75th Anniversary Celebration It’s hard to believe summer is over. We’ve had so many fun events this summer- a few member mixers, the annual cookout, and the annual golf outing. We’re heading into the homestretch of the year and we’re all focused on meeting our annual goalsbut we have one more celebration. 2019 is the 75th anniversary of the beginning of the North Coast Building Industry Association. October 16th we will be celebrating what we have accomplished as an association over the last 75 years. I hope you can join us. We’ll look back at where we started, where we’ve been, and look to the future. We’ll also be voting in members of the association that have stepped up to be part of our board of directors for 2020. We are a trade association made up of businesses that work tirelessly day in and day out to make the American Dream of Homeownership a reality. Some do it by swinging a hammer and others do it by helping homebuyers with other aspects of the homebuilding process. Being a member of the NCBIA means you are a member of the National Association of Home Builders and the Ohio Home Builders Association- you are really a member of 3 associations. The NAHB and OHBA have lobbyists in Washington D.C and at the statehouse in Columbus fighting for affordable housing. I am proud to be a leader member of these organizations that are on the frontlines of making housing affordable for all. We’ll have past leaders and members of the NCBIA at our “birthday bash”. I encourage all the less “seasoned” members of the association- new members and members of our younger generation- to go up to our long-time members and leaders of the past and introduce yourself & get to know them. We can learn so much by talking less and listening more. The association is fueled by volunteers who give so generously of their time, talents, and financial support. Without them, there’d be no Association. I’d like to thank all the previous leaders and volunteers for their hard work. If you’re a new member or part of our “next gen” of members and possible future leaders- thank you for seeing the value in being part of our Association & I hope you’ll look at our list of committees you can become a part of and join one for 2020. We’re planning now for the future and we need all of you!

The association has experienced growth the last few years, but we still have more work to do both here at home and in Washington DC and at the statehouse. We need to continue to focus on making the public aware of our Association & the tremendous resource we are for them. I challenge all members to share information about the NCBIA and what we have to offer with our clients, colleagues, friends, family, and neighbors-whether it be on social media (we are on Facebook & Twitter) or in conversation. 2020 is an election year and I urge all of our members to donate to our BUILD PAC so we can make donations to candidates who are fighting for what this Association stands for. I’d like to thank Jason Scott for being our BUILD PAC chair for 2019 & to all those that have donated in 2019. If you have any questions about BUILD PAC- feel free to reach out to Jason directly or to our Executive officer, Judie Docs. We also need to keep the Association and what it offers to its members relevant so that we can continue to grow our membership. If there’s some educational offering or event you’d like to see the NCBIA offer- please bring it to myself or your Executive Officer, Judie’s attention. CELEBRATING The Seasons Et Al It’s the end of summer; football season; schools starting. It seems everyone celebrates something. So here at OHBA we may want to celebrate the beginning of a recognition by local government of a shortage of affordable housing and the need for more of it. It’s positive, for starters. Now, we have to come together and do something about it. There is a clear trail of government involvement making housing less affordable. So, this all begs the question; how will more government make housing more affordable? Perhaps it’s my many years here which causes me to be a bit leery of what remedies may be proposed. I see one major Ohio city raised the real estate conveyance to create more affordable housing. Hmmm. A recent enactment of the legislature to create property tax relief encouraging more affordable housing development was vetoed as it may increase speculative development. Hard to understand that one. Every unit of local government has steadfastly opposed most efforts to ease property tax relief for housing development as it would impose great harm to them. This all brings us back to just how will more affordable housing be created. It’s clear a serious shortage exists. Solutions will involve some serious thought and analysis. NAHB and others have found, through thoughtful study, that up to 25% of housing costs are due to excessive regulations.

REBOUNDS AND REVERSALS: Construction and the Fed

D

eclining interest rates through the first half of 2019 bolstered

housing demand. After a period of somewhat elevated inventories of newly built single-family homes, market conditions are now supporting a rebound in home building. The NAHB/Wells Fargo Housing Market Index has posted consistent gains, and is registering a positive reading of 68 — the highest since last fall. Consequently, the rate of single-family permits has increased since April, and single-family housing starts have expanded since May. August’s annual rate of single-family starts (919,000) was the second highest since the Great Recession. Nonetheless, due to the declines a year-to-date basis, and are on pace to close out the year below the 2018 totals. As the rest of the economy grapples with slowing prospects, the Federal Reserve continued its gradual pivot to a more dovish policy stance, reducing the Federal Funds rate by 25 basis points in September. This action reverses half of the interest rate tightening it undertook in 2018, which is an admission by the Fed that the prior policy path was too aggressive and threatened an economic downturn. While the policy reversal is positive for home building, there are signs that short-term credit market conditions are under additional stress, requiring further action by the Fed to ensure liquidity. This is not a cause of immediate concern for the overall economy, but short-term interest rates will be closely monitored in the months ahead. For example, while mortgage interest rates declined over much of 2019, interest rates on builder and land developer loans have remained somewhat elevated.

