexico in the Americas. Change PEMEX’s fiscal regime to allow it to re-invest its profits and not have to resort to debt, to fulfill its fiscal obligations and finance its projects. The reduction of taxes, the lack of transparency in the destination of the same and the low quality of the few services obtained in exchange for these, is something that affects all productive sectors of the country. A good public policy, in addition to reasonable taxes, should include the availability of land with adequate infrastructure and communications, services and security. Apparently there are two essential tax models, that of the low social economy countries, where taxes are very high and citizens receive many and very good services in return; and in North America, the taxes are low, basic services are good, but the personal ones (school, doctor, retirement) are expensive.
HUMAN CAPITAL AND THE TRANSFER OF TECHNOLOGY The professional development project for the energy sector should be continued. Give support to technicians who are at an average level, since the creations of jobs is mainly at a standard level. In general, the ratio of technicians is 6 for each professional at the undergraduate level.
It is necessary and urgent to update the diagnosis of requirements of the industry and to redesign the programs of the schools and universities according to the tendencies of development from the industry, that is, based on future requirements, not present or past.

INFRASTRUCTURE
It is necessary to update the port’s infrastructure for the operation of offshore projects, there is the only port of Dos Bocas. Update and adapt the airports for operation of helicopters to transport personnel to offshore installations. It is necessary that the airports that operate in cities in the Gulf of Mexico establish air routes connecting within Houston. All infrastructure of the country must be adequate and redesigned according to the requirements of its specific use, the rules of construction, design and distribution of spaces, communication routes, accesses and maneuvering countries must be rigorous. The perception is that, in general, we are very careless in this sense and a safe industry requires strict controls and full compliance. To speed up the installation and development of special economic zones for industrial promotion and, first of all, to assemble equipment and later manufacture it for oil activities. This would contribute to the industrialization of the country, its imports, trade balance, employment generation and activate regional productive chains. Strengthen and support the development of petroleum storage and distribution infrastructure, at the same time to make government / private sector alliances and initiate such action. Development of greater highway infrastructure in the southeast, for example: there is only one highland road access from the highlands to the southeast (on one occasion it was blocked by the Villahermosa floods in 2007). For gas, it is very important to finish the gas pipeline systems that are currently under construction. The government should get involved as soon as possible to resolve the pending issues in the field. Many of the issues have to do with city councils that demand excessive payments from developers.
IMPLEMENTATION OF THE ENERGY REFORM
The particular perception is that the poor implementation of the energy reform distorted its true meaning. The purpose was to attract investments and fresh money to be added to the country’s resources, to increase the capabilities and development of the national industry, this was not achieved by the internal and external factors that we know, however, it is a fact that Mexico requires resources and a possible source of wealth is our well-managed oil industry. Accelerate activities in PEMEX’s mature fields portfolio to increase production in the short term.
DEVELOPMENT OF SUPPLIERS, PROMOTION PROGRAMS AND FINANCING STRUCTURE
It is necessary that there is a public policy, of development, of national and foreign suppliers that manufacture in Mexico. The support of the cement and iron mining industry as a primary activity in Mexico, equipment and services segment for subsea equipment, drilling, as well as construction projects for drilling and production platforms, they are the big Operators, these services and equipment will be able to supply the mining of the iron and cement; besides being able to supply the steel industry to supply the shipyards. PETROLEUM SUB-SECTOR LEGAL AND REGULATORY FRAMEWORK
It is important to establish an area specialized in creating standardized standards for specialized service companies in the industry and the Mexican market, beyond copying that establishes realities in the deliverables for Mexico, with a high commitment to the Anticorruption Policy. The international homologation „topicalized” to Mexico”, but if it works only to apply it, there must be a multidisciplinary team with faculty and legal support. It is important to simplify the reports between various regulatory bodies or to homologue, reducing the paperwork and the time between authorizations. The regulatory framework is diffuse and evolving in the area of cybersecurity in the country. The criminal acts are fought under the current code, some computer crimes are prosecuted, more, it is thought that the companies of the branch integrate a cybersecurity council to implement the best practices and ensure notification of cases to the same and to the CERT of the federal police. Look for support and belonging with the coordination of the national digital strategy, to be included in public policies and development plans in the sector. Redefine the legal framework for cybersecurity, harmonizing federal and state legislation, guaranteeing the protection of personal data and encouraging the sharing of information. TAX REGIME
Tax incentives for the industry that generates jobs in the country. In the value chain give weight to small and medium enterprises, which is the support of the industry. A reduction from the income tax to the salary, according to the income of the worker, is a labor cost that does not benefit the competitiveness, nor the worker. Micro, small and medium-sized companies and industrial companies, by production segment, the average rate of the OCD (Oil Conservation Division ) is 24.66%, but it should be adjusted to the reality of the country. An additional tax burden is the Special Tax on Production and Services of fuels, which we know was considered in fuels to compensate for the drop in oil prices, therefore, for me, the situation should be considered temporary until the recovery of prices and the increase of hydrocarbon reserves, for this purpose, the reaction of offshore exploration and with better technology is required. Create a fiscal stimulation, as well as disseminate or make known the benefits of carbon credits, for companies that meet the criteria of environmental protection and use of clean energy. PEMEX must pay like the rest of the companies in the country, it does not have to pay more or less. Energy projects should have the option of accelerated depreciation, this would help to make them more attractive. Energy projects are very long term, there should be incentives to recover the value added tax
in the short term and not until it starts to invoice, which sometimes takes more than 5 years. HUMAN CAPITAL AND THE TRANSFER OF TECHNOLOGY Link universities with industrial processes to have more qualified personnel. Development of human capital according to the needs of the country and the projection of development of the different productive sectors of the economy.
