Electric scooters have become more pertinent for some pedestrians across the province. Now they are slowly but surely becoming mainstays in Hermanus. But what does the law say about these modes of transport locally and what regulations are they guided by?
In correspondence with Hermanus Times Overstrand municipal manager Dr Dean O’Neill said there was “no comprehensive national regulatory framework [in place] that specifically governs the use of e-scooters.
“However, the provisions of the National Road Traffic Act, 1996 (Act 93 of 1996) and the National Road Traffic Regulations may apply where an e-scooter falls within the statutory definition of a ‘motor vehicle’.
“In such instances the applicable provi-
sions of the Act and regulations may be enforced.”
E-scooters have been praised for offering an alternative to regular motor-vehicle transport for various reasons such as convenience, cost-effectiveness and eco-friendliness.
However, according to global research, the rapid growth of e-scooters has created new challenges and safety concerns in many cities around the world. Especially when e-scooters share pavements with pedestrains.
Taking to social media, concerned residents have noted how the small wheels of e-scooters “can be unstable on uneven surfaces and collisions with walkers – particularly children and elderly people – can result in serious injuries”.
Such was the case in Sea Point when one resident had to undergo knee surgery after being struck by an electric scooter, according to an article by 2 Oceans Vibe
For now Hermanus residents and visitors are urged to ride responsibly, respect pedestrians and stay alert to any future regulations that may provide clearer guidance on where electric scooters may legally be used.
Meanwhile, in South Africa “the regulation of e-scooters remains a developing area of law”, according to O’Neill.
According to the National Road Traffic Regulations “, ‘motor vehicles’ means any self-propelled vehicle and includes a vehicle having pedals, an engine or an electric motor as an integral part of it or attached to it.
Also, it is designed or adapted to be propelled by means of such pedals, engine or motor, or both such pedals and engine or motor.”
However, these do not include “any vehicle propelled by electrical power derived from storage batteries and which is controlled by a pedestrian”.
This furthermore blurs the line on how e-scooters in the Overstrand may be regulated.
“Given the legal complexities and the evolving regulatory environment,” said O’Neill, “the Overstrand Municipality is in the process of obtaining a formal legal opinion from its Legal Services Department regarding the use of e-scooters and the concerns that have been raised.” He added that “until this process has been concluded the Overstrand Municipality is not in a position to comment further on the interpretation or application of the legislation.”

The difference between life and death can come down to seconds - and knowing where to find a pink rescue buoy.
Two young men proved exactly that when their decisive actions helped rescue a person from the water.
The successful rescue took place at Betty's Bay Main Beach on 13 July.
Three young surfers had been surfing when they unexpectedly got caught in a rip current. Two of them managed to break free while the third surfer did not.
"Two managed to break free and return safely to shore, but the third surfer was unable to escape the powerful current and was swept further out to sea," says the National Sea Rescue Institute (NSRI).
"Without hesitation, his friends ran to the nearest pink rescue buoy, removed it from its post and one of them swam the buoy out to the surfer in distress."
He then used the buoy to "provide vital flotation and support" assisting the surfer in danger safely back to shore.
The NSRI Station 42 Kleinmond commander, Schalk Boonzaaier received a report from a Betty's Bay resident who told them of the successful rescue.
The rescue marks the 263rd known life saved through the NSRI's Pink Rescue Buoy Programme. The programme places easy-to-spot flotation devices strategically along the water to offer immediate support in emergencies which helps the public assist those in distress while keep
ing themselves safe in the process.
NSRI has commended the quick-thinking young men for their courage and decisive actions that ultimately saved a life.
"Their calm response and correct use of the pink rescue buoy undoubtedly contributed to a successful rescue," says the NSRI.
"The life-saving impact of these flotation devices and the importance of having them readily available at beaches and inland waterways across South Africa" will now be a priority and continue saving lives of beach lovers and surfers in distress.
The Theewaterskloof Municipality is in mourning following the death of one of its employees, Donovan Petersen, who was killed in a freak accident while on duty on Wednesday (16 July).
Petersen, a refuse collection worker attached to the municipality's waste management team, was involved in an incident which is still under investigation. Details of the accident remain limited, and the municipality has not yet released further information about the cause.
According to reports the municipality's director of community services, Wilfred
Solomons-Johannes, received a call about the accident while travelling and immediately turned back to the scene. Upon arrival, he rendered emergency assistance, stabilising Petersen before handing him over to paramedics.
"With hope in my heart, I continued with my official duties, only to receive the heartbreaking news shortly thereafter that he had passed away," Solomons-Johannes said. He described Petersen as a humble, respectful and dedicated staff member who carried out his duties with professionalism and kindness.