Builder Confidence Hits Yearly High in September

uilder confidence in the market for newly-built single-family homes rose one point to 68 in September from an upwardly revised August reading of 67, according to the latest National Association of Home Builders/Wells Fargo Housing Market Index (HMI). Sentiment levels have held in the mid- to upper 60s since May. Builders’ optimism in recent months is being fueled by low interest rates and solid home buyer demand. However, the trade dispute with China is a growing headwind for the industry, both raising the cost of construction inputs and holding back demand in parts of the country that rely on the manufacturing sector. NAHB’s latest Home Building Geography Index shows that home construction in manufacturing areas started weakening in the last quarter of 2018. Derived from a monthly survey that NAHB has been conducting for 30 years, the NAHB/Wells Fargo Housing Market Index gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. The HMI index gauging current sales conditions increased two points to 75 and the component measuring traffic of prospective buyers held steady at 50. The measure charting sales expectations in the next six months fell one point to 70. Looking at the three-month moving averages for regional HMI scores, the Northeast posted a two-point gain to 59, the West was also up two points to 75 and the South moved one point higher to 70. Housing Starts Rebound in August BY DANUSHKA NANAYAKKARA-SKILLINGTON Total housing starts posted a 12.3 percent increase in August (1.364 million units) compared to an upwardly revised July estimate of 1.215 million units, according to the joint data release from the Census Bureau and HUD. Relative to August 2018, total starts are 6.6 percent above the annual pace of 1.279 million units. Single-family production in August posted a monthly increase of 4.4 percent to a seasonally adjusted annual rate of 919,000. Single-family starts in July were revised up to 880,000 units. The three-month moving average for single-family in August is 888,000 units. On a year-to-date basis, single-family starts are 2.7 percent lower as of August relative to the first eight months of 2018. Single-family permits, a useful indicator of future construction activity, rose 4.5 percent in August (866,000 units) compared to July but have registered a 4.1 percent loss thus far in 2019 compared to last year. Regional data show, on a year-to-date basis, positive conditions for single-family construction only in the South (+1.1 percent). Single-family construction is down 6.9 percent in the West, 4.8 percent in the Midwest, and 11.9 percent in the Northeast.

Multifamily starts (2+ unit production) registered an increase of 32.8 percent in August to a 445,000 annual rate compared to July. On a yearto-date basis, multifamily 5+ unit production is slightly up 0.4 percent thus far in 2019, while multifamily 5+ unit permitting is trending higher with an increase of 4.2 percent relative to the first eight months of 2018.

RULES AND REGULATIONS GOVERNING EXHIBITS MANAGEMENT: The North Coast Building Industry Association (NCBIA) shall be deemed Event Management and shall have all rights thereto assigned. (From here on the North Coast BIA will be referred to as NCBIA). NCBIA reserves the right to increase and/or decrease the size of any event and/or reassign Exhibitor space numbers prior to any event(s). CHARACTER OF EXHIBITS: NCBIA reserves the right to approve all exhibits. The exhibits and the distribution of promotional material shall be limited to the confines of the Exhibitor’s space. Under no circumstances shall any Exhibitor be permitted to attract attention to his/her exhibit in such a way as to distract or interfere with the other exhibitors. REGISTRATION: Exhibitors and their employees at the Event should wear a registration badge and/or tag for proper identification. SET UP/REMOVAL OF EXHIBITS: All exhibits must be placed and ready at the opening of the show and no movement of exhibits will be permitted until after the close of the show. Exhibits must remain intact until after closing of the show and be removed within such time as may be specified by the NCBIA. Strict compliance with move in and move out times is mandatory. A fine for late move in and/or early move out will be assessed at the discretion of the NCBIA. RAFFLES: No exhibitor other than Event Management shall conduct any game, lottery and/or similar activity unless authorized by the NCBIA. CARE OF EXHIBITS/AISLES: The NCBIA will maintain the aisles and exhibit areas in a clean condition. Aisles must be kept clear at all times. Seating for buyers must be confined within the exhibitor’s space. Exhibitors are requested at all times to cooperate with the NCBIA in maintaining all exhibits in perfect condition and to provide supervisory personnel at all times during exhibit hours. *In the event that the Exhibitor does not exhibit as provided herein or fails to comply in any respect with the terms of this agreement, the NCBIA management shall have the right without notice to the Exhibitor, to license the use of said space to any other company, enterprise, person or persons and the Exhibitor agrees to pay any deficiency, loss and/or damage sustained by the NCBIA as a consequence of such failure to occupy space as provided in this agreement. In addition, it is agreed that should the NCBIA be unable to license the use of said space as herein provided, it shall have the right to occupy said space for its own purposes without prejudice to its rights against Exhibitor pursuant to this agreement, including but not limited to the payment of a license fee. *Exhibitor will not sub license any part of the space herein provided for without the express written consent of the NCBIA. In the event the exhibit premises are destroyed or rendered unavailable for any reason whatsoever (whether before or during the scheduled exhibition), the rights of the Exhibitor under this agreement shall be limited to a pro-rated refund of the amount paid for the space licensed.

