NAHB Board Approves New Mission and Value Statements
DISCUSSIONS ON UTILITY REGULATION/LINE EXTENSIONS EXPECTED In addition to recent questions from members around the state on line extension installation and scheduling, there is also a larger discussion in the works around the statehouse on the re-regulation of utilities. OHBA was involved and closely followed all prior efforts to make changes in the regulations of utilities, paying particularly close attention to how line extension charges were treated. Likewise, OHBA will again be closely monitoring any upcoming discussions on the topic.
During the Builders’ Show, NAHB’s Board of Directors approved a new mission statement:
LICENSING OF SPECIALTY CONTRACTORS AND SUBCONTRACTING DISCUSSION TO CONTINUE As the new General Assembly begins, discussions continue on the licensing of specialty contractors, including both the roofing industry and the extension to residential. OHBA continues to insist any changes to the specialty contractor licensing law must allow for residential contractors to utilize unlicensed subcontractors for portions of the work.
Vision Statement and Value Proposition NAHB Vision Statement Building Homes, Enriching Communities, Changing Lives
Given the unique nature of the residential side, and common business model including the use of such subs, if any specialty contractor licensing requirements are extended to residential, OHBA has made clear it is crucial to consider these allowances. OHBA also plans on reviewing the prohibition on the use of unlicensed subcontractors, as the law exists today. UPDATED MINIMUM QUANTIFIABLE WORKMANLIKE STANDARDS UP FOR ADOPTION At its meeting, last month, the workmanlike standards committee reviewed and voted unanimously to adopt the 2017 2nd edition of the minimum quantifiable workmanlike standards. These standards are to be promulgated by the Ohio Home Builders Association, as a result of HB 383, the Home Construction Services Act. The Committee will bring the 2nd edition to the full board for its approval at the OHBA Spring Organizational meeting in March. Please feel free to contact OHBA with any questions.

Sales of newly built, single-family homes rose 12.2% in 2016 to 563,000 units, the highest annual rate since 2007, according to newly released data by the U.S. Department of Housing and Urban Development and the U.S. Census Bureau. “To ensure sales continue to move forward in 2017, builders need to price their homes competitively, especially given that mortgage interest rates are expected to rise this year,” said NAHB Chairman Granger MacDonald, a home builder and developer from Kerrville, Texas. The inventory of new homes for sale was 259,000 in December which is a 5.8-month supply at the current sales pace. The median sales price of new houses sold was $322,500. Regionally, new home sales increased 48.4% in the Northeast. Sales fell 1.3% in the West, 12.6% in the South and 41% in the Midwest. More analysis is available on NAHB’s Eye on Housing blog.

Streamlined Wetland Permits at Risk
Softwood lumber, oriented strand board (OSB), ready-mix concrete and bypsum products all posted price changed in 2016 well above the 1.3% average for the Consumer Price Index, according to the latest Producer Price index released by the Bureau of Labor Statistics.
While the U.S. Army Corps of Engineers re-issued Clean Water Act streamlined nationwide wetland permits (NWPs) as a final rule on Jan. 6. White House Chief of Staff Reince Priebus on Jan 20 issued a memo directing federal agencies to withdraw or postpone recently finalized regulations for at least 60 days.

The NWP program is set to expire on March 19. If the NWPs get caught up in this regulatory freeze, then builders and developers face the potential burden of costly and time-consuming “individual” wetland permits for even the smallest of impacts to wetlands, ponds and streams. Activities that do not qualify for authorization under an NWP must seek an individual permit, granted by the Corps on a case-by-case basis through a rigorous review process, including public notice and additional permit conditions. Builders and developers rely on NWPs for a much faster and cheaper authorization process: For example, a 2002 study found that it takes an average of 313 days and $28,915 to obtain a NWP, while the average time and cost to secure and individual permit were 788 days and $271,596. NAHB has asked the White House Office of Management and Budget to either exclude the NWPs from regulatory review or to fast-track the NWP review process.

“There used to be a time when both Republicans and Democrats felt more of a moral obligation to be more moderate in their views, to try to find that middle ground,” Howard said. “Now, it’s people from the extremes of both parties who are being elected, and that makes coalescing around a common view extremely rare. It’s dehumanized the process. Everything is ideological, and extremism has a much greater opportunity to prevail.” The Growth of Grassroots Few things are more important to a politician than staying in office, so they want to make sure their constituents are happy. That means that regularly gathering a group of home builders to meet with their member of Congress and their staff is more important than ever. “It’s always better than cold calls from your office,” Tobin said. “We need to build those relationships, so when I need a senator or a representative to take a specific action for the industry, we have the people we need to move our agenda.”

Attention spans are much shorter today,” he said. “Nothing will ever replace shoe-leather lobbying, but people are much busier, and they’d rather not have to take the time to interact with a lobbyist with meetings in the front office.”

