From the President If you are member of North Texas Home Builders, then you are also a member of Texas Association of Builders (TAB), and National Association of Builders (NAHB). Just a little update from Austin; Teri, Barney, Jose, and I attended the TAB Fall Committee & Board meetings on November 11 & 12. Each of us went to different meetings, see below for some of the information that we gathered. ETJ. ==Extraterritorial jurisdiction - is still a concern. But most of these lawsuits are in TAB’s favor. OSHA Requirements for confined spaces. NAHB is working with OSHA on this topic. 2015 Energy Code is coming. There will be some training coming to Wichita Falls the first quarter of next year. This Code will come in effect September 2016. Membership- TAB is rolling out a membership drive for 2016 called Two for TAB. You will receive details about the drive in the very near future. Teri will be working on some information about the benefits of being a member. TAB HOMEPAC - With the new Election cycle coming up TAB is trying to raise funds to support candidates that will be backing are industry. Local President Council no major issues from this meeting. Barney reported the TAB is in the black about $88,000. Thanks to the Sunbelt Builders show, and the TAB Builder Contracts. From Region #2 Wichita Falls is well represented. ‘Texting and Driving’ film shown to home builders group By: Lee Grace
Adele Lewis of the Texas Department of Transportation (TXDOT) presented the program at the November Membership Luncheon of the North Texas Home Builders Association held Thursday, Nov. 5, at the Kemp Center for the Arts. She presented a film concerning “Texting and Driving” showing how lives can be changed forever when drivers are distracted because they are texting while operating a vehicle. One young man in the film was paralyzed when hit by a driver texting while driving through a school zone. Another gentleman was interviewed who ran over an Amish family while texting with his wife. A third subject of the film was a lady who was hit while walking her dog. She suffered permanent brain Adele Lewis of TXDOT presented the program Membership Luncheon of damage and more than $1 million in medical costs, while the insurance company would only pay her $50,000. atthetheNorthNovember Texas Home Builders Association. She is shown with association president Eddie Holcomb. Viewers of the film will think long and hard before ever texting and driving. Lewis also said the passing of Proposition 7 should benefit all Texans concerned about transportation. “More than 1,000 persons are coming into the state daily. Transportation issues will be a major concern in the future. In other news presented to the membership, President Eddie Holcomb said the passing of Proposition 1 will benefit all homeowners and those wanting to buy or sell property. Announcements also were made concerning the budget and bylaws of the association, the production of a new membership directory in 2016, the Christmas Party set for Thursday, Dec. 3, and the dates for the 2016 Parade of Homes. Michael Grassi of the Parade of Homes Committee said next year the Parade will be held on two consecutive weekends in June, starting June 3. Times will be from 6-8 p.m. each Friday and on Saturday and Sunday from 1-5 p.m. Tickets to next year’s parade of Homes will be $10 for adults and 17 and under are free.

