Learner is distraught ‘Attack’ from fellow learners upsets family Ishmael Mabena

family has been left distraught after their son was allegedly beaten and left unconscious by more than 20 male learners at Gansbaai Academia. Now his family is questioning the school’s response after they were left with no solid answers.

A Grade 10 learner at Gansbaai Academia was attacked allegedly by a group of male learners on the school premises on Wednesday 9 September. The assault allegedly took place during an interval. According to his family he was playing a game of “touchies” with friends when allegedly approached by another pupil and told to go to the fence where someone wanted to speak to him. They said his refusal is when the assault began. According to the victim one of his alleged attackers was a classmate while the others were “in Grade 9”, and the assault continued as he called for help. He was left unconscious for about 15 to 20 minutes, according to his aunt. “His school uniform was torn in the incident,” she said in correspondence with Hermanus Times. “He suffered a concussion from the assault.” A MOTHER’S BROKEN HEART The victim’s family alleged neither an ambulance nor police were called following the incident. Instead, the school contacted his mother and asked her to collect him. According to the mother, a single parent with a visual disability, the news left her tempo-

rarily blind from shock. “My heart is broken. My son doesn’t have a father in his life. I am a single mother with an eye condition.” Moreover, a medical assessment subsequently found the victim had suffered a concussion. He was further advised to stay away from physical sport for at least six weeks. DIFFERENT ACCOUNTS OF EVENTS Hermanus Times reached out to the Western Cape Education Department (WCED), which responded to questions on behalf of the school. Bronagh Hammond, media liason for the WCED, said that the school was made aware of the incident when the incident was brought to the regional school office. Furthermore, information was reportedly received from other learners about an altercation in the school grounds. “School management immediately attended to the learner and initiated an investigation into the circumstances surrounding the incident,” Hammond said. She said staff provided assistance to the learner and attempted to contact his parent using the contact details on record. When those attempts were unsuccessful, alternative channels were used to reach her. “The parent subsequently attended the school and was advised of the incident. The parent was also encouraged to seek medical assessment for the learner and to report the matter to the police should they wish to do so.” However, the department’s response does not specify whether an ambulance was called, emergency medical assistance was sought at the school or what

assistance was provided to the learner before his mother arrived. Moreover, the family alleged the teenager was first left on the field before being moved to reception, where he received no medical attention. A CALL FOR ACCOUNTABILITY AND ANSWERS The family later approached the school seeking answers and accountability. According to the family the principal declined to comment on the incident. They allege the principal let a teacher deal with the matter instead. The family said they asked the department to place the Grade 10 learner at another school for safety, but had not yet received a response. The WCED said the incident was reported to its Safe Schools Call Centre and the relevant Circuit Manager was informed. Hammond confirmed the learners alleged to have been involved had been identified and their parents requested to attend meetings with the school. “The matter is being investigated,” she said. The department added that, depending on the outcome of the investigation the school would take appropriate disciplinary action according to its Code of Conduct. “And applicable disciplinary procedures” including formal disciplinary proceedings will be held where warranted. De Mond park case withdrawn The proposed redevelopment of the former De Mond Caravan Park in Voëlklip can move into its next phase after a High Court application challenging the tender award and lease agreement was withdrawn on 29 August. The withdrawal clears the way for Point Caravan Resort (Pty) Ltd to proceed with the required town-planning applications for the site. "However, no development can proceed until the necessary planning approvals have been obtained and the required public-participation process has taken place," said the acting municipal manager of the Overstrand Municipality, Edward Jantjies. TWENTY MONTHS ON HOLD The legal challenge was launched in December 2024 by Ms E de Kock, who sought to have both the tender award and lease agreement set aside. The application remained a barrier to the development process for about 20 months, from December 2024 until its withdrawal in August 2026. "During that period, Point Caravan Resort could not be expected to incur development costs while the tender award and lease agreement were being challenged," Jantjies said. "The withdrawal now allows the company to take the next steps by submitting the relevant applications." A LONG-STANDING EYESORE The future of the site is being watched closely by Voëlklip residents. The property lies near the Klein River Lagoon Mouth and has stood vacant and neglected for

more than a decade,. The Caravan Park Association's lease expired in 2012 and about 200 families had been evicted by 2014. Since then, the property has frequently been targeted by vandals, vagrants and illegal occupiers. Residents have repeatedly complained about the derelict appearance of the site. Earlier efforts to secure a future for the property also failed. Atterbury Western Cape's 2010 tender was unsuccessful, while a lease signed with Crown Grant JV (Pohl Group) in March 2018 later lapsed after its suspensive conditions were not met. TENDER AND LEASE DETAILS The current tender was advertised on 29 July 2022 and awarded to Point Caravan Resort on 4 March 2024. A 45-year lease agreement was signed in July 2024 and approved by Council on 25 September 2024. The lease provides for a monthly rental of R117 735,80, incl VAT, and allows the lessee a two-year period to obtain the necessary approvals and start development. WHAT HAPPENS NEXT "The Municipality will provide information on the proposed development once the relevant applications have been received and the public-participation process has been initiated. The public will have an opportunity to comment. That process is triggered by the applications and must take place before any development can proceed. What may ultimately be developed will depend on the approvals obtained through the planning process," Jantjies concluded.

