The High Court in Kimberley has issued a stinging ruling against the Ga-Segonyana Local Municipality in Kuruman and its municipal manager, Martin Tsatsimpe, setting aside a major public procurement contract and ordering a tax consultancy to repay millions of rands in inflated fees.

In judgment delivered on 8 September, Judge President Pule Tlaletsi and Acting Judge Willem Coetzee declared both the award of Tender 06/2023-’24 for Value-Added Tax (VAT) recovery services to MNK Tax Advisory Services (Pty) Ltd and an interim month-tomonth contract between the parties constitutionally invalid. This follows findings of the South African Human Rights Commis-
sion (SAHRC) earlier this year that show a municipality struggling with infrastructure, administration and financial management. The legal challenge was brought by competing bidder Maximum Profit Recovery (Pty) Ltd, which sought to review the municipal decisions. In August 2023, the High Court had previously set aside an earlier VAT recovery tender awarded to MNK.

Although the court granted a fourmonth suspension of invalidity, expiring on 17 December 2023, to enable the municipality to rerun the tender, municipal officials failed to conclude a lawful procurement process in time. Instead, Tsatsimpe allowed subsequent tender invitations to lapse whilst continuously extending MNK’s services under an interim monthto-month Service Level Agreement.
Under this illegal arrangement, MNK continued to collect a lucrative 10% commission on all VAT refunds recovered from the South African Revenue Service (SARS). The High Court heavily admonished Tsatsimpe, finding that he improperly introduced irrelevant considerations to force an outcome in favour of MNK. Continues on p. 2.

Failures impact residents’ basic needs Continued from p. 1 The court similarly struck down the month-to-month contract extension. The municipality attempted to justify the interim contract under Regulation 36 of the Municipal Finance Management Act (MFMA), which permits emergency deviations from competitive bidding. Whilst the court declined to substitute its decision by directly awarding the tender to Maximum Profit due to time constraints, it took firm corrective action against the public funds paid under the illegal month-tomonth arrangement. Holding that MNK was not an innocent party because it knowingly participated in an unlawful contract extension, the court ordered MNK to repay 6% of all commissions received from 18 December 2023 to the date of the order. MNK is allowed to retain only 4% to ensure public funds are protected from excess profiteering whilst recognising services rendered.
Furthermore, the respondents were ordered jointly and severally to pay Maximum Profit’s legal costs on Scale C, including the costs of two counsel. To enforce oversight, the court directed the Registrar to forward copies of the judgment directly to Premier Dr Zamani Saul and the executive mayor of the Ga-Segonyana Municipality. The report by the SAHRC that details service delivery failures within the municipality was handed to Saul in April this year. A primary issue is service provision across the municipality’s 33 villages. Refuse collection and sanitation reach three villages, whilst electricity goes to six. A Department of Water and Sanitation (DWS) audit shows 65% of residents lack access to water sources. In Kuruman, residents report paying monthly availability fees whilst going days without water. Outages relate to pump vandalism, lack of infrastructure protection, and shortages of spare parts for repairs.

The Northern Cape High Court has dismissed an urgent application by suspended municipal manager Kagisho Klaas Teise, who sought to overturn his precautionary suspension following his arrest by the Hawks in June. Judge Mpho Mamosebo delivered the judgment on 25 August, ruling that the municipality’s precautionary suspension of Teise was neither unlawful nor unfair, and dismissed the application with costs. Teise, who has served in this position since 1 June 2023, launched urgent court proceedings on 17 July challenging the validity of a special council meeting held on 13 July and the subsequent notice of suspension served to him on 14 July. He sought an order to resume his duties immediately, arguing that the municipality failed to comply with Regulation 6 of the Disciplinary Regulations for Senior Managers because he was not given a proper opportunity to