Exhibitor agrees to indemnify and hold harmless the NCBIA against any loss, damage or expense (including reasonable attorney’s fees) act or omission of Exhibitor or its agents connected in any way with its exhibits. DECORATIONS, SIGNS, ETC: All equipment in conjunction with the exhibit must be provided by the Exhibitor. However, only the sign of the firm covered by the Exhibitor’s agreement may be placed in the booth or upon printed list of exhibitors or program. All decorations must conform to fire regulations. No exhibit is permitted that is more than eight feet high, or that obstructs other exhibits due to its design or size. PAYMENT DEFAULT: A service charge of 15% per month is applicable on all balances after 30 days. In the event any unpaid amount is placed for collection, client and/or agent agree to pay all collection costs, including reasonable attorney’s fees. REFUND POLICY: A partial refund will only be given with a minimum of 45 day’s notice prior to the event. The NCBIA retains the right to use their own discretion when deeming the reason for refund as a viable one to determine whether refund shall be granted. *The NCBIA shall have the right to make such rules and regulations in connection with the Exhibition as it may deem proper and may amend them at any time, and the NCBIA shall have the full power in the matter of interpretation and enforcement thereof. The rules and regulations heretofore referred to are printed on this agreement and are incorporated herein by reference. Exhibitor agrees to abide by said rules and regulations. *It is agreed that this instrument is a license, and not a lease, and that no leasehold or tenancy is intended to be or shall be created hereby. *This agreement cannot be varied, modified or canceled by the Exhibitor without the express written consent of the NCBIA.

EPA Repeals Obama-Era WOTUS Rule

In a positive development to resolve years of uncertainty over where federal jurisdiction begins and ends, the Environmental Protection Agency today rescinded the Obama-era “waters of the U.S.” (WOTUS) rule.

And, because the proposed rule narrows the extent of federal jurisdiction by excluding isolated water bodies, “ephemeral” waters that only form in response to rain, and most ditches, builders should require fewer Clean Water Act permits for isolated or temporary wetlands or water bodies. “NAHB commends the EPA and U.S. Army Corps of Engineers for repealing the 2015 WOTUS rule that vastly expanded federal overreach over water and land use by regulating man-made ditches and isolated ponds on private property,” said NAHB Chairman Greg Ugalde. “By repealing the 2015 rule, the EPA and Corps have finally provided consistency among all 50 states, which will make the federal permitting process more predictable and affordable,” he added. “Now, the agencies need to finalize a new definition that restores common sense to the regulatory process by respecting states’ rights and balancing economic and environmental concerns.” The 2015 WOTUS rule has been subject to several legal challenges that halted its implementation nationwide. Last month, the U.S. District Court for Georgia issued a decision finding that the substance of the rule violates the Clean Water Act. The court remanded the rule back to the agencies to fix it. Prior to EPA’s repeal announcement, the Obama-era rule was in effect in 22 states and the District of Columbia, and the previous regulations issued in 1986 were in effect in the remaining 28 states. The EPA decision means the 1986 rule will now be in effect in nationwide until a final replacement rule is issued. The Trump administration has proposed a new WOTUS rule that NAHB generally supports. The proposed rule would clarify the extent of federal oversight and correct the vast overreach of prior rules. Once finalized, builders and developers will be better able to determine for themselves whether they will need federal permits for construction activities.