Update on NAHB’s Advocacy Initiatives by Carl Harris, NAHB Federal Government Affairs Chairman
At any given time, NAHB’s advocacy team, including staff from government affairs, legal affairs, housing finance, regulatory affairs and communications, is working on scores of issues that can have a significant impact on members. Below is a status update on several critical issues that we discussed last month at the NAHB Fall Board meeting. Court Ruling Suspends New EPA Water Rule NAHB has been on the forefront of fighting the “waters of the U.S.” (WOTUS) rule issued by the Environmental Protection Agency and the Army Corps of Engineers ever since the proposal was first introduced. We have taken action on the legal, legislative and regulatory fronts to put a stop to this ill-advised rule. The rule went into effect on August 28, but we are pleased to report that the U.S. Court of Appeals for the Sixth Circuit enacted a nationwide stay on Oct. 9. NAHB opposes this rule because it makes millions of additional acres subject to federal regulation under the Clean Water Act.The rule raises housing costs and adds unnecessary regulatory burdens to small businesses. Even the Corps of Engineers — which is charged with administering and enforcing the rule — raised objections with EPA over the rule, which EPA ultimately ignored. NAHB Fights Wide Range of Labor Regulations NAHB is fighting several proposed workforce regulations, including the Department of Labor’s (DOL) draft regulation on overtime for “white collar” employees. Starting next year, this proposal would raise the “exempt” salary level for executive or administrative staff from $23,660 to $50,440. Under the regulation, more than 110,000 construction supervisors may be eligible for overtime pay. NAHB CEO Jerry Howard has spoken up against the rule publicly, and NAHB submitted comments explaining how the regulation could harm small businesses. DOL has also been focused on the classification of independent contractors. The agency requested $10 million in FY 2016 for worker misclassification enforcement and detection efforts. rejected, but DOL continues to pursue this issue. The agency has put forth a guidance document on worker classification, which may trigger litigation. To help members navigate this topic, NAHB created a state-by-state guide that examines the laws determining whether a worker is an independent contractor or employee. Another issue is the National Labor Relations Board’s (NLRB) decision in Browning Ferris Industries, which expands the definition of “joint employer� and erodes long-established protections afforded to neutral employers, such as builders. Legislation supported by NAHB was introduced in the House that would protect the traditional joint employer definition. OSHA Delays Enforcement of Confined Spaces Rule In a victory for single-family home builders, the OccupationalHealth and Safety Administration (OSHA) announced Oct. 2 its decision to delay enforcement of the new Confined Spaces in Construction Standard until Jan. 8, 2016. Though the ruling became effective Aug. 3, OSHA has agreed to refrain from issuing citations to any employer that is making good-faith efforts to comply with the standard. This temporary enforcement policy applies to construction of single-family homes, duplexes and townhouses in federal jurisdictions.OSHA-approved state plan enforcement dates may vary; for more information visit www.osha.gov/dcsp/osp. NAHB Actions Limit Impact of Federal Flood Risk Management Standard NAHB scored an important victory for home builders when it convinced the Army Corps of Engineers to back off on sweeping new flood plain standards that could have had a dramatic impact on home building and development. In January, President Obama issued an Executive Order to expand federal floodplain management requirements far beyond the 100-year floodplain. NAHB members voiced serious concerns about the potential impact on federal permits and programs that builders and developers use. As a result of our efforts, the Army Corps will not be applying the floodplain requirements to Clean Water Act wetland permits. Similarly, FEMA will not apply the requirements to the National Flood Insurance Program, and HUD has indicated that the standard will not apply to FHA insurance of single-family mortgages. Building Codes Require Ongoing Vigilance NAHB is very involved in the ongoing effort to keep codes sensible and cost-effective. At present, the International Code Council is in the process of reviewing thousands of proposed changes to the 2018 version of the codes. Earlier this year, after careful review by our committee members and codes staff, NAHB took positions on 262 proposals. Of those, 129 did not receive public comment, and NAHB won on 82 percent of those proposals. The ICC held public comment hearings in Long Beach, California, in early October. The NAHB delegation to the hearings included NAHB First Vice Chairman Ed Brady, Codes Committee Chairman George Schluter, Codes Committee Vice Chairman Phil Hoffman, and the NAHB staff codes team. There are 51 permits pulled to date with 39 being pulled by NTHBA builder members. These figures reflect only permits pulled in the City of Wichita Falls.

Senate Vote Another Hit to WOTUS Rule

On Tuesday, the Senate failed to secure the 60 votes needed to proceed to consideration of S. 1140, legislation that would have overturned the Environmental Protection Agency’s “Waters of the United States” (WOTUS) rulemaking. But it’s not all bad news. NAHB solidified the support of 58 Senators. Democratic Sens. Joe Donnelly (Ind.), Heidi Heitkamp (N.D.), Joe Manchin (W.Va.) and Claire McCaskill (Mo.), along with all 54 Republican senators, voted in support of S. 1140. The Senate then took up the Congressional Review Act (CRA) resolution disapproving the WOTUS rule, which passed by a majority vote. Passage of the CRA would force the EPA to withdraw the rule.

