In an answering affidavit to the court case brought by the South African Property Owners Association (Sapoa) to have the three new fixed tariffs for Cape Town residents reviewed and set aside, Mayor Geordin Hill-Lewis warns that scrapping them would leave the City with a billions of rand shortfall this financial year

The 300-page affidavit was filed in the Western Cape High Court on Monday 11 August

Sapoa in mid-July filed an urgent application in the Western Cape High Court, challenging the legality of the three new property-linked tariffs in Cape Town’s 2025- 26 budget

Sapoa held that the cleaning levy and fixed water and sanitation charges based on property value unfairly burden ratepayers and infringes on property rights under Section 25 of the Constitution along with setting a concerning precedent They stated that the new tariffs do not comply with the Property Rates Act in that it is based on property values rather than actual use It says the charges are not a consumption-based fee, a basic surcharge, or a municipal tax, but rather a form of property rate that doesn’t meet legal requirements

Negating the argument Hill-Lewis stated that the City in determining the 2025- 26 budget fulfilled its constitutional obligation and that the tariffs are lawful and constitutionally sound

He says Sapoa’s case has no substantial legal grounds, as the tariffs are fair and rational, as well as being constitutional in that the metro has a constitutional duty to provide water, sanitation and cleaning services and to establish the right or levies to pay for them

Pointing to South Africa having the highest inequality in the world, he said, the budget encapsulates the principle of equality within the current social context "In an ideal world the City's revenue would meet all the City's needs, but this is not the case There are obvious tensions

The mayor says Sapoa does not argue that the tariffs are excessive and that the court application is therefore limited to one issue, namely that it is unlawful to link the fixed tariffs to property values In this respect he argues that property values in this instance are merely used as a measure to determine the tariffs that are not in essence a property tax

He furthermore stated that municipalities across South Africa are caught in a financial vice, driven by rapidly growing populations and the urgent need to expand infrastructure to maintain basic services Without raising funds from residents, the only alternative is the decline and eventual collapse of public services and infrastructure

He said the tariffs are needed to set the city on a "new path" to combat poverty in the face of a massive population growth in Cape Town

Hill-Lewis cited census data showing Cape Town’s population grew by 27% between 2011 and 2022, now officially at five million He believes the true figure is higher due to undercounting in informal settlements, where over 1,2 million people live in some 800 such settlements with only shared taps or toilets

A taxi crash on Riverside Drive near Milnerton High School on Monday morning sparked safety concerns from residents and motorists in the area

Maxine Bezuidenhout, spokesperson for the City of Cape Town’s Traffic Services, confirmed that the department received a call at approximately 05:29 on Monday morning, 18 August, reporting an accident involving a taxi on Riverside Drive According to Bezuidenhout, the driver of the vehicle lost control and collided with a lamp pole

“Six men and five women sustained slight injuries in the incident,” Bezuidenhout said “They were treated at the scene and did not require hospitalisation Our officers are investigating the cause of the accident ”

While the incident fortunately did not result in serious injuries, it has reignited concerns among residents about the manner in which some taxis operate in Milnerton, particularly in the Joe Slovo area

The Milnerton Community Police Forum (CPF) and local residents have long highlighted the issue of reckless driving, with taxis frequently being cited for speeding, erratic lane changes, and failure to observe traffic rules

“Traffic services presence is minimal, and it feels like taxis are running the roads unchecked,” said Nomsa Mthembu, a resident

“I’ve seen taxis speeding past pedestrians on Koeberg Road more times than I can count ”

Another resident, Gayle Booysen, echoed the concerns: “It’s frightening to watch how some taxis maneuver through traffic This accident was bound to happen sooner or later ”

Residents have called for increased traffic monitoring along key routes, particularly Koeberg Road, where taxis often transport large numbers of passengers at unsafe speeds

“More traffic officers need to be stationed here, especially during peak hours,” said Linda Petersen, who lives near Riverside Drive “The community cannot keep fearing for our lives every time we cross the road ”

She also urged taxi associations to take responsibility for the behavior of their drivers “Regulation is not just about laws; it’s about enforcing them consistently Taxi owners must ensure drivers are trained and accountable ”

Since early July, a new outbreak of high pathogenicity avian influenza (HPAI) has been confirmed in wild seabirds across the Western Cape These are the first wild–bird detections in the province since April 2024. The public is therefore encouraged not to touch sick or dead birds and to report them to the authorities.

Wild seabirds infected with HPAI often develop neurological signs such as tremors, head twitches and seizures Although HPAI occasionally infects mammals and humans, the risk to the public remains very low when basic precautions are followed

Lions host diabetes screening

Table View Lions Club organised a free diabetes screening event at West Coast Village recently The initiative, which supports Lions Clubs International’s global cause of Diabetes Awareness, served 39 members of the community and was staffed by six dedicated volunteers During the event, community members received blood glucose testing and personalised health counselling to better understand the risks associated with diabetes and how to prevent or manage it

The event aimed to raise awareness, offer early detection, and connect individuals with valuable health information

New land-use rights to build affordable rental flats in identified neighbourhoods with highest demand in Cape Town will be effective as from 1 September, affording thousands more to make the leap from informal housing to City rental flats. This after the revised Municipal Planning Bylaw (MPBL) was gazetted on Friday 8 August A number of changes to the bylaw will make it easier to build and develop in the City

AFFORDABLEHOUSING

These additional land-use rights will enable micro-developers to deliver affordable housing in townships, informal and lower-income suburbs at a far faster rate

. New provisions will see incentive overlay zonings for development focus areas in Athlone, Maitland, Parow/Elsies River, Bellville and Diep River This zoning assign additional and enhanced development rights to properties that fall within certain areas in these overlay zonings

. Additional use rights for Residential Zoning include affordable rental flats, supplementary dwelling units and place of instruction

. An affordable rental flat is a new additional use right to enable the development of small scale affordable rental accommodation in identified areas

The number of small-scale affordable rental units on a single property may not

exceed eight units plus a dwelling house, or 12 units if there is no dwelling house on the land

New additions under Section 135 allow the City to impound moveable property that is being used for illegal building or demolition work if an order to stop work is being disobeyed This amendment intends to address the challenge of owners and contractors continuing illegal work without tangible consequences

Over the past week, I saw a man strong, capable, and loving confront the unimaginable: the absence of the one person who has been a constant presence in his life since birth His grief was raw and unfiltered, spilling into every corner of the room and touching everyone near him I wanted to comfort him, to hold him, to take away the sorrow, but I could only be there, quiet, present, a steady hand and listening heart

The pain was multiplied when I had to explain to our three-year-old that his “Ma” had gone to heaven The innocence of a child makes grief even more poignant His small face scrunched with confusion and disbelief “No,” he said repeatedly, “she went to work and will be back ”

“Key objectives of the draft policy include establishing a sustainable programme that protects the most vulnerable road users, especially where they are most at risk, and recognises roadways as public assets meant for all users,” said Quintas

KEYPROPOSEDCHANGES

The draft policy introduces several significant updates:

.Greater flexibility to accommodate environmental differences, especially in high-pedestrian areas, through policy exceptions;

.Expanded scope for the design and implementation of traffic calming measures, under the City’s oversight;

that will assist the City in assessing and managing applications for traffic calming measures (such as speed bumps and road signage) across the metro

.An increase in the baseline number of traffic calming interventions per financial year; and

.Proactive planning for traffic calming in new developments and land use applications

“The policy is designed to make it possible for traffic calming measures to be implemented in more scenarios than previously; while continuing to prioritise schools, walking routes in their vicinity and other public facilities,” Manuel added