Link government-sector, productive / initiative, private-educational institutions, preparing the CH from the educational institution for its proper performance once the educational period, avoiding a learning curve of longer duration and more expensive. Making jobs more attractive, considering the working conditions according to the legislation and the verifications by the institutions must be effective.
Exchange of international technological knowledge through public institutions and companies willing to give the corresponding support, ensure the return to the country of the trained CH. We have a tremendous lack of talent in human capital, as there is no staff with knowledge, except for the one developed by PEMEX. In order to compete and grow we need to develop more personnel, we must create a plan for the development of new talents and
a plan to attract talents from abroad. There is still a lot of ignorance in Mexican companies about activities where they want to compete with PEMEX. With the salary law that they plan to take out, the people who will work in government bodies will be the least capable, this must be reconsidered. The development of specialized human knowledge in the sector should be subsidized, with the aim of developing local expertise and reducing the continuous importation of talent from abroad.
Seek support and belonging with the coordination of the national digital strategy, to be included in public policies and development plans in the sector. Train professionals in cybersecurity. Differentiate between information technologies, information security and cybersecurity. Initiate the creation of the cybersecurity operations center (CSOC) focused on cybersecurity management for incident prevention and remediation. Definition of strategic security plans in the sector and by company. An impact on the sector is an impact to critical facilities that can paralyze the activity in the country. Strengthen the SME to be an important factor in the supply of goods and services that the energy industry requires, also enhancing the generation of sources of work that the country requires.
INFRASTRUCTURE
Continuity is required in the works stopped in the sector, to have the project capacity in storage and distribution of hydrocarbons. PEMEX, being the most important company in the hydrocarbons sector in Mexico, must have the necessary solvency to make the investments in infrastructure, in such a way that the tax regime to which it is subject must consider the necessary aspects for the sustainable growth of the company.
Mexico has had to import services and products from abroad, since the research and development of technology was stalled for decades, the IMP as a technological support that was only given to engineering services. It is therefore that this institute should be strengthened and focused on research to resolve the technological gaps that separate us from other powers. Review and create new mechanisms so that the Mexican IP can associate with PEMEX, introducing foreign high technology, but giving priority to national content. Create the legal and fiscal mechanisms to have a Mexican fleet of multipurpose
vessels, built or rebuilt in Mexican shipyards to provide offshore service. Innovation and technology transfer. Promote friendly technology with the environment. The growth of the APIS needs to be encouraged. It is necessary that the governmental entities push the development of new decentralized infrastructure points of those already known. REDEFINE THE LEGAL FRAMEWORK
FOR CYBERSECURITY
Modernize the Mexican port sector, providing tax promotion schemes, improvement in response times of the authorities, including the APIS, regulatory organizations (CRE, CNH, ASEA) and offices related to ports, so that new constructions and adjustments to existing facilities can be made in shorter times. In regards to this, it is important that the federal government grants the different areas of private investment, so that the infrastructure required by the country can be rapidly generated, especially in storage and transportation, which are the most serious structural faults. who has the country. It is worth mentioning that even when the physical security of installations and equipment is not an infrastructure issue, the truth is that it is a fundamental issue for the development of new infrastructure, as to reduce maintenance costs and environmental risks in transport.
IMPLEMENTATION OF THE ENERGY REFORM It is necessary to implement the projects so that in the medium term it can enter into operation with the various contractors and generate economic benefits in the sector. The energy reform should continue with priority given to Mexican companies, supporting the creation of national consortiums with the support of foreign companies, which align with medium-term transfer policies. Apply technology according to the previous points. Make a plan from the transfer of foreign labor to Mexican labor. Plan to increase national content in services and equipment for foreign companies in the medium and long term. Develop the field according to a conscious development plan to increase the production factor. Allow regulators to remain autonomous entities. Allow a healthy transition and not so abrupt, between what was made last and this sexennium, ie not change things so quickly. Do not cancel projects in development. Improve the response times of permits.
Harmonize federal and state laws, guaranteeing the protection of personal data and mulling the sharing of information. SECURITY AND CYBERSECURITY

and innovation, public institutions, national security and public security, whose development requires 8 transversal axes; 1. Cybersecurity culture. 2. Capacity development. 3. Coordination and collaboration. 4. Research, development and ICT innovation. 5. Standards and technical criteria 6. Critical infrastructures 7. Legal framework and self-regulation 8. Therefore, it is recommended to continue and implement more quickly since annually, the cost is between 3,000 and 5,000 million dollars each year in Mexico, according to the OAS. It is necessary to work on a national regulation regarding the technical requirements for the storage of information in the cloud.
