Theappeals against the Environmental Authorisation (EA) for the development of Cape Winelands Airport, which was granted on 27 October last year, have been dismissed by the provincial minister of localgovernment, environmental affairs anddevelopment planning.

Anton Bredell signedhis decision last Thursday, statingthat he is satisfied that the information before the department was sufficienttoenable alawful and rational decision in termsofNEMAand the 2014 EnvironmentalImpact Assessment (EIA) Regulations.

Six appeals lodged

Of the approximately 1500 registered interested and affected parties, atotal of six appeals were lodged byLeonard Heydenrych, twopoultry farmers —one of which is CountyFair, GardenCities (a neighbouringdeveloper), aneighbouring airfield (Morningstar Flyers Association), and five airport tenants who jointlyappealed.

They are Cape Town FlightTraining Centre;Diepkloof Aircraft Maintenance; 4Aviators;Helivate HelicopterServices; and WCMSCCT/A AeroSport.

APPEALWITHDRAWN

Garden Cities's appeal was withdrawn prior to Bredell making his decision.

The grounds for appeal differ for each of the appellants and range from concerns about the impact of noise; impact on birdlife; impactoncontinued operations once theairport goes into construction; and socio-economicimpacts

Other grounds for appeal include sustainability and climate change, carbon emissions, and impact on traffic.

Alate appealwas received fromthe Darson Trust, trading as Aberfeldy Farm in Klipheuwel. In their appeal, they stated that they have already received approval for an environmental impact assessment (EIA)for new poultry houses to expand their operationontheir farm Kliprug, which is adjacent to the land on whichthe airportisproposed.

'PUBLICPARTICIPATIONWASADEQUATE'

Bredell statedinhis decision: "I am further satisfied that the key environmental, social, andeconomic impacts were adequatelyidentified, assessed,and considered; that the public participation process was adequate in the circumstances; that no matter material to the environmental decisionwas impermissiblydeferred; andthatthe conditions of the EAand the approved Environmental Management Programme (EMP) provide forthe mitigation andmanagement of the identified impacts."

"In arriving at my decisiononthe appeal, itshould be noted thatIhave not responded to each andevery statement setout inthe grounds of Appealand/ or Responding Statement, andwhere aparticular statement is not directly addressed,the absence of anyresponse shouldnot be interpreted to mean that Iagree with or abide by the statement made," he said.

Bredell exercised his decision-making powers in making this decisionand is now functus officio in this regard meaningthathehas completed the dutiesassigned to him andnolonger holds any official authority or power to alter, reconsider, or reopen the matter.

my decision, is to apply to the Western Cape High Court to review my decision," he said.

"The approval of the EA marked a majormilestone in the progression of the Cape Winelands Airport expansion project and followed an extensive environmentalassessment and consultation process undertaken in full compliance with the National Environmental Management Act(NEMA).

Die Dullah Omar-instituut en die Universiteit van Kaapstad se Navorsingseenheid vir Digitale Regering (DGRU) aan dieUniversiteitvan Kaapstad het356 afsonderlikehofsake ontleed. Dienavorsing het patrone uitgelig wat ernstige vraelaat ontstaan oordie doeltreffendheid vandie strafregstelselindie hantering vanekonomiese misdade.

Een van diekommerwekkendste bevindings wat uit die datanavore gekomhet, is dat handelshof-aanklaers oënskynlik die pad van dieminste weerstandkies deur sake met hoë kanseop skuldigbevindings tekies, terwyl hulleingewikkelde, meer riskante sake vermy.

Van die R2,2 miljard aan beweerde verliese in die 356 afsonderlike sake, isslegs R6,8 miljoen deur vergoedingsbevele en R8,1 miljoen deur verbeurdverklaringsbevele verhaal.

Michael O’Donovan, die data-analis vir die projek, het beklemtoon datdie gekombineerde boetes, vergoeding, verbeurdverklarings en boetes aandie Suid-AfrikaanseInkomstediens slegs sowat 1,7% van diealgehele waardes uitmaak. Sy het geargumenteer datdie NPA te laat by die projek betrek is en dat diemetodologie en gevolgtrekkings diegevaar loopom’nskewebeeld van aanklaers te gee

Kanyanehet beklemtoon datdie onttrekkingvan sake ’n dieper ontleding benodig, aangesien daar ’n verskil is tussen voorlopige en finale onttrekkingsensake wat weer geregistreer kanword.Syhet ook geargumenteer dat die verslag dierol van ander rolspelers in dieregstelsel,soos die regbank, verdediging, hofadministrasie endie polisie, in vertragings en onttrekking van sake onderskat.

