Also, continuing is fundraising; it just never stops. I expect we will see new benchmarks raised in spending when all the reports are submitted. We will also find if the Ohio House will speed passage of HB 371. The bill is being held up by county auditors and their supporters as they do not want to make a few minor changes to their holy grail of rules. This is done in spite of a clear advantage fostering the production of affordable housing development where its need is greatest. Only time will tell if we can get it to the House floor. In the meantime, be ready for the usual political banter for the next month.

Eye on Housing BY DAVID LOGAN Residential construction goods input prices declined, on average, in August as large monthly increases and decreases offset each other, according to the latest Producer Price Index (PPI) release by the Bureau of Labor Statistics. Although the index for inputs to residential construction fell by 0.5% (not seasonally adjusted), it has increased more than twice as much in 2018 (+4.9%) as it did over the same period in 2017
index decline 3.3% between May and July. February to April 2016 was the last two-month period in which gypsum prices rose by 6% or more. From January to August of 2017, the price index of gypsum products rose 3.9%. The index has more than doubled that pace in 2018, having increased 8.2%, year-to-date.
On a more sanguine note, softwood lumber and OSB prices each decreased substantially in August (not seasonally adjusted). Softwood lumber fell 9.6%, its largest monthly decline per the PPI in over seven years (May 2011). (+2.0). Perhaps the most concerning news in the report was the relatively sharp increase in prices paid for gypsum products. Prices have climbed 6.1% (seasonally adjusted) since a two-month reprieve that saw the gypsum

Builder Confidence Remains Firm in September BY ROBERT DIETZ Builder confidence in the market for newly-built single-family homes remained unchanged at a solid 67 reading in September on the National Association of Home Builders/Wells Fargo Housing Market Index (HMI). Despite rising affordability concerns, builders continue to report firm demand for housing, especially as millennials and other newcomers enter the market. The recent decline in lumber prices from record-high levels earlier this summer is also welcome relief, although builders still need to manage construction costs to keep homes competitively priced. Wages and subcontractor payments continue to rise as the labor market for residential construction sector remains tight.
Similarly, the index for prices paid for OSB (and waferboard) decreased by 11.8% in August, the largest such decline since July 2013.
As expected, the August PPI release captured more decreases in prices paid for softwood lumber that began in mid-June. Even after accounting for the most recent price movements, the average price paid for softwood lumber in 2018 remains the highest on record according to Random Lengths data—22.0% above the prior record set in 1997. A growing economy and rising incomes combined with increasing household formations should boost demand for new single-family homes moving forward. However, housing affordability is becoming a challenge, as builders face overly burdensome regulations and rising material costs exacerbated by an escalating trade skirmish. Interest rates are also forecasted to keep rising. We nonetheless expect some market disruption effects due to the impact of Hurricane Florence. Single-family construction in North Carolina, South Carolina and Virginia makes up 12% of national production.
The index for ready-mix concrete (RMC) prices fell (-0.1%), the fourth consecutive monthly decrease after increasing in 10 of the preceding 11 months (seasonally adjusted). After an uncharacteristically large monthly increase in March—when the index rose 3.3%–the PPI for RMC has fallen back in line with its long-run trend.
Derived from a monthly survey that NAHB has been conducting for 30 years, the NAHB/Wells Fargo Housing Market Index gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. The HMI index measuring current sales conditions rose one point to 74 and the component gauging expectations in the next six months increased two points to 74. Meanwhile, the metric charting buyer traffic held steady at 49. Looking at the three-month moving averages for regional HMI scores, the Northeast rose one point to 54 and the South remained unchanged at 70. The West edged down a single point to 73 and the Midwest fell three points to 59. The HMI tables can be found at nahb.org/hmi. page 10

Housing’s Summer Soft Patch Continues BY ROBERT DIETZ Rising interest rates and declining housing affordability caused housing demand to weaken slightly this summer. On a seasonally adjusted annual basis, the pace of new home sales in each of the previous three months was slower than any other month so far this year. This soft data for both sales and single-family starts coincided with declines in resale activity, as some buyers pulled back from a market that saw notable increases in home prices largely driven by low inventory. The softening demand has also led to a recent deceleration of home price growth. Nonetheless, the single-family and multifamily markets continue to expand. Multifamily starts are up 8% on a year-to-date basis through August. Single-family starts are up 6% and new, single-family home sales are up 7%. Home builder confidence continues to be solid, and macroeconomic conditions remain strong, with improved GDP growth and a hot labor market. Looking forward, NAHB is forecasting continued, modest growth for residential construction, tempered by rising interest rates. Indeed, the Federal Reserve raised the federal funds rate by 25 basis points this week — the third such rate hike of 2018. While this indicates the economy is continuing to perform well, it is also a sign that the cost of buying a home will continue to increase in the months ahead.

