THE South AfricanHuman Rights Commission (SAHRC) launched its investigative report into recreational water quality, wastewaterinfrastructurefailures, sewage-relatedcontamination and the condition of selected rivers,estuaries and coastal waters in the Eastern Cape.

According to the report, the Commission has found that Kouga LocalMunicipalityhas not demonstratedadequate treatment performance at theJeffreys Bay Wastewater Treatment Worksorcompliant final-effluent quality at the KwaNomzamo WastewaterTreatment Works.

Thereportalso investigated Nelson Mandela BayMunicipality and Buffalo City Metropolitan Municipality.

The report found that Kouga “failed to take adequate,effective andsustained measures to prevent wastewater-related pollution, protect water resourcesand safeguard the rights of affected communities and public users.”

The investigation followed complaints about sewage discharges into the Swart River,Seekoei River, lagoons and the ocean near AstonBay, and public use of affected watercourses without adequate warning.

The Public Protector's report of 30 September 2025 found that Kouga lackedadequate measures for maintaining and upgrading wastewaterinfrastructureatboth plants, which were non-compliant with key legal prescriptsand discharged effluent exceeding permissiblelimits.

Accordingtothe report, the deficiencies infringed constitutionalrights, includingdignity, asafeenvironment and access to basicservices

The report indicated that theresponselacked urgency, with weak oversight and enforcement

The report states that at Jeffreys Bay, deficiencies included an unmonitored inlet,inadequate maintenance and inadequate chlorine dosing, and no backup power during outages and load shedding.

Meanwhile, at KwaNomzamo,the plant had not operated at full capacityfor an extended pe-

riod and wasassociated with untreated or partiallytreated flows and security vulnerabilities.

The Commission’sindependent coastal samplingon14October 2025 showed low microbiological contamination at the Jeffreys Bay coastal site, but the reportstates that this did not displace the March2026 treatment-performance data. According to the report, at JeffreysBay, the clarifier outlet recordedEcoli and faecal coliforms greater than 2420 per100 mL.

Thereport indicates that after the polishing-pond stage, the pondoutflow recorded Ecoli of 133per 100 mL against afinal-effluent limit below 1per 100 mL, faecal coliforms of 461 per 100 mLand total coliforms greater than 2420 per 100 mL. At KwaNomzamo, final effluent recorded Ecoli and faecal coliforms greater than 2420 per 100 mL.

The report indicates that the water-use licence prescribes limits of no morethan 1000 per 100 mL, but the results exceeded the limits in its water-uselicence by at least 142%.

According to the report, on 23 July,Kouga submitted written representations including water-uselicences and stated that measures at KwaNomzamo had not yetrestored compliant final effluent, and didnot rely on refurbishment as proof of compliance. The Commission accepted theseasdemonstrating institutional responsiveness but found they “donot alter the central finding that sustained compliant final-effluent performance had not yetbeen achieved.”

It concluded that “the existence of infrastructure, refurbishment projects, monitoring programmesorfuture plans doesnot by itself establishcompliance” and that “general assurances,unsupported statementsofintention and descriptionsoffuture work will not constitute compliance.”

The report recommended that Kouga continue and strengthen remedial measures, secure compliant operation of bothtreatment works and associated infrastructure. Monitoring should cover the final-effluent point, the downstream receiving environment, and the Seekoei River and Estuary mouth, and the Aston Bay area.

The reportcalled forevent-responsive testing after sewage spills and infrastructure failures, prompt public warningswhere risksarise, and continued implementation of the PublicProtector’s remedialaction.

The reportstates that Kouga must submit a consolidated implementation report within60 days,signed by the Municipal Manager.

Municipal Manager Charl du Plessis acknowledged the SAHRC's finding that sustained compliant treatment performance has not yet been achieved at the Jeffreys Bay WWTW.

“The JeffreysBay WWTW is currently not operating fully within its licence conditions. A significant contributing factor is the high salinity entering the sewer reticulation network along the coastal areas, where naturally brackish groundwater infiltrates the system. This elevated salinity accelerates corrosion and causes frequent failures of mechanical components that were never designed to operate under such conditions,” said Du Plessis.

He said that, recognising these challenges, the municipality undertook extensive repairs and maintenance at the Jeffreys Bay WWTW during November 2025, with the plantbeing recommissioned in December 2025. Du Plessis said since then, operational performance has improved considerably, although further workremains necessary to achievefull licence compliance.

He said several immediate and medium-term mitigation measures have already been implemented. These includethe installation of an additional sodium hypochlorite disinfection system during June 2026 to improve final effluent quality,while additional budget has been requested to clean and rehabilitate the oxidation ponds.

He said beyond Jeffreys Bay, Kougaoperates seven wastewater treatment works that collectively achieved an average effluent compliance of 63% during the July2025 to June 2026 reporting period.