“Die studiekyk nie diep genoeg na die redes vir uitstelle en stelselwye oorsakenie,” het Kanyane gesê. Sy hetdaarop gewys dat dieverantwoordelikheid vir vertragings oor diehele stelsel versprei is en dat ditonregverdig is om slegs aanklaers te blameer.

Die navorsingspan het egter erken dat diebevindings nie diefinale woord oor die saak is nie, maar eerder ’n beginpuntvir ’n breër gesprek oor hervorming.

Verskeie aanbevelings is gemaak, insluitend die hersiening van prestasieaanwysers om nie net skuldigbevindingkoerse in te sluit nie, maar ook die deurvloei en gehalte vansake te meet.

Die navorsers het ook voorgestel dat ’n gedeelde definisie vanwat ’n “komplekse”saakuitmaak, ontwikkel moet word, endat hervorming van hoe sake bestuur word,dringend benodig word.

Die seminaar het ook dierol van die Geïntegreerde Sakebestuurstelsel (ICMS) ondersoek, wat volgens verskeie deelnemers onbetroubaar is en teenstrydighedemet hofrekordsbevat.

Terwyl die debatoor diebevindinge sal voortduur, bly een feit volgens die navorsers onbetwisbaar –die huidige stelsel slaag nie daarin om komplekse ekonomiese misdade doeltreffend te vervolg ofomdie miljarde randewat verloregaan, te verhaal nie.

Of die “stille ineenstorting”gekeer kanword,hang volgens dieaanwesiges af vandie bereidheid van alle rolspelers om betekenisvolle hervormings te aanvaar.

At the Athletics South Africa All Age Groups Championships held in Germiston on Thursday 26 March, the Grade 11 learner produced a100m sprint time that left officials, coaches and spectators in awe as he crossed the line in 10.31 seconds. Parents whose childrenwere not offeredplacements at their preferred schools for the 2027 academic year are beingurged to remain patient, as the Western Cape Education Department (WCED) saysthe admissions process is still in its early stages and many placements are expected to change in the coming weeks.

The outcomes of on-time online admissions applications for Grade R, Grade 1and Grade8 learners were made available on the WCED's online admissions system last week

While many parents have already receivedplacement offers, othershave expressed disappointment after their childrenwere eithernot offered aplace at any of the schools they appliedtoorwere placed at schools that were not their first choice. Respondingtoa Paarl Post's enquiry this week, WCED spokesperson Bronagh Hammond said parents should not lose hope, as movementin placements is expected as families begin accepting anddeclining offers.

"We understand that there will be parents who are disappointed, as theydid not receive offers of placement or an

offer from theirfirst choice of school. We are still very early inthe process,and we appeal to parents forpatience andunderstanding as the processcontinues."

According to Hammond, schools determinethe outcome of admissions applications in linewith theirown admissions policies.

"The Western Cape Education Department (WCED) does not determinethe outcome of applications to aschool,"she explained

Oneofthe factors affecting placement availability is that many learnersreceive offers from morethan one school. Hammond says that at the stage when admissionsoutcomes are firstreleased, asubstantial number of learners areeffectively occupying multipleplaces on the system.

"For example,last year, over 40 000 learners had multiple successfuloutcomesatvarious schools andwereinitially 'doubleparked'onthe system. This means that while aparent may initiallysee that their child has not been successfulataparticular school, manyplaces arein fact stilltemporarily occupied by learnersholding multiple offers."

Parentshave until 15 June to

confirm their school choices, but the departmentisencouraging them to do so as soon as possible.

"Assoonasparents begin confirming their choice of offers, this frees up additional places which canthen be offered to others," Hammondadded.

She emphasised that the admissions process does not end with the initial release of results andthatsignificant movement in placements usuallyfollowsin the days andweeks thereafter.

"Many learners who are initially unsuccessful do receive placement shortly afterwards," Hammondexplained, adding that schools willcontact parents directlywhen spaces become available

Those whosechildren have notyet been placed are advised to remain engaged with the schools they applied to and ensure thattheir contact details on the system are up to date.

"We ask for your patience andunderstanding during this phase. The departmentisclosely monitoring the process and remains committed to ensuring that every learner is placed," Hammondsaid.

She added that further communication andsupport will be provided as the admissions process continues.
