In an answering affidavit to the court case brought by the South African Property Owners Association (Sapoa) to have the three new fixed tariffs for Cape Town residents reviewed and set aside, Mayor Geordin Hill-Lewis warns that scrapping them would leave the City with a billions of rand shortfall this financial year

The 300-page affidavit was filed in the Western Cape High Court on Monday 11 August

Sapoa in mid-July filed an urgent application in the Western Cape High Court, challenging the legality of the three new property-linked tariffs in Cape Town’s 2025-'26 budget Sapoa held that the cleaning levy and fixed water and sanitation charges based on property value unfairly burden ratepayers and infringes on property rights under Section 25 of the Constitution along with setting a concerning precedent

They stated that the new tariffs do not comply with the Property Rates Act in that it is based on property values rather than actual use It says the charges are not a consumption-based fee, a basic surcharge, or a municipal tax, but rather a form of property rate that doesn’t meet legal requirements

Negating the argument Hill-Lewis stated that the City in determining the 2025- 26 budget fulfilled its constitutional obligation and that the tariffs are lawful and constitutionally sound

He says Sapoa’s case has no substantial legal grounds, as the tariffs are fair and rational, as well as being constitutional in that the metro has a constitutional duty to provide water, sanitation and cleaning services and to establish the right or levies to pay for them

Pointing to South Africa having the highest inequality in the world, he said, the budget encapsulates the principle of equality within the current social context "In an ideal world the City's revenue would meet all the City's needs, but this is not the case There are obvious tensions

The mayor says Sapoa does not argue that the tariffs are excessive and that the court application is therefore limited to one issue, namely that it is unlawful to link the fixed tariffs to property values In this respect he argues that property values in this instance are merely used as a measure to determine the tariffs that are not in essence a property tax

He furthermore stated that municipalities across South Africa are caught in a financial vice, driven by rapidly growing populations and the urgent need to expand infrastructure to maintain basic services Without raising funds from residents, the only alternative is the decline and eventual collapse of public services and infrastructure

He said the tariffs are needed to set the city on a "new path" to combat poverty in the face of a massive population growth in Cape Town

Hill-Lewis cited census data showing Cape Town’s population grew by 27% between 2011 and 2022, now officially at five million

He believes the true figure is higher due to undercounting in informal settlements, where over 1,2 million people live in some 800 such settlements with only shared taps or toilets

"I do not in any way wish to suggest that I regard concerns raised over the budget as trivial The concern which almost all residents in this country raise in relation to relentless increases in municipal bills, food and fuel is real and acknowledged by the City and has been taken into account "

GrandWest faces R4m claim in court

GrandWest Casino and Entertainment World is currently involved in an ongoing legal case following an incident in 2020, when a four-year-old girl was allegedly shocked while on the premises.

The child’s father has lodged a claim of R4 million in damages, alleging negligence on the part of GrandWest Responding to the matter GrandWest confirmed that it is aware of the incident and that its legal team is studying the judgement

The Table View Beachfront Upgrade Recovery Plan, which aims to revitalise one of Cape Town’s most popular coastal stretches, has made significant progress between June and mid-August this year, with several key milestones reached despite the challenges of winter weather

“The work along our beachfront is progressing well, and although the winter rains have caused some delays the project team has managed these effectively

“Residents and visitors can look forward to a safer, more attractive beachfront once the upgrades are complete ”

STORMWATEROUTFALLSANDTIMBERWORKS

Under Contract 004Q/2023/24, AMS Civils has successfully upgraded eight of the 11 stormwater outfalls to durable gabion structures, with final inspections and minor repairs underway

The large outfall near the Whitewaters parking area is almost complete, after which the timber viewing deck will be rebuilt

“Post-and-rail fencing has been completed at POD 8 and is in progress at POD 7, with timber transition elements being installed at both sites,” Van der Linde said

Around 80% of unfinished works left by the previous contractor have now been completed This includes the construction of small retaining walls, seating walls, and paving of surrounding walkways The Whitewaters parking area remains closed as it serves as the contractor’s site camp

espite being home to two national key points – the Koeberg Nuclear Power Station and a major internet tower – the Melkbosstrand Police Station is operating with only one patrol vehicle per shift, raising serious concerns about the safety of residents and visitors alike