The Federation showed a strong, united front in responding to the call to action. Members ensured that NAHB’s voice was heard on Capitol Hill. Thousands of emails, letters, phone calls and personal appeals were made to Senate offices. “Our members’ efforts were critical to our outreach,” said NAHB Chairman Tom Woods. “This week’s response from our members is a testament to the impact we can have when our industry’s important issues are being debated in Congress. We cannot thank them enough.” Thursday’s vote was another step in stopping these onerous regulations – which do nothing to improve the health of the nation’s wetlands, Woods pointed out. “With your continued support and engagement, we will ensure that these burdensome regulations are rolled back,” he said. Consumers want Texas Builders to be licensed (Reprinted article from TAB News Brief – KVUE News Story)
The KVUE Defenders uncovered a contractor several homeowners paid, but claim he didn't finish renovations he was paid to do. Veronica Escobar of Round Rock, Lisa Fuquay of Cedar Park and Julie Neaville of Austin all said they hired John Wasley this past summer after receiving a flyer in the mail. It identifies himself as the owner of JW Construction and claims he can do “any interior or exterior renovation.” “He is a home builder from hell," said Escobar. Documents show Escobar paid Wasley thousands of dollars to renovate her bathroom. It still is not finished, and she also blames him for improperly installing carpet. Fuquay paid Wasley to renovate her formal living room and kitchen. He didn’t finish that either. "I’m supposed to have a floor. This is supposed to be a floor," said Fuquay standing in front of her living room with pieces of hardwood floor scattered everywhere. Neaville said he didn’t finish her $7,000 bathroom renovation. "There’s supposed to be a glass door," said Neaville while giving KVUE a tour of her bathroom. For months, the KVUE Defenders tried to give Wasley an opportunity to respond to customer complaints. Over the phone, he blamed delays in poor subcontractors he had to fire and an illness in the family. He also contends he does not owe the women any money. In person,Wasley refused to answer questions and left in his vehicle. Other than hiring what they now consider a poor contractor, there's something else all three woman did not know about Wasley: He’s not licensed and nor is he required to be in Texas. “I did not know that. I think all contractors need to be licensed. Why would they not be licensed?” asked Escobar. That doesn’t make sense to Alex Winslow, executive director of Texas Watch, a consumer watchdog group. “We believe there should be some basic requirements for home builders, certain financial ability requirements.

So, that if something does go wrong, there are resources available for homeowners to make it right,” said Winslow. More specifically, Texas Watch believes state lawmakers should pass legislation to create licensing board for builders and contractors, which would require them to meet minimum job training standards. Winslow believes contractors should have to maintain liability insurance or a surety bond, which would help pay for unexpected mistakes. “The small increase in cost that may happen by requiring home builders to set aside some money in insurance or a bond, is well worth it for consumers’ peace of mind to make sure that when something bad does happen there are resources available to them,” said Winslow. According to the National Association of State Contractors Licensing Agencies, at least 23 states require builders to be licensed. The Texas Association of Builders believes licensing and requiring insurance would be an unfair burden for builders here. “It’s not like an insurance product. It’s a hard product to get. It’s not something that is readily available like people would think car insurance or homeowners insurance is,” said Muñoz, an attorney for the association. Muñoz says most contractors building homes are already licensed. “The plumbers, the electricians, the engineers, they are licensed,” said Muñoz. That doesn’t include the contractors responsible for building the structure of the home. “At one point they were, the Texas law did require them to be registered, it had all sorts of regulations for home builders,” said Muñoz. Lawmakers removed those regulations six years ago. Many Texas law enforcement agencies don’t have the resources to investigate contractor fraud, but the association says there are statutes available to prosecute. It’s Chapter 162 of the Texas Property Code. “Additionally, we have in the state of Texas a trust fund to protect consumers. If a home builder misappropriates those funds, with an intent to defraud, that is felony in this state, so that’s not a civil issue it’s a criminal one,” said Muñoz.

I will be open 2 consecutive weekends beginning on Friday evening. The dates are June 3rd, 4th 5th, 10th, 11th, 12th, 2016. The hours will be 6-8PM on Fridays and from 1-5PM on Saturday & Sundays. Ticket prices will be $10.00 for persons 18 and older, 17 and under will be free. The committee will begin soliciting members to purchase ads for the 2016 Parade of Homes Housing Guide in early 2016. We hope everyone will continue to support the Parade of Homes which is trademarked and exclusive to Texas Home Builder Associations. The Government Affairs Committee will once again begin raising money for TAB’s HOMEPAC Fund. With an election year coming up in 2016 it is important for TAB to support legislatures who support the home building industry. The NTHBA has a goal set each year by TAB of $25.00 per member. We have been fortunate over the past several years to exceed that goal. Workforce Advocacy Committee - The NTHBA has recently created a new committee that will be working closely with the area high schools and colleges to educate individuals about the job opportunities in the construction industry and help implement training in the institutions.
