With 2016 coming to an end, it seems like a great time to take a look back over my 2 years as President of this great association and reflect a little on what’s been happening. All in all, its been a great year out there moving new homes. With the great rates and inventory of resale homes flying off the market, it has opened a great many doors for all the local builders out there to sell models and write contracts on new homes. I have attended many economic forecast meetings this year and although interest rates are on the rise, 2017 still looks to be a promising year for our industry. I’m certain that in order to make our county flourish, we need to buy local and keep employment alive here in Erie, Huron and Lorain Counties! We need to educate our youth on the importance of growth in our county. We have begun this journey by being more involved with the students at Lorain County Joint Vocational School. Our Sales & Marketing Committee hosted their first Girl’s Night event in February that raised enough money to start a Student Chapter of the NCBIA at the Joint Vocational School for those students in the building trades. That chapter will become active in January of 2017. If you are interested in being a part of our Workforce Development committee who will be helping with these students, please feel free to contact the NCBIA office and let Judie know. She will be happy to add you to the committee for 2017. The last two years have shown significant membership growth in our local association. While other area organizations are treading water, we managed to win NAHB Membership drives for our association size in BOTH 2015 and 2016. The Membership Committee is key to the success or failure of any association. Expressing your passion for this industry is something that I’ve always held in high regard. I’ve been a member for seemingly forever and take any chance I have to encourage others to become a member of the NCBIA. As a member of this association, I would encourage you to do the same. Taking another moment to thank yet another important group of people this year, I would like to express my gratitude to our Sales & Marketing Committee. This group of marketing professionals has worked on multiple events this year that have promoted our builders, raised money for charity, and educated our membership. They continue on new and exciting paths each year and 2016 was no exception. SMC will continue to do exciting things in 2017 with multiple educational offerings in the form of “Talk Nerdy to Me” classes beginning on January 19th, 2017. I had the opportunity to sit in on the first “trial run” of this class at the Economic Forecast meeting and learned about how tablet and smart phone apps can help my business run smoother and quicker. Be sure to take a look at the info on page 8 to sign up for these classes. page 4
To the Board of Directors: I want to express my gratitude to the members of our NCBIA Board of Directors and Staff. I would not have been able to serve in this capacity without all of you. 2016 OHBA Legislative Year in Review
RESIDENTIAL CONSTRUCTION ADVISORY COMMITTEE (RCAC) OPERATING AS INTENDED - After years of effort to establish and educate stakeholders on the role of the RCAC, OHBA continues to make the operation of the RCAC a priority. Throughout the year, OHBA attended meetings, monitored the code review process, encouraged use of code interpretations, and brought builders in to provide their practical insight on the impacts of more stringent codes. CHANGES IN THE CONSUMER SALES PRACTICES ACT (CSPA) WERE SUCCESSFULLY UPHELD - OHBA’s language creating the Home Construction Services Act, and providing builders with relief from the CSPA survived its first real court challenge. A court partially granted a motion to dismiss the OCSPA claim. The court found the builder had met all the requirements necessary to be exempt from the CSPA and the contract would be governed by the Home Construction Services Act. OHBA’s efforts in writing the new law were reaffirmed in the court’s opinion finding, ”when statutory language is plain and unambiguous, and conveys a clear and definite meaning, we must rely on what the General Assembly has said. The court must give effect to the words used, making neither additions nor deletions from words chosen by the General Assembly... While the OCSPA affects a wide range of business, it specifically excludes “transactions involving a home construction service contract as defined in section 4722.01 of the Revised Code” (as part of the Home Construction Service Suppliers Act, R.C. 4722.01, et seq.).
In the spring, OHBA agreed to file another Amicus in support of action in prohibition and mandamus with the Supreme Court of Ohio. In the original election matter, the Supreme Court ruled in favor of the Relators’, finding the Board of Elections abused its discretion in denying relators protest to referendum petition. The finding prevented the issue from being placed on a November ballot. FACILITATED DISCUSSION WITH PUCO AND UTILITIES ON LINE EXTENSION ISSUES - After hearing from members with concerns over somewhat arbitrary and increased charges to install utility line extensions, OHBA reached out to the PUCO for some immediate clarification, as well as, to start discussions going forward. Further, OHBA helped bring developers and utilities together to also have a more in depth discussion on achieving a more predictable scheduling process and reasonable timelines. MODERATED ENERGY PANEL DISCUSSION ON ROLE OF ENERGY CODES - At it’s spring meeting, OHBA hosted an energy panel consisting of a BBS member, utility representative and American Chemistry Council representative to provide members with each participant’s perspective into the role of energy codes and making codes more stringent. IMPORTANCE OF ALL TYPES OF RESIDENTIAL HOUSING DEFENDED TO LEGISLATURE - In response to residential housing being specifically left out of a property tax relief bill, OHBA defended
OHBA OFFERED SUPPORT FOR LEGISLATION TO INCLUDE VARIETY OF PIPING OPTIONS - OHBA offered support of legislation to ensure that all suitable piping materials be included in bids for water and wastewater utility service improvement projects. OHBA supported making common sense improvements to ensure Ohioans have access to broad range of products when constructing this crucial infrastructure in the most cost effective manner.

