‘Blank cheque’ challenged

he Western Cape High Court has reserved judgement in a landmark legal challenge that could transform municipal financing nationwide. The South African Property Owners Association (SAPOA) and Afriforum squared off against the City of Cape Town over three days last week in a hearing centred on whether municipalities have the constitutional authority to impose fixed charges based on property values — a practice SAPOA argues amounts to an unconstitutional “blank cheque” for local government spending. The matter was heard by a full bench of three senior judges — Judge President Nolwazi Mabindla-Boqwana, as well as presiding judges Andre le Grange and Katharine Savage. The legal clash centres on SAPOA and AfriForum's bid to have three contentious budget tariffs covering cleaning, fixed water charges, and fixed sanitation — as introduced in the City's 2025-'26 Budget — struck down as unconstitutional. While the City insists these are legitimate service charges rather than rates, it has raised the stakes considerably with a bold counter-application. Should the court rule against the municipality, Cape Town wants Section 75A of the Systems Act itself declared invalid, arguing that such a decision would cripple its constitutional mandate to deliver municipal services. “In essence, SAPOA argued that the City does not have the power, in terms of the Constitution and the applicable legislation, to raise fixed charges based on property value bands,” comments SAPOA CEO, Neil Gopal. Fastflowing rivers should never be crossed, whether on foot or in a vehicle, and no one should enter floodwaters to attempt a rescue without proper flotation.

‘DROWNING IS SILENT’ The NSRI emphasised that drowning is quick and typically silent, urging caregivers to remain alert at all times and avoid distractions such as cellphones. Young children must always be kept within arm’s reach near any body of water. Alcohol remains a leading factor in holiday-related incidents. The NSRI advises adults to avoid drinking when swimming or boating and to ensure sober supervision of children if alcohol is being consumed. They further stressed the importance of swimming only at beaches where lifeguards are on duty and between the designated red-and-yellow flags. ESSENTIAL NUMBERS AND FLOOD SAFETY REMINDERS Holidaymakers are urged to store emergency numbers before travelling:

SAPOA and its members have no objection to the principle of subsidisation, or to pay its fair share of municipal service costs. The problem arises, however, if a municipality is given unbridled power and a blank cheque to do as it pleases. Municipalities across the country, including the City of Cape Town and others that regularly receive clean audits, must also be held accountable on the way taxpayers’ money is spent,” says Gopal. “The Court reserved judgment, but no indication has been given as to when it may be expected. The Court did point out, however, that this is a complex matter, that requires careful adjudication, and that it is mindful of the effect that this judgment may have on other municipalities throughout the country.”

fforts are currently underway to track down a taxi driver involved in a reckless and negligent driving incident that endangered the public and law enforcement officers on Koeberg Road in Milnerton on Sunday 7 December. According to reports, a traffic officer attempted to stop the taxi for a routine check, but the driver sped off, heading towards the N1 highway. During the ensuing chase, the driver collided with two traffic patrol vehicles on the N7 near Potsdam Road. In a desperate attempt to evade arrest, the driver abandoned the vehicle and fled the scene, leaving behind eight passengers who suffered minor injuries. Four traffic officers also sustained slight injuries during the collision. DANGEROUS BEHAVIOUR The City has condemned the driver's dangerous behaviour. “This kind of disregard for law and order puts the lives of innocent commuters and our officers at risk, and will not be tolerated,” said JP Smith, Mayco member for safety and security. “We are fully committed to apprehending the driver and ensuring that justice is served.” The taxi has been impounded and will remain so until the driver is found and brought to justice. Authorities have already identified and tracked down the vehicle’s registered owner and continue to work tirelessly to locate the suspect. RECKLESS DRIVING The incident comes amid growing community concerns about reckless

Epping building damaged in fire A building in Epping near Goodwood sustained extensive damages on Wednesday 10 December after a fire broke out in the area. Jermaine Carelse, spokesperson for the City’s Fire and Rescue Services, said they received the call at about 13:20 of a motor spares shop alight in Epping Avenue. He said numerous resources were called out to the scene including specialised vehicles and the IMT 4 team. “The fire was divided into two divisions to utilise the manpower optimally, and so the blaze was contained around 14:30,” Carelse said. Franchesca Walker, ward councillor, said she was aware of the fire in Epping Avenue as she was on the scene. “It is an illegal car parts business that was running their business outside of a yard. The business was destroyed. A house at the back was also partially damaged,” she said, adding that three other structures were destroyed in a separate fire in Elsies River.

