JUDITH S. KAYE

In the long, slow, ascent of society to the rich and dynamic experience of diversity, the educational community has often been called upon to precede social change. Nowhere has this been more apparent, nor perhaps more important, than in the profession of law, and The New York Law School has been committed since its founding to hold open the doors to a legal career so that all could enter whose abilities and ambitions alone established their credentials. Along with opportunity, however,individual contributions are essential. In every great period of social change, a few individuals become role models, others become leaders, and some become agents of change and progress. It may be said that Judith Smith Kaye has been all three. As a journalist, as one of 11 women in her 300-member New York University law school graduating class, and as an attorney, she refused to accept the status quo. As the first woman Associate Judge of the New York State Court of Appeals, she applied higher standards of equity and justice in state law than some would apply under the federal Constitution. Newlyappointed Chief Judge of the State of NewYork,she has noted that "I wanted to be a lawyer because I saw such a potential for doing good ... bringing justice to all citizens, and contributing to the enlightenment and progress of society. And 30 years later, I don't have any different view of what lawyers do or what they should be doing." The child of a farmer and merchant in rural New York, Judge Kayeenvisioned a career in journalism but soon turned to the study of law. Graduating cum laude, sixth in her law school class at a time when only three percent of lawyers were women, she became a highly respected commercial trial lawyer and rose to become one of the fewwomen partners of a major firm. Selected by Governor Mario Cuomo to be the first woman ever to serve on New York's highest court, she noted at the time that her "gender travels with me. Being the first woman, I don't lay that aside." During the intervening ten years she gained a reputation as one of the most articulate and wellrespected judges on the court, while writing articles and giving numerous lectures about women in the law and serving as co-chair of the Permanent Judicial Commission on Justice for Children. In naming her Chief Judge, the Governor noted: '.'The qualities that earned Judith Kaye her appointment were her character, her temperament, her professional aptitude, and her experience," and these have been demonstrated throughout her professional and personal life. As writer, lawyer,and judge, Judith Smith Kayehas exemplifiedthe highest standards of principle and justice to which the law and its institutions can aspire. Judith Smith Kaye, for your recognized achievements, on behalf of all men and all women of New York State, and, through your example, elsewhere as well, the Board of Trustees of New York Law School hereby confers upon you the degree of Doctor of Laws, honoris causa, with all the rights and privileges thereunto appertaining.

Days III has been a major presence in the struggle for international human rights. He was characterized by Attorney General Janet Reno, when his nomination as Solicitor General of the United States was announced, with the words: " ... it seems to me for most of my professionallife I havebeen hearing about Drew Days and the wonderful things that he has done to seek justice for all Americans." After serving in Honduras for the Peace Corps, Drew Days became First Assistant Counsel for the NAACP Legal Defense and Educational Fund, where he was responsible for federal trial and appellate cases in such areas as school desegregation, police misconduct, employment discrimination and prisoners' rights. During part of this time, as well, he administered the LDF's Earl WarrenLegal Internship Program, designedto train black civil rights and civil liberties lawyers and assist them in starting private practices. Nominated in 1977 by President Jimmy Carter to the post of Assistant Attorney General for Civil Rights, Drew Days took responsibility for initiating civil actions challenging discrimination in employment, education, housing, credit, federally-assisted programs, and voting. He was further responsible for criminal prosecution of conspiracies and official acts designed to deprive individuals of their civil rights. In the past decade he has undertaken fact-finding missions to Haiti and Honduras on behalf of the LawyersCommittee for Human Rights, to El Salvador for Amnesty International, to Honduras for Americas Watch, and to Kenya for the Robert F. Kennedy Memorial. At YaleLaw School since 1981, Mr. Days has served as the Alfred M. Rankin Professor of Law, as well as Director of The Orville H. Schell Jr. Center for International Human Rights. Among his numerous voluntary activities, he has been a Trustee and Executive Committee Member of The Lawyers Committee for Civil Rights Under Law, a Member of the Awards Committee of The Robert F. Kennedy Memorial Human Rights Awards, and a Member of both the Executive Committee of the Association of American Law Schools and the Board of Governors of the Society of American Law Teachers. Drew Days' substantial contributions to legal scholarship include articles on subjects ranging from "Moral Philosophy and Legal Reasoning" to "Civil Rights in Canada," contributions to such books as "Our Endangered Rights" and "He Shall Not Pass This Way Again: The Legacy of Justice William 0. Douglas," co-editorship of "Federal Civil Rights Institute" and authorship of the two-volume "Materials on Police Misconduct Litigation." SHEPARD BROAD