Flat Conditions for Some Housing Sectors, but Not All BY NA ZHAO Personal income climbed 0.3% in August after increasing by the same margin in July, according to the most recent data release from the Bureau of Economic Analysis (BEA). Wages and Salaries, the biggest component of personal income, registered an increase of 0.5%. Personal consumption expenditures edged up by 0.3% in August. Adjusted for inflation, real personal spending edged up 0.2% after climbing 0.3% in July. On a year-overyear comparison, real personal spending increased 3.0% in August. Disposable personal income, income remaining after deducting personal income taxes, rose by 0.2% after accounting for inflation. Moreover, disposable personal income is 2.9 % higher than a year ago. July data release showed that BEA made significant revisions to the real

Businesses help Avon veteran with vandalized lawn *Reprinted with permission from the Avon Press. By KAREN UTHE-SEMANCIK AVON – Two local, small businessmen stepped forward recently to help a disabled Vietnam veteran after his yard was vandalized. The two friends heard about the incident through social media, and sprang into action less than 24 hours later. Heather Scaife-Arkley, daughter of Harold and Bernadette Scaife of Arlington Drive in Avon, took to an Avon-centric Facebook page on Sept. 13 to seek information about the damage done to her parents’ lawn. The vandals used a bleaching solvent or weed killer to draw a large outline of a penis in their front yard.

“My parents are in their 60s, my father a 100-percent disabled Vietnam Army Veteran,” Scaife-Arkley’s post read. She went on to ask for information so that the “disrespect” could stop.

The Facebook post and photo got the attention of two local businessmen, Joe Work of Seasonal Yard Work and Jimmy Cheeko of Computer Crisis. The two entrepreneurs, along with two of Work’s crew members, joined forces to fix the Scaifes’ yard and install a security camera system. “He is a veteran,” said Work. “I sacrificed a few hours to help him; he has sacrificed a lifetime. I will never be able to repay the vets, but I’ll do what I can to help their lives now.” Work and his crew managed to turn the large obscenity into a patriotic symbol for the veteran homeowner. “Instead of prolonging the damage, we went over there and reshaped the damage into an American flag,” Work said. “We used a weed whacker to burn out the design and some super duper grass seed to fill in the rest. It should look good in about 10 days.” Work, a former Avon resident who now lives in Avon Lake, said eventually the flag will become the same color as the rest of the lawn. His team also helped mount the security camera that Cheeko donated. Work estimates his gift of supplies and labor was worth $300. Cheeko, who specializes in computer sales and repair, said he was able to put his technology side into action to help the Scaifes. He thought donating the security camera would be helpful to deter future vandalism or help identify anyone who does it again. “Joe did the mounting of the camera and I am doing the tech side setup, hooking it up to the wireless network and to their smartphones and laptop,” Cheeko said. Cheeko, who lives and works in Avon, estimates his donation of equipment at $300.