Executive Mayor Lincoln de Bruyn also paid tribute to Petersen, extending condolences on behalf of Council and the broader Theewaterskloof community.

Theewaterskloof, I extend our heartfelt condolences and assure all who loved and knew him that they remain in our thoughts and prayers during this difficult time," Mayor de Bruyn said." His passing is deeply felt across our organisation. We stand in solidarity with his loved ones and our employees as we mourn this loss together. May his soul rest in peace."
The circumstances surrounding the accident remain under investigation.

The Overstrand is producing world-class boxing talent - and the Overstrand Whale Boxing Club (OWBC) has just delivered one of its most outstanding weeks. Three athletes made their mark at the South African Youth and Elite National Boxing Championships (SANABO) National Championships.
The 2026 SANABO National Boxing Championships were held from 8 July 8 to 11 July in Kuils River.
Leading the charge was Sihle Mjongile, who delivered a superb performance to win gold in the Elite 51 kg division - and was then named Best Elite Male Boxer of the Championships, one of the highest individual honours of the event. It is a result that puts Hermanus firmly on the national boxing map and marks Mjongile as one of the country's most exciting young fighters.
With this remarkable achievement, Mjongile also secured his place in the Commonwealth Games team. The 2026 Commonwealth Games in Glasgow, Scotland, are taking place from 23 July to 2 August.
The 11-day event will feature 10 sports and six Para sports held across four iconic venues in the city, including the Scottish Event Campus (SEC) and the OVO Hydro.
Mjongile is very excited about the opportunity and says he believes he will make South Africa and Hermanus proud.

Dít is die woorde van Rodney Nissen, wat tans die Caledon-rugbyklub bystaan om op ’n jare lange tradisie voort te bou.
“Ek dink die Caledon-rugbyklub is die enigste rugbyklub in die Overberg wat met sy eie klubhuis pronk en ons as klub het besluit om die klubhuis op te knap,” het Nissen gesê.
“Ons het dit in fases opgedeel en met die ondersteuning van die gemeenskap is die projek besig om alle verwagtinge te oortref.”
Volgens Nissen het hulle die opknapping in vyf fases opgedeel met die kroeg-gedeelte wat hulle as fase 1 in ’n kleedkamer omgeskep het. “Die Theewaterskloof-munisipaliteit is besig om die pawiljoen op te knap. Tans is hulle besig met die dak, maar met dié opknapping het ons kleedkamers in die slag gebly. Daarom het ons besluit om die kroeggedeelte in kleedkamers te veran der,” het Nissen gesê. Hermanus Times het al berig oor die haglike toestand waarin die Caledon-sportterein is asook die Theewaterskloof-munisipaliteit wat beloof het om die pawiljoen op te knap. “Só byvoorbeeld het iemand vir ons al die elektriese bedra ding geskenk én dit kom installeer.
“Ons wil ook graag ons waardering uitspreek teenoor Joshua Hendricks, die eienaar van Third Generation Investments (Edms.) Bpk., vir sy ruim bydrae tot die herstel van ons klubhuis, het Nissen die klub se dank oorgedra.
“Joshua het as ’n derde-generasie-entrepreneur besluit om in die gemeenskap terug te ploeg deur die klub te onder steun. Hy het die houtbalke en verwante boumateriaal vir ’n groot gedeelte van die hoofdak van die klubhuis geskenk.”
Volgens Joshua is dit die regte ding om te doen aangesien hy self ’n sportman is en sy oupa, pa en ooms vir die Caledon-rugbyklub gespeel het.
Okuhle Gqadushe also performed strongly, winning silver in her Elite division, while Kolunga Ndleleni competed well in the Youth division, winning his opening fight and contributing to the club's solid team showing

The successes are a testament to the dedication of Head Coach Mzi Damesi and the club's long-term commitment to developing talented boxers from Zwelihle and the broader Overstrand. OWBC is also entering an exciting new chapter off the canvas, with the formation of a new governing board aimed at strengthening governance, partnerships and opportunities for its athletes. Through a partnership with international boxing apparel brand BOXRAW and its "Boxing is Love" community programmes, the club has already received valuable kit support for its boxers — building strategic partnerships that create greater opportunities for athletes from Zwelihle and the Overstrand.These achievements show what is possible through committed coaching, athlete determination, strong community roots and meaningful partnerships.
The success of Sihle, Okuhle, Kolunga and the rest of the team is proof that talent from Zwelihle can reach the highest levels of the sport.For the young people of Hermanus and the Overstrand, the message is clear: the ring is open, the talent is real, and the world is watching.
