We Thank OUR ASSOCIATES! September was Associate Member Appreciation Month. The North Coast Building Industry Association would not be where we are today without our fantastic associate members. What is an associate member? An associate member is any of our members that supports the builders and remodelers in the NCBIA. Our associates range from bankers to mortgage lenders, roofers to flooring, alarm companies to landscapers. Most of our membership here are associate members and they are truly the driving force that keep us moving. Look at the committees that we have here; every single one has an associate member as either the chair or a co-chair. They run our events, assist our builders with anything they may need, and help keep our association diving forward and keeping us relevant. I would be remiss if I did not mention the great associate members that are on our board of directors; Sara Majzun-Garwood; BCT Alarm Services, Liz Schneider; Dollar Bank, John Toth; Floor Coverings International, Mark Craig; Mark Craig Esq, Dennis Willis; Action Coach, Emily Mae Brunke; Northwest Bank, Jason Rodriguez; Lorain County JVS, and Mary Felton; Guardian National Title. These individuals volunteer their time to help me keep the association running and in the public’s eye. They run our events from our golf outing to our home show and everything in between! First and foremost, our thoughts go out for the safety and health of everyone during this challenging time. The pandemic is an unprecedented health event that has drastically affected the worldwide economy, including the residential construction industry. Our association is here to help navigate this new terrain and minimize disruption to your business. NAHB and OHBA took the lead in getting the Department of Homeland Security to designate residential construction as an “Essential Infrastructure Business” meaning construction can continue in places under stayat-home orders, meaning that you were able to could continue to work. Who do you know who might benefit from the connections, discounts, opportunities and programs that the NCBIA provides? Here are some tips to keep in mind when you meet someone who might be a good fit for our organization. What questions can you ask to find out what benefits would be helpful to them? 1. 2021 Design & Construction Week WILL BE AN ALL-VIRTUAL EVENT
Due to health and safety concerns and ongoing travel restrictions stemming from the COVID-19 pandemic, NAHB and the National Kitchen & Bath Association (NKBA) today regretfully announce that the 8th annual Design & Construction Week® (DCW) featuring NAHB’s International Builders’ Show® (IBS) and NKBA’s Kitchen & Bath Industry Show® (KBIS) will no longer be an on-site event. Instead, the two groups are planning a robust, all-virtual event. Design & Construction Week was scheduled to take place on Feb. 9-11, 2021, at the Orange County Convention Center in Orlando, Fla. The new all-virtual DCW 2021 will still take place the week of Feb. 8 with extended programming. “Out of an abundance of caution and concern for the safety of our exhibitors, attendees and the thousands of on-site workers who support the premier event of the residential construction industry, we feel the only prudent course is to make this year’s show a virtual event,” said NAHB Chairman Chuck Fowke. “We have plenty of great virtual educational programs, innovative products, services and workshops on tap, and we are very excited about the 2021 show. It’s an opportunity to set a precedent for the industry by producing a dynamic virtual trade show, and we look forward to a very successful Design & Construction Week.” “This difficult decision comes following months of lengthy conversations with NAHB and Emerald,” said NKBA CEO Bill Darcy. “The safety and well-being of our attendees, partners, exhibitors, site workers and staff has always been our top priority. WHITE HOUSE JOINS NAHB in Opposing House Energy Bill
T
he White House today joined NAHB in opposing House energy bill H.R. 4447 due in part to problematic language regarding building codes that would harm housing affordability. NAHB has come out in strong opposition to the legislation because it would needlessly raise home construction costs while doing little to boost energy efficiency in the housing sector. NAHB ran a strong grassroots campaign asking our members to reach out their congressional members and urge them to oppose the legislation. Over the past two years, NAHB has also met with the White House to discuss our concerns regarding the building code language and we are pleased to see that the administration shares our concerns as well. The White House Statement of Administration Policy opposing H.R. 4447 said the bill would lead to higher energy costs “by setting rigid energy savings and water consumption reduction targets for Federal agencies, requiring State and local governments to establish strict building codes that are not grounded in available technologies, and mandating a rigorous transition from hydrofluorocarbon use in the private heating and cooling sector.�

Department of Labor Proposes New Independent Contractor Rule
T
he U.S. Department of Labor (DOL) has announced a proposed rule clarifying the definition of employee under the Fair Labor Standards Act (FLSA) as it relates to independent contractors. In a press release, the DOL said its proposed rule: •

