Suspension pending High Court ruling

A
controversial 45-year lease agreement for the De Mond Caravan Park property in Overstrand has been effectively suspended following a High Court challenge, forcing the municipality to implement temporary measures while legal proceedings continue. At the Overstrand Municipal Council meeting on 25 March, councillors approved a 15-month temporary lease to Point Caravan Resort (Pty) Ltd, the company that won the original tender but cannot proceed with planned developments due to ongoing litigation. “The property is currently under a valid long-term lease agreement with a private developer. However, the project has effectively been ‘placed on hold’ due to a High Court challenge,” confirmed Dr Dean O’Neill, Municipal Manager of the Overstrand.

COURT CHALLENGE HALTS PROGRESS The legal dispute began in December 2024 when Ms E. de Kock, a private individual, launched a High Court application seeking to set aside and cancel both the tender award and the lease agreement. The matter is now sub judice, meaning under judicial consideration. The challenge has created significant uncertainty about the development. “Because the developer’s right to the property is being challenged in court it cannot reasonably be expected to spend millions on construction until the court makes a final ruling,” O’Neill explained.
As a result, the municipality has granted the developer “relief”, pausing certain compliance deadlines until the legal uncertainty is resolved. The agreed monthly rent of R117 735,80 (including VAT) has also been postponed for one year from July 2026, with the developer instead paying a reduced amount based on actual income from existing sub-tenants and operational expenses.
SECURITY AND MAINTENANCE DISPUTES The lease agreement, signed in July 2024, places “full responsibility” for the property on Point Caravan Resort, including security and maintenance obligations. However, the company has faced community resistance when attempting to address safety concerns. According to the municipal report the developer has encountered complaints from some community members when trying to clear areas for safety-and-security purposes. The municipality supports the clearing activities as necessary to reduce fire risks and improve security sightlines, despite public pushback. The developer is also legally responsible for preventing illegal occupation of the property and managing vagrant issues, responsibilities that have proven challenging amid this uncertainty. ONGOING OPERATIONS Despite the legal uncertainty, Point Caravan Resort continues to manage existing sub-leases on the property, including De Vette Mossel and Klein River Lagoon Park. To page 3.