Scaife-Arkley said the help and donations from the two businesses was “so heartwarming. Great people; sad situation.” Avon Police Capt. Larry Fischbach said a radio log was created for this vandalism incident when the homeowner called to alert police. Fischbach said vandalism has occurred in all neighborhoods within the city at some point, and that these acts of vandalism are typically done by kids picking random houses to vandalize. Third Party Administrator (TPA) and Managed Care Organization (MCO): What’s the Difference? Many employers are confused about the different responsibilities between Third Party Administrators (TPAs) and Managed Care Organizations (MCOs). Both play a vital role in mitigating cost and returning injured workers to work as soon as medically possible. First, the Ohio Bureau of Worker’s Compensation (BWC) requires that all employers have an MCO and there is no direct cost to the employer for their services. MCOs are responsible for managing and monitoring the medical portion of workers compensation claims including maintaining a medical provider network, submitting First Reports of Injury documentation to BWC, monitoring medical costs and medical bill payment, ensuring proper utilization of medical services and monitoring medical needs and level of care. They are also charged with helping to insure injured workers return to work as soon as medically possible by helping to facilitate return -to-work programs and vocational services in coordination with your TPA. As we all know, the sooner an injured worker returns to work, the better for all concerned. While MCOs are impartial parties to the claim focusing on medical management, TPA’s responsibilities are specifically focused on reducing the administrative and financial burden of the workers’ compensation system on the employer community. Their responsibilities include managing employers’ workers’ compensation programs and providing them with cost control strategies and programs to directly reduce their workers’ compensation costs. Employers pay service fees directly to TPAs for their assistance with claim administration, claim appeals, consultation / advice and assistance on cost control strategies for lost time claims, monitoring experience claim costs and representing employers at Industrial Commission hearings. In addition, TPAs provide rate analysis and financial impact studies to help employers make informed decisions. One of the most important functions of a TPA is the expertise and ability to provide employers the opportunity to reduce their workers’ compensation premiums through group rate discount and refund programs. Quality TPAs also provide client education, workshops and seminars to increase employer knowledge and to help them meet BWC training requirements. We all have a lot to do in the remaining months of 2018, and I do hope you will get in touch if there is anything I can do to help you accomplish your risk management goals.

The Ohio National Guard (ONG) and US Army Reserve (USAR), US Marine Reserves (USMCR) I want to personally thank Deborah Fisher of the NCBIA for putting this program together not only to help our members but to help our military men and women looking for jobs. NCBIA, The North Coast Building Industry Association (NCBIA) serves Erie, Huron and Lorain Counties. NCBIA members have been an integral part of the growth and economic development of the communities we serve since 1944. NCBIA was founded as a not-forprofit local affiliate of the Ohio Home Builders Association (OHBA) and the National Association of Home Builders (NAHB) representing home builders and other businesses directly related to the home building industry. Our members are builders, remodelers, tradesman and associated professions representing the collective interests of the residential construction industry in Erie, Huron and Lorain County. We hold inviolate the free enterprise system and the American Way of Life. ONG, USAR, USMCR The housing market is improving along with improving economy which makes it more difficult for the BIA members to find qualified, dedicated employees. Builders and contractors need employees who will show up on time, take pride in their work and put forth the extra effort AND pass a drug test. Today’s military is technologically astute, they are disciplined, and they understand and respect the “chain of command”. They are motivated to suggest less complicated more cost effective and efficient operations and procedures. Our soldiers and Marines excel with the innate leadership abilities. ONG, USAR, USMCR train one weekend a month and two weeks the summer, they go through regular drug testing, physicals and fitness assessments. Employers - Create detailed job descriptions, to include position’s purpose - What education and/or experienced is needed to successfully accomplish the essential functions of the job? - Consider alternatives to full-time employment, such as work experiences, internships and apprenticeships Know what you can and should not ask during an interview First and foremost, interviewing a Veteran or wounded warrior is no different than interviewing any other candidate. It is important to ask all questions of all candidates, without exception. A good interviewing practice is to ask all candidates the following question: “Have you read the job description? Yes or no - can you, with or without a reasonable accommodation, perform the essential functions of the job?” You are not asking the candidate to disclose whether or not they have a disability, but are ensuring they can perform the essential functions of the job. In addition, you make it clear that as an employer you understand this process and are not likely to discriminate due to disability.
• “What type of discharge did you receive?” Only federal agencies - or those that assign a Veterans’ hiring preference or have requirements related to security clearances, should ask questions related to military discharge (especially in a pre-employment phase). • “I notice that you’re in the National Guard...are you going to be called up for duty anytime soon?” This is similar to asking a woman if she is planning to have a baby anytime in the near future. Remember, it is unlawful to discriminate against someone because of membership in the National Guard or Reserves, a state defense force or another state or Federal Reserve unit. • “Did you see any action over there?” “Did you lose your arm getting hit by an IED?” “Have you seen a psychiatrist since you’ve been back?” Questions related to deployments to Iraq or Afghanistan may be interpreted as trying to determine if the Veteran has PTSD or TBI and could be construed as violation of the Uniformed Services Employment and Reemployment Rights Act (USERRA) or the Americans with Disabilities Act (ADA). Most of the standard behavioral interview questions should be no different than those you would typically ask any other candidate (e.g., management style, problem solving, strengths/weaknesses related to teamwork, etc.). Consider phrasing your questions to ensure the interviewee clearly understands that you are referring to both civilian and military work experience. For example: • “Tell me about the type of training and education you received while in the military.” • “Were you involved in day-to-day management of personnel and/ or supplies? How many people did you supervise? If you managed resources such as supplies, inventory and/or equipment, what was the net worth of these resources?” Additionally, it is perfectly fine to thank the individual for their service to our country - plain and simple. Did You Know? Many civilian employers have admitted challenges when it comes to evaluating a Veteran during a job interview. This is often because Veterans have difficulty explaining how their military experience relates to the needs of the civilian employer. Additionally, while Veterans will be quick to praise their team or unit, they are typically not self-boastful in interviews, so civilian employers can often feel like Veteran candidates are not “selling themselves.” It is important to keep in mind that the concept of “professional presentation” is often different for former military personnel than for civilians. Military personnel (particularly those recently separated/ discharged from military service) will often present themselves with eyes forward, back straight, and using “Sir” and “Ma’am” vocabulary (often without much smiling). This behavior may be misperceived as cold, distant, unapproachable or demonstrating a lack of social skills. While this is generally not the case, these perceptions have caused many Service Members to be discarded early in the interview process. Employers should recognize that former military personnel may need permission to “speak freely” to create a comfort level where they can appear in the most positive light. Hiring managers should be encouraged to be patient with these candidates and to “dig deep” with follow up questions to find qualities that are not apparent at first glance. It is worth remembering that Veteran candidates, unlike many civilian candidates, may not be accustomed to interviewing and may require a little latitude.

