From the President The dog days of summer finally arrived; hot –dry- July. The weather will help all the builders catch up on things delayed by the welcomed rain Wichita Falls has been blessed with. The rains did bring our lakes to 100% capacity and I noticed the Wichita Lakes spillway stopped running over on July 22nd. The direct potable reuse project has officially been taken off line and Wichita Falls will be able to begin the reuse of the pipe with their permanent indirect potable reuse project to Lake Arrowhead. This project will yield 10-12 million gallons of water per day to our water supply and be in place to help with the fight with future droughts. The Chamber of Commerce along with the local news has been reporting on the growth of the workforce in Wichita Falls with the Eagle Rail Cars Phase II expansion, the possibility of new company by the name of Amfuel which could possibly create over almost 300 jobs and Pratt & Whitney being rewarded a 1.8 million dollar loan to purchase new equipment. Under the agreement with Pratt & Whitney in order for the loan to be forgiven they must maintain their work force of 120 jobs. These are just a few that stick out. Construction is continuing on the Burlington Northern Coat Factory set to open this fall and buildings are being erected or remodeled on just about every street corner. Wichita Falls is beginning to see a positive rebound from the last several years of the doom and gloom we’ve grown accustomed to. As for the association Eddie Holcomb and his golf committee are gearing up for a great event. Mark your calendar for Monday, September 28th. The 4 person scramble will be at the Wichita Falls Country Club this year. There is a 30 team limit so sign up early. To participate or sponsor give Teri a call at the NTHBA office. July 28-30th several NTHBA members attended the Sunbelt Builder Show and TAB Summer Committee & Board Meetings at the Gaylord Resort in Grapevine,TX. Young Professionals Council is in the process of planning their 2nd Texas Hold Em Poker Tournament. The tentative date will be Friday, October 16, 2015. It will be held at the PPG – ERA Building off Bacon Switch Rd. Please watch your emails, Facebook, the web site and Reporter for details about the Tournament and other upcoming items mentioned in these reports. Publications & Communications Committee met in July and determined it is time to upgrade the association web site. Bids were taken and it has been approved by the Board to move forward. It will be announced when the upgrades have been completed. The committee is also getting ready to start on the 2016/2017 Membership Directory. Information and order forms will be hitting your emails around September 1st. Please make sure you read your emails and respond. Carol Chatterton, volunteer coordinator at Interfaith Ministries, discussed the ongoing work of the non-profit organization and the 2015 scholarship winners were presented their checks at the July membership luncheon of the North Texas Home Builders Association held Thursday, NTHBA Vice President Eddie Holcomb is shown July 9, at the Kemp at the Forum. with July speaker Carol Chatterton, volunteer Chatterton explained that coordinator of Interfaith Ministries. Interfaith Ministries began following the 1979 tornado. “Twenty-five churches came together to serve the needs of those affected by the tornado.” She added that today 70 area churches and other organizations support the work of Interfaith Ministries. The organization has four paid staffers and 120 volunteers. Interfaith Ministries’ food pantry helped 1137 people last year, distributing 13,023 pounds of food. The organization also helped people with their utilities bills, giving out $36,520 for utility payments. In addition to Chatterton, board chairwoman Jean Graham also attended the luncheon. Following her talk, Barney Brock, scholarship chairman for the North Texas Home Builders Association, introduced the five scholarship winners. Each received a $1,000 check to help with their education expenses for the upcoming year. The five winners are Abigail Lam, Bailey Broyles, Brennen Nelson, Kolten Booher, and Trevor Criddle. Abigail Lam graduated Wichita Falls High School in 2014. She is a two-time recipient. She attends the University of Texas at Austin, majoring in finance. Continues on page 7