Local libraries tops in province The Overstrand is officially home to the province’s best libraries as Hermanus and Hawston public libraries won big at the Western Cape Cultural Affairs Awards. Hermanus Public Library took home two of the top honours at the awards ceremony held last night in Cape Town. It was named Public Library of the Year and received the Best Friends of the Public Library Award. The library beat Greyton, Kuyasa and Vermaaklikheid public libraries. Hawston Public Library was recognised for its service, taking home the award for Community Impact through Outreach. The award further highlights the impact of its work, services and programmes on the community it serves. Hawston Library beat Lindela Mjenxane and the Whitaker Peace Development Initiative, also nominated in the category. Overstrand Executive Mayor and avid reader Archie Klaas said the award wins reflected the work being done across the Overberg and Overstrand’s library network. “While we are celebrating a double win for Hermanus and Hawston this is a proud moment for all our libraries and staff,” he said of the 23rd edition of the Cultural Affairs Awards. “Our teams work closely together, sharing ideas and running joint programmes that benefit communities across Overstrand.”

Klaas was joined by Lizé Richter of Hermanus Library and Belinda May from Hawston Library who accepted the awards and received the certificates, respectively. They were also joined by Aron Gcotyelwa from the Community Services Directorate and Councillor Ronald Nutt, Mayco member for community services. CELEBRATING CULTURAL AFFAIRS The awards, held at the acclaimed Artscape Theatre, were hosted by the Western Cape Department of Cultural Affairs and Sport. The event celebrated and recognises the contributions made in the fields of arts, culture, language, heritage, libraries, museums and archives in the province. “Our arts, culture and heritage tell the story of who we are as a province,” said Provincial Minister of Cultural Affairs and Sport, Ricardo Mackenzie. “The Cultural Awards give us an opportunity to recognise the extraordinary people who have dedicated their lives to enriching the Western Cape. And [those] who have played an important role in shaping the story and history of our province.” He added that “those whose decades of work have left an enduring legacy” represent the richness and diversity of our cultural and creative sector. “We are proud to honour you and, importantly, to ensure your contributions are seen, celebrated and remembered.”

According to a family member a female student was recently assaulted in similar circumstances at the school. “[Gansbaai Academia] is a new school and since it opened, every year children are bullied, especially the boys from neighbouring towns.” There have also been reports of learners being subjected to intimidation and threats. The WCED had not confirmed these allegations. Asked whether incidents of learner violence were common in Overberg schools or specific to Gansbaai Academia, the department said conflicts between learners could occur at schools from time to time. “The school has an approved bullying and cyberbullying policy as well as a code of conduct for learners,” said the department, “which outline the school’s approach to preventing, reporting and addressing bullying, harassment, violence and related misconduct. The well-being and safety of learners remain the school’s primary concern.” Hermanus Times is currently awaiting the department’s response about the investigation and whether the school has any security or footage from the assault.

Cable thefts’ havoc on R65m investment Ishmael Mabena

Overstrand Municipality’s allocated capital budget of R65,1 million for electricity in 2026-’27 is in jeopardy from an ongoing spate of cable theft. In all, R20,1 million is allocated for upgrading or replacing electricity infrastructure across the region, for the scourge persists. Yet another incident of cable theft disrupted electricity supply in Voëlklip on Wednesday 9 September. Stolen overhead electrical lines during the night or early evening left parts of the suburb without power. Households in parts of 3rd and 4th Avenue as well as 4th and 5th streets were affected by stolen cables. Acting Overstrand Municipal Manager Edward Jantjies confirmed that the power was restored on Thursday evening. RECURRING INCIDENTS The incident comes after months of repeated theft and vandalising of electricity infrastructure across the Overstrand and wider Overberg. Hermanus Times previously reported on a growing pattern of attacks since May.

In May the municipality offered a R5 000 reward for information leading to arrests of people stealing cables and damaging infrastructure. Between 8 May and 15 June at least 16 separate incidents involving cable theft, vandalism and storm-related damage were recorded in various parts of the Overberg. These places include Fisherhaven, Hawston and the Hemel-en-Aarde Valley. The attacks continued into June, when copper conductors were stolen from Eskom infrastructure in Onrus, leaving Bosplasie residents without electricity. In July another theft affected residents in Fisherhaven, Vermont and Onrus River after two spans of copper conductor were stolen from the Hawston feeder. Eskom acting Cape Coastal cluster manager Promise Ntuli described copper theft as “a scourge that continues to undermine service delivery, damages critical infrastructure and puts lives at risk”.