Residential Construction Employment Growing BY ROBERT DIETZ The count of unfilled jobs in the overall construction sector declined recently, as residential construction employment accelerated in the last three months.
Monthly employment data for January 2017 (the employment count data from the BLS establishment survey are published one month ahead of the JOLTS data) indicate that home builder and remodeler employment continued to grow at a fast pace, increasing by 20,300. Who Claims the Home Office Deduction?
BY DAVID LOGAN With tax preparation season well underway, it is a good time to examine the use of the home office deduction. Often cited as a “red flag” for tax audits, the home office deduction is a legitimate business deduction particularly important for certain professionals and small business owners. Moreover – from the housing economics perspective – IRS data concerning the deduction, along with Census data reporting who works at home, can shed light on an important and growing role for homes: workplaces for business owners and telecommuters. There’s no doubt that the practice of working at home is on the rise. Data from the Survey of Income and Program Participation shows that only 7% of workers (9.2 million individuals) reported working at home at least one day a week in 1997. By 2005, the share had grown to 7.8% (11.3 million) and reached 9.5% (13.4 million) in 2010—an 18% increase in just five years. What’s more, the most recent data from the Bureau of Labor Statistics suggests that 25.7 million people—or 24% of the workforce—performed some portion of their daily work at home on an average day in 2015. The distribution of workers who primarily work at home (most days) shows clear geographic clustering. Using data from the 2015 Census Bureau American Community Survey, the map above exhibits the share of the workforce (age 16 and over) who report working at home. The highest shares are found in the West, Northwest, and New England. Colorado (7.1%) and New Hampshire (7.0%) lead the nation, while Mississippi has the lowest share at 2.2%. The reasons behind this geographic distribution are not immediately clear. Potential explanations include the geographic distribution of jobs page 20
that are more likely to include or allow at-home employment, weather, age/education differences in the workforce, and less quantifiable differences in workplace culture across states. Regardless, the growth of working-at-home represents a business opportunity for both remodelers as well as builders to benefit from designing homes with this trend in mind. Recent industry-specific IRS data (2014) for the home office deduction for independent contractors and sole proprietorships (not telecommuters) provides a sense of who is using space in their home for a dedicated office. Unsurprisingly, workers in industries that require more individual independence or are reliant on technology, relative to other industries, tend toward greater use of the deduction. For example, educators, IT professionals, workers in professional services (lawyers, accountants, architects, etc.), and those in arts and entertainment are all more likely continued on page 21

Who Claims the Home Office Deduction?
(continued from page 20) to claim the home office deduction. Real estate ranks 6th in terms of the value of the home office deduction relative to others, with many Realtors reporting home office expenses. Home office deductions are less common in the construction sector, although many small construction firms do have home office expenses. Specific sectors with high levels of home office deduction use include: • internet-based workers • real estate brokers • CPAs • architects • building inspectors • designers • management consultants • marketers • educators • doctors • social workers • religious and professional organization workers IRS data shows that a total of $9.5 billion in home office expenses (insurance, rent, repairs and utilities) were claimed for tax year 2014. The deduction is split into two classes: direct expenses related to the actual office and indirect expenses that apply to the entire home and are only partially deductible. Approximately 6 out of every 7 dollars claimed as a deduction relate to indirect expenses. An additional $1.2 billion in home office related depreciation deductions was claimed in 2014. Taxpayers likely to claim the deduction, including small business owners (builders and remodelers) and Realtors, should be aware of the rules
for doing so. The IRS has a good summary page on the deduction. More details can also be found in IRS Publication 587, which includes a flowchart (shown below) taxpayers should use to determine if their expenses qualify for the deduction. From a tax law perspective, two relatively recent key changes are worth noting. First, the IRS provided a simplified method for claiming the deduction in 2013, which can save taxpayers time in filing the required form. Under this approach, taxpayers may claim a $5 per square foot of home office space (up to a maximum of 300 square feet). Other related expenses such as mortgage interest and real estate taxes are still claimed on Schedule A, and no depreciation deduction (including future recapture) is allowed. Second, those worried about the historically strict tests connected to the deduction should be aware of tax law changes that went into effect in 1999. The Taxpayer Relief Act of 1997 clarified that a residence can qualify as a principal place of business when it is used to conduct administrative or management activities if there is no other fixed business location. However, homeowners as well as renters must use the office space exclusively used for business purposes. Telecommuting employees are less likely to be able to claim the deduction (they must itemize, for example), and should consult IRS Form 2106 for additional detail to determine whether they qualify. Finally, the IRS recently published IRS Tax Tip 201542 and more explanations on the simplified deduction method. The Tax Tip document provides 6 helpful points on the use of the deduction.

Top Challenge for Builders is Labor Cost/Availability BY ASHOK CHALUVADI The monthly NAHB/Wells Fargo Housing Market Index includes a set of “special” questions on a topic of current interest to the housing industry. In December 2016, the special questions asked builders about the problems they faced in 2016 and expect to face in 2017. Topping the list of problems builders faced in 2016 and expect to face in 2017 is the Cost/Availability of Labor, a significant issue for 78% of builders in 2016 and one that has significantly grown in importance since 2011. That year, 13% of builders rated labor as a significant problem, followed by 30% in 2012, 53% in 2013, 61% in 2014 and 71% in 2015.

Building material prices was a significant problem for 48% of builders in 2016 and expected to increase to 60% in 2017. In fact, this issue experienced the largest difference between builders noting it was an issue in 2016 and builder expectations of it as a challenge in 2017. Other issues builders expect to become more significant problems in 2017: labor, lots, and rising interest rates.
The second most significant problem in 2016 was Cost/Availability of Developed Lots-cited by 60% of builders. In 2011, the Cost/Availability of Lots was rated significant by 21% of builders who responded to the survey. That share increased to 34% in 2012, 46% in 2013, 55% in 2014 and again to 58% in 2015. Both the availability of labor and lots highlight the expected constraints of a recovering housing market. Impact/Hook-up/Inspection or other Fees was a significant problem for 60% of builders in 2016. In 2013, it was a problem for 46% of builders, 52% in 2014, and 53% in 2015 and is expected to be an issue by 61% in 2017. Federal Environmental Regulations and Policies was a significant problem for 58% of builders in 2016. In 2013, this was rated a significant problem by 46% of builders, 53% in 2014 and then 55% in 2015. Regulation of Banking/financial institutions was a significant problem for 55% of builders in 2016.
