LOOKING FOR NEW LEADERSHIP With new leadership come new possibilities. We all know the housing market is constantly changing and those changes bring the challenge to adapt new ideas and plans, not only in your business but, in the Associations business. It is an honor and a privilege to serve as an officer, board member, committee chair, as well as a committee member. I would like to ask the membership to support our association by stepping up to the next level. Nominations are now being taken for the North Coast Building Industry Association Board of Directors that need to be filled (commitment beginning January 1, 2019). There are only six board meetings a year: January, March, May, July, September & November. Don’t be afraid to nominate yourself! There are also National Director and State Trustee positions available to fill:

Catherine Squillace Catherine L. Squillace, 69, of Gahanna, Ohio, passed away on August 12, 2018 after a courageous battle with endometrial cancer. She was preceded in death by her mother Grace Dickinson, her brother Jeff Dickinson, grandparents Eva and Harold Dickinson, and Harry and Theresa Griffin. She is survived by her father, Joseph (Mary Margaret) Dickinson; husband of 46 years, Vincent Squillace II; children, Vincent (Jennifer) Squillace III, Marci (Sam) Ewing, Beth (Todd) Sheraw; and most precious grandchildren, Ellie, Connor, Evelyn, Gianna, Vincent IV, and Leonardo. She was a compassionate, dedicated teacher at Gahanna Middle School West, Whitehall Yearling High School, and Stonybrook Early Learning Center. One of her proudest accomplishments after retirement was achieving a brown belt in Tae Kwon Do from Darimar Martial Arts. What brought her greatest joy was spending time with family, spoiling her grandchildren, and visiting Charlevoix, Michigan. We give special thanks to Dr. Reid, Dr. Rath, and their staff, and the empathetic, committed, and loving staff at The Bing Infusion Center and Riverside Yellow 7. AMT Changes Made in the Tax Cuts and Jobs Act

law and under the TCJA alternative minimum tax rules that apply for 2018-2025.

BY DAVID LOGAN As tax reform negotiations pressed forward last year, there were high hopes that the dreaded individual alternative minimum tax (AMT) would be repealed. While the corporate AMT was abolished permanently, unfortunately, the individual AMT still exists under the Tax Cuts and Jobs Act (TCJA). However, the AMT rules are now more taxpayer-friendly, and other changes to the tax code reduce the odds that you will owe the AMT while the changes are in effect (i.e. tax years 2018 through 2025). More than five million taxpayers owed the AMT according to the most recent IRS statistics. Under the new tax law, this number is expected to fall to somewhere between 200,000 (Tax Policy Center) and 500,000 (Joint Committee on Taxation). This post provides an overview of: • features of the AMT, • how it is calculated, • changes made by the TCJA, and • risk factors that increase the chances of owing the AMT. It concludes with an example of how to calculate the AMT under prior and TCJA law.

No matter the source(s), high income can cause the benefit of the AMT exemption to be partly or completely phased out. This increases your AMT income, which in turn increases the odds of owing the AMT. 2. Large itemized SALT deductions You could usually fully deduct state and local taxes (SALT) paid under the prior-law regular federal income tax rules (if itemizing), but they were disallowed under the AMT rules. 3. “Too many” personal and dependent exemptions

Introduction to the AMT The AMT is a tax system wholly separate from the one used to calculate regular federal income tax liability. The main difference is that more—sometimes much more—of a taxpayer’s income is taxable under AMT rules. This is because the amount of AMT owed is determined using one’s “AMT income.” This post provides an overview of: • certain types of income that are tax-free under the regular tax system, and • the amount of itemized deductions, in dollar terms, that are disallowed under AMT rules. This more than offsets the fact that the maximum AMT rate is 28 percent in contrast with the 39.6 percent and 37 percent maximum rates under prior law and the TCJA, respectively. In addition, the minimum tax rate under AMT rules is 26 percent while the minimum rates under prior law and the TCJA are both 10 percent. When calculating AMT income, taxpayers are allowed an AMT exemption which is deducted and phased out as AMT income surpasses the applicable threshold. As of 2018, however, the exemption amount increased from $84,500 to $109,400 (married filing jointly). The applicable threshold at which the exemption is phased out was also raised—from $160,900 in 2017 to $1 million for 2018-2025. If your alternative minimum tax bill is greater than your regular tax bill, you owe the higher AMT amount. Technically, the AMT liability is the difference between the tax calculated under the AMT rules and the lower regular tax amount. For simplicity’s sake, however, we will refer to the entire amount calculated under the AMT rules as the AMT liability.