This alarming reality came to light after MP Nicholas Gotsell and Ward councillor Paul Swart met earlier last week with representatives from Melkbosstrand police, the Community Police Forum (CPF), Neighbourhood Watch (NHW), and Community Safety and Support (CSS)

The concerns are amplified by the recent tragedy that shook the community just two weeks ago, when a retired teacher was brutally murdered in her Melkbosstrand home a case reported on by TygerBurger last week

Community leaders and residents have since expressed outrage, questioning how such a violent crime could occur in a suburb that houses two national key points

“The murder of a well-loved teacher is a painful reminder that crime does not respect boundaries,” a resident said

“When there’s only one vehicle patrolling such a large and important area, it’s not just inadequate it’s dangerous ”

“Our police members are passionate, committed, and doing their utmost under difficult circumstances,” Gotsell said

“But they cannot fight crime effectively when they are so severely underresourced Staff numbers have dropped over the years, even as the population grows, and vehicles that are taken off the road have not been replaced ”

MELKBOSSTRAND POLICE: ONE PATROL CAR PER SHIFT

Currently, the single patrol vehicle is frequently required to leave the precinct to transport suspects On occasions, this includes driving a drunk driver as far afield as Athlone, leaving the entire Melkbosstrand community – including its rural outskirts and coastline – without any patrol coverage

Gotsell described the situation as “shocking” and has written to the Provincial Police Commissioner demanding answers He questioned whether police senior management has been neglecting Melkbosstrand because the community has managed to maintain low contact crime statistics thanks to strong CPF, NHW, and CSS initiatives

“We must not accept this,” Gotsell stressed “This week, an elderly lady tragically passed away under circumstances still under investigation Her death is a stark reminder that no community is immune to violent crime SAPS management must act proactively, not reactively, when it’s too late ”

While highlighting the challenges, Gotsell praised the dedication of CPF, CSS, Neighbourhood Watch members, street watch groups, and active residents who play a crucial role in keeping the community safe He urged residents to attend CPF meetings and raise their voices in support of local policing “Let us be part of the change we want to see,” he said

COLLABORATION

Swart expressed confidence that the soon-to-be-deployed Ward Safety Officers will further strengthen collaboration

between the police and community-based safety structures “These officers will act as force multipliers, enhancing the already strong partnership between law enforcement and residents,” Swart said Community members are now calling for urgent attention from police management to ensure that resources, personnel, and vehicles are appropriately allocated to Melkbosstrand, which has grown rapidly in recent years Many residents echo Gotsell’s sentiments that proactive policing and visible law enforcement presence are vital As Melkbosstrand continues to develop as a residential and coastal hub, the pressure on the local police station remains high Residents hope that sustained community engagement, combined with better resourcing from police, will prevent future tragedies and secure a safer environment for all

When goodbye comes too soon

It is a strange, almost unreal feeling to watch someone you love endure a grief so deep it seems to swallow them whole Two weeks ago, I watched my fiancé lose his mother, and I felt a pain unlike any I have ever known

Over the past week, I saw a man strong, capable, and loving confront the unimaginable: the absence of the one person who has been a constant presence in his life since birth His grief was raw and unfiltered, spilling into every corner of the room and touching everyone near him I wanted to comfort him, to hold him, to take away the sorrow, but I could only be there, quiet, present, a steady hand and listening heart

The pain was multiplied when I had to explain to our three-year-old that his “Ma” had gone to heaven The innocence of a child makes grief even more poignant His small face scrunched with confusion and disbelief “No,” he said repeatedly, “she went to work and will be back ”

He said this year's venue elevated the tournament to new heights and gave people from across the province an opportunity to witness young soccer talent on display The tournament also gave the players a chance to play on a proffessional pitch

"This means if you dream it you can do it Playing at Athlone Stadium is not something many of our young footballers get to do in their lifetime This gives them an opportunity to be part of something special," he said Rodrigues described the occasion as "very special" and an the journey to Athlone Stadium as "emotional"

"It was not an easy journey There were too many obstacles but the support from everyone has been amazing This is not about people It is about giving the

younsters an opportunity to showcase their talent "

He added that preparations were already underway for next year's tournament

"We've launched a platform for a great tournament moving forward We have started with plans for next year and hope to make it even better