LEGISLATIVE LEADERS ASKED FOR OHBA SUPPORT FOR UNEMPLOYMENT COMPENSATION DEBT PAYOFF PROVISIONS - Legislative leaders asked OHBA and other business groups to meet and sign off on changes to be made which included authority for the Kasich Administration to completely pay off the state’s unemployment compensation debt to the federal government estimated to total between $225-$240 million. SUCCESS IN BOTH OHIO SUPREME COURT AND FEDERAL DISTRICT COURT CASES WHERE OHBA FILED AMICUS BRIEFS Throughout the year, OHBA agreed to file Amicus briefs in multiple cases. First, in federal district court, OHBA filed an amicus brief in the major election case regarding an initiative to rewrite a city’s comprehensive plan and potentially retroactively invalidate permits. The Court issued its opinion finding, as a matter of law, that the developer is entitled to permanent injunctive relief on its due process claim that the Charter Amendment contains an unlawful delegation of legislative power and on its state constitutional claim that citizens of a municipality may not exercise the power of referendum, by means of a charter amendment, so as to nullify City Council’s administrative action of approving the development plan. december 2016

Federal Open Market Committee December Popularity of Building Information Meeting Modeling Increases Among NAHB Members Analysts scrutinize the statements released immediately following the meetings of the Federal Reserve’s monetary policy setting arm, the Federal Open Market Committee (FOMC) for hints about the likely direction of policy and implications for the economy. Like Kremlinologists, every adjective, choice of wording and change is examined. In the December statement, only one sentence mattered: “In view of realized and expected labor market conditions and inflation, the Committee decided to raise the target range for the federal funds rate to 1/2 to 3/4 percent.”
The move was widely anticipated. Futures contracts based on the federal funds rate, used to hedge short-term interest rate risk (FOMC), traded at prices equivalent to a market estimation of a 95% probability of a 25 basis point increase at this meeting. At the press conference following the meeting, Federal Reserve Chair Janet Yellen’s circuitous response to a question about the recent sharp increase in other market interest rates deftly concluded that the committee had effectively communicated their conditional inclinations, and market participants had correctly interpreted the incoming data since the November meeting, making the rising rates confirmation that the process was working well. Yellen emphasized that this increase was a vote of confidence in the progress of economic recovery among FOMC participants, and acknowledged that recent increases in longer term rates also suggested market participants expected strong economic growth in the years ahead, perhaps based on proposed fiscal stimulus, although the details and implementation are highly uncertain, and likely to take some time to affect the path of the economy.
BY: CARMEL FORD More NAHB members are familiar with and are using Building Information Modeling (BIM) for their businesses, a recently conducted NAHB survey shows. BIM is a process for managing the information produced during a construction project, in a common format, from the earliest feasibility stage through design, construction, operation and finally demolition, to make the most efficient use of that information. A representation of a building project in BIM format typically consists of a three-dimensional model integrated with an informational database about materials, products, components, systems and their properties and performance. In a 2016 survey of architects, single-family and multifamily builders, 27 percent of respondents said they were familiar with BIM, compared to 17 percent who reported being familiar in 2014. During this period, the share who never heard of BIM declined from 43 percent to 32 percent (Figure 1). The most revealing finding from this year’s survey is that a significantly larger share of those who are familiar with BIM are using it in their businesses. Of the 27 percent who are familiar with BIM, 47 percent are currently using it. This is a large jump compared to 2014: of the 17 percent who were familiar with BIM that year, only 27 percent were using it for their businesses (Figure 2).

FED Raises Interest Rates
For just the second time since the Great Recession, the Federal Reserve increased its target for the federal funds rate by 25 basis points. While still low, the rate increase continues the path toward higher interest rates and a normalized monetary policy after years of stimulative policy designed to support an economic recovery. The current outlook is for three additional rate hikes in 2017. Economic growth remains modest, though the pace could increase with a fiscal stimulus in the form of deficit-financed tax cuts or government spending increases as the Trump administration takes office.

