The South AfricanNational Defence Force (SANDF) and thepolicelast week commenced preparatory operations in Cape Townahead of the military's deployment to tackle gang violence in identified crime hotspots.

Aselect contingent of police officials and SANDFmembers conducted operational scanning exercises on Wednesday and Thursday last week, involving air and ground presence of limitedforces at variousidentified locations across the city.

Brig Novela Potelwa,spokesperson for Western Cape police, emphasised that "the exercise should notbemistaken for the actual commencement of deployment of theSANDF" and described it as "essential preparation for the integrated forces ahead of theactual deployment."

Potelwa urged thepublic to "respect the operational spacethese forces require and refrain from speculating about their presence in thetargetedareas.

"The preparatory operations follow President Cyril Ramaphosa's announcement duringthe State of the Nation Address on 12 February that SANDFmembers would be deployed to support thepolice in addressing gang violence and illicit mining at identified crime hotspots.

On Monday9March the Bellville Magistrates’ Court sentenced Rennert van Rensburg to an effective fine of R24 000 or 48 months’ directimprisonment for failure to submit personal income tax returnsfor the period2018 to 2023. Van Rensburg registered for income tax at theSARS Bellville office in 1985, with the initialyearofliability being 1986. He filed his returnsuntil the 2018 tax year, after whichhefailedtofile anyreturns up to and including the2023 taxyear.

Barmania registered for income tax with theSouthAfrican Revenue Service (SARS) in 2005 andfiledher returns through 2010. However, she failed to submit returns from 2011 through the 2023 tax year, despite efforts by SARS to encourage compliance.

The National Prosecuting Authority (NPA) chargedher on 13 counts relating to her failure to file returns. Under apleaand-sentence agreement she was sentenced to R6 000 or 12 months’imprisonment percount,with R2 000 or four months suspended for five years.

STRONGWARNING

The NPA welcomedthe conviction and sentence, sayingithopedthe outcome would sendastrong message that failure to complywith tax obligations was a seriousmatterwith costly consequences.

The prosecutingauthority, together with SARS, warned that tax non-compliance would not be tolerated andsaid they will ensurenon-complianttaxpayers are held accountable,particularly as the tax year ending31March2026 approaches.

The casewas prosecuted at the Bellville office of SARS andhighlights the authorities’ commitment to pursuing tax evadersthroughthe courts.

Prior to the preparations starting the Western Cape Government last Sunday received abriefing from the senior management of the Western Cape police on national plans on the deployment.

"The deployment will be focused on numerous high-crime policing precincts across the Western Cape which together account for approximately 55% of violent crime in the province. Winde underscored the importance of ensuring that the deployment is intelligence-driven, collaborative and informed by lessons learned from previous SANDF deployments, including the intervention undertaken in 2019.

"Cabinet noted that provincial resources and initiatives should form part of the integrated effort,including the Western Cape Government’s Law Enforcement Advancement Plan (LEAP), K9 units, technology-enabled policing tools,and the deployment of provincial traffic services to assist with stabilisation efforts," said Winde.

Murphy is currently serving an effective 18-year direct imprisonment sentence after the High Court of SouthAfrica: Western Cape Division convicted himon multiple serious charges. These include managing an enterprise conducted through racketeering activity, 139 counts of attempting to deal in drugs, one count of dealing in drugs and 73 counts of money laundering.

TheHigh Court also fined him R2 million after the state successfully argued that his drug dealing stemmed from greed for money and power, and that hisactions destroyed communities and the people living in them.

Thecourt ordered the registrar to issue awarrant authorising the Sheriff to recover the R2 million fine through the attachment and sale of movable property belonging to Ulterior Trading Solutions CC. If proceeds from the sale of movable property prove insufficient,the registrar is authorised to issue awarrant for recovery of the unpaid amount from the company’simmovable property.

TAXOBLIGATIONSIGNORED In the plea and sentence agreement Advocate Conrad Heydenrych described Ulterior Trading Solutions CC as aclose corporation registered as ataxpayer. Murphy was itssole member and representative taxpayer,and was also registered as an individual taxpayer. Under the Income TaxAct and Tax Administration Act Murphy was required to submit income tax returns for both himself and his company, declaring gross income to the SouthAfrican Revenue Service (SARS). He had failed to fulfil theseobligations.

Thecourt ordered Murphy to submit all outstanding returns to SARS by 19 September 2025. The National Prosecuting Authority welcomed the sentence.

Muslim marriageofficers gain equal recognition in reform

Muslim marriage officers no longer need to reapply for certification every five years.

Thenew directive from Home Affairs MinisterDrLeon Schreiber means Muslim religiousleaders certified as marriage officers will nowberecognised on the same basis as other faithcommunities, whichare certified for an unlimited period.

Thechange brings the officers in line with other religious groups under the Marriage Act 25 of 1961, removing what theministry called an “administratively burdensome” renewalprocess.

“For many years, Muslim marriage officers were subject to arenewal requirement that didnot apply to other religious groups. The five-year limitation was originally introduced as atemporary measure, while new marriage legislation was being developed,” the ministry saidin arelease last week.

Theminister’sdecision follows discussions with relevant stakeholders who raised the issue with him. This reform comes after the department introduced marriage certificates that recognised Muslim marriages for the first time in 2024.