LEGISLATIVE REVIEW

SEPTEMBER 18, 2019 REPORT #13 OHIO SUPREME COURT RULES IN FAVOR OF PROPERTY OWNER; A VICTORY FOR OHBA After months of anticipation, awaiting the Ohio Supreme Court’s opinion in Gloria Wesolowski v. City of Broadview Heights Planning Commission, yesterday the Court announced it affirmed the court of appeals, ruling in favor of Gloria, 5-2. As you are likely aware, this is the case in which OHBA filed an amicus brief and ended up presenting oral arguments in support of Gloria Wesolowski. This is not only a victory for OHBA in its first appearance before the Ohio Supreme Court, but a win for all property owners. In a two part find the Court held 1) R.C. 711.09(C), including 30-day time limit for considering subdivision applications, applies to city planning commissions; and 2) a home rule municipality’s adoption of subdivision regulations constitutes an exercise of its police powers and the Ohio Revised Code 711.09(C) prevails over city’s subdivision regulations. RESTORING GENERAL LIABILITY COVERAGE FOR DAMAGE RESULTING FROM FAULTY WORK OF A SUBCONTRACTOR OHBA Staff attended a continuing legal education seminar including discussion from attorneys with key advice for restoring CGL Completed Operations Hazard coverage following the recent Supreme Court ruling damage from faulty work of subcontractor is NOT an occurrence, thus NOT covered under the policy. Quite simply, the advice is 1) You must ASK, 2) not all endorsements are created equal, those most highly recommended, modify the definition of “occurrence” to very specifically include damage resulting from faulty work, and 3) You must ASK. It appears, there may only be a minimal increase in premium for these additional endorsements, but it is crucial you confirm the coverage in included in your policy. NAHB Committees & Councils If you’ve ever wanted to serve on one of the numerous committees or councils for our National Association of Home Builders, now is the time to make an application to do so. The application process started this past week with the final deadline being November 3, 2019. The applications are for the 2020 year and the terms start immediately after the International Builders Show. The qualifications and the expected requirements are included in the link below, where you can sign up. If you’re looking to do so and you have any questions and/or need a referral name, give me a call and I can probably help. I have been involved and serving on various committees since the early nineties and have found the experience to be very worthwhile and rewarding, in many ways. Ohio Homebuilder Celebrates a Century of Construction The Haverstick family has been a fixture in their local home building community since 1919, when Joseph N. Haverstick established himself in Dayton, Ohio, to pursue his boyhood dream of becoming a builder. Born on a farm in nearby Greene County, he cut his teeth on construction initially as the family property repairman, where he would not only work on projects but also occasionally create his own tools to help finish the job. The Haversticks were the first Dayton builders in the moderate to low-cost housing field, according to a 1948 Dayton Daily News story. “They did not have all the tools they have today, or prefab, so it was a real hands-on type of experience,” said Kim Haverstick, his grandson and current owner of Haverstick Builders Dayton Inc., of the company’s early home building projects. Haverstick’s sons, Joseph B. and Robert J. Haverstick, joined the company in the 1930s. In 1937, they purchased real estate in the Dayton area that they would develop over a period of time into 77 homes, emphasizing simplicity and affordability. These two-bedroom homes averaged around 700 square feet, with a price tag of $3,200 to $3,800 each (at a time when less than $10,000 was considered low cost). “There was a living room and a dining room and a kitchen on first floor, and two bedrooms upstairs,” Kim noted. “It’s about the same as a nicesized little apartment, but it was a house.” The Haversticks continued to expand their business, including commercial construction alongside residential and remodeling work. The industry was also growing, and Joseph B. Haverstick was a player in helping to form not only the Home Builders Association of Dayton (originally the Home Builders Association of Montgomery County) but what would become NAHB. As the first president of the HBA of Dayton in 1942, and again in 1945, Joe oversaw the HBA’s efforts to allocate building materials for local builders during World War II, when restrictions were placed on the amount of lumber that could be purchased. Joe’s work in the Federation continued as president of the Ohio HBA and chairman (then president) of NAHB in 1956. “He really, for the first 15 years of the association, was heavily involved in it and spoke at a lot of events and promoted NAHB,” observed Kim, who missed most of kindergarten the year his dad was president as he traveled the country with his parents. “It’s always been something he was very proud of.” Joe was recognized for his efforts to create a unified building industry through induction into the National Hall of Fame in 1978. “I felt in time we would become a strong group to represent the home building industry,” Joe stated in a previous interview with NAHB, noting the Federation’s evident potential early on and how he had watched it grow over the decades. Kim has shifted the focus of the business toward remodeling projects, such as this room addition from the 2000s. By 1971, Kim and his brother Ned had also joined the family business, alongside their father, uncle and cousin Brian. Federation leadership would carry on with the next generation as well: Both Ned and Kim served as president of the HBA of Dayton in 1978 and 2010, respectively. (Robert Haverstick also served as president of the HBA of Dayton in 1950.) Since 1987, Kim has been operating the business as its president. After decades of commercial and residential construction experience, Kim and his wife, Joanie, have switched the focus of the family’s business solely to remodeling. However, Kim continues to address many of the same issues his father did, including housing affordability and labor shortages. “During my time as member of the board for the HBA of Dayton and Ohio HBA, I really got to learn how important it is to stay on top of legislation that’s going on in in our industry,” Kim shared. “I believe that building codes and local government intervention are having a significant effect on affordable housing. However, the severe lack of qualified workers is now affecting the cost and time it takes to complete a project.” “I think my father would agree if he could put his two cents in,” he added. Kim continues to remain active in his state and local HBA to help in these efforts, and sees positive signs, such as builders increasing their labor prices, on the horizon. As the industry continues to innovate its business and building practices, there will no doubt be many more exciting milestones to come. September 2019