Hotter’N Hell Hundred and the cycling community of America can look forward to continued innovation in 2015, including the return of Hell’s Gate. Riders and racers from all over the USA will celebrate the 34th annual Hotter ‘N Hell Hundred on Aug. 29, 2015. HHH will continue to excite record numbers of participants and add to their fitness experience. The Hotter’N Hell Hundred is one of the oldest and largest cycling events in the nation. Fitness oriented riders and bicycle racers will come to Wichita Falls, Texas, from virtually every state and several foreign countries. They will set their calendars for the week of Aug. 27 – Aug. 30, 2015. The official HHH Endurance Ride start will be approximately 7:00 a.m. (official sunrise) on Saturday, Aug. 29, 2015. The USA Cycling Road Race is Saturday, Aug. 29, 2015 with USA Cycling Criterium racing on Friday and Sunday. The HHH will continue to offer a mountain bike race on Friday, August 28, 2015 and a trail run on Sunday, August 30, 2015 as well. By the way, the HHH is always 9 days before Labor Day. Several things happen during the Hotter’N Hell weekend. The activities that comprise the HHH are: Registration, Consumer Show, Spaghetti Dinner, USA Cycling Criterium Race, USA Cycling Road Race, the Hotter’N Hell Hundred Endurance Ride, an Off-Road bicycle race, off-road trail run along with entertainment food and fellowship at the Finish Line Village. Endurance cyclists will face wind and heat with the help of 4,000 event volunteers on routes up to 100 miles. The Hotter’N Hell Hundred route is rolling with some long inclines accentuated by incessant wind. With the huge consumer products show, off-road mountain biking and USA Cycling Races over the weekend, the Hotter’N Hell offers an awesome start and the greatest weekend on two wheels. If you are going to ride 100 miles, the best place to do it is at the Hotter’N Hell Hundred! People ask what you get when you register for the HHH. It is a grueling day in the sun, so what does a rider get besides sore muscles, tired posterior, sense of accomplishment and several hours of pure cycling madness? There is no answer that fits all. Riders pit themselves against the road and elements for different reasons. What everyone does get is a ride T-shirt and water bottle, goodie bag, free stuff from the consumer show, his or her share of 15,000 gallons of hydration fluid, truckloads of fruit, pickles, thousands of helpers on the route and a hard-earned finisher pin. Route distances are: 10K – 25 mile – 50 mile – 100K – 100 mile. There were a number of rider suggestions for route improvements from the 2012 Ride that were implemented in 2013 & 2014 that carry over to this year. After taking a year off, Pyro Pete returned to Hell’s Gate on the 100 mile route in 2013 and will again join us for 2015. HHH weekend includes a 13.1 mile off-road route. The start is across the river at the JS Bridwell Agriculture Center. The trail will be open all day but will be swept for survivors at 6 p.m. on Friday and 1 p.m. on Sunday. The trail is single track with quick short climbs and drops. The route is fun but riders are reminded that these nature trails are on natural surfaces surrounded by trees, water, wild animals, pointy objects and poison ivy. Capitol News Governor Signs TAB Priority Bills HB 1736 – Energy Code Bill Relating to building energy efficiency performance standards. Establishes a 6 year minimum cycle for energy code updates by the State of Texas for residential construction. Sets reasonable alternate performance path Energy Rating Index Scores for compliance with the state energy code. Signed by the Governor on June 16. Effective immediately. The 2015 code will be implemented Sept. 2016. HB 1455 – Condo Owner Protection Bill Relating to procedures required before a condominium association files a suite or initiates an arbitration proceeding for a defect or design claim. Provides condo unit owners with notice and an opportunity to vote on construction defect litigation brought by a condo board. Provides builders/developers with a right to make repairs prior to litigation. Signed by the Governor on June 17. Effective Sept. 1, 2015. HB 32 – Franchise Tax Relief Bill Relating to decreasing the rates of the franchise tax. Reduces the franchise/margins tax rate by 25%. Signed by the Governor on June 15. Effective January 1, 2016. HB 84 – Tax Credit Rural Definition Bill Relating to financial assistance administered by the Texas Department of Housing and Community Affairs (TDHCA) in certain rural areas. Directs TDHCA to develop rules to re-define certain “rural areas” for housing assistance/tax credit development. Signed by the Governor on June 18. Effective Sept. 1, 2015. SB 900 – TWIA Bill Relating to the operation of the Texas Windstorm Insurance Agency (TWIA). The lack of accessible and affordable windstorm coverage along the coast would have a devastating effect on Texas’ economy. This bill allows the opportunity for Texas to address this issue by including incentives to bring private insurance coverage back into the market and by funding TWIA reserves in a fair, consistent and even manner. Signed by the Governor on June 16. Effective Sept. 1, 2015. HB 2187 – Metal Theft Bill Relating to the regulation of metal recycling entities. To address metal theft, the bill requires recyclers to issue cash transaction cards to sellers of metal. Without an issued card a recycler would only be able to pay by check, money order or direct deposit. Signed by the Governor on June 19. Effective Sept. 1, 2015.

If you’re in the construction business, you may want to ensure that your worksite is free from serious safety risks and hazards. The Occupational Health and Safety Administration (OSHA) recently issued several hefty fines, and even jail time, to a number of construction companies that had repeated and serious safety violations. In May, nine contractors working at a newly constructed luxury housing complex got slapped with more than $150,000 in fines after OSHA inspectors visited the work site last fall. Inspectors cited the contractors for exposing employees to a number of safety hazards and risks, including 35-foot falls, exposed rebar, head and eye injuries and other hazards that could lead to death or serious injury. This incident is notable because OSHA cited nearly all of the contractors on site, including the developer, project manager, a roofing company, window outfitters, and carpentry, masonry and drywall trade subs. Of the nine companies cited, OSHA had previously inspected four of them for serious violations.


One month later, a president and vice president of a local roofing company were arrested for failing to comply with a civil contempt order that came as a result of nonpayment of fines for multiple OSHA infractions. In 2011 and 2012, OSHA conducted several inspections of the company’s work sites and found multiple fall protection, eye and face protection and ladder safety violations, among others. When the company failed to pay penalties of more than $195,000 plus interest and fees, and continued to violate OSHA standards, the courts issued the arrest. After spending more than a week in jail, the owners were released on bond and given 30 days to either pay off the outstanding penalties, or demonstrate an inability to pay and certify that they have worked to resolve the OSHA Continues on page 12

More recently, two sister companies were cited with willful and repeat safety violations, including fall hazards for workers installing wood framing more than 10 feet off the ground. The citations resulted in proposed penalties of $153,090. According to the agency, the parent company has a history of OSHA violations and was shut down earlier this year. Its former owner restarted the company as two new ones in February, but continues to ignore OSHA regulations.

Safety Program and Jobsite Safety Standards Package© was developed with input from OSHA safety experts, custom and volume builders, remodelers, and attorneys who specialize in OSHA law. TAB members and staff conferred with OSHA officials during multiple visits and communications with OSHA Region 6 Headquarters regarding the Model Safety Plan.