Industry Will Continue to Improve I would like to thank you for being a crucial part of our industry’s recovery. As you know, the strength of our association and ability to take meaningful action to help your business to grow and thrive comes from our numbers – and your membership in the North Coast BIA has helped move the needle over the past year. Some of you may not realize all the things that NAHB does that benefit you, our local association and our State association. At any given time, NAHB is working on more than 100 complex issues and doing its utmost to create a better business environment and save members money. NAHB advocates on behalf of its members on a wide range of issues, including environmental regulations, the tax code, federal housing programs, building codes, OSHA, building materials, and housing finance. Below are just a few examples of NAHB policy victories and services that have contributed to real savings and benefits for members. • NAHB Study Highlights Need to Rein in Burdensome Regulations. An NAHB report released earlier this year showed that government regulations account for more than 24 percent of the final price of a new single-family home. NAHB has been working tirelessly to reduce
o Federal Judge Blocks Overtime Rule. NAHB joined other groups in filing a legal challenge to the Department of Labor’s final overtime rule that would have doubled the minimum salary limit from $23,660 to $47,476 as of Dec. 1. A federal judge on Nov. 22 granted a preliminary injunction to delay the rule from taking effect until a final court decision is made. Nearly 100,000 additional construction supervisors would have been eligible for overtime had the rule gone into effect. o NAHB’s Legal Victory Blocks “Persuader” Rule. NAHB scored a major legal victory when a federal district court on Nov. 16 granted the association and other groups a permanent stay on the Department of Labor’s final “persuader” rule. The court ruling essentially put an end to union efforts to prevent employers from talking to their lawyers in response to union organizing. o NAHB, OSHA Settle Litigation on Confined Spaces Rule. NAHB earlier this year reached a settlement agreement that resolves the association’s legal challenge to the agency’s Confined Spaces in Construction final rule. The settlement clarifies that the vast majority of the rule’s requirements only apply to permit-required confined spaces, and that attics, basements and crawl spaces in a residential home will not typically trigger these requirements. Working with the incoming Trump administration and new Congress, along with officials at the state and local level, NAHB will redouble its efforts in 2017 to make policymakers understand that their actions have real consequences and that they must act decisively to reduce burdensome regulations that increase the cost of housing. • Congress Reinstates Health Reimbursement Arrangements. A health care package approved by Congress on Dec. 7 includes a provision to allow employers to provide Health Reimbursement Arrangements (HRAs) to help their employees pay for health insurance. NAHB has been spearheading efforts to reinstate the use of HRAs since the IRS issued guidance prohibiting their use and instituting onerous financial penalties for those who failed to comply. The bipartisan 21st Century Cures Act is an important step forward to allow small business owners to help their workers with rising health care costs and to ensure more Americans receive affordable health coverage. At the same time, it will protect employers against outrageous fines for providing this costsharing option to their workers. Residential Construction Employment Grew in November