Under the AMT rules, these deductions are completely disallowed. However, personal and dependent exemption deductions are eliminated under the new law, so this will not be a risk factor again until 2026. 4. Significant miscellaneous itemized deductions Under prior law, these could include investment expenses, fees for tax advice and preparation, and unreimbursed employee business expenses. You could write these off for regular tax purposes, but they were completely disallowed under the AMT rules. 5. Interest income from private activity bonds This interest is tax-free for regular tax purposes but taxable under the AMT rules. 6. Deductions for home equity loan interest Under prior law, you could deduct interest on up to $100,000 of home equity loan balances. But under the AMT rules, you could only deduct this interest to the extent you used the loan proceeds to acquire or improve your first or second residence. Although, the TCJA suspended this deduction, home owners may still deduct interest on HELOCs as long as your original mortgage balance and the balance of your HELOC are under the mortgage interest deduction cap. If these balances exceed the cap (now $750,000), you may only deduct the share of interest payments equal to $750,000 divided by your initial mortgage and HELOC balances (i.e. if your original mortgage and HELOC balances were $1 million, you could deduct 75 percent of your interest payments). 7. Claiming the standard deduction

Past and present AMT risk factors One of the biggest criticisms of the AMT has always been its complexity. So, it is no surprise that numerous interacting factors make it difficult to say exactly who will be hit by the new AMT and who will not. Here are some common signs that you may owe the AMT under prior page 6

1. High income

Standard deductions allowed under the regular tax rules are completely disallowed under the AMT rules. Because the TCJA nearly doubled the standard deduction, this risk has increased. For 2018-2015, the new law almost doubles standard deduction

amounts. So, the TCJA increases this risk factor. Example The following example illustrates how results may differ under the prior-law AMT rules and under the TCJA’s new rules for 2018-2025. In 2017, a married couple filing jointly claimed itemized deductions totaling $50,000, half of which were for state and local income and property taxes. The couple’s income and deductions as well as the calculation of their regular tax and AMT liabilities are below:

TCJA’s more generous exemption amount, which makes their AMT liability actually less than what they owe under the new tax code. As the taxpayer must pay the higher of the two amounts, they pay their regular tax liability of $55,059, or $6,712 less than they would have owed in years past. Conclusion Although the TCJA greatly reduces the odds that you will owe the AMT for 2018-2015, do not assume that you are now exempt. This is especially true if some of the AMT risk factors that remain under the new law apply to you. Not paying the AMT if you owe it will result in underpayment and therefore back taxes, interest, and possible penalties. If you are one of the 200,000 taxpayers that still owes the alternative minimum tax under the new law, there is still reason to be optimistic. Although you may owe the AMT under the new rules, you likely owe less (potentially much less) than you did under the old rules. Talk with your tax professional to figure out if you are still hit by the new and improved (albeit temporary) AMT. Hopefully you can work together to reduce any liability you may owe. Builders Discuss Rising Lumber Prices with Commerce Secretary Ross NAHB Chairman Randy Noel, CEO Jerry Howard and senior staff met today with Commerce Secretary Wilbur Ross to discuss the growing problem of escalating lumber prices that are being exacerbated by tariffs on Canadian lumber imports into the U.S. Following the meeting, Noel issued the following statement: “Today, we discussed with Secretary Ross our mutual concern that lumber prices have risen sharply higher than the tariff rate would indicate, and that this is hurting housing affordability in markets across the nation. Rising lumber prices have increased the price of an average single-family home by nearly $9,000 and added more than $3,000 to the price of the average multifamily unit.