FINANCIAL CONSEQUENCES In June Dean O’Neill, current Acting Municipal Manager of George Municipality, said material loss to Eskom infrastructure was estimated at about R1,43

million. This was in Fisherhaven and the Hemel-en-Aarde Valley alone, while municipal infrastructure losses in Hawston added another R1,2 million. “Combined, the material losses stand at roughly R2,63 million,” O’Neill said. He added that labour, transport, plant-hire and restoration costs could push the total financial impact to between R3,5 million and R4,5 million, with full network restoration potentially exceeding R6 million. O’Neill also warned the consequences extended well beyond the cost of replacing stolen infrastructure. “The impact reaches far beyond inconvenience.” He pointed to the impact on businesses forced to use generators, residents losing refrigerated food and learners left without light or internet access.

CALL FOR MORE VIGILANCE The municipality has urged residents, businesses and community organisations to remain vigilant and report suspicious activity involving theft, tampering with or vandalising infrastructure. They can be reported through the Collab Citizen App, the municipal Contact Centre on 028 313 8111 or Law Enforcement on 028 313 8996.

Sandbaai cameras boost security Sandbaai residents have gained an enhanced layer of security following the installation of Automatic Number Plate Recognition (ANPR) cameras by Fidelity ADT at key entry points into the suburb. The cameras, positioned at high-traffic locations, monitor vehicle movements in and out of the area and flag vehicles of interest against relevant databases in real time. They have been integrated into Fidelity ADT's existing ANPR and security camera network already covering Hermanus and surrounding areas, creating a wider surveillance footprint across the region. Marius Boshoff, Hermanus

Branch Manager for Fidelity ADT, said the camera at one of Sandbaai's main entrances provides an additional layer of security and valuable intelligence to support the company's proactive operations. "This high-traffic point allows us to maximise the opportunity to identify and flag vehicles of interest. By integrating these cameras into our existing network, we are able to build a broader picture of vehicle movements across Sandbaai and the wider Hermanus area," Boshoff said. The ANPR system uses intelligent analytics to capture images of passing vehicles and automatically identify registration numbers.

When a vehicle triggers an alert, operators at Fidelity ADT's 24-hour monitoring centre can assess the information and initiate an appropriate response in line with established security protocols. Boshoff said the technology forms part of a layered security approach that combines surveillance, intelligence, monitoring and rapid response capabilities to strengthen community protection. "This initiative forms part of Fidelity ADT's ongoing commitment to using technology, proactive security measures and effective response capabilities to protect the communities we serve," he concluded.

Is a seller liable to repair a leak? When a property is sold and transferred, disputes often arise if defects are discovered after occupation. A common example is a leaking roof following heavy rainfall, especially during our winters in Hermanus. The key issue is whether the defect is latent or patent. A latent defect is not visible or discoverable upon reasonable inspection and impairs the use or enjoyment of the property - such as leaking roofs, dampness or structural issues. A patent defect, by contrast, is visible during inspection and can be negotiated between the parties, either through repairs by the seller or a reduction in the purchase price. Liability typically arises in relation to latent defects. Under common

law, a seller may be held liable if: An express warranty is given that the property is free of defects, and this proves untrue (for example, stating the roof does not leak when it does), resulting in a breach of contract. The seller misrepresents the condition of the property, including failing to disclose known defects. In such cases, the purchaser may cancel the sale or claim a reduction in the

purchase price. Although many agreements include a voetstoots clause (meaning the property is sold “as is”), this does not protect a seller who knowingly conceals defects or makes misrepresentations. If applicable to the transaction, the Consumer Protection Act strengthens purchaser rights by requiring full disclosure of the property’s condition. Where the condition is clearly disclosed and accepted, implied warranties may fall away. However, sellers are strongly advised to disclose all defects to avoid disputes and potential liability. Like the dawn of the new season, there was something quietly magical about Spring Day at Camphill School Hermanus on Tuesday 1 September. Flowers, paint and camaraderie became tools for connection, creativity and learning.