Adopts an “economic reality” test to determine a worker’s status as an FLSA employee or an independent contractor. The test considers whether a worker is in business for himself or herself (independent contractor) or is economically dependent on a putative employer for work (employee); Identifies and explains two “core factors,” specifically the nature and degree of the worker’s control over the work, and the worker’s opportunity for profit or loss based on initiative and/or investment. These factors help determine if a worker is economically dependent on someone else’s business or is in business for himself or herself; Identifies three other factors that may serve as additional guideposts in the analysis: the amount of skill required for the work; the degree of permanence of the working relationship between the worker and the potential employer; and whether the work is part of an integrated unit of production; and Advises that the actual practice is more relevant than what may be contractually or theoretically possible in determining whether a worker is an employee or an independent contractor.
NAHB has called on DOL to take steps to provide greater clarity to employers and workers in light of the often conflicting federal tests that exist to determine who is an employee and who is an independent contractor. The proposed rule would also provide more clarity to shield more employers from misclassification claims, which occur when an employer incorrectly defines a worker as an independent contractor rather than an employee. NAHB will review the rule in more detail once it is published in the Federal Register, and interested parties will have 30 days to submit comments. HOME VALUES, Owners' Equity Rise in 2Q20

s the novel coronavirus took hold in the second quarter, households’ market values continued to rise, per second quarter 2020 Federal Reserve Flow of Funds report. In the second quarter, the aggregate value of all household mortgages rose by $80 billion to $10.6 trillion, while the aggregate value of the households’ market values, i.e., that of all owner-occupied real estate including vacant land and mobile homes, increased by $450 billion to $30.8 trillion. The result was an increase in net equity by $370 billion to $20.2 trillion. In the previous quarter, net equity stood at $19.8 trillion. A recent study by the Federal Reserve showed that among the various categories of expenditures spent from “equity extraction”, the highest included home improvements and home maintenance. Such residential investment bodes well for future values of the homes. It is also worth noting home equity loans and lines of credit (HELOCs). Home equity loans and HELOCs are forms of closedended and open-ended credit, respectively. In the second quarter of 2020, home equity loans in the U.S. decreased by a total of $83.8 billion, of which $61.2 billion was a decrease in lending by U.S. banks. On one-to-four-family residential mortgages, a category which includes property on farm houses, holdings of home equity loans and HELOCs decreased by a combined total of $21.2 billion to $474.1 billion.

SHOULD BE a Fun Few Months Usually I need to scurry a bit to find a topic for this column. However, 2020 is now the year to remember; and its only three quarters through. COVID is the main story and will likely continue to be through next year. Fortunately, we secured the classification of “essential” allowing business to continue as long as safety protocols are observed. This lessens the load a bit. Of some inconvenience to us was adjusted legislative schedules and meetings. Just a short time ago the statehouse was rocked with reports of a major scandal. The Speaker of the House was arrested along with a number of lobbyists. The federal charges involved a criminal “enterprise” conspiring to secure passage of a bill and later defeating a referendum effort to repeal its passage. That in itself is new activity well above the norm. What set the statehouse crowd to attention was the amount involved; over 60 million dollars. Yes, that is correct. It is spelled out in the federal indictment. In announcing the largest scandal in Ohio history, the federal prosecutor stated directly the feds are not through investigating yet. That certainly sent chills on this hot summer season of isolation through the statehouse community. As a result of the indictment, the House moved and dethroned the Speaker. The next step was to elect his replacement. This turned out to be another difficult episode. Eventually, Rep. Bob Cupp of Lima was elected. The winning margin was 1 vote. Apparently about half of the majority caucus differs on leadership styles. NOT DONE YET. In the last week, a few majority House members announced they are preparing articles to impeach Governor DeWine. That is something new to just about everyone on the street here. And just to keep the emotions running at a high-level, Labor Day is sure to set off a nasty presidential election. Happy to report though we at OHBA are faring well through all this. HOUSING MARKET Remains Strong but Labor Market Lags