For the European emigrants of the 1920's seeking new hope in a land untorn by the ravages of war and the uncertainties of revolution, the beacon of liberty burning above New York Harbor offered prospects rather than promises. In lower Manhattan, then as now, The New York Law School was committed to providing the tools with which first generation Americans could build lives of public service and personal fulfillment. Shepard Broad, arriving on August 4, 1920, from Pinsk, Russia, at the age of 14 with energy and ambition as his primary luggage, began learning finance as a messenger, clerk and bookkeeper with the State Bank of New York and the brokerage firm of W. J. Wolman & Company. Earning his law degree in 1927 from The New York Law School, he practiced law in New York City until 1940, when he established a law office in Miami Beach, Florida, which is today the statewide firm of Broad and Cassel. Simultaneous with the growth of his law practice, he founded and served in executive and legal capacities several Florida banking institutions, including North Shore Bank in 1940 and American Savings and Loan Association of Florida in 1950, and served on the Boards of Directors of several corporations listed and traded on the New York Stock Exchange such as Diamond-T Motor Company, Bohn Aluminum and Brass Corporation, and, on the American Stock Exchange, Holophane Company, Inc. 0

His record of civic activities is as multifaceted as his professional achievements. An early supporter of the State of Israel, he was actively involved with David Ben Gurion in its creation and has supported the Broad Family Torah Institute in Talpiot, Jerusalem, and that city's Great Synagogue. In 1947, Shepard Broad founded the Town of Bay Harbor Islands, linked with North Miami across Biscayne Bay since 1951 by the Shepard Broad Causeway, and served as its Mayor from 1947 until 1973. He is a founder of the Mount Sinai Medical Center in Miami Beach, and served for many years on its Board of Trustees. In addition, he has been a member of the Board of Advisors and the Board of Directors of St. Francis Hospital in Miami Beach, is Chairman Emeritus of Barry University, is a former member of the Citizen's Board of the University of Miami, and is a founding member of the Board of Governors of the Law School of Nova University in Ft. Lauderdale, now named the Shepard Broad Law Center. He has been honored with the Prime Minister's Medallion of the State of Israel, the Doctor of Laws degree of Barry University, designation of the Shepard Broad Law Center of Nova University, the Dean's Medal of New York Law School, the Horatio Alger Award, and he has been named Mayor Emeritus of the Town of Bay Harbor Islands. THE NEW YORK LAW SCHOOL: AT THE HEART OF NEW YORK'S LEGAL COMMUNITY FOR OVER 100 YEARS FOUNDING: 1891 New York Law School was established in 1891 by faculty, students and alumni of the Columbia College School of Law who were protesting the trustees attempts to dictate the teaching methods used by professors. Theodore Dwight, founder and dean of the Columbia School of Law and a major figure in the history of American legal scholarship, led the creation of New York Law School in lower Manhattan, near its present location. THE EARLY YEARS: 1891-1914 Almost immediately, New York Law School attained a formidable reputation due to the excellence of its students and faculty. One early lecturer was Woodrow Wilson, then Professor of Jurisprudence at Princeton University. Another was Charles Evans Hughes, subsequently Chief Justice of the United States. The first class included James Gerard, who went on to serve as Ambassador to Germany during World War I, and Bainbridge Colby, who became Secretary of State under President Wilson and, later, Wilson's law partner. The School began its evening division within its first decade. By 1904, the Law School was the largest in the country, and, by 1906, it had over 1,000 students, the largest enrollment attained by any law school before World War I. Many of those attending New York Law School during this period became founders or name partners of leading law firms, including: Henry Hurlbut Abbott of Breed, Abbott & Morgan; Edwin Sunderland of Davis, Polk, Wardwell, Sunderland & Kiendel, and Thomas Debevoise of Debevoise & Plimpton. It was rare for minorities and recent immigrants to attend law school in those days, but from the outset New York Law School was hospitable to all races and ethnic groups. The evening division proved a special asset in providing access to legal education for those who needed to work to support their studies. Among the Black graduates of the pre-World War I era, the most prominent was probably James S. Watson, who became a power in the New York Black community and a distinguished judge. The Judge's daughter, Barbara Watson, also attended the law school and was the first woman to attain the rank of Assistant Secretary of State of the United States. Later, Justice Emilio Nunez, class of 1927, was the first Hispanic to be named to the bench in New York State.

WORLD WAR AND THE GREAT DEPRESSION: 1915-1946 The School closed for one year during World War I, briefly interrupting a steady expansion that lasted until the mid-1920s. Classes of the 1920's produced graduates who would play a leading role in the profession. Among the most notable were U.S. Supreme Court Justice John Marshall Harlan and Albert Parker, a founding partner of Parker, Chapin, Flattau & Klimpl. The Depression hit the school very hard and enrollment dwindled. While the situation had improved by the late 1930s the inauguration of the draft in 1940 dealt the institution another blow. In 1941, the School was forced to close for the duration of World War II. REBUILDING: 1947-1980

In 1947,New York Law School reopened and began the difficult task of rebuilding. A major impetus for reopening came from alumni who formed a committee spearheaded by New York State Supreme Court Justice Albert Cohn. The new program was small, but in the 1950s, the School made significant strides. The Law Review was re-established, admission standards were raised, and faculty and curriculum were improved. Many alumni now prominent in the bar, the judiciary, government and business attended the school during these years, including Judge Roger J. Miner of the Second Circuit Court of Appeals, Presiding Justice Francis T. Murphy of the New York Supreme Court Appellate Division, Otto Walter, founding partner of Walter, Conston, Alexander & Green, Bernard Mendik, a leader in the real estate industry and former Chairman of the Board of Trustees, and Lawrence S. Huntington, CEO of Fiduciary Trust International and current Chairman of the Board of Trustees.