In this case, the couple would have paid AMT in prior years because their exemption was partially phased out as they were above the income threshold. This resulted in their AMT liability being higher than their regular tax liability. Under the TCJA rules, however, these issues no longer affect the couple. Their AMT income of nearly $300,000 is well below the new phase-out threshold of $1 million. Thus, they get the full benefit of the July-August 2018

Remodeling Confidence Increases Despite Rising Costs

Housing Share of GDP: First Quarter of 2018 With the release of the final estimate of first quarter 2018 GDP growth (2% growth rate), housing’s share of gross domestic product (GDP) declined slightly to 15.3%. The home building and remodeling component – residential fixed investment – held steady at 3.5%.

The Remodeling Market Index (RMI) rose one point to 58 in the second quarter of 2018, according to the National Association of Home Builders (NAHB). A RMI reading above 50 indicates that more remodelers report market activity is higher than report it is lower compared to the prior quarter. The RMI has been above 50 for 21 consecutive quarters (Figure 1).

Housing-related activities contribute to GDP in two basic ways. The first is through residential fixed investment (RFI). RFI is effectively the measure of the home building, multifamily development, and remodeling contributions to GDP. It includes construction of new single-family and multifamily structures, residential remodeling, production of manufactured homes and brokers’ fees. For the first quarter, RFI was 3.5% of the economy, reaching a $603 billion seasonally adjusted annual pace (measured in inflation adjusted 2009 dollars). The second impact of housing on GDP is the measure of housing services, which includes gross rents (including utilities) paid by renters, and owners’ imputed rent (an estimate of how much it would cost to rent owner-occupied units) and utility payments. The inclusion of owners’ imputed rent is necessary from a national income accounting approach, because without this measure, increases in homeownership would result in declines for GDP. For the first quarter, housing services was 11.8% of the economy or $2.06 trillion on seasonally adjusted annual basis. Taken together, housing’s share of GDP was 15.3% for the quarter. Historically, RFI has averaged roughly 5% of GDP while housing services have averaged between 12% and 13%, for a combined 17% to 18% of GDP. These shares tend to vary over the business cycle.

The RMI is a composite measure of current market conditions and future market indicators. In the second quarter, current market conditions decreased one point to 57. Among its three major components, major additions and alterations waned one point to 55, minor additions and alterations decreased two points to 58, and the home maintenance and repair component rose two points to 59. Meanwhile, future market indicators gained four points to 59 in the second quarter. Among its components, calls for bids fell two points to 55, amount of work committed for the next three months increased two points to 56, the backlog of remodeling jobs jumped nine points to 66 and appointments for proposals rose seven points to 61. The increase in this quarter’s RMI reflects a strong remodeling industry supported by continued economic growth. Congress Reauthorizes Perkins CTE Act The House and Senate this week voted to reauthorize the Carl D. Perkins Career and Technical Education (CTE) Act.