ome building has been an undisputed bright spot for the economy as the recovery continues. New home sales are outpacing construction. In fact, recent Census data indicate that August new home sales of homes that have not started construction are 69% higher than a year ago. The ongoing shift to lower-density markets, as well as historically low interest rates, are further supporting housing demand. Data from the Mortgage Bankers Association finds that for the week ending Oct. 2, applications for purchase mortgages were 21% higher than last year. The duration of this hot housing market is dependent on a number of factors. Although low interest rates are expected to continue until at least 2023 because of forward guidance from the Federal Reserve, a mass deployed vaccine could reverse, in part, some of the geographic shifts in housing demand. And in the near term, the labor market will determine the endurance of both rental and for-sale housing demand. Economic data regarding employment have shown slowing improvement. Initial jobless claims totals have leveled off in recent weeks, registering between 800,000 and 1 million new claims since the end of August. Although this is an improvement over the large scale of job losses in March and April, the ongoing elevated count is a concern. (Jobless claims were averaging 200,000 to 300,000 before the recession.) This is consistent with the September BLS report, which found that the unemployment rate declined from 8.4% to 7.9% — a move in the right direction, but at a slower pace of improvement. However, residential construction gains continued. Builders and remodelers added 22,100 net jobs in September, and the open jobs rate in construction remained relatively high as of August. It is likely the home building sector will post a year-over-year gain in employment in the coming months as builders add workers to meet solid demand.

Soars to an All-Time High, Lumber Risks Remain
I
n a strong signal that housing is leading the economic
recovery, builder confidence in the market for newly-built singlefamily homes increased five points to hit an all-time high of 83 in September, according to the latest NAHB/Wells Fargo Housing Market Index (HMI) released today. The previous highest reading of 78 in the 35-year history of the series was set last month and also matched in December 1998. “Historic traffic numbers have builders seeing positive market conditions, but many in the industry are worried about rising costs and delays for building materials, especially lumber,” said NAHB Chairman Chuck Fowke. “More domestic lumber production or tariff relief is needed to avoid a slowdown in the market in the coming months.”
Looking at the three-month moving averages for regional HMI scores, the Northeast increased 11 points to 76, the Midwest increased nine points to 72, the South rose eight points to 79 and the West increased

35 years, the HMI gauges builder perceptions of current singlefamily home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. All the HMI indices posted their highest readings ever in September. The HMI index gauging current sales conditions rose four points to 88, the component measuring sales expectations in the next six months increased six points to 84 and the measure charting traffic of prospective buyers posted a nine-point gain to 73.

NAHB SEEKS QUICK RESUMPTION

resident Trump announced on Oct. 6 that he is calling off
coronavirus stimulus negotiations with Democrats until after the November election. NAHB believes both sides must resume talks immediately, and Chairman Chuck Fowke issued the following statement following Trump’s announcement: “The White House and congressional Republican and Democratic leaders need to put politics and posturing aside and think about the American people. It’s time for all sides to get back to the negotiating table and to quickly hammer out a coronavirus stimulus package that will provide economic relief to American homeowners, renters and small businesses.” The White House subsequently appeared to change course. On Oct. 9, Trump tweeted: “Covid Relief Negotiations are moving on. Go Big!” Treasury Secretary Steve Mnuchin made a $1.8 trillion offer to House Speaker Nancy Pelosi, who is insisting on a $2.2 trillion package. Mnuchin’s latest offer is an increase from the White House’s previous offer of $1.6 trillion. It is still unclear whether the two sides will reach an agreement.

fter hitting a 6-year low last month, consumer confidence bounced back in September, as consumers were more upbeat on outlook for economy and the job market. The Consumer Confidence Index, reported by the Conference Board, rose 15.5 points from 86.3 to 101.8 in September, the highest level since March 2020 and the largest monthly gain since April 2003. The Present Situation Index jumped 12.7 points from 85.8 to 98.5, and the Expectation Situation Index increased 17.4 points from 86.6 to 104, almost back to February level. Consumers’ assessment of current business conditions improved in September. The shares of respondents rating business conditions “good” remained rose by 2.3 percentage point to 18.3%, while those claiming business conditions “bad” fell by 5.9 percentage points to 37.4%. Meanwhile, consumers’ assessment of the labor market was also favorable. The share of respondents reporting that jobs were “plentiful” increased by 1.5 percentage points, while those saw jobs as “hard to get” decreased by 3.6 percentage points. Consumers were optimistic about the short-term outlook. The share of respondents expecting business conditions to improve increased from 29.8% to 37.1%, while those expecting business conditions to deteriorate fell from 20.7% to 15.8%. Similarly, expectations of employment over the next six months were favorable. The share of respondents expecting “more jobs” rose by 3.2 percentage points to 33.1%, while those anticipating “fewer jobs” declined by 5.6 percentage points to 15.6%. Despite the overall improvement, consumer confidence still remained below pre-pandemic levels and the Present Situation Index suggested that current economic conditions remained weak. The Conference Board also reported the share of respondents planning to buy a home within six months. The share of respondents planning to buy a home slightly rose to 6.4% in September. The share of respondents planning to buy a newly constructed home increased to 1.4%, and for those who planning to buy an existing home remained at 3%.