Make public the risk studies of the country and create a security unit for new companies. The need to have a national cybersecurity agency that coordinates the strategy that is being defined and generates the critical path of governance on the Internet, and that also contributes to generating certainty and confidence.
DEVELOPMENT OF SUPPLIERS, PROMOTION PROGRAMS AND FINANCING STRUCTURE
Encourage the creation of service provider companies, made up of personnel with experience and technical capacity and administration, allowing them to access public tenders of PEMEX, in such a way that free competition among national individuals is encouraged. In the same way but for foreign and Mexican companies that have been benefited in the oil rounds. Give soft loans to Mexican companies in training according to the previous points, giving advice and training in business development and monitoring to achieve the stated objective. Give preference to those companies that comply with the best international practices regarding HSE, and also propose or have new methodologies or systems for environmental protection, giving an added value to their services. Publicize the position of the development bank on the projects that it seeks to promote, in this way create more incentives for new projects.
Operators and permit holders do not have a list or list of specialized service providers, which makes it difficult for both parties to develop business and competitive prices. It is suggested the development of a portal of suppliers on the Internet, including a rating by clients and / or users that facilitates decision making based on filters and experiences of other customers and / or users. Loans with more competitive interest rates should be offered to Small and Medium Enterprises, with the objective of encouraging their development. Standardization of processes between new operators and oil companies vs national suppliers on issues such as national content. Collaboration schemes throughout the sector, provide new operators with the elements that help them identify their potential suppliers because it has happened that some international companies, only extend invitations to tender to a limited number of national contractors and not all suppliers possible.
ELECTRICAL SUB-SECTOR REGULATION AND STANDARDS
Develop technical regulations of obligatory observance in greater quantity and with greater rapidity, by means of an active participation of the industrial organizations and of standardization. Improve the surveillance of the standards in the internal market by demanding and verifying compliance with them, through the support of the verification and certification bodies to PROFECO. (Federal Consumer Procurator’s Office). Require compliance with the NOM and the NMX in all public procurement procedures, requesting the corresponding certification as a requirement to participate in the purchase procedure. Make the actions of the Comisión Nacional de Normalización (CNN) (National Commission of Normalization) and the Federal Law on metrology and standardization binding for all state ministries and regulatory bodies. Create programs for young professionals who aspire to specialize in the issues of standardization and conformity assessment, as part of the strategy called „Young people building the future”.
PRODUCTION CHAINS AND NATIONAL CONTENT Expand the scope of trusts and public support to make them more inclusive, for the benefit of national suppliers and contractors in the electricity industry. Promote national procurement, emphasizing that all scheduled government purchases must observe the following points: • Purchases below the thresholds negotiated in the TLC (Free trade agreements) must be through national procedures. • The purchasing agencies, mainly CFE and • PEMEX, must make use of the reserves agreed in the various TLC (Free trade agreements), in order to carry out national procedures. • Demand compliance with national content allowed by the treaties, for the integrated projects of the electric sector. • The supply of those goods that are not national in the major integrated projects should only come from those countries with which Mexico has covered government purchases in an TLC (Free trade agreements). • The conditions of delivery of materials and equipment in national territory must be the same for imported products and domestic products. Take advantage of the purchasing power of the public sector for the development of Small and Medium Enterprises.
INTERNATIONAL TRADE
Maintain the rules favorable to Mexico in the TLC (Free trade agreements), especially in matters of rules of specific origin, so as not to unfavorably modify the percentage of regional content. Improve the verification of compliance with Mexican official norms on imports, to promote a competitive market and the safety of end users (timely update of the „agreement on standards�). Speed up times and facilitate complaints of unfair competition and imposition of compensatory taxes, especially when dealing with capital goods. Promote mutual recognition agreements for certification of compliance with the national destination standard, for the benefit of the participants of the conformity assessment procedures.
INNOVATION
Incorporate into the support programs available for technological innovation, eligible items for laboratory tests and product and process certifications. Support the design and development of prototypes of products, through collaborative projects with public institutions and productive companies of the state. Promote the integration of supply chains of electrical manufactures, associated with the development of technologies for the generation of clean energies. Establish a strategy in conjunction with the National Chamber of Electrical Manufacturing, with the purpose of: • Strengthen the impact of government programs for the incorporation of human capital in companies • Elaborate the standards of competencies required according to the trends of the sector. • Define the instruments for the development of required technical competences.
AREAS OF OPPORTUNITY IN THE ELECTRICAL INDUSTRY
Act according to the future demand of generation, attending to the transition to clean energies. Create tools that encourage investment in new generation plants, oriented towards environmental sustainability. Intensify the effort and stewardship of the authorities of the electricity sector, in their work of planning, regulation and operation of the country’s strategic policy. Modernize electrical networks through the replacement of those equipment that does not meet the efficiency standards. Strengthen the national electricity system to avoid delays and improve the quality of the public electric power service, especially in terms of transmission Prepare a roadmap for the implementation of smart grids (Smart Grid) in the national electricity system, with a long-term perspective that incorporates the vision of the industry. Develop the specialty in intelligent networks for engineers and technicians.