Kavanaugh and Homebuilding: What the Record Shows

Last reauthorized in 2006, the program provides grants to states to fund vocational programs for high school and college students. The bill now heads to the president’s desk for signing. As the demand for new housing grows, so does the demand for qualified individuals to fill positions at all levels of the building process. Ensuring state and local CTE programs are aligned with soughtafter jobs is critical to developing the skilled workforce the home building industry greatly needs and to energizing more students to pursue a career education track. By improving federally supported CTE programs to align training with jobs in critical industries and promoting partnerships between employers and educators, the bill will provide students better exposure to career opportunities in the construction trades. NAHB, through its workforce development arm, the Home Builders Institute (HBI), is dedicated to the advancement and enrichment of education and training programs that develop skills essential to working in the housing industry. Last week, NAHB Chairman Randy Noel attended President Trump’s signing ceremony for an executive order to develop a national strategy for training and retraining workers for high-demand industries, such as home building. At the event, Noel pledged that NAHB and HBI would educate and train 50,000 new workers over the next five years for careers in the construction trades. As legal pundits and news outlets pour over Judge Brett Kavanaugh’s extensive judicial record to learn more about President Trump’s new Supreme Court nominee, members need only turn to the multiple NAHB court cases over which Kavanaugh has presided at the U.S. Court of Appeals for the D.C. Circuit to get a fuller picture. In his 12 years on the D.C. Circuit, Kavanaugh has been involved in eight cases in which NAHB was a petitioner, appellant or amicus. While not always siding with NAHB’s position, Kavanaugh has consistently viewed agency rulemakings with a healthy dose of skepticism. For example, NAHB was a petitioner in Coalition for Responsible Regulation et al v. EPA, challenging EPA’s attempt to apply an onerous Clean Air Act permitting program to millions of new sources, including some multifamily buildings. A three-judge panel at the D.C. Circuit upheld EPA’s regulation, and the full D.C. Circuit did as well – except for Judge Kavanaugh. Ultimately, NAHB and its industry coalition took this case to the Supreme Court, which overturned EPA’s regulation for exceeding its statutory authority, just as Kavanaugh had forecast when he declined to go along with the D.C. Circuit’s full court ruling. Kavanaugh also carefully examines Congress’ actions to ensure they pass constitutional muster. NAHB participated as an amicus in PHH v. Consumer Financial Protection Bureau, a case in which Kavanaugh held that a provision of the Dodd-Frank Act was unconstitutional because it vested too much power in the sole director of the Consumer Financial Protection Bureau (CFPB). NAHB’s main concern in this case was the CFPB’s re-interpretation of RESPA provisions that affected the use of marketing services agreements, commonly used by builders, real estate agents, lenders and others in the settlement process. Kavanaugh held that the CFPB could not change its position on RESPA without going through the rulemaking process and making sure the public had a chance to make comments. While the full D.C. Circuit ultimately overturned Kavanaugh’s constitutional holding, it upheld his RESPA holding, which benefits NAHB members significantly. Judge Kavanaugh’s record of curbing regulatory overreach, as evidenced by these two cases, is one of the key reasons NAHB supports his nomination to the Supreme Court.

NAHB, HBI Pledge to Train 50,000 Workers Over Next 5 Years

Existing Home Sales Suffer from Low Inventory BY NAHB CHIEF ECONOMIST ROBERT DIETZ Despite favorable macroeconomic conditions, the recent pace of existing home sales has been weak. Sales fell 0.4% in May due to a lack of inventory, which declined 2.8% for the month and is 6.1% lower than a year ago. Resale inventory has decreased on a year-over-year basis for 36 straight months. Pending existing home sales also declined in May and volume is 2.2% lower than a year ago. June’s labor market report from the Bureau of Labor Statistics revealed an above-forecast jobs gain of 213,000. Though the unemployment rate increased to 4%, this was actually good news because it was due to an increase in the number of people looking for jobs, thus boosting the labor force participation rate to 62.9%. To sustain economic momentum late in the business cycle, additional workers need to come into the labor market. Some acceleration in wage growth, such as the 2.7% year-over-year gain in June, will help in this regard. Year-to-date, new home sales for 2018 are up almost 9% compared to this time last year. Sales are up across most of the nation — increasing 15% in the Midwest, 11% in the West and 8% in the South. Only the Northeast recorded a decline (almost 4%). However, residential construction continues to be limited by the availability and costs associated with labor and materials. Nonetheless, builders continue to add workers — 4,800 more jobs in June — in anticipation of expanding construction volume. Still, the gains are not occurring fast enough to raise construction output above recent trends.

Attending a White House event on workforce development, NAHB Chairman Randy Noel pledged that NAHB and the Home Builders Institute (HBI) will educate and train 50,000 new workers over the next five years for careers in the construction trades. President Trump signed an executive order that establishes the National Council for the American Worker, which will develop a national strategy for training and retraining workers for high-demand industries. As part of this initiative, the administration is asking companies and associations to sign a pledge committing them to expanding apprenticeships, increasing on-the-job training and providing students and workers the training and opportunities they need to succeed in the American workforce. In a statement commending the White House plan to expand workforce development, Noel said: “NAHB applauds President Trump’s leadership for signing an executive order that will develop a national strategy to expand job-training and apprenticeship opportunities for students and workers and give them the proper tools to succeed in the American workforce.

