As New York State lawmakers begin negotiations on the Fiscal Year 2026-27 budget, NYACS is reviewing Governor Hochul’s Executive Budget proposal for its potential impact on convenience stores and small businesses. The proposal includes several tax and regulatory changes that could affect retail operations, product sales, and compliance requirements across the state. With ongoing cost pressures and a challenging retail environment, these proposals could shape how convenience stores operate in the year ahead. We’ll be watching for the Senate and Assembly to release their one-house budgets in the next few weeks and work to ensure the final agreement reflects the needs of convenience stores and our suppliers across New York. Read on for a snapshot of some proposals in the Governor’s budget.
Alternative Nicotine Product Tax
The proposal would apply the state tobacco products excise tax to alternative nicotine products, including nicotine pouches. These products would move into a new tax category. The change could raise wholesale costs and retail prices, particularly at the proposed rate of 75%.
Temporary Alcohol Retail Permits
The budget would extend the State Liquor Authority’s authority to issue temporary retail permits. This allows businesses to begin alcohol sales while full license applications are pending. The goal is to reduce delays for new or transferred licenses.
Vapor Product Tax and Enforcement Changes
The proposal would create a new distributor tax on vapor products sold in New York. It would also establish a stateapproved directory of vapor products that may be legally sold. Enforcement and penalties tied to the state’s vapor flavor restrictions would be expanded to target illegal products.
EBT Card Modernization
The Executive Budget would modernize New York’s EBT cards in response to a sharp rise in benefit theft tied to magnetic stripe skimming. The proposal would replace outdated cards with secure chipenabled and tap-to-pay technology that encrypts each transaction and reduces fraud risk. Funding would allow OTDA to begin a statewide rollout, helping protect benefits as federal reimbursement for stolen funds has ended.

Alcoholic Beverage Control Law Updates
The proposal would make several updates to New York’s Alcoholic Beverage Control Law. These changes focus on pricing rules, licensing flexibility, and enforcement authority. Retailers could see both new compliance requirements and expanded options.
Sales Tax Vendor Re-Registration and Amnesty
The state would phase in a statewide sales tax vendor re-registration program through 2030. Vendors who pay outstanding sales tax liabilities in full by the end of 2026 could qualify for reduced penalties and interest. The program aims to improve compliance and clean up inactive accounts.
EV Charging Electricity Sales Tax Exemption
Electricity sold through commercial electric vehicle charging stations would become exempt from sales tax. Instead, sales tax would apply to the electricity purchased for resale. This change affects retailers offering or considering EV charging services.
Vending Machine Sales Tax Extension
The budget would extend the sales tax exemption for certain low-cost food and beverage items sold through vending machines. This maintains existing relief for small-dollar transactions. It helps keep prices stable for consumers.
Workers’ Compensation Fraud Assessment
A new workers’ compensation fraud assessment would fund enforcement grants for district attorneys. The assessment would apply broadly to support fraud investigations. It could result in an added cost for employers.
Corporate Tax Rate Extension and Security Credit
The proposal would extend temporary higher corporate tax rates for certain large businesses. It would also extend the commercial security tax credit. This credit helps offset costs for investments in retail theft prevention measures.

Ready-to-Drink Cocktail Sales
Bill A6931B (Tapia)/S6703 (Jackson) would authorize the sale of distilled spiritsbased Ready-to-Drink (RTD) cocktails by businesses currently licensed to sell beer and other malt-based RTDs. The current ban on RTD sales is arbitrary, confuses consumers, and blocks small retailers from competing in a fast-growing category, despite parity with malt-based RTDs in ABV, packaging, and use. The NYACS legislative team has been working closely to draw attention to this issue. A sign-on letter from NYACS retailers and Alison Ritchie’s Op-Ed in the Albany Times Union last month have launched a campaign to get this bill passed in 2026. We’ve held meetings with co-sponsors of the Wine in Grocery Stores legislation to ask them to sponsor this bill as well. Other planned activity includes media advertising, social media outreach, and retailer meetings with legislators. Penny Circulation
Bill S8580 (Skoufis)/A9274 (McDonald) would require merchants to round cash purchases to the nearest five cent
denomination in order to reduce the circulation of pennies within New York state provide necessary clarity considering the federal determination to cease production of the penny. We’ve been collaborating with the Food Industry Alliance to express our support of this legislation and are meeting with Senator Skoufis and Assemblymember McDonald to clarify some details of the bill.
Nicotine Pouch Flavor Ban
Efforts to ban flavored nicotine pouches were defeated in 2025, but the issue is expected to return in 2026. NYACS is actively monitoring and working to stop renewed legislative attempts. Retailers should expect continued debate on this issue in the coming year.
Bottle Bill Expansion
A proposed bill, known as “the bigger, better, bottle bill” would double the can and bottle deposit to 10 cents and expand covered containers, exacerbating the problem of dirty bottles in food stores. NYACS has opposed the bill because it raises costs and operational burdens. In the past two years, the bill has moved in committee but ultimately did not pass either house. In 2026, NYACS will educate legislators on the financial strain expanded redemption mandates place on small stores.

