Thejudgment, deliveredlastweek,found Neumannhad failed to demonstrateirreparable harm to himselfand hadnot shownthe WCED wouldnot suﬀer irreparableharmifhewere reinstated.“Thereisnothing unusual,extraordinary or unique aboutthiscasethatwarrants departingfromthe generalrulethatanappeal suspends theoperation of ajudgment,”the courtstated. “For that reason alonethe application must fail.”

Therulingcomes afterthe Labour CourtorderedNeumann’s reinstatementinJanuary this year,replacing hisdismissal with a ﬁnalwritten warning. TheWCEDimmediately ﬁledan applicationfor leavetoappeal that judgment, whichautomatically suspendedthe reinstatement orderunder section18(1) of theSuperior Courts Act.