At any given time, federal regulators are working on dozens of rules that can have significant impacts on the viability and costs of housing Every year the NAHB holds an Association Management Conference (AMC). I received a partial scholarship to attend this year’s conference in Long Beach, California, and as usual the conference was awesome.

The AMC is the premier professional

development conference for association Executive Officers. Delivering cutting-edge

government affairs and leadership development. This annual event is aimed at helping to build healthier, more productive and more successful associations for their members. Education programs offered focus on all aspects of managing an association, from membership recruitment, retention and development to advocacy, governance and everything else in between.

association worthwhile.

JULY 31, 2018 REPORT #12 RCAC RESIDENTIAL CODE RECOMMENDATION MOVES TO BBS FOR REVIEW AND ACTION; STAKEHOLDER MEETING SCHEDULED At its last meeting, the Residential Construction Advisory Committee (RCAC) finished up its residential code review and put together the statutorily required cost impact analysis before voting to move the proposed RCO along in the rule making process. Although not all committee members were present, with a split vote, the RCAC sent the code to the BBS. The proposed code is now in front of the BBS for its review with the required stakeholder meeting scheduled for Friday, August 17, 2018 from 11 a.m. to 1 p.m. in Training Room 1, 6606 Tussing Road, Reynoldsburg, Ohio 43068. The proposed code can be viewed at the link below. https://www.com.ohio.gov/documents/dico_Proposed%20Residential%20Code%20of%20Ohio%20Rules%20(AG%2097)%20-%20August%2017,%202018%20Stakeholder%20Meeting.pdf The most contentious discussions came from the review of the 2018 IECC. The sub-committee charged with reviewing the IECC changes recommended the adoption of a modified 2018 IECC with alterations to maintain current 2013 RCO Energy requirements for remodeling/additions, as well as, the OHBA Alternative compliance paths, among a few further modifications hoping to mitigate some of the cost increase associated with the changes. The committee voted to include several paths to achieve compliance with the energy provisions: a modified 2018 IECC, OHBA Alternative Compliance Paths, and an option for remodeling/additions to maintain current 2013 Energy requirements. These, along with all other proposed changes can be viewed in the link above. PLENTY OF LICENSING LEGISLATION STILL BEING CONSIDERED While the legislature is on summer recess, there are still numerous pieces of licensing legislation on the list of bills remaining when they return in the fall. OHBA will continue to monitor each of them and engage in discussions to prepare for the House and Senate’s return in the fall. HB 148 Home Improvement Contractors (Patmon, B.) To require statewide registration of home improvement contractors, to create the Home Improvement Board, and to make an appropriation. HB 148 provides exclusive authority to home improvement board to regulate home improvement contactors in Ohio. Prohibits any person from knowingly acting as a home improvement contractor unless the person is registered, or the person is licensed under the OCILB and home improvement is covered by the license. Home improvement includes cost to owner exceeding $500 but does not exceed $25,000. The bill has been referred to House Finance due to an appropriation but has yet to be heard. OHBA has met with both the sponsor and chairman from House Commerce and Labor, where the bill is likely to end up. HB 164 Commercial Roofing (Patton, T.) To require commercial roofing