1. Diereg om te eniger tyd gedurende redelike ure die eiendom te betree en bestaande paaiete gebruik om torings,geleiers, kabels en toestelleofander masjinerie en toerusting op of oordie eiendomtevervoer,soosnodigofgerieflikmagwees.

2. Die reg om binne die serwituutgebied te wees en werke uit te voer wat verband houmet die konstruksieeninstandhoudingvandiekraglyn.Ditsluitindieregomfondasiesvanbetonenstaalte bou,staaltoringsenondersteunende struktureop terig,geleierstespanen alleander dingetedoen watnodigofgerieflikmagweesomdieserwituutuitteoefenofinstandtehou.

3. Dieregomopofwerkeuittevoerwatbuitedieserwituutgebieduitbrei,slegsindiematewatnodig of gerieflik is om te verseker dat die werke wat verband hou met die konstruksie of herstelvan die kraglynveiliguitgevoerkanword.

4. Dieregombestaandepaaieenhekkewattoegangtotdieeiendomverleen,tegebruik,soosnodig of gerieflik om toegang tot die serwituutgebied en enige toring, ondersteuningsstruktuur,heiningof bykomstighedebinnedieserwituutgebiedteverkry

5. Virsover nodig of wenslikvir die doeleindes en om die werke te beskerm, die reg om enige boom(e), materiaal, geboue of struktureteverwyder of om enige boom(e) binne die serwituutgebied te kap of te snoei en die area rondom enige toring of ondersteuningsstruktuur in die serwituutgebied af te hein.

6. Elke bykomstige reg wat nodig of gerieflik is vir die behoorlike uitoefening van die serwituut om elektrisiteit binne die serwituutgebied oor die eiendom oor tedra deur middel van twee400 kV kraglyneenbykomstigestrukture.

C.DieNTCSAsalsyregtekragtensdieserwituutuitoefenonderhewigaandievolgende voorwaardes:

1.DieNTCSA,sywerknemersen/ofkontrakteurssalvoorafreëlingstrefmetdieeiendomsbesitterten opsigte van die datum en duur van die toegang wat hulle benodig tot die eiendom en die serwituutgebiedvir diedoeleindes vandieuitoefening vandieNTCSAseserwituutregte,behalwein noodgevalle wanneer die NTCSA, sy werknemers en/of kontrakteurs die reg op onmiddellike volle toegangtotdieserwituuteneiendomsalhê.

2. Die NTCSA sal verseker dat enige hekkewat deur die NTCSA, sy werknemersen/of kontrakteurs gebruikword,gesluitis.

3. Die NTCSA sal voldoen aan en sulkeredelike veiligheids-ensekuriteitsmaatreëlsimplementeer soosdeurdieeienaarvandieeiendomvereis.

4. Gedurende die konstruksie van die kraglyne en daarna vir doeleindes van inspeksie en instandhouding van die kraglyn, sal die NTCSA, sy werknemersen/of kontrakteurs op bestaande paaie oor die eiendom reis en binne die serwituutgebied bly wanneer hulle werk verrig. Indien dit nodig word vir die NTCSAom werk buite die serwituutgebied te verrig,sal sodanige werk uitgevoer wordkragtensvoorafgaandereëlingsmetdieeienaar,wiesetoestemmingnieonredelikgeweiersal wordnie.

D.DieaanspreeklikheidvandieNTCSAvirskadevergoedingbydieuitoefeningvandie serwituut:

1. Die NTCSAsal vergoeding betaal waar skadenalatig of opsetlikveroorsaak word deur dieNTCSA, sy werknemers en/of kontrakteurs,wat optree in die loop van hul indiensneming by dieNTCSAom ditinstaattestelomdieserwituutvirsybeoogdedoeltegebruik.

2. Die NTCSA sal geen vergoeding betaal vir skade aan enige natuurlike plantegroei wat binne die serwituutgebiedveroorsaakmagwordnie.

E.Dieserwituutsaldievolgendespesialebeperkingsopdiegebruikvandieeiendomplaas:

1. Dieeienaarofenigegebruikervandieeiendomwordverbiedomgeboueofstruktureboofonderdie grondoppervlakbinnedieserwituutgebiedopterig

C. TheNTCSAshallexerciseitsrightsintermsoftheservitudesubjecttothe followingconditions:

1. TheNTCSA,itsemployeesand/orcontractorswillmakepriorarrangementswiththe propertyownerinrespectofthedateanddurationoftheaccesstheywillrequiretothe propertyandtheservitudeareaforthepurposesofexercisingtheNTCSA'sservitude rights,exceptininstancesofemergencywhentheNTCSA,itsemployeesand/or contractorshallhavetherightofimmediatefullaccesstotheservitudeandproperty.

2. TheNTCSAshallensurethatanygatesusedbytheNTCSA,itsemployeesand/or contractorsareclosed.

3. TheNTCSAwillcomplyandimplementsuchreasonablesafetyandsecuritymeasures asinsisteduponbytheowneroftheproperty.

4. Duringconstructionofthepowerlinesandthereafterforpurposesofinspectingand maintainingthepowerline,theNTCSA,itsemployeesand/orcontractorswilltravelon existingroadsacrossthepropertyandstaywithintheservitudeareawhenperforming works.ShoulditbecomenecessaryfortheNTCSAtoperformworksoutsidethe servitudearea,suchworksshallbeexecutedbypriorarrangementswiththeowner, whosepermissionshallnotbeunreasonablywithheld

D TheNTCSAliabilityfordamagesinexercisingtheservitude:

1. TheNTCSAshallpaycompensationwheredamageiscausednegligentlyorintentionally bytheNTCSA,itsemployeesand/orcontractors,actinginthecourseoftheir employmentwiththeNTCSAtoenableittousetheservitudeforitsintendedpurpose

2. TheNTCSAwillnotpayanycompensationfordamagetoanynaturalvegetationthat maybecausedwithintheservitudearea

E. Theservitudewillplacethefollowingspecialrestrictionsontheuseofthe

property:

1. Theowneroranyoccupierofthepropertywillbeprecludedfromerectingbuildingsor structuresaboveorbelowthesurfaceofthegroundwithintheservitudearea

2. Theowneroranyoccupierofthepropertymaynotplantanytreeswithintheservitude areathatgroworallowanytreewithintheconfinesof,orneartheservitudeareatogrow toaheightinexcessofthehorizontaldistanceoftheheightofthattreefromthenearest conductor

Theowneroranyoccupierofthepropertymayperformfarmingactivitieswithinthe servitudetotheextentthatsuchfarmingactivitiesdonotendangerthesafetyofthe powerlineandsupportingstructures.Thefarmingactivitieswhichtheownerwill,for example,bepermittedtoperformintheservitudeshallinclude,butnotbelimitedto plantingcropsandallowinganimalsandgametograzeinthearea

6. WithoutobtainingpriorpermissionfromtheNTCSA,theownermaynotconductany earthworks,miningactivities,blastingoperationsoranysuchactivitieswithin500metres ofthe110-metre-wideservitudeareawhichmayendangerthesafetyandintegrityofthe powerline,conductorsorsupportingstructures.