submit written representations before his suspension took effect. Judge Mamosebo noted that whilst regulations require an opportunity for representation, they do not establish an inflexible rule prohibiting a municipal council from taking immediate protective measures where objective risks exist. The court highlighted that Teise was expressly granted a seven-day window to make written representations but chose not to do so, opting instead to immediately launch legal proceedings. The legal battle follows a high-profile operation on 29 June when the Hawks’ Serious Corruption Investigation Team arrested Teise and two other senior municipal officials at their workplace in Kuruman. The other co-accused are Motshabi Wilberforce Molusi, manager of the Project Management Unit, and Lerato Agreeneth Morris, manager of Council Administration. The state alleges that the trio worked in tandem to illegally alter the competency assessment results of an applicant for the position of director of community services, which was advertised on 16 October 2022. Teise and Molusi were released on R10 000 bail each, whilst Morris was granted R5 000 bail. On 10 July, the DA issued a sharp warning to council speaker Ikgopoleng Aiseng, demanding that standard internal disciplinary processes against Teise be implemented without delay. DA councillor Koketso Paul accused the ANC of “blatant interference” in municipal governance, claiming that an earlier special council meeting was “purposefully derailed” when ANC councillors were recalled and a “suspiciously convenient” power outage delayed proceedings.

Natuur triomfeer oor die verskroeide grond HANNES NOËTH Onlangs het die berg agter ons huis gebrand. Dit was winterveld met droë gras, en maklik vir ’n brand om vinnig deur die gras te beweeg. Hoewel dit amper ’n skouspel genoem kan word – hoe mooi die vernietigende vlamme in die donker voortgerol het – is ’n mens die heeltyd bewus van die skade en die vernietiging wat so ’n brand bring. Dit is byna, soos ’n mens dit sien, dat jy besef daar is skade en dit wat hier gebeur is nie goed nie. ’n Mens dink onwillekeurig aan al die veld-
diertjies, die skilpaaie, voëlnessies en sommer net alles. Maar dan is die brand oor. Die dae gaan gewoon voort en vorentoe en die natuur het sy eie manier om op te staan. Hoewel die eerste lente-reën nog nie regtig geval het nie en ’n mens nog wag vir die groot reën om te kom, staan jy verstom oor hoe kragtig die natuur is om so ’n krisis te oorkom. Met swartgebrande gras oral rondom staan die natuur tog groeiend weer op. Aan die bome, ondanks brandletsels, sit lentebloeisels. In die veld, oral veldblommetjies; ondanks gebrande gras rondom is daar vars nuwe blomme aan die uitroep ’n nuwe seisoen is hier. In pienk en pers, in oranje en wit, geel en helderrooi. Alle vorms en alle groottes.

Die wet lei glo dikwels tot uitstel en ondoeltreffendheid, aangesien take meer kompleks word wanneer meer tyd daaraan bestee word. Ook is die sosiale media en apps ontwerp om fokus te steel. Hul voortdurende afleiding verbreek konsentrasie, en veroorsaak dat basiese take langer neem om af te handel. Boonop, omdat die sosiale media jou vertel dat jy ’n foutlose huis en perfek saamgestelde lewe moet hê, het jy eindelose take. Indien jy nie soos die lappop op die ashoop wil voel nie, wees dapperder as die dapper muis: Skakel die nie-noodsaaklike boodskapkennisgewings op jou foon af. Hou op om werksboodskappe ná ’n sekere tyd buite werksure na te gaan. Doen een ding op ’n slag, want om heeltyd tussen take te wissel mors kosbare geestelike energie. En jy is immers nie ’n mier nie.

Die groei van die hierdie lenteblomme en kleur bring gewoon hoop. Hoe kan daar uit soveel vernietiging soveel mooi kom? ’n Mens is te klein om te begryp. ’n Mens staan maar net dankbaar stom vir groei uit seer. Die mooiste groei kom dikwels uit die seerste seer.