contractors to have a license. HB 164 would include commercial roofing contractors as a licensed specialty trade under the OCILB. OHBA has met with the sponsor and chairman of the committee hearing the bill to express concerns with the extension of the current OCILB law to roofing. Most concerning is the prohibition on the use of unlicensed subcontractors. The law currently requires a company use employees or licensed subs. HB 211 Home Inspectors (Hughes, J.) To require the licensure of home inspectors and to create the Ohio Home Inspector Board to regulate the licensure and performance of home inspectors. OHBA has been involved in discussions with interested parties, as well as, the sponsor to address concerns with any additional authority given to the licensed home inspector. Additionally, the committee adopted a substitute bill with some changes requested by OHBA to remove any language referencing the adoption of a particular national model code. The House voted to approve HB 211 before summer recess. HB 236 Model Elevator Law (Patton, Cupp) and SB 308 (Uecker, Yuko) had hearings in the House and Senate committees. The House committee heard from proponents, opponents and interested parties, while the Senate heard from the sponsor in its first hearing. Two representatives from the residential/accessibility elevator industry came to testify on some concerns with the way the correct bill is drafted. It appears HB 236 and SB 308 may continue moving and OHBA will be contacting and meeting with committee chairs and sponsors over the summer. HB 339 Residential Contractors (Schaffer, T.) To extend specialty contractor licensing to residential work. As with several other bills under consideration, OHBA has made clear its concerns with the current prohibition on use of subcontractors and will not sign off on this extension until this is addressed. Further, there also needs to be a separate residential section if HVAC licensure is extended to include residential work. SB 115 Roofing Contractors (Bacon, K., Hackett, B.) To require the registration of roofing contractors. SB 115 sets forth an extensive registration requirement for residential roofing. This legislation is a national effort being pushed by insurance groups, and it appears there will be time, according to the sponsor, to discuss further. SB 115 has been referred to committee and received sponsor testimony. An interested party meeting brought a room full of insurance representatives, in addition to, industry groups. OHBA made comments regarding the current prohibition on unlicensed subcontractors and the potential of simple registration beyond roofing contractors. OHBA continues to provide feedback on potential changes. NEW HOUSE MEMBER SWORN IN Mr. Rezabek resigned at the beginning of the month after Gov. John Kasich appointed him to the judgeship he planned to seek in November. Mr. Rezabek swore in Rep. Todd Smith (R-Germantown) to fill his seat. Rep. Smith won the Republican primary in that district, narrowly defeating Kenneth Henning. OHIO EPA NPDES CONSTRUCTION GENERAL PERMIT UPDATE The OEPA presented changes made to the draft permit before sending it to the Director to become effective April 23, 2018. The agency agreed to make modifications after receiving feedback from OHBA, as well as, other stakeholders on concerns with requirements proposed in the new permit. A brief summary, including important time frames for renewals, can be found below. • Multiphase example: existing regulation detention basin with older permit and new phase to drain into old pond—the project will not need to upgrade detention basin to meet new requirements. (so long as detention basin constructed post 2003)