“Although microbiological compliance and certain organic loading parameters remain below the required standards,other critical indica-

tors, including pH, nitrate, nitrite and fluoride, continue to demonstrate consistently high compliance, confirming that key aspects of the treatment process remain stable,” said Du Plessis, adding that the municipality has implemented acomprehensive, funded recovery programme aimed at restoring long-termcompliance. He said following years of under-investment, Kouga's institutional Green Drop score improved from 19% to 43.3% during the 2025 Green Drop assessment, with five of itsseven wastewater treatment works moving out of the critical-risk category.

Du Plessis said aformal Corrective Action Plan has been submitted to the Department of Water and Sanitation, with implementation already well underway. He said the municipality has also intensified efforts to address external factors that negatively affect treatment performance. Du Plessis said during the 2026/27 financial year, the municipality will continue implementing afocused programme of infrastructure investment, operational enhancement and regulatorycompliance.

“Key priorities include restoring full operational and drinking water quality compliance through improved chlorine dosing and laboratory reporting; improving wastewater treatment performance; implementing advanced pollution-monitoring systems and strengthened trade-effluent enforcement; expanding and developing the process-controller workforce in accordance with Regulation 3630; and fully implementing the Green Drop Corrective Action Plan to improve performance ahead of the next national assessment in 2027,” said Du Plessis. He said the municipality is fully committed to fulfilling itsresponsibilities as aWater Services Authority.

Du Plessis further said the municipality is equally committed to transparency and accountability. “Municipal teams continuously monitor wastewater infrastructure, respond rapidlyto incidentswhen they occur and implement corrective measures to minimise environmental impactsand protect public health.”

He said the accused, who were arrested just hours after the armedrobbery at Gabriël Jewellers in Fountains Mall on 2August, face provisional charges of robbery with aggravating circumstances,possessionofstolen propertyand unlawfulpossession of ammunition

According to policespokesperson Captain Marius McCarthy, on 2August, at approximately10:15, employees and witnesses were inside the businessassisting customerswhen two armed suspects entered.

AHUMANSDORP attorney has been convicted of stealing nearly R6 million from 14 deceased estates after pleading guilty to 14 counts of theft in the Specialised Commercial Crime Court in Gqeberha on 30 July.

According to National Prosecuting Authority (NPA) regional spokesperson Luxolo Tyali,the matter stems from allegations that, between 23 March 2021 and 4December 2023, Annene Krouwkam-Claasen (36), acting in her capacity as atrustand estate administrator through her own firm,served as the appointed agent, executor andtrustee of variousdeceased estates.

He said that, in this role, sheunlawfully and intentionally misappropriatedfunds entrusted to her for safekeeping and administration. Tyalisaid that,inher plea, Krouwkam-Claasenadmitted that, during the period in question and in or near Humansdorp, shesiphoned nearly R6 million from the bank accounts of 14 deceased estates.

“The stolen funds were transferred into her personalbank account and theaccountofAncoris Fiduciary Services (Pty) Ltd, acompany of which she wasthe soledirector,” said Tyali.

THESarah Baartman District Municipality (SBDM) has assured residents that the Thornham Informal Settlement Upgrade Project in the Kou-Kamma Municipality has not been abandoned, confirming that the project remains underway and has arevised completion date of 30 September followingdelays experienced during construction.

Accordingtothe municipality, the Thornham InformalSettlement Upgrade Project formspart of the Informal Settlements Upgrading Programme (ISUP), which aims to improveresidents’ living conditions through the provisionofessential municipal services.

The municipality said Lilitha Project Managers were appointedasthe Professional ServiceProvider responsible for the planning, design and construction supervision of the project.

Their scope of work includes:

• Social facilitation and householdenumeration; Preliminary and detailed designs;

• Tender documentationand procurement support;

• Preparation of workingdrawings; Construction supervision; and

• Projectclose-out

The municipality indicated that the projectcommenced with an in-

ception meeting held on 27 August 2024between the SBDM,Kou-Kamma Local Municipality officials and the Professional Service Providerto confirm the project scope and implementation programme.

This was followed by apublic participation meeting on 29 September 2024, where beneficiaries and Thornham Board members were introduced to the project, and aProject Steering Committee (PSC)was elected torepresent the community throughout implementation.

The project deliverables were presented to and agreed upon by the Department ofHuman Settlements, Sarah Baartman DistrictMunicipality and the Thornham Project Steering Committee. Theseinclude:

• Household standpipesfor watersupply;

• Householdlow-flush VIP toiletsfor sanitation;

• Refuseskip bins and householdwheelie bins forwaste management; Access roads; and

• Street lighting.

“The municipalityisnot aware of any deviation from thisagreed project scope. Should any amendments become necessary during implementation, these would be discussed withall relevant stakeholders in accordance withthe approved project governance processes,” the municipalitysaid.

The municipalitymaintains that the project has been implemented in accordance with all applicable legislativeand policy requirements, includingthe Public Finance Management Act (PFMA), Municipal Finance Management Act (MFMA), Municipal SupplyChainManagement Regulations, the Informal Settlements Upgrading Programme Framework, and the conditionsattached to Human Settlements grant funding.