OCTOBER 17, 2018 REPORT #14 OHIO SUPREME COURT RULES IN FAVOR OF INSURANCE COMPANY IN CONSTRUCTION GENERAL LIABILITY INSURANCE CASE The Ohio Supreme Court recently issued its opinion in the Ohio N. Univ. v. Charles Constr. Servs., Inc., reversing the Court of Appeals decision, and instead, finding coverage did not exist for faulty work of a subcontractor under the construction general liability insurance completed operations provisions. The Court held the insurer is not required to defend a commercial general liability policyholder against suit by property owner, because subcontractor faulty workmanship is not fortuitous and not an occurrence. OHBA and NAHB filed a joint amicus urging affirmation of Appeals Court decision finding coverage under the policy. The Court acknowledged policyholders pay premiums for additional endorsements, such as completed operations coverage, but failed to expand its analysis to what then is covered under such provisions. The Court continued to suggest proponents take the issue to the legislature to modify the statutory definition of ‘occurrence’, if it is intended to include faulty workmanship. This brings about more questions: what does general liability insurance cover, as currently written; what other endorsements are being offered and at what additional cost? OHBA is currently reviewing the practical impacts of this recent decision, and continues discussions with both construction and insurance industry stakeholders. WITH ELECTION LESS THAN A MONTH AWAY, RESULTS HARD TO PREDICT With early voting underway, and November 6th less than a month away, many of the races are still very much up in the air. There seems to be agreement, however, the results will be based on voter turnout. At this point, there are so many races up for grabs, including all the statewide offices, all 99 Ohio House seats, and 17 Ohio Senate seats. In the more contested races, both sides are optimistic, but remain uncertain about turnout. It is unclear what lame duck, or next year will bring until after the results of November 6th are counted up and winners announced. RULES AND REGULATIONS GOVERNING EXHIBITS MANAGEMENT: The North Coast Building Industry Association (NCBIA) shall be deemed Event Management and shall have all rights thereto assigned. (From here on the North Coast BIA will be referred to as NCBIA). NCBIA reserves the right to increase and/or decrease the size of any event and/or reassign Exhibitor space numbers prior to any event(s). CHARACTER OF EXHIBITS: NCBIA reserves the right to approve all exhibits. The exhibits and the distribution of promotional material shall be limited to the confines of the Exhibitor’s space. Under no circumstances shall any Exhibitor be permitted to attract attention to his/her exhibit in such a way as to distract or interfere with the other exhibitors. REGISTRATION: Exhibitors and their employees at the Event should wear a registration badge and/or tag for proper identification. SET UP/REMOVAL OF EXHIBITS: All exhibits must be placed and ready at the opening of the show and no movement of exhibits will be permitted until after the close of the show. Exhibits must remain intact until after closing of the show and be removed within such time as may be specified by the NCBIA. Strict compliance with move in and move out times is mandatory. A fine for late move in and/or early move out will be assessed at the discretion of the NCBIA. RAFFLES: No exhibitor other than Event Management shall conduct any game, lottery and/or similar activity unless authorized by the NCBIA. CARE OF EXHIBITS/AISLES: The NCBIA will maintain the aisles and exhibit areas in a clean condition. Aisles must be kept clear at all times. Seating for buyers must be confined within the exhibitor’s space. Exhibitors are requested at all times to cooperate with the NCBIA in maintaining all exhibits in perfect condition and to provide supervisory personnel at all times during exhibit hours. *In the event that the Exhibitor does not exhibit as provided herein or fails to comply in any respect with the terms of this agreement, the NCBIA management shall have the right without notice to the Exhibitor, to license the use of said space to any other company, enterprise, person or persons and the Exhibitor agrees to pay any deficiency, loss and/or damage sustained by the NCBIA as a consequence of such failure to occupy space as provided in this agreement. In addition, it is agreed that should the NCBIA be unable to license the use of said space as herein provided, it shall have the right to occupy said space for its own purposes without prejudice to its rights against Exhibitor pursuant to this agreement, including but not limited to the payment of a license fee. *Exhibitor will not sub license any part of the space herein provided for without the express written consent of the NCBIA. In the event the exhibit premises are destroyed or rendered unavailable for any reason whatsoever (whether before or during the scheduled exhibition), the rights of the Exhibitor under this agreement shall be limited to a pro-rated refund of the amount paid for the space licensed.