• Project with local approval and starts construction within 180 days of effective date of #OHC00005 will remain okay under #OCH00004.

3-Olentangy set to expire May 2019, so current permit remains in effect until May 2019, at which time the #OHC00005 will replace it. 4-Renewals: Existing permits not renewed with 180 days (increased from 90) will be terminated. If the project will not be completed by October 20, 2018, then you must submit a renewal application by this date or your coverage will terminate (see Part I.F.5 of OHC000005). 5-Post-Construction Water Quality Treatment for sites 1-2 acres-ability to use less restrictive BMP than required for larger construction. 6-‘Perpetual’ and ‘perpetuity’ have been stricken and replaced with ‘long term’. 7-Redevelopment requirements have been put back to current permit requirements (removal of increased % and green infrastructure incentives). RULES AND REGULATIONS GOVERNING EXHIBITS MANAGEMENT: The North Coast Building Industry Association (NCBIA) shall be deemed Event Management and shall have all rights thereto assigned. (From here on the North Coast BIA will be referred to as NCBIA). NCBIA reserves the right to increase and/or decrease the size of any event and/or reassign Exhibitor space numbers prior to any event(s). CHARACTER OF EXHIBITS: NCBIA reserves the right to approve all exhibits. The exhibits and the distribution of promotional material shall be limited to the confines of the Exhibitor’s space. Under no circumstances shall any Exhibitor be permitted to attract attention to his/her exhibit in such a way as to distract or interfere with the other exhibitors. REGISTRATION: Exhibitors and their employees at the Event should wear a registration badge and/or tag for proper identification. SET UP/REMOVAL OF EXHIBITS: All exhibits must be placed and ready at the opening of the show and no movement of exhibits will be permitted until after the close of the show. Exhibits must remain intact until after closing of the show and be removed within such time as may be specified by the NCBIA. Strict compliance with move in and move out times is mandatory. A fine for late move in and/or early move out will be assessed at the discretion of the NCBIA. RAFFLES: No exhibitor other than Event Management shall conduct any game, lottery and/or similar activity unless authorized by the NCBIA. CARE OF EXHIBITS/AISLES: The NCBIA will maintain the aisles and exhibit areas in a clean condition. Aisles must be kept clear at all times. Seating for buyers must be confined within the exhibitor’s space. Exhibitors are requested at all times to cooperate with the NCBIA in maintaining all exhibits in perfect condition and to provide supervisory personnel at all times during exhibit hours. *In the event that the Exhibitor does not exhibit as provided herein or fails to comply in any respect with the terms of this agreement, the NCBIA management shall have the right without notice to the Exhibitor, to license the use of said space to any other company, enterprise, person or persons and the Exhibitor agrees to pay any deficiency, loss and/or damage sustained by the NCBIA as a consequence of such failure to occupy space as provided in this agreement. In addition, it is agreed that should the NCBIA be unable to license the use of said space as herein provided, it shall have the right to occupy said space for its own purposes without prejudice to its rights against Exhibitor pursuant to this agreement, including but not limited to the payment of a license fee. *Exhibitor will not sub license any part of the space herein provided for without the express written consent of the NCBIA. In the event the exhibit premises are destroyed or rendered unavailable for any reason whatsoever (whether before or during the scheduled exhibition), the rights of the Exhibitor under this agreement shall be limited to a pro-rated refund of the amount paid for the space licensed.

COMPLIANCE WITH LAWS: Exhibitors must comply with all federal, state and local laws, regulations and rules that may be in force during the exhibit. INSURANCE: Exhibitors who desire insurance on their exhibits must procure same at their own expense. The NCBIA will not be responsible for any losses incurred by the Exhibitor or its employees because of theft, damage or for any cause whatsoever nor to any property of employee(s) or Exhibitor(s) while en route to or from exhibit. The Exhibitor agrees to make no claim for any reason whatsoever, including negligence, against the NCBIA or NCBIA management, its agents or employees while in the show quarters. Exhibitor agrees to indemnify and hold harmless the NCBIA against any loss, damage or expense (including reasonable attorney’s fees) act or omission of Exhibitor or its agents connected in any way with its exhibits. DECORATIONS, SIGNS, ETC: All equipment in conjunction with the exhibit must be provided by the Exhibitor. However, only the sign of the firm covered by the Exhibitor’s agreement may be placed in the booth or upon printed list of exhibitors or program. All decorations must conform to fire regulations. No exhibit is permitted that is more than eight feet high, or that obstructs other exhibits due to its design or size. PAYMENT DEFAULT: A service charge of 15% per month is applicable on all balances after 30 days. In the event any unpaid amount is placed for collection, client and/or agent agree to pay all collection costs, including reasonable attorney’s fees. REFUND POLICY: A partial refund will only be given with a minimum of 45 day’s notice prior to the event. The NCBIA retains the right to use their own discretion when deeming the reason for refund as a viable one to determine whether refund shall be granted. *The NCBIA shall have the right to make such rules and regulations in connection with the Exhibition as it may deem proper and may amend them at any time, and the NCBIA shall have the full power in the matter of interpretation and enforcement thereof. The rules and regulations heretofore referred to are printed on this agreement and are incorporated herein by reference. Exhibitor agrees to abide by said rules and regulations. *It is agreed that this instrument is a license, and not a lease, and that no leasehold or tenancy is intended to be or shall be created hereby. *This agreement cannot be varied, modified or canceled by the Exhibitor without the express written consent of the NCBIA.