During the next decades, the Law School continued to upgrade its curriculum, faculty and trustees. A major expansion came with the appointment of E. Donald Shapiro as dean in the early 1970s as the School joined the Association of American Law Schools and the trustees authorized an increase in the size of the full-time faculty. Admissions requirements were raised while enrollment climbed. Facilities were significantly expanded to include three adjacent buildings, and an endowment'fund grew. GROWTH AND REVITALIZATION:

1983-1992

This period was a time of dramatic growth and revitalization for the New York Law School. Under the leadership of James F. Simon, dean from 1983 until 1992, a series of major facilities renovations

were begun, highlighted by the opening of the new Mendik Library in 1990. This was followed by the construction of the new Samuel and Ethel LeFrak Moot Court Room, the Ernst Stiefel Reading Room and other extensive remodeling which completely transformed the.Law School's classrooms, offices and specialty training areas. During Dean Simon's tenure, the Law School introduced an innovative Lawyering Skills Program into the curriculum. The School has attracted a distinguished full-time faculty of nearly 50. They are productive scholars as well as skilled teachers, and train a student body of almost 1,400 students in the day and evening divisions. Some of the nation's most prominent scholars from other law schools have also served on the Law School's faculty as visitors, including John Hart Ely of Stanford, Edward G. White of Virginia, and Harry H. Wellington of Yale. Distinguished visiting lecturers and speakers have also been attracted, including former President Jimmy Carter, Associate Justices of the Supreme Court Harry A. Blackmun, William J. Brennan, Jr., and Sandra Day O'Connor, and Governors Mario Cuomo of New York and Thomas Kean of New Jersey. Other distinguished visitors include former New York City Mayor Edward I. Koch, U.S. Ambassador Max Kampelman, head of the SALT delegation in Geneva, Justice Aharon Barak of the Supreme Court of Israel, Ambassador Jean-Pierre Derisbourg, head of the European Community's Delegation to the United Nations, and Thomas Pickering, the former U.S. Ambassador to the United Nations. The admissions process has continued to afford the School an opportunity for increased selectivity as the applicant pool has remained high, and aggressive outreach efforts have resulted in the largest minority enrollment in the history of the Law School. The Office of Career Services was expanded and revitalized during this time, resulting in greater placement of New York Law School's students in law firms, as well as local, state and federal agencies, law enforcement departments, public defender and non-profit public service organizations. THE PRESENT: On July 1, 1992, Harry H. Wellington, Sterling Professor emeritus of Law and former Dean of the YaleLaw School became the 14th Dean and President of The New York Law School. During his first year, Dean Wellington has started a process of long-range planning, which includes positioning New York Law School as a truly urban law center with an emphasis on lawyer-centered education. It is also during this time that New York Law School undertook a spectacular renovation of its Student Center, made possible by a large challenge grant from the Kresge Foundation and by the growing generosity and support from alumni and friends. New York Law School has entered its second century with fully renovated facilities, a strong student body, an outstanding faculty and a bright future.

TRADITION OF ACADEMIC ATTIRE The caps, gowns and hoods worn at college and university functions date back to the Middle Ages. Monks and students used them to keep warm in medieval castles and halls of learning. From these practical origins, they have developed into the accepted garb which symbolizes scholarly achievement. Baccalaureate gowns have a long, pleated front with shirring across the shoulders and back. They are primarily distinguished by flowing sleeves, pointed at the fingertip. These gowns may be worn either open or closed. The master's degree gown is worn open, and the sleeve is cut so that the forearm comes through a slit just above the elbow. Gowns for the doctor's degree are also worn open. They carry broad, velvet panels down the front, and three velvet bars on the full, round sleeves. This velvet trimming may be either black or the color distinctive of the degree. Mortar boards or caps worn with baccalaureate and master's gowns generally have black tassels. The tassel of the doctoral cap is usually made of gold bullion. Faculty members and guests in today's procession are robed in gowns and hoods which represent the institutions from which they have received degrees. The hood gives color and real meaning to the academic costume. Its silk lining bears the colors of the institution conferring the degree. The hood is bordered with velvet of a prescribed width and color to indicate the field of learning to which the degree pertains.