DRIVER CAUSES N7 COLLISION AND ABANDONS TAXI AND PASSENGERS TO FLEE POLICE taxi driving in the area. During recent Community Policing Forum (CPF) meetings, members repeatedly raised alarms over taxis speeding and driving negligently along Koeberg Road. The CPF has called for an increased presence of traffic officers to curb these dangerous behaviours and improve road safety. We will be deploying more officers to the area to ensure that reckless drivers face consequences and the public can travel safely.” SUB-COUNCIL MEETING CONCERNS At the recent Subcouncil 3 meeting held last month, several important concerns were raised regarding traffic enforcement and public safety within the area. Councillor Anthony Benadie expressed serious concerns after comparing current traffic prosecution statistics with those from earlier this year. In February this year, there were approximately 2 600 prosecutions recorded, but by October, this number had dropped to around 1 800 — a difference of 600 cases. He also noted a noticeable decline in the visibility of public safety departments across the wards and called for an internal meeting with the safety and security cluster to address these challenges. Councillor Sue van der Linde supported these concerns and asked about nonfunctional cameras on Blaauwberg

Road in Ward 113, which showed zero activity in reports. Cluster Inspector (CI) Plaaitjies explained that these cameras were currently being serviced by the urban mobility department, leading to the empty casings. He also clarified that camera statistics are managed by other departments, and his team reports only on internal activities such as mobile patrols, which use devices not reflected in the reports. Benadie also highlighted ongoing

issues with taxi drivers on Bridle Way and adjacent roads, where bylaw violations were reportedly rampant and enforcement was lacking. This issue has been frequently reported by community members. Additionally, questions were raised about the readiness and resource use of neighbourhood safety officers and traffic services vehicles. Residents and commuters are urged to report suspicious or dangerous driving behaviour to the Traffic Department.

his festive season, the spirit of giving and community shone brightly as TLC Outreach Projects in Table View, together with local schools, businesses, and partners, came together to bring joy and hope to hundreds of children and families in need. The young hearts of Sunningdale Primary School took the lead by donating 100 Santa gift boxes filled with toiletries, stationery, and treats — a gesture that brought smiles to many faces. Kensio House School also contributed 60 Santa boxes, showing that the joy of giving crosses all ages. “These generous donations are a powerful reminder that kindness begins in our schools and spreads throughout the community,” said Colleen Pietersen of TLC Projects. BUSINESSES, COMMUNITY GROUPS STEP UP Clippa Sales donated 30 Santa gifts, while Pick n Pay Table View went beyond donations by hosting a special Christmas party for the children of Radar Bush. The event featured a delicious lunch, gifts, and festive cheer, creating lasting memories for over 180 children and their families. Additionally, WCN’s generous financial support helped fund Christmas celebrations and gifts for more than 567 children living in informal settlements, amplifying the reach of TLC’s efforts. ygerBurger team teamed up with Save a Fishie on 11 December to help clear litter from Lagoon Beach. The weather could hardly have been better for a morning of conservation work. The group spent an hour combing the sands, sharing stories and concerns about the environment and the changing state of the beach. Despite improvements, the team was shocked — yet again — by the sheer volume of lollipop sticks scattered along the shore. “It's unbelievable how many tiny items there are. You wouldn’t think something so small could add up to so much litter,”

said Zoë Prinsloo of Save a Fishie. Altogether, the small but dedicated team collected 41 kilograms of litter, with approximately 60% consisting of tiny debris items such as cigarette butts, plastic fragments, and those infamous lollipop sticks. The clean-up not only helped to protect marine life but also raised awareness about the ongoing challenge of micro-litter at Cape Town’s beaches. Save a Fishie encourages residents to join future events and take small actions daily to reduce litter and protect the coastal environment.

