“The approval of the filling station despite more than200 objections, has prompted aformal appeal from residents. It raises significantconcerns about lawful decision–making, environmental governance, and the protectionof children’s rights in municipalplanning,” Thersia Smit, aresident andlawyer, said.
“The decision, taken on 24 Marchthis year, authorises ahigh–risk commercial land useinanestablished residential area, notwithstanding 222 written objections from residents andaffected parties.The site lies within close proximity to residential homes, aprimary school,aswell as theUitkamp Wetlands system— an areaidentified in municipal policy as environmentally sensitive.
“At the centre of ourappeal is the allegation that thetribunal failed to comply withbinding planninglegislation andpolicy, mostnotably the Northern District Spatial Development Framework (2023).Thatframework expressly classifies D’Urbanvale as alow- to mediumdensity residential areaand cautions against furtherfuelstationapprovals in the Durbanville corridor, because of service-station saturation, traffic safety risks, and environmental constraints. The approval was granteddespite the presence of multiple fuel stations within ashort radius of thesite andwithout demonstrated evidenceofunmet demand,” according to an executive summary of the appeal.

“Thesite falls near wetlands and groundwater recharge areas, yet the tribunal proceeded without evidence of prior authorisation under applicable waterand environmentallegislation.
The approval is said to rely heavily on mitigation measuresand compliance conditions rather thanonaprecautionary, risk-averse assessment,”Smit says.

Section 99 of the City of Cape Town’s Municipal Planning By-Law must be applied together with national and provincial planning legislation —most notably the Spatial Planning and Land Use Management Act (Spluma) and the Western Cape Land Use Planning Act (Lupa), as well as binding City policies.
“Properly interpreted, section 99 does not confer anarrow or mechanical discretion. It imposes alayered constitutional obligation requiring decision makersto evaluate applications substantively, not formally,” she says.
MATTERISSUBJUDICE
Eddie Andrews, the City’s deputy mayor and Mayco member for spatial planning and environment, previously said to TygerBurger on enquiry that as aresult of the appeal against the decision, the matter is sub judice until the appeal is heard and afinal decision has been made by the appeal authority. “The City cannot comment until theseprocesses have been concluded,”hethen said.

Incelebration of Earth Day, the Mosselbank River becamethe focus of avibrant community-driven conservationeffort this past Saturday to plant 130 trees.
The Mosselbank River Conservation Team (MRCT), in partnership with the Cityof Cape Town’s water and sanitation directorate and the Durbanville LionsClub, hosted the tree planting marathon that drew strong local support
About50residents joined organisers and partner organisationstoplant the trees, and 200 river rehabilitation plants along the riverbanksand open spaces.
“The initiativeaimed to restore and protect thenatural ecosystem while fostering asense of environmental stewardship within the community,” said Danielle Cronje, director and cofounder of MRCT.
MADEPOSSIBLEBYCONTRIBUTIONS
The event was made possible through contributions from several organisations. Buchu Farm in Durbanville donated 100 trees, while the City’s recreation and parks department provided an additional 35 trees, Cronje said. Compost was supplied by Osdam Farm in Greenville Garden City, and Vula Environmental Services contributed 200 river plants for rehabilitation efforts.
“Hydration for volunteers was generously provided by
Smuts andCo, withfurther supportfromthe Lions Clubs ofDurbanville, Table View and Northpine, andthe Fairmont High SchoolRepresentative Council for Learners,” Cronje added.

Soaring pricesput houses outofreach
Cape Town residents acrossall income brackets arestrugglingwith housing affordabilityasmunicipal ratesand taxes continue to rise, according to Leon vanZyl, chair of the Western Cape PropertyDevelopment Forum (WCPDF)
In the forum’slatest newsletter addressing the housingcrisis, vanZyl warned that affordabilitychallenges, onceconfined to lowerincome groups, arenow affecting the middleclass as propertyprices soarthroughout the region.
“In response, some commentators are calling forpricecontrolsand land-value taxation to cross-subsidisehousing. Others arguethat short-term rentals arereducing availablehousing stock. Stillothers blame risingoperational costs, particularlyhighermunicipal rates and taxes, and point to an increasingly bloatedpublic administration as the root cause,”hewrites.
But housing affordabilityisnot unique to Cape Town; priceescalations in surroundingtowns such as Stellenbosch, Paarl and even as farafieldasGeorge and Mossel Bayconfirmthat affordability is abroader regional challenge, drivenby both demand and supplychallenges