The municipality said appropriate governance structures were established to oversee implementation, including the appointment of the Professional Service Provider through approved procurement processes, project governance and reporting mechanisms, as well as continuous monitoring of project progress and expenditurebyofficials from both the municipality and the Department of Human Settlements.

It addedthat technical meetings, site inspections and stakeholder engagement sessions have been conducted throughout the implementation of the project

“The municipality further confirmsthat all expenditureincurred has been directed towardsachieving the approved project objectivesand is supported by workcompleted on site and certified through approved payment certificates,” the munici-

The municipalityalso said public participation remains afundamental requirement of the Informal Settlements Upgrading Programme.

It saiditrecognises the importance of ensuring that communities areinformed and actively involved throughout the implementation process.

“Sincethe inception of the project, stakeholder engagement has taken place through community meetings, technical project meetings, site visits and ongoing consultation with both the Project Steering Committee and Thornham Board members,” the municipality said.

The municipality indicated that although the project has experienced delays, it has not been abandoned.

It said the delays were due to circumstances beyond the contractor’s control, namely:

• Abnormal weather conditions: Recent heavyrainfall resultedinthe loss of 20 working days,assiteconditions were unsuitable forconstruction

Rockexcavation:Duringexcavationforthe conservancytanks, hardrock wasencounteredapproximately400 mm belowground level. Excavation to the required depthof approximately2.2 metres required heavymachinery and additional excavation work that wasnot includedinthe original construction programme. This resultedinanadditional 19 working days

• Variation in earthworks: Additional earthworksrequiredduringimplementation resulted in afurther 23 working days being added to the construction programme

The municipality said thesedelays have been communicated to the community throughout the implementation of the project.

As aresult, the municipality approved an extension of time for the contractor, with the revised project completion date being 30 September.

The municipality further said a copy of the extension approval was provided to Thornham Board members for theirinformation.

“The Sarah Baartman District Municipalityremains committed to implementing the Thornham Informal Settlement Upgrade Project in atransparent,accountable and responsiblemanner. The municipalitycontinues to monitor the project closely to ensure itssuccessful completion and remains committed to delivering the agreed infrastructure and improved municipal services to the residentsofThornham,” the municipality said.

The municipality also encouraged community members to obtain project information through established stakeholder engagement structures to ensure that concerns are addressed through factual and constructive dialogue.

REPRESENTATIVES of two of Kouga's long-serving animal welfare organisations have expressedtheir heartfelt gratitude after Kouga Local Municipality approved long-term right-to-use agreements, securing the futureofthe vital services they provide to animals and communities across the region.

As previously reported, at aSpecial Councilmeeting on 27 July, Council granted final approvalfor Jeffreys Bay Animal Rescuetocontinue occupying aportion of Erf 8783,Jeffreys Bay, and for SPCA Assisito continue operating from aportion of Erf 499, Humansdorp.

According to the municipality, both organisations have been awarded right-to-use agreements for aperiod of nineyears, 11 months.

Kouga Executive MayorHattingh Bornman said Council recognises the invaluablerole that animal welfare organisations play in supporting both animals and residents “Animal welfare is about farmore than caring for animals. These organisations provide an essential community service by preventing cruelty, promoting responsible pet

ownership and supporting many vulnerable families who would otherwisebeunable to access assistance for their animals,”said Bornman.

Jessie Naude of JBay Animal Rescue Sanctuary said that since the early 2000s,they have been working in the townships,conducting outreach in Pellsrus and Ocean View.

She said that at the timethey could not keep up with the demand in the area and were not able to sterilise as many animals as they knew they needed to, to make adifference.

Naude said they saw avacant piece of land and approached Kouga

Municipality, and after ayear of negotiations,they secured afive-year lease.

“We built kennels, aconsult room, reception area and asurgery.Since then, we haveaddeda laundry and six more kennels and extended our cattery,” said Naude.

She said they had been waiting in anticipationfor thisrenewed lease and now that it has been confirmed, they feel blessed that theirprayers were answered.

Naude said the sanctuary relies on fundsgenerated through theircharity shoplocated at 22 Jeffrey Street,

Drommedaris Building, and various fundraising initiatives, which have allowed them to continue expanding the facility.

She said the sanctuary has aregistered veterinarian, Dr Shannon Theobald, who is at the clinic once a week, where she sterilises and treats at least 25 animals.

Naude further thanked theiradditional staff members, Annelize Meyer, Lindelwa Dyan (general worker), Vusi Singatha (field worker), Siyabonga January (field worker)and Bernadine Claassen (receptionist).

She also thanked the community, everyonewho supported the sanctuary, as well as theirvolunteers.

“We wouldn't be here without them andwehope to be here for a very long time to come, helping the animals in need,” said Naude.

Louise Bakkes of SPCA Assisi thanked KougaMunicipality and Bornman for granting SPCA Assisi a long-term lease agreement for their facility