ratibha Singh Baghel, who performed to a sold-out audience during her 2023 Symphony of Love concert with the Cape Town Philharmonic Orchestra, returns for a one-night-only performance called Encore at Artscape on Saturday 31 January at 20:30. The concert, produced by Cape Town-based Inner Circle Entertainment, will feature a different format from her previous symphony performance – an acoustic evening showcasing Bollywood classics, ghazals, and contemporary hits. fter two decades of unwavering service to animal protection, Chief Inspector Jaco Pieterse of the Cape of Good Hope SPCA has announced that he will be stepping down from his position at the end of the year as he prepares to begin his legal articles in 2026. The move marks the end of an era for the Cape of Good Hope SPCA Inspectorate — and the beginning of a new chapter for one of its most dedicated champions. Pieterse, who started at the SPCA as a 15-year-old volunteer, describes the decision as “extremely emotional” and one of the hardest he has ever made. “This organisation has been my entire life. My identity. My purpose. My home,” he writes. “But it is not goodbye — it is simply the next chapter.” A lifelong calling rooted in childhood Pieterse’s journey began long before he put on his first SPCA uniform. Growing up on a smallholding surrounded by animals, he developed a deep sense of responsibility and compassion from a young age. That early love — from caring for family pets to showing chickens competitively — laid the foundation for a life of advocacy. A pivotal moment arrived when he watched Animal Cops Houston on Animal Planet. “This is what I want to do,” he told his mother. At 15, he walked through the doors of the Vereeniging SPCA, changing the trajectory of his life. He would go on to become the youngest person to write the NSPCA Inspector Entrance Exam, the youngest qualified SPCA Inspector, and later the youngest Senior Inspector in the organisation’s history.

‘THIS IS NOT GOODBYE’ SAYS JACO PIETERSE , AS HE LEAVES THE ONLY JOB HE HAS EVER KNOWN TO TAKE ON THE LEGAL FRATERNITY A CAREER MARKED BY FIRSTS Over 20 years, Pieterse built a reputation for courage, grit, and unshakeable ethics. He fought cases many dismissed — including one involving cruelty to frogs, which won in court and made international headlines. But the work came at a cost. “I have been insulted, assaulted, held hostage, threatened, and had stones thrown at me,” he says. “But I never backed down. Not once. Because animals depended on me.” Leading South Africa’s largest SPCA Inspectorate, Pieterse helped rescue hundreds of thousands of animals and strengthened enforcement across Cape Town and beyond. “I am proud of what I achieved. I am proud of who I have become.” BALANCING ACT Driven to expand his impact, Pieterse began studying law part-time while managing the Inspectorate — a path he describes as “unbelievably difficult.” He completed his LLB in 2024, passed his first board exams, and even trained as a law enforcement auxiliary officer. He went on to establish the Animal Control Unit Auxiliaries, now a 10-member team assisting the SPCA. Volunteering 45 to 72 hours a month after hours, Pieterse played a key role in increasing arrests, improving convictions, and elevating

animal welfare enforcement in the city. “This year has been one of the most challenging of my life,” he reflects. “But I am proud of the sacrifices. Proud of the impact.” ‘THIS IS NOT GOODBYE’ Submitting his resignation in October was devastating, Pieterse admits. “This is the only job I’ve ever known. The only career I’ve ever had.” Yet he is clear that his departure from operational duties does not mean he is leaving the mission behind.

He plans to remain actively involved with the SPCA in a legal capacity, advocating for animals in courtrooms, policy environments, and wherever he is needed. “And who knows? After my articles, perhaps I will find my way back home to the SPCA.” He thanked his colleagues, inspectors, rescuers, and the public for their support. “This is not the end of my story. It is simply a new chapter in the same mission I have had since I was 15 years old: To protect animals. Always.”