Wêreld vol skerp punte Rooyouers pluk ’n lat KARIN MULLER Die wêreld waarin ons leef, is vol spreekwoordelike skerp punte. Siekte. Dood. Werkloosheid. Konflik. Armoede. Ongelukke. Vrees. Twyfel. Soms voel dit asof mense hierdie skerp punte afbreek en jou daarmee deurboor. Asof hierdie skerp punte wat ons moet oorleef, nie opsigself ’n groot genoeg uitdaging is nie. Hierdie soort mense is volop. Hulle verlekker hulle in die wete dat iemand anders swaarkry. Die feit dat hulle die swaarkry veroorsaak of vererger, besorg hulle nie slapelose nagte nie. Mense kan wreed wees. Magsbehep wees. Selfgesentreerd wees. Mense kan vrygewig wees. Ontfermend wees. Tegemoetkomend wees. Daar is mense wat, met hul optrede, hierdie spreekwoordelike skerp punte effens ronder maak. Meer aanvaarbaar en meer han-
teerbaar maak. Daar is dierbare mense wat, in moeilike tye, na ander mense uitreik en ’n hand van liefde en omgee uitsteek. Hulle is vriendelik. Opreg. Standvastig. Hulle verstaan wat dit behels om deur moeilike tye te gaan. Ons almal ken mense wat onlangs hul werk verloor het of in kennis gestel is dat hulle binnekort nie meer werk gaan hê nie. Skokgolwe van ongeloof en verdwasing gooi ’n somber kombers van wanhoop oor ons plaaslike gemeenskap. Mense is, met rede, bekommerd. Bekommernis wat in desperaatheid oorvloei, is altyd ’n gevaarlike kombinasie. Desperate mense kan dinge doen wat teen die grein met hul menswees is. Gesinne probeer oorleef. Mense probeer sin maak uit die sinnelose. Ons kan nie terugstaan en dink dat ons teen geweldige uitdagings verskans is nie. Die wêreld waarin ons leef, is vol spreekwoordelike skerp punte. Dankie aan diegene wat help om die skerp punte effens ronder te maak.
GERDA-MARIÉ VAN ROOYEN Rooyma weet witleuentjies is seker nie reg nie, maar die hele definisie daarvan steun tog op die idee dat dit noodgedwonge om ’n noodgeval gaan. Hoewel Ouma Lappies altyd waarsku dat die leuen kort beentjies het, is dit selfs nog korter as kinders in die prentjie is. Een so ’n mite in die Rooyhuis is: “As jy nie hare kam nie, kan jy nie dink nie.” Natuurlik moes Sussie dit op ’n Saterdag – die enigste laatslaapoggend in die week – onthou. Verwoed en desperaat skree sy haar ma uit droomland, want sy wil teken en daarvoor moet sy kan dink. Half deur die slaap probeer haar ma haar hare kam, voordat Kleinste ongevraagd inval: “Jy trek my hare. Hou op dink dit is ’n speelding.” Dieselfde trant van witleuentjie het ook al op die Rooyouers geboemerang wanneer Kleinste
op die onmoontlikste tye haar ore skoongemaak wil hê sodat sy kan “hoor”. Daarteenoor het Rooyma een oggend spontaan vir Boetman gewaarsku dat sy vinger in sy oor gaan vassit toe sy hom, onder Bybellees, in so ’n posisie betrap. Net om later self onnadenkend haar jeukende oor met haar wysvinger te verlig. As verdere motivering dat die Rooykinders hul groente moet eet, het Rooyma Oudste sover gekry om te glo dat sy groeiseisoen van sy Sondagmiddaggroente-eet afhang. (Eerder afwurg op Sondagmiddae, wanneer hy en sy suster ’n teelepel van alles op die tafel moet eet.) Nou gaan daar kwalik ’n Sondag verby dat hy nie wortelslaai of pampoentert vereis nie. Hoekom kinders ook net sommige goed op sulke oomblikke kan onthou, weet nugter. Maar dan besef Rooyma: Dit is wat familie doen. Familielede vang mekaar uit en help mekaar reg – selfs al kos dit ’n witleuentjie of ’n ouvroustorie wat geen wetenskaplike grondslag het nie.