AMAZING “Everything [for the event] was sponsored by donation in kind and we have the support of the community.” The event included making flower crowns, painting and activities designed to help learners and guests understand and regulate stress while encouraging them to see difference not as something to fear, but something to appreciate. Speaking to Fisher, Gillion noted how “amazing” the event was. Moreover, what makes the “people so unique is that we’re all part of the human race but vastly different in how we deal with and react to the things, people and situations” that we either care about or find ourselves in. This is according to Faye Graham, chief executive officer of I-Med Africa. The flower-crown activity was facilitated by Lilly Rose Florists, giving learners the opportunity to work with flowers and transform them into colourful crowns of their own creation. Lily Rose Florists also celebrated its one-year anniversary on the day. The remainder of the programme was facilitated by I.M. Africa. The activities created space for learners, staff and guests to explore emotions, stress, and the ways people experience the world differently. I.M. Africa is a community-driven organisation dedicated to promoting holistic health and well-being. The organisation helps

Established in 1952, Camphill School provides education and care to learners with special needs, continuing a philosophy rooted in dignity, respect and recognising the individual potential of every child. Although resources are quite thin and the school’s generations long tenure as one of the most recognised organisations for learners with disabilities, the day reminded staff and learners alike that they are a big part of the Overstrand. “We have so many businesses and people who really care about the school. I think sometimes it can feel like sources are spread thinner,” Fisher said adding that the school is always welcoming of

All “while developing sustainable project models” to achieve this. But perhaps most importantly for Camphill, the morning was made possible entirely through generosity. The school did not have to dip into its own pockets to fund the event. Instead, the costs were covered through donations, with sponsors joining the learners and staff to share in a day that placed inclusion, wellbeing and creativity at its centre. “We are always looking for donations and sponsors,” Fisher said. “So, it was really cool that we got help for the project from a number of businesses which we are grateful for. We do, however, need any monetary or service help or donations we can get. Every little way and anything goes a long way.”

The retiree who played it safe . . . The retiree who played it safe, and ran out of money. Retiring brings about a lot of changes: emotionally adjusting to life after work and a career, but also financially. Along with more time to spend on leisure activities the general assumption is that one requires less income in retirement. The one obvious expense that falls away is the monthly savings one was making towards retirement and hopefully mortgage or car payment should no longer be required as one should retire debt-free in an ideal world. The emotional change of no longer being able to contribute to your savings will reduce your tolerance for risk in your investments and make you cautious about assets that have price fluctuations (like equities/shares). Our hypothetical retiree (Ben), who played it safe, decided that he could live off the interest that he could earn in a money market fund. His capital would be 100% safe (not actually

guaranteed by the way) and he wouldn’t have to concern himself with local and global market movements. The key risk he faces, though, is inflation. Every person experiences their own inflation rate depending on the basket of goods they consume, but in Ben’s case let’s assume his inflation rate is the “average” South African’s, as published by Statistics SA. If Ben can live comfortably on R40 000 a month today in five years’ time (using the past five year’s inflation in SA) his expenses could be R50 982 per month and his constant interest income will not be enough to pay for that. By this point Ben will be drawing down on his capital sum and his interest income will therefore be falling too. This is a downward spiral. Although Ben feels that his biggest risk is volatility it is in fact inflation. The key priority of central banks is to try and keep inflation low. The US Federal Reserve has a dual mandate of promoting maximum em-

ployment and stable prices. The South African Reserve Bank (SARB) must “protect the value of the currency (the rand) in the interest of balanced and sustainable economic growth”. Although the SARB has announced that it is targeting 3% inflation, it will be a while before we experience that. The US Federal Reserve has not done well either, with inflation exceeding its 2% target for more than five years now. Inflation is therefore here to stay and something that a sustainable financial plan must take into consideration. Planning for longevity is vital, and although holding cash may feel safe it will not keep pace with inflation over long periods. A retirement portfolio needs to provide access to income, protect against short-term shocks and still offer enough growth to support you in the years ahead. You may need to take on more investment risk than you feel comfortable with to continue being comfortable in your retirement.

Stanford the winners . . . Overstrand senior clubs gather

he community hall in Stanford was alive with friendly rivalry, fellowship and the sharp click of dominoes on tiles recently as senior clubs from across the Overstrand gathered for the annual Overstrand Mayoral Dominoes Competition. Six teams battled it out for top honours, with Stanford Volvertroue defending their title in convincing fashion to claim first place for the second consecutive year. Hosts and two-time champions the Volvertroue were pushed hard all the way by Zwelihle, who finished as runners-up, while Mount Pleasant took third spot. The full line-up of competing teams was: Stanford Volvertroue (champions), Zwelihle (second), Mount Pleasant (third), Hawston Pearly Shells, Gansbaai Silwerjare and Hawston – Overberg Wheelchair Association. The competition, hosted by the Overstrand Municipality under the banner “Celebrating Our

Seniors, Building a Stronger Community” brings senior clubs from across the municipality together for a day of friendly competition and fellowship. The atmosphere reflected exactly that; warm camaraderie among old friends, generous applause for good plays and plenty of laughter between rounds. The Overstrand Wheelchair Association team from Hawston drew particular admiration from spectators for their skill and determination, proving dominoes is a game where sharp minds and steady hands matter far more than mobility. Stanford’s back-to-back victory cements the village’s reputation as a dominoes powerhouse in the Overstrand, but with Zwelihle closing the gap and Mount Pleasant showing steady improvement, next year’s contest promises to be keener than ever.