COMPLIANCE WITH LAWS: Exhibitors must comply with all federal, state and local laws, regulations and rules that may be in force during the exhibit. INSURANCE: Exhibitors who desire insurance on their exhibits must procure same at their own expense. The NCBIA will not be responsible for any losses incurred by the Exhibitor or its employees because of theft, damage or for any cause whatsoever nor to any property of employee(s) or Exhibitor(s) while en route to or from exhibit. The Exhibitor agrees to make no claim for any reason whatsoever, including negligence, against the NCBIA or NCBIA management, its agents or employees while in the show quarters. Exhibitor agrees to indemnify and hold harmless the NCBIA against any loss, damage or expense (including reasonable attorney’s fees) act or omission of Exhibitor or its agents connected in any way with its exhibits. DECORATIONS, SIGNS, ETC: All equipment in conjunction with the exhibit must be provided by the Exhibitor. However, only the sign of the firm covered by the Exhibitor’s agreement may be placed in the booth or upon printed list of exhibitors or program. All decorations must conform to fire regulations. No exhibit is permitted that is more than eight feet high, or that obstructs other exhibits due to its design or size. PAYMENT DEFAULT: A service charge of 15% per month is applicable on all balances after 30 days. In the event any unpaid amount is placed for collection, client and/or agent agree to pay all collection costs, including reasonable attorney’s fees. REFUND POLICY: A partial refund will only be given with a minimum of 45 day’s notice prior to the event. The NCBIA retains the right to use their own discretion when deeming the reason for refund as a viable one to determine whether refund shall be granted. *The NCBIA shall have the right to make such rules and regulations in connection with the Exhibition as it may deem proper and may amend them at any time, and the NCBIA shall have the full power in the matter of interpretation and enforcement thereof. The rules and regulations heretofore referred to are printed on this agreement and are incorporated herein by reference. Exhibitor agrees to abide by said rules and regulations. *It is agreed that this instrument is a license, and not a lease, and that no leasehold or tenancy is intended to be or shall be created hereby. *This agreement cannot be varied, modified or canceled by the Exhibitor without the express written consent of the NCBIA.