CONTINUING CLAIMS Continue to Decline BY JING FU
A
ccording to the Unemployment Insurance Weekly Claims Report released by the U.S. Department of Labor today, weekly initial jobless claims increased for the week ending October 10, while continuing claims, which lag initial jobless claims by one week, fell for the week ending October 3. Labor market continues to struggle to recover from the COVID-19 pandemic. In the week ending October 10, the number of initial jobless claims increased by 53,000 to a seasonally adjusted level of 898,000, from the previous week’s revised level. This week’s initial jobless claims were the highest number since August 22 and 218% higher than the prepandemic level of 0.3 million in the week ending March 14. It brought the 30-week’s total to 64.5 million. The four-week moving average increased to 8,000, from a revised average of 866,250 in the previous week. Meanwhile and perhaps more importantly, the number for seasonally adjusted insured unemployment (in regular state programs), known as continuing claims, decreased by nearly 1.2 million to a seasonally adjusted level of 10,018,000 in the week ending October 3. It is the fifth consecutive decrease and the lowest level after continuing claims hit 24.9 million in the early of May. The four-week moving average declined to 11,481,750 from the previous week’s revised average of 12,164,000. The seasonally adjusted insured unemployment rate decreased by 0.9 percentage point to 6.8% for the week ending October 3. The previous week’s rate was revised up by 0.2 percentage point from 7.5% to 7.7%. The U.S. Department of Labor also released the advanced number of actual initial claims under state programs without seasonal adjustments. The unadjusted number of advanced initial claims totaled 885,885 in the week ending October 10, an increase of 76,670 from the previous week. The chart below presents the top 10 states ranked by the number of advanced initial claims for the week ending October 10. Like last week, California, New York and Georgia had the most advanced initial claims. California was unchanged from last week, with 226,179 initial claims, as the state of California announced it is taking a two-week pause in its processing of initial claims for unemployment insurance benefits. New York reported 68,670 initial claims, followed by Georgia with 53,400 initial claims. South Dakota, Vermont and Wyoming had the least advanced initial claims across all the states. Meanwhile, about one third of states reported declines in advanced initial claims for the week ending October 10. Michigan (-4,793), Alabama (-1,258), and Oklahoma (-940) had the largest decreases in advanced initial claims. Indiana, Illinois and Massachusetts had the largest increases in advanced initial claims. Indiana reported an increase of 18,788 advanced initial claims, Illinois increased by 9,805 and Massachusetts increased by 9,582.