The event took place from Saturday 13 September to Sunday 21 September. Gardeo Isaacs says he still can't believe it. "It is still sinking in, and I must get used to a medal," he says in his family home still recovering from jet lag. He recently won a bronze medal at the Tokyo World Championship Athletics 2025 as part of the South African men's 4x400m relay team. The team secured the bronze medal with a time of 2:57.83 seconds, narrowly missing silver. Isaacs says the last time SA won a medal was in 2017. So, to him this means something major for the country, and it also means they are somehow headed in the right direction. He says for the next generation this was an inspiration. Isaacs says he's not doing this for himself but for his family and also the country, as this was

always a dream for him to represent his country. "To get that first medal after eight years still gives me goosebumps." Isaacs' athletic career started back in high school. He first started out to play soccer but laugh when he says he did not like the aspect where he had to work hard and the next person was just feeding from someone else. Also, the fact that one person was not accountable for the success of the team. When he went to high school, he did athletics. First without training before he realised he can do so much better with the training. The rest is history. Isaacs mentions he trains five days a week, three gym sessions. A typical training day for him ranges from two hours to two and a half hours. He advises those who would like to follow in his footsteps or dream of being any successful

Faraz Khatieb has been selected to represent South Africa at the Continental Africa Championship in Kenya next month. According to Reygana Khatieb, Faraz's mother, her son lives for cycling and has very big dreams. "If you've seen Faraz cycling around the area, you probably think he's just another kid on a bike but let me tell you what you are actually seeing. You are seeing a 16-year-old who rushes home from school every day to train many kilometres four days a week, and races over weekends in the u-19 category but competes against elite riders aged 23 and older – and consistently finishes in the top 10. This is the opportunity we've been working towards for nearly four years. But here's what I'm terrified to admit – we might not be able to send him.

nother major sewer-line collapse in Montague Gardens has sparked renewed concerns over ageing infrastructure, traffic disruptions, and environmental risks in the area. Last week a 900 mm bulk sewer pipe beneath a section of Montague Drive gave way, prompting an immediate emergency response from the City of Cape Town’s Water and Sanitation Directorate.

This marks the 13th sewer collapse in the area following 12 similar incidents in 2023 and 2024, which were previously reported by TygerBurger. The ongoing failures are widely attributed to severe corrosion from sulphuric acid and the age of the infrastructure. “City teams were deployed within minutes to cordon off the affected area, implement traffic-safety measures and begin assessing the extent of the damage,” said Zahid Badroodien, Mayco member for Water and Sanitation. “We are finalising an emergency-repair plan and closely monitoring the site to mitigate any further risks, especially to the nearby Milnerton Lagoon, which remains a key environmental priority.” TygerBurger reported on the issue since August 2023 of the collapses occurring successively and at multiple points in the 50-year-old 900 mm fibre cement bulk sewer pipeline, which runs underground at a depth of 5 metres. The road was cordoned off for months, with motorists having to use alternative routes.

Last year’s collapsed section of Montague Drive, which has since been repaired.

After the first collapse the City appointed a contractor to assist with emergency repairs to the sewer. Subsequently, 11 collapses occurred between August 2023 and January 2024, which have all been repaired.

Buiten die Christelike en feestelike simboliek dink ek tog die Kersboom het in elke huis sy eie betekenis en tradisie. Vir baie is dit net nog 'n "feesmal" versiering. Sommige van ons gebruik dit as 'n verskoning om die kleinspan op Oukersaand vroeg in die bed te kry - want Kersvader gaan nie geskenke onder die boom los terwyl jy wakker is nie. Sommige, hoewel hulle Kersfees en Jesus se geboorte vier, slaan glad nie 'n Kersboom op nie, juis oor sy heidense wortels. Dit neem my terug na my kinderdae waar in die vroeë jare ons ook nie 'n Kersboom onder ons dak gehad het nie. Ons het op Kersoggend wakker geword met ons ouers wat al singend in die gang afkom. My pa met 'n lemoensak oor sy skouer waarin my en my broer se geskenke was. Hulle het dan op die voetenend van ons beddens gesit en gesels oor die ware betekenis van Kersfees terwyl ons ons nie-uitspattige Kersgeskenke oopgemaak het. Latere jare, toe een huishouding twee geword het, was daar in my ma se huis 'n Kersboom, maar nie by my pa nie. Dit was tot ek en broer een jaar so knaend geraak het dat hy 'n paar bougainvilleatakke gaan afknip en aan 'n boomstok vasgemaak het. Tot vandag toe is dit my gunsteling Kersboom ooit. Nie omdat hy teen sy waardes ingegee het op 'n tradisie waarin hy nie glo nie, maar oor die liefde waarmee dit gedoen is. Liefde, die simboliek wat ek vandag aan Kersbome heg. Dit het ook in my 'n voorliefde gekweek vir unieke Kersbome. Ek skep veel eerder my eie met klatergoud, viersierings en 'n paar stokke as wat ek 'n plastiekboom ten duurste in die winkels gaan koop. Maar maak nie saak watse Kersboom vanjaar in ons voorkamer opgeslaan gaan word nie, dit word met liefde gedoen. - CECILIA HUME