TheWestern Cape’s appeal as an internationally recognised destination is drivinghealthy market demand. VanZyl cited the region’snatural beauty, superior governancecompared to otherparts of South Africa, and its attractiveness

“And,measuredonaninternational scale, theCapeisaffordable when compared to otherinternational addresses.Plus, withthe message of good governanceand abetterlife, comesthe message of potentialemployment opportunities, leadingto mass semigration across alllevelsofincome.”
However, supply-sidechallenges areexacerbatingthe crisis.Despitethe Western Cape’s reputation forgood governance, vanZyl criticisedexcessive redtapeand associatedcosts
“Manywould agreethat theWestern Cape is exceptionallygood at crossing every‘t’ anddotting every‘i’ when it comes to statutoryapprovals fornew development.Thiscreates the perception that thegoverningculture is oneof: ‘It’seasier to saynothantosay yes’,” he observed.
“With publicsectorsalaries andjob security often exceedingthose in the private sector,bureaucrats arefrequently criticised forlackofurgencyindelivery, prioritising cleanauditsoverimplementation. However, sinceclean audits seem to be thepoliticaldifferentiatorcelebrated by politicalleadership, canone blame thebureaucratsfor the politicalculture ofclean auditabove delivery?Red tape isarealchallenge in the Cape,and the cost of timeisdirectly reflected in the cost of housing,” he wrote.

prefer to preserve thestatusquo.Despite itsliberal reputation, theCape is farmore conservative than most wouldcareto admit,” he writes.
CONSTRUCTIONCOSTS ADDPRESSURE
Building material costsfurther compound theproblem, as fewmaterialsare produced locallyinthe Western Cape
“Materialsdelivered at scalein Gauteng arebrokenintosmaller quantities forCape projects, with transport costsand markupsadded along theway,” vanZyl explained.
Combined with higher labour costs, stricter site controls,and rising fuel expenses, construction costsinthe Western Cape significantly exceed those in other provinces.

The Academy of Acrobats and Dance (AAD) celebrated outstanding results following the Acrobatic FederationofSouth Africa (AFSA) examinations held from 16 to18April in Durbanville.
Under the evaluation of examiner MerleneVigliotti, atotal of 70 acrobats participated over the three-dayassessment period.
Theacrobats achieved an impressive overall average of 90%, reflecting ahigh standard of training and dedication.
Several dancersearned topmarksin their respectiveexaminations.
Theseincluded Lara Jongkind (98%; White Shield Examination 1), Hailey de Bruin (98%; Pink Shield Examination2),
Zelda Tandy, owner of AAD and acrobaticsteacher, expressed her pride in thestudents’ achievements, noting their commitment to maintaining ahigh level of technique and discipline.
In additiontoacrobaticdance, the academy offers contemporary dance classes led by Karin Wilke, as well as conditioning, technique and tumbling programmes.

Representatives of rugbyclubs in theprovincemet withFrancineHigham, Maycomemberfor recreation andparks in theCity, on Saturday 18 April in a dialogueabout thechallenges theclubs face with theCity’sfacilities.
Club rugbyisthe heartofevery communityunder theumbrella of theWestern ProvinceRugby Union (WPRU)and each year when theseasonstarts, clubsshare thefacilities with summer sporting codes or have to usehighschool sport fieldsintheir community.
“This is afirst in aseries of seminars with the sporting fraternity from WP rugbyclubs,aspartof ongoing efforts to strengthen relationshipswith keystakeholders in thesporting community. Iwant to thank theWPRugby Union forsuggesting this seminar as aplatform foropen dialoguebetween the City andrugby clubs,”she says.“Whilethis wasa useful opportunitytobuildstronger bonds with our user groups, we understand that thereare existing challenges andwork to be done.AsaCity, we’re committedtowalkingthis journeywiththe clubs andall users of City facilities.”