Reynolds America marked its 150th anniversary by burying an employee-curated time capsule at the Reynolds Operations Center in Tobaccoville, North Carolina, on Feb. 11, the company’s founding date. The capsule closed out a yearlong celebration that began in February 2025 with a mayoral proclamation and historical marker, and it will be opened in 2050 to honor the company’s heritage and values.
HWY Partners announced the addition of Colin Reisdorf as Account Executive for Western New York and Matt Burton to support the Eastern upstate New York market. Reisdorf previously led partnership sales at Legends Global, while Burton brought seven years of experience at QuickChek in operations, category management, and loyalty.
Global Partners earned a spot on Fortune’s World’s Most Admired Companies list for the third consecutive year, ranking No. 6 in the Diversified Wholesalers category. The recognition reflected the company’s performance, innovation, and leadership as one of the East Coast’s largest liquidenergy operators investing in renewable fuel solutions.
Mirabito donated $8,500 to The DICK’S Sporting Goods Foundation Sports Matter Program through a partnership with Syracuse University Athletics, pledging funds for every successful kick made by the Syracuse football team during home games. The contribution supports youth access to sports and reflects the company’s broader community mission through its Mirabito Cares initiative.
PepsiCo lowered snack prices by up to 15 percent for brands such as Lay’s, Doritos, Cheetos, and Tostitos as part of a strategy to improve affordability and accessibility. The new suggested retail prices began rolling out across the United States this month, as the
company responded to consumer budget pressures and shifting demand toward valueoriented pack sizes.
Stewart’s Shops contributed an amount equal to 20 percent of eligible employees’ annual salaries into its Employee Stock Ownership Plan to reward their work and dedication. The company, which operates more than 400 stores, said the 100 percent company-funded ESOP benefits about 3,300 active employees and reflects its employee ownership model, where workers own about 40 percent of the business.
Marathon Petroleum signed a multi-year sponsorship with the Detroit Lions covering the 2025 and 2026 NFL seasons, adding branding across team media, in-stadium signage, and fan experiences at Ford Field. The company also renewed sponsorships with the LSU Tigers through 2028 and the Buffalo Sabres through 2027 to expand brand visibility and community engagement across key markets.
Cliff’s Local Market introduced customizable salads, fresh wraps, fruit and veggie snacks, and protein options to make healthier eating more accessible in 2026. The chain also expanded offerings with gift cards, weekly meal deals, delivery through the Vroom app, and select local products in stores.
Altria received U.S. FDA market authorization for six on! PLUS nicotine pouch products under a pilot program meant to speed up reviews. The agency allowed the mint, tobacco, and wintergreen pouches in 6 mg and 9 mg strengths to be sold to adults after finding they contained lower levels of harmful chemicals than other smokeless tobacco products, as nicotine pouches remained the fastest-growing tobacco category in the U.S.
QuickChek proposed another Albanyarea store at 1850 Central Ave. in Colonie, replacing an existing Walgreens as part of its aggressive regional expansion. The New Jersey-based chain now has eight pending locations in the Albany region, including sites in Colonie, Brunswick, Latham, and Saratoga County, though none have opened yet.
BIC launched Maxi Special Edition Cloud 9 Lighters with bold, playful designs aimed at cannabis smokers. The eight-count set offered up to twice as many lights as the next leading brand and underwent 100 percent quality inspection.
Sunoco acquired 56 Duck Thru Food Stores from North Carolina-based Jernigan Oil Company, expanding its retail footprint in eastern North Carolina and southeastern Virginia. The deal adds to Sunoco’s recent acquisitions as it strengthens its position as a leading independent fuel distributor.