According to the BLS Job Openings and Labor Turnover Survey (JOLTS) and NAHB analysis, the number of open construction sector jobs (on a seasonally adjusted basis) came in at 205,000 in October, after reaching 221,000 in September. The cycle high was 225,000 set in July. The open position rate (job openings as a percent of total employment) for October was 3%. On a smoothed twelve-month moving average basis, the open position rate for the construction sector increased to 2.7%, setting a cycle high and surpassing the top twelve-month moving average rate established prior to the recession.
Residential construction employment now stands at 2.644 million, broken down as 743,000 builders and 1.901 million residential specialty trade contractors.
Over the last 12 months home builders and remodelers have added 120,000 jobs on a net basis. The reaction from the legislature to OHBA’s concerns seems to send a clear message: the legislature does not understand the value of residential development nor does it consider it an important aspect of economic development. OHBA intends to bring this subject to the attention of legislative leaders going forward, and would encourage anyone who is interested in contacting their legislative members do the same. Congress Reinstates Health Reimbursement Arrangements
Pending Sales Maintain Pace
In a major victory for home building firms and other small businesses across the land, the Senate today passed the 21st Century Cures Act, a comprehensive health care package which includes a provision to allow employers to provide Health Reimbursement Arrangements (HRAs) to help their employees pay for health insurance. The House approved the bill President Obama is expected to sign the measure into law shortly. “NAHB has been spearheading efforts to reinstate the use of HRAs since the IRS issued guidance prohibiting their use,” said NAHB Chairman Ed Brady. “This bipartisan legislation is an important step forward to allow small business owners to help their workers with rising health care costs and to ensure more Americans receive affordable health coverage. At the same time, it will protect employers against outrageous fines for providing this cost-sharing option to their workers.” HRAs allow small businesses to offer pre-tax dollars to insured employees to help pay premiums and/or other out-of-pocket costs associated with medical care and services. Most small companies do not have human resource departments or benefits specialists. HRAs offer these businesses a simpler, easier way to help their employees to obtain health coverage.
The Pending Home Sales Index increased a slight 0.1% in October, but was 1.8% higher than last October. The Pending Home Sales Index (PHSI), a forward-looking indicator based on signed contracts reported by the National Association of Realtors (NAR), increased to 110.0 in October from a downwardly revised 109.9 in September. The PHSI increased 1.6% in the Midwest, 0.7% in the West and 0.4% in the Northeast, but fell 1.3% in the South. Year-over-year, the PHSI increased in all regions, ranging from 3.9% in the Northeast to 0.8% in the South. Commenting on the continued tight supply of homes for sale, NAR reported that 40% of October sales were at or above list price, compared to 33% last October. Existing sales increased in October, and builder confidence remained firm in November. These reports are good news for new residential construction as the housing recovery continues to address demand among first-time buyers and broadens across a wider range of markets during the balance of 2016 and into 2017.
The Internal Revenue Service issued guidance in 2013 stating that employers are no longer able to use HRAs because they don’t meet the requirements of the Affordable Care Act. Not only did the IRS make HRAs illegal, the agency decreed that all employers can face fines of $100 per day per employee if they offer this benefit to their workers. That can add up to $36,500 per employee over the course of a year and up to $500,000 per company. This $100 per day penalty went into effect on July 1, 2015. NAHB has led the charge working independently and with a coalition of other business organizations to remedy this injustice by calling on the IRS to revoke its ruling on the use of HRAs and pushing for a congressional solution. At NAHB’s urging, a section was added to the 21st Century Cures Act that would reinstate the use of HRAs and rescind the punitive IRS penalties associated with them. “NAHB commends Congress for bringing choice and affordability to the health care marketplace by allowing small employers to once again use HRAs,” said Brady. Workers Comp Update - Important Dates!!! Of course the year has sped by and we have already filed the 2017 traditional group rating program roster, but the 2017 group retro deadline is still ahead; the last day to submit the enrollment forms for next year is coming up (see below). We also have a timely ~ and time-sensitive ~ opportunity from our Unemployment department for a common-rating analysis, as well as good news from the state regarding workplace injuries. Upcoming dates/deadlines: * January 24, 2017 Enrollment deadline for Group Retrospective Rating programs. * January 31, 2017 o Deductible Program application deadline to begin on 7/1/17. o Individual Retro rating application deadline to begin on 7/1/17. o One Claim Program application deadline to begin on 7/1/17.

Unemployment Updates: We have an opportunity from our Unemployment division which is timesensitive. CareWorksComp is always looking for multiple strategies to reduce our customers’ business expenses, and to that end we are offering an unemployment tax control opportunity which Ohio employers can consider only in the month of December, for a very low fee. The Ohio Department of Job and Family Services (ODJFS) recently sent

2017 annual tax notices to Ohio businesses. ODJFS allows commonly owned businesses (two or more companies operating under common ownership) to apply for a common/joint tax rate group for 2017 to reduce their unemployment tax liability. This strategy can be highly profitable for companies that qualify. CareWorksComp can complete a common/joint rating analysis to determine your amount of savings. In addition, customers taking advantage of the common/joint rating analysis will also benefit from a special reduced service fee (see the Service Agreement for details). To enroll in this program, please sign and return the Service Agreement and Employer’s Authorization form for each account via fax to (614) 932-1564. Decline of Workplace Injuries: In September the BWC’s Division of Safety & Hygiene reported that Ohio has experienced nearly a 17% decline in workplace injuries between 2010 and 2014. This is almost double the national average of 8.6% for the same time period! Total injuries reported in BWC’s system went from 105,568 to 95,802, even though there was a 7.5% growth in employment at the same time. The reason for this, in large part, is credited to the success of various safety programs offered by the Division of Safety & Hygiene, and the increase in the number of employers who take advantage of them. “Ohio is becoming a leader in the workers’ comp industry with an impressive offering of workplace safety programs and services, and the state is now exceeding the national trend of declining injuries,” said BWC Administrator/CEO Sarah Morrison. “Ohio employers are recognizing the benefits of injury prevention and investing in a culture of safety, including partnering with BWC to make their workplaces safer.” To learn more you can visit www.bwc.ohio.gov and click on the “Safety Services” tab.