In die hartjie van die middestad troon daar vanjaar 'n Kersboom uit bo Kaapstad. Sover vasgestel kan word is dié skitterende 17m-lange "Kersboom van Hoop" op die dak van die Sky Hotel die hoogste van sy soort in Afrika. Dit dien boonop 'n goeie doel. Tesame met 'n geldinsamelingsdoel, waarmee vier plaaslike organisies ondersteun word, is dit ook 'n baken van eenheid, vrygewigheid, opheffing en, soos sy naam verklap, hoop. So na aan die moderne betekenis van die Kersboom - 'n simbool van lewe, hoop en die gees van Kersfees. Dit raak nogal interessant wanneer jy Google inspan en begin soek na die simboliek en ontstaan van die Kersboom. Dit het vroeë heidense wortels met antieke Egiptenare, Romeine, Druïde en Vikings wat tydens die wintersonstilstand immergroen takke gebruik om lewe en wedergeboorte gedurende die donkerste winterdae te simboliseer en die son se terugkeer te vier. Die meer moderne Kersboom se Christelike wortels lê in Duitsland waar families dennebome op 24 Desember, die feesdag van Adam en Eva, met appels en wafels versier het. Sedert die 16de eeu word hierdie tradisie in die huise ingebring en later met kerse versier - 'n tradisie wat aan Martin Luther toegeken word - om sterre na te boots wat deur takke skyn, wat Jesus se koms na die aarde simboliseer. Hierdie tradisie het in die 1800's na Engeland versprei vanwaar dit later na die res van die wêreld uitgebrei het. Vroeë versierings het vrugte, koekies, springmieliekranse en kerse ingesluit, voor vandag se kenmerkende glasballe en elektriese liggies hul verskyning gemaak het.

Stay in the safe zone this summer season With the school holidays officially under way, the City’s "Safe Zone" drowning prevention campaign is in full swing, forming part of a broader drive to ensure public safety during the busy festive season, with a strong focus on water safety. The Safe Zone campaign reinforces four golden rules of drowning prevention, aimed at reducing incidents at beaches, pools and other water spaces as families head outdoors in large numbers.

ith the Atlantic howling at more than 40 knots and crowds lining Kite Beach, Bloubergstrand, Hugo Wigglesworth rose higher than any kitesurfer in history. On 6 December the 19-year-old New Zealander launched into the Cape Town sky and landed a world-first 40-m jump, officially verified by WOO Sports, a moment that shattered the sport’s perceived limits and rewrote big-air history. He declared: “I knew I could do it; I just needed the right day, the right gear, and the right mindset.” A BRAAI AND A BOLD FORECAST The story began the night before, at a relaxed South African braai hosted by the Flysurfer crew. As meat sizzled and the evening wind picked up conversation turned to the forecast. Violent gusts pushing towards 40 knots were predicted for the following afternoon, dream conditions for big-air riders. Someone asked the question hanging in the air: Could Wigglesworth break the world record tomorrow? Opinions were split. Some nodded. Others laughed at the madness of it. The man of the moment said nothing, just smiled.