Zitholele Consulting (Pty) Ltd has been appointed as the independent Environmental Assessment Practitioner (EAP) to undertake the proposed EA application for the 2.9 Deviation and Part 1 EA and EMPr amendment process. The Ferrum–Upington 400 kV Transmission Powerline is a strategic electricity transmission project developed by NTCSA to strengthen the national electricity transmission network and facilitate the integration of renewable energy generation into the national grid. Environmental Authorisation for the main transmission line was granted by DFFE on 29 January 2025 under Reference No. 14/12/16/3/3/2/3047, together with approval of the associated Environmental Management Programme (EMPr). Following the granting of the EA and during subsequent project planning and implementation preparations, an affected landowner requested a deviation to a section of the authorised alignment. The proposed deviation is approximately 2.9 km in length and is located between Towers 174–185 in the Tsantsabane Local Municipality, ZF Mgcawu District Municipality, Northern Cape Province. The proposed deviation extends beyond the originally assessed 90 m authorised corridor and is therefore being assessed through a separate Basic Assessment process and Application for Environmental Authorisation. Paul Job, professional photographer from Kimberley, has achieved a major career milestone, officially earning his Certified Professional Photographer (CPP) designation from the Professional Photographers of America (PPA). The CPP designation is held by a select group of photographers worldwide. To earn the credential, candidates must pass a comprehensive written examination covering advanced exposure and lighting theory, as well as submit a technical portfolio for rigorous review by a panel of master photographers. Team retains cup DUSTIN WETDEWICH George Whitehead marked his 150th appearance for the Peacock Blues in fitting fashion, orchestrating a nail-biting 23 – 16 victory over the Pumas to secure back-toback Currie Cup titles in a pulsating final in Kimberley on Saturday 12 September. It was a finale worthy of the occasion, with two heavyweight provincial sides trading blows throughout. The Pumas’ defensive line speed tested Griquas, but ultimately, the home side’s set-piece dominance and Whitehead’s ice-cool temperament proved decisive. The match exploded into life from the opening whistle. Bobby Alexander nearly opened the scoring in the sixth minute, only for the television match official to reveal a
crucial knock-on. Whitehead steadied the ship two minutes later, slotting a penalty to give the hosts a 3 – 0 advantage. The Pumas roared back through Darren Adonis in the 14th minute, following an intercept from Jay Cee Nel deep in his own territory. Nel galloped upfield before offloading to Adonis, who showed blistering pace to score and establish a 7 – 3 lead. The see-saw nature continued when Mnombo Zelendaba capitalised on a wayward pass from Alexander in the 21st minute, pouncing on the loose ball and powering through three defenders to restore the Griquas’ advantage at 10 – 7. Clinton Swart kept the Pumas in touch with penalties in the 25th and 34th minutes, sending the teams to halftime with the lowvelders leading 13 – 10. The second half maintained the intensity. levelled proceedings at 13 – 13 in the 58th minute before delivering the turning point in the 69th minute: a monster penalty from 55 m out, for a 16 – 13 lead. Swart responded with his fourth penalty to tie the scores at 16 – 16. Then came the knockout blow. Whitehead launched a 50:22 kick that gave the Griquas field position in the Pumas’ 22 with six minutes remaining. From the lineout, their driving maul was unstoppable as Janco Uys rumbled over the whitewash. Taking distances in their stride The third Kimberley Iconic Sites Half Marathon, presented by the Kgosi Galeshewe Athletics (KGA) club, took place on Saturday 12 September, with athletes competing in the 21 km, 10 km or 5 km event. Ambitious Masihleho of the Bloemfontein Striders is the men’s winner in the half marathon (1:04:30), while Patricia Motshabi (Pan African Resources Elite Running Club) was the first woman to finish the half marathon (1:16:46). In the 10 km event, Avuma Pheza (NWU Pukke AC) and Lizandré Mulder (Boxer AC) won the men’s and women’s categories, respectively. Tshidiso Dilosotlhe (Teemaneng Running Club) and Mamosebetsi Khajwane (Lesotho) are the winners in the 5 km event. Young cricketers take centre stage

In this year’s Wildeklawer Primary Schools Cricket Tournament, running from 10 September to 7 November, schools and cricket hubs come together in Kimberley for weeks of competitive primary school cricket. This tournament aims to create more opportunities for young cricketers to play quality cricket, experience proper tournament conditions, and compete against schools they would not normally face. This year, 22 boys’ teams and 11 girls’ teams are competing. The boys’ division has been expanded into two competitive sections. In the cup section, 12 boys’ teams are competing, and in the shield section, 10 teams. A promotion and relegation system will be introduced, according to which teams will be playing for their position, as well as their future in the tournament.

The participating schools and hubs include Newton, Eureka, Kimberley Junior School, St Patrick’s CBC, Kathu, Oranje-Noord, Seodin, Jacobsdal, West End, Herlear, Hopetown, Douglas, Hartswater, Futurum Akademie, Upington, Frank Roro Hub, HC Rose Hub, Yorkshire Hub, Prieska and Staats. Wildeklawer will be the main sponsor. At the end of the 2025 tournament, the Kathu Primary School was crowned boys’ division champion, whilst the Oranje-Noord Primary School in Upington claimed the girls’ division title. This year’s champions will be crowned at the Staats Primary School.