The Senate voted 22-8 along party lines for a conference committee's report on HB 606, a day after the House did the same. In conference committee, the bill's expiration date was extended from Dec. 31, 2020 to Sept. 30, 2021. An emergency clause was also removed. HB 199 ROOFING CONTRACTORS SENT TO HOUSE FOR VOTE; HOUSE ADJOURNED WITHOUT ACTION ON HB 199 The house rules committee voted to put HB 199 to require commercial roofing contractors to have a license, on the calendar for House session Tuesday. While OHBA was there to monitor any activity, given several concerns raised particularly with the prohibition on unlicensed subcontractors, it turned out to be a false alarm. After passing other pieces of legislation, the house abruptly adjourned without taking any action on HB 199. OHBA will continue to monitor upcoming session activity and plans to continue its discussions, if and when, HB 199 moves to the Senate for hearings. COVID-19 pandemic. The somewhat controversial legislation provides broad civil immunity during the public health crisis. It will be 90 days before the bill takes effect after an emergency clause was removed during negotiations between the House and the Senate. The conference committee to resolve also extended the law's end date from Dec. 31. to Sept. 30, 2021. The legislation proved divisive as it worked its way through the legislature. The Senate approved the conference report in a party-line vote, while the bill cleared the House 62-30 with a handful of Democrats joining Republicans in supporting its passage. Business groups had made the legislation a priority, saying it will provide businesses with confidence to remain open amidst the pandemic. HOUSE AND SENATE SESSION SCHEDULE UNCLEAR With lingering uncertainty arising from allegations against former House speaker Larry Householder, COVID-19, and the upcoming elections, it is unclear just when and how often the chambers will be back in session. OHBA continues to monitor any activity at the Statehouse and state agencies as discussions on what may or may not happen over the coming months.
ERAC APPEAL PROCESS MOVING FORWARD WITH AGENCY DISCUSSIONS OHBA's ERAC appeal filed in response to the most recent adoption of the general permit for impacts to ephemeral streams moves forward with an agreement to hold discussions with the OEPA and other industry groups also filing similar appeals. OHBA is working closely with all parties to draft a list of concerns and potential fixes to share with the agency. The state's draft permit was a result of the new federal WOTUS definition, excluding ephemeral streams from Army Corp jurisdiction. Thus, OEPA felt any impacts would become impacts to a water of the state and a permitting mechanism would be necessary. OHBA will continue to update on the process as the appeal moves forward.
SEPTEMBER 28, 2020 REPORT #15 The past week was the first full week of legislative activity over the past five months, and likely the last, until the November election. Most action was held as part of a resolution to a controversial bill being reconsidered. The legislation (HB 6) was the centerpiece of the FBI 60-million-dollar conspiracy. HB 6 is one issue which may bring the House and Senate back sooner. Nonetheless, this current session of the general assembly continues until the end of this year. Without a doubt, there will be a lame duck session. Hovering over the minds and moods of many is the election. All 99 House seats and half the Senate seats are up. With term limits, many are running for the first time. We expect about twenty competitive races in the House and five in the Senate. There is little chance the current party holding the majority in both houses will change, however, we expect the minority party will gain some seats. In terms of the presidential race, current polls have the President up slightly. It is unclear how that may influence spending and impacts on other races. Over the next few weeks, such spending and impacts may become clearer. Otherwise, in the legislature this week‌ HB 199 Roofing Contractors A few weeks ago, the house rules committee voted to put HB 199 to require commercial roofing contractors to have a license, on the calendar for House session. When the House again convened for session this past week, HB 199 was not brought forward for action, so will remain stalled in the house, for now. OHBA will continue to monitor upcoming session activity and plans to continue its discussions, if and when, HB 199 moves to the Senate for hearings. Resolution for HB 6 will not be a quick one. Plans for final action for multiple proposals to repeal HB 6 remain unclear as legislative committees hold ongoing hearings, while the democratic side continues to be angry. Both majority and minority leaders have the desire for some form of action on the nuclear subsidy law (HB 6) which is tied to criminal charges in the House. Repeal, replacement or delay are all actions discussed over the past week. Currently, HB 738, HB 746 and SB 346 are being vetted in committees. OHBA continues to monitor this issue and any potential impacts such energy policy may have on the homebuilding industry.

In a recent rule package for the Credible Data Program, the OEPA has proposed the addition of “state universities” to the definition of “state environmental agency” found within OAC 3745-4-02. Several industry groups submitted requests that this proposed amendment be removed. OHBA also submitted multiple questions, potential considerations and need for clarification, as to the impact of such a change. OHBA continues to monitor these rules and the agency’s response. BWC Board Approves 2nd Dividend this Year to Ease COVID-19 Financial Impact On September 25, 2020, the Board of Directors of the Ohio BWC approved yet another employer “Billion Back” dividend. This approximately $1.5 billion dividend will be sent to Ohio employers near the end of October 2020, after first applying the dividend to any unpaid balances. The BWC’s aim is to provide some immediate economic relief to employers amid the ongoing pandemic. This dividend equals approximately 100% of the premiums paid in policy year 2019. (This would be January 1, 2019 to December 31, 2019 for public employers and July 1, 2019 to June 30, 2020 for private employers.) Dividends like this, as well as previous ones, are possible because of strong investment returns on employer premiums, a declining number of claims each year, prudent fiscal management, and employers who work hard to improve workplace safety and reduce injury claims. Employers who did not complete their 2019 policy year True Up may be ineligible to receive this Billion Back Dividend. “Thank you to the BWC Board of Directors for approving a second round of dividends for Ohio employers,” said Governor DeWine. “The pandemic continues to impact businesses across Ohio, and we hope that this next round of dividends provides financial relief.” “We’re grateful our strong fiscal position allows us to assist our business community during these unprecedented times,” said BWC

Let’s Learn: Important BWC Acronyms •
RTW: Return to Work—The date when the injured worker has returned to employment.

