A highlight of the day this year was a tug-of-war contest between the dads and the combined might of the children and their teachers; amazingly, the fun competition ended in a draw and lots of laughs all round.

The Court of Appeal has reserved its decision on an application by Forest and Bird opposing an Environment Court landfill approval of a Dome Valley mega-dump, seen as a threat to the Kaipara Harbour watershed. Lawyer for Forest and Bird Martin Smith told the hearing last week the dump site meant the loss of 12.2km of streams that could not be mitigated by compensatory measures. Dump applicant Waste Management New Zealand proposed plantings alongside 50–60km of streams in the Hōteo River catchment and beside onsite streams as mitigation, as well as through compensation. Forest and Bird says the landfill did not need to be located over a river to function: “It’s not a hydro dam, it’s not a port.” The court heard the New Zealand
freshwater rules are primarily governed by the National Environmental Standards for Freshwater and the National Policy Statement for Freshwater Management. Waste Management said it had relied on offsets and compensation to reduce the level of impact to below material harm, and if there was no material harm then the rivers policy did not apply. “We say it’s entirely appropriate to offset and compensate.” Waste Management has also applied for referral to the fast-track process for the Dome Valley at Wayby landfill. If referral is granted, the fast-track process would run
alongside the court process. The appeal was heard by Justices Jillian Mallon, Matthew Palmer and David Collins, who said they were conscious of the need for a reasonably prompt decision. This was reserved. The Fight the Tip movement, which has long fought against the landfill, is anxiously awaiting the outcome after eight years of legal action leading to a first adverse decision from independent commissioners. Hearings have escalated through the Environment Court, the High Court and Court of Appeal, culminating in the August Forest and Bird appeal. ¢