A RIDER WITH SOMETHING TO PROVE The next morning there was motivation beneath the calm. Just weeks earlier he had been one of the most-talked-about omissions from the 2025 Red Bull King of the Air, the most prestigious event in kiteboarding. Yet he had ridden every day. After training Wigglesworth returned to the Flysurfer house, made avocado on toast and settled in to watch Formula 1 qualifying. But his attention kept drifting to live wind updates. Determination set in: “Let’s break a WOO World Record today.” Within seconds the house erupted into action. Gear was packed, cameras charged, wetsuits thrown into cars. Wigglesworth’s parents and the Flysurfer team headed straight to the beach, parking, with perfect irony, at the very event site of the competition he hadn’t been invited to. A NEW SET-UP AND A MOMENT OF DESTINY Conditions were escalating fast. Jamie Overbeek, the second highest on the WOO leaderboard, was already throwing massive jumps on a 7 m SONIC5, a clear signal that the window was opening. Then came a critical decision. Wigglesworth changed his setup, switching from 23-m lines to a 17-m configuration, a move that would shape the session. His first jump registered 28 m, an outrageous

“warm-up” that stopped spectators in their tracks. He kept climbing higher, cleaner, more controlled. Then he tacked far outside, lined-up a choppy kicker wave and came in with nearly double the speed of his earlier attempts. He edged hard. Sent the kite. And for a moment time froze. The beach erupted. Wigglesworth launched into what would soon be confirmed as the highest jump ever recorded in kiteboarding. Watching from the sand, his mother whispered quietly: “This is the highest I’ve ever seen Hugo go in my life.” SIX WORDS THAT SHOOK THE BEACH Despite the gasps and cheers he showed no reaction. No fist pump. No celebration. He simply rode back out. Ten minutes later he came ashore, landed his kite, walked to his parents and the Flysurfer team, leaned in and whispered: “I just went 40 metres.” Five words. Delivered calmly. He packed up his SONIC5, slung it under his arm and walked towards the parking lot like someone finishing an ordinary training session, not someone who had just redefined human flight. But history spreads fast. Within minutes, riders, photographers, podcasters and media crews rushed back to the beach. The news rippled through the kiteboarding world in real time. Later that afternoon the new worldrecord holder grabbed a 6m ERA, smiled and ran back to the water. “You can’t train double loops every day, can you?” What followed looked like the start of a session; massive double loops, explosive rotations, huge S-loops, as if breaking the record had simply unlocked a new level. By nightfall it was official. No-one, including Overbeek, had beaten the mark. WHY THE 40-M JUMP MATTERS Wigglesworth’s achievement is more than just a number: He now holds the WOO world record on both twin-tip and foil. The record was set at the event site of the competition that didn’t select him. The top three all-time WOO jumps have all been done on foils. The previous record, set by Charles Brodel, stood for just 43 days, underlining the sport’s explosive progression.

IDENTIKIDZ AND HOLIDAY PROGRAMMES As an added child-safety measure, the Identikidz programme will be rolled out at 15 of the City’s busiest beaches from 15 December. Parents can register their children to receive identification armbands, allowing caregivers to be contacted quickly should a child become separated or lost. Details on Identikidz are available on the City’s website. The City has also activated a range of safe zones for children, including recreational facilities and libraries offering facilitated holiday programmes designed to keep young people engaged in safe, meaningful activities. THE FOUR GOLDEN RULES OF WATER SAFETY The City is urging residents and visitors to follow these simple but life-saving principles: Swim only between the lifeguards’ red and yellow flags at beaches. Avoid alcohol at the beach and never drink and swim. Be alert to rip currents and understand how to escape them. Actively supervise children at all times, especially near water. The event was the final stop of the five-round FIM World Supercross series, with the world champions crowned at the end of the night. There was plenty of excitement as the world's best riders went head-to-head in three races for each class. The crowd favourite was undoubtedly the thrilling battle between Americans Jason Ander-

son and Joey Savatgy in the SX1 class. In the ﬁnal race, Savatgy led early but Anderson chased relentlessly. There were a few collective gasps from the crowd as the riders swapped positions, nearly colliding. Anderson pounced in spectacular fashion to ﬁnally take the lead in the last couple of laps.