TTD: Temporary Total Disability—Compensation paid by the Ohio BWC to an injured worker who is totally disabled from employment on a temporary basis.
•
MMI: Maximum Medical Improvement—The point where the allowed conditions in the claim have stabilized and no improvements and/or changes can be expected with reasonable medical probability.
•
IW: Injured Worker—The employee who has filed a workers’ compensation claim with the Ohio BWC.
•
EOR: Employer of Record—A term that both the Ohio BWC and the Ohio Industrial Commission use in describing who the employer is of the injured worker that filed the workers’ comp claim.
•
DOI: Date of Injury—The calendar date that the employee sustained the injury.
House Bill 81: Important BWC Changes Governor Mike DeWine has signed H.B. 81 and it became effective Sept. 15, 2020. H.B. 81 creates several important changes to Ohio Workers’ Compensation Law including: •
Reduces the statute of limitations for filing an application for Violation of Specific Safety Requirement (VSSR) to one year from the date of injury or occupational disease from two years. The new limit will apply to all claims occurring on or after Sept. 15, 2020.
•
Settlement of state fund claims can no longer be objected to by the state fund employer if both of the following apply: (a) the employee is no longer employed with the employer and (b) the claim is no longer within the date of impact for the employer’s experience rating.
•
In certain circumstances, expands the time you have to appeal an Industrial Commission decision from 60 days to 150 days for claims pending on or arising after September 29, 2017.
•
Increases the maximum amount of reimbursable funeral expenses in death claims from $5,500 to $7,500.
•
The Industrial Commission may now invoke continuing jurisdiction from within five years from the date medical services were provided or services rendered, rather than the date of payment. The change will apply to all claims occurring on or after July 1, 2020.
•
While testing of peace officers, firefighters, emergency medical workers, and corrections officers exposed to blood and bodily fluids on the job is already covered by workers’ comp, H.B. 81 expands that coverage. Beginning September 15, 2020, ORC 4123.026 extends payments of post-exposure testing to employees of detention centers and includes exposure to drugs or other chemical substances.
H.B. 81: Changes with “Voluntary Abandonment” In addition to the changes listed above, H.B. 81 also has reframed the conversation around whether a claimant has “voluntarily abandoned” his or her job. Prior to this recent decision, the voluntary abandonment case law offered an option to stop disability benefits (temporary total compensation “TT” and permanent total compensation “PTD”) if a claimant retired, quit or was terminated due to violation of a known work policy. The new legislation removes language surrounding “voluntary abandonment” and instead replaces it with a general guideline that PTD (ORC 4123.58) and TT (ORC 4123.56) may not be payable if the claimant “is not working for reasons unrelated to the allowed injury or occupational

disease”. This applies to all claims pending on and arising after 9/15/2020. What does this mean for an employer? While voluntary abandonment language has been removed from ORC 4123.56 and ORC 4123.58, the discussion will now focus on whether the claimant’s disability is related to the allowed conditions. This leaves the question of “voluntary abandonment” up in the air until this new legislation is tested and applied to real world Industrial Commission hearing determinations. This will give us guidance on how the Industrial Commission intends to interpret and apply this statute. In short, this legislation change is being closely watched by all parties participating in the workers’ compensation system. Attorneys for both sides of the conversation will provide recommendations and guidance as we navigate this change.

Another $1.5 billion for Ohio employers BWC delivers second dividend this year to ease COVID-19 impact
Frequently Asked Questions for Employers Why is BWC giving a dividend? We are issuing a dividend of up to $1.5 billion to ease the financial pressures your organization may be experiencing amid the coronavirus (COVID-19) pandemic. This is our second dividend of this magnitude this year, following Gov. DeWine’s order that his agencies do everything they can to mitigate COVID-19’s impact on Ohioans. Even after the dividend, the net position of the State Insurance Fund for injured workers remains strong due to investment returns, declining injuries and decreasing reserves. Please note: Because BWC is providing two dividends in the same year, we are not expecting to issue a dividend in 2021.
How much will an employer receive? BWC defines the private employer dividend as 100% of billed premium for eligible employers for the policy period of July 1, 2019, through June 30, 2020. BWC will apply the percentage to the blended premium amount. BWC defines the public employer dividend as 100% of billed premium for eligible employers for the policy period of Jan. 1, 2019, through Dec. 31, 2019. BWC will apply the percentage to the blended premium amount.
When will I receive my dividend? BWC will mail dividend checks to eligible employers in late October and early November.
I have an outstanding balance on my account. How will this impact my dividend? An employer who has an outstanding balance — including but not limited to deferred installments, balances in an appeal status and balances owed resulting from a transfer of experience or liability from a predecessor entity — will have its dividend payment reduced by the amount of the outstanding balance. If an employer’s outstanding balance exceeds the dividend amount, BWC will offset the employer’s account by the amount of the dividend. An employer whose dividend is applied to an outstanding balance will receive detail regarding how the dividend was applied on their next scheduled invoice. Employers will be able to see their updated account information at any time on bwc.ohio.gov.

Where will my check be sent? We will send dividend checks to the current address we have on file. Can I receive my dividend electronically? No. We are sending paper checks by mail only. In the event you lose your check and fail to cash one we re-issue, we will credit your BWC account.
Who is eligible for the dividend? BWC defines eligibility as follows. 1. State Insurance Fund employers (private employers or public employer taxing districts only). 2. The employer must have reported payroll greater than zero for the applicable policy period. 3. The employer must have been billed premium for the applicable policy period. 4. Employers must have completed their payroll true-up for policy year 2019 as of Oct. 2, 2020. 5. The employer must be in an active, reinstated, combined, cancelled – business sold, or debtor-in-possession status or, in a lapsed status with a lapse date of Jan. 1, 2020 or later as of Oct. 2, 2020. Employers who do not meet all the criteria listed above will not be eligible to receive a dividend.
When will BWC determine eligibility? Eligibility was based on an employer’s status (active, lapsed) with us as of Oct. 2. BWC will not make changes to eligibility after this date.
How will this impact BWC’s finances and the State Insurance Fund? BWC and the State Insurance Fund will remain in a strong financial position after payment of this dividend.
I am in an individual-retrospective-rating program. How will BWC calculate my dividend? I am in a Deductible Program. How will BWC calculate my dividend? BWC defines premium for private employers participating in a Deductible Program as discounted, blended premium.
I received a discount on my premium for Go-green, Lapse-free or Safety Council. Will this reduce my dividend? Yes. BWC will reduce the dividend amount by premium-based discounts already earned, including, but not limited to Go-green, Lapse-free, and Safety Council.
I reported zero payroll but paid the minimum administrative charge. Will I receive a dividend? No. Employers reporting zero payroll are not eligible.
I had a no-coverage penalty during the period upon which the dividend is being calculated, but formally took out coverage after the conclusion of the applicable period. Will I receive a dividend? No. BWC will not include no-coverage penalties in the premium base it uses to calculate the dividend.
I canceled my coverage but paid premium during July 1, 2019, to June 30, 2020. Will I be eligible for a dividend? No. A private or public employer that cancels coverage prior to Oct. 2, 2020, is not eligible for the dividend. BWC will not make account adjustments to give these employers the dividend.
I purchased a company that was billed premium for the July 1, 2019, through June 30, 2020, policy year. How will this impact my dividend? BWC will determine eligibility based on the status of the predecessor policy. If the predecessor policy would have been eligible for the dividend, the successor will receive the applicable dividend. If the predecessor policy was canceled, the successor will not be eligible for the dividend. If the predecessor policy was in a lapsed status prior to the combination, the successor will not be eligible for a dividend. If there is existing debt on the predecessor policy, BWC will reduce the successor dividend by the amount of the outstanding balance.

I just went self-insured. Will I receive a dividend? Private employers that paid premium for the policy reporting period of July 1, 2019, through June 30, 2020, but were granted the privilege of self-insurance before Oct. 2, 2020, are eligible for the dividend based upon the billed premiums during the July 1, 2019, through June 30, 2020, policy period. Public employer taxing districts that paid premium for the policy reporting period of Jan. 1, 2019, through Dec. 31, 2019, but were granted the privilege of self-insurance before Oct. 2, 2020, are eligible for the dividend based upon the billed premiums during the Jan. 1, 2019, through Dec. 31, 2019, policy period.
I used a Professional Employer Organization (PEO) during the July 1, 2019, through June 30, 2020, policy period. Will I receive a dividend? PEOs that receive a dividend must provide notice of the dividend to their client employers of record for the July 1, 2019, through June 30, 2020, policy period. BWC will also notify PEO client employers that it sent a dividend to their PEO. The amount PEOs pay to their client employers must be equal to 100% of the blended premium paid by the PEO to BWC on behalf of the client employer for the July 1, 2019, to June 30, 2020, policy period less the permissible administrative fee discussed herein. The PEO shall calculate the client employers’ share of the dividend based on the full amount of the dividend BWC issued it. The PEO shall not reduce the employers’ share of the dividend by any credit applied to the PEO policy as a result of non-pending, outstanding balances. The PEO may retain up to 6% of the client employers’ dividend as an administrative fee. PEOs must issue dividends to clients within 30 days of BWC’s issuance of the dividends. The PEO may not withhold or offset payment of the dividend based on any contractual obligation and must issue the dividend regardless of whether the client employer continues as a client employer of the PEO.

An employer whose dividend is applied to an outstanding balance will receive detail regarding how the dividend was applied on their next scheduled invoice. Employers will be able to see their updated account information at any time on bwc.ohio.gov.
Will BWC adjust the dividend if it audits me in the future or if it adjusts my rate? The dividend is a one-time payment. BWC will not adjust the dividend amount for any reason, including, but not limited to, audits, rate adjustments, appealed balances, changes in lapse status retrospective claim billings, etc. after Oct. 2, 2020.

SET UP/REMOVAL OF EXHIBITS: All exhibits must be placed and ready at the opening of the show and no movement of exhibits will be permitted until after the close of the show. Exhibits must remain intact until after closing of the show and be removed within such time as may be specified by the NCBIA. Strict compliance with move in and move out times is mandatory. A fine for late move in and/or early move out will be assessed at the discretion of the NCBIA. RAFFLES: No exhibitor other than Event Management shall conduct any game, lottery and/or similar activity unless authorized by the NCBIA. CARE OF EXHIBITS/AISLES: The NCBIA will maintain the aisles and exhibit areas in a clean condition. Aisles must be kept clear at all times. Seating for buyers must be confined within the exhibitor’s space. Exhibitors are requested at all times to cooperate with the NCBIA in maintaining all exhibits in perfect condition and to provide supervisory personnel at all times during exhibit hours. *In the event that the Exhibitor does not exhibit as provided herein or fails to comply in any respect with the terms of this agreement, the NCBIA management shall have the right without notice to the Exhibitor, to license the use of said space to any other company, enterprise, person or persons and the Exhibitor agrees to pay any deficiency, loss and/or damage sustained by the NCBIA as a consequence of such failure to occupy space as provided in this agreement. In addition, it is agreed that should the NCBIA be unable to license the use of said space as herein provided, it shall have the right to occupy said space for its own purposes without prejudice to its rights against Exhibitor pursuant to this agreement, including but not limited to the payment of a license fee. *Exhibitor will not sub license any part of the space herein provided for without the express written consent of the NCBIA. In the event the exhibit premises are destroyed or rendered unavailable for any reason whatsoever (whether before or during the scheduled exhibition), the rights of the Exhibitor under this agreement shall be limited to a pro-rated refund of the amount paid for the space licensed.

DECORATIONS, SIGNS, ETC: All equipment in conjunction with the exhibit must be provided by the Exhibitor. However, only the sign of the firm covered by the Exhibitor’s agreement may be placed in the booth or upon printed list of exhibitors or program. All decorations must conform to fire regulations. No exhibit is permitted that is more than eight feet high, or that obstructs other exhibits due to its design or size. PAYMENT DEFAULT: A service charge of 15% per month is applicable on all balances after 30 days. In the event any unpaid amount is placed for collection, client and/or agent agree to pay all collection costs, including reasonable attorney’s fees. REFUND POLICY: A partial refund will only be given with a minimum of 45 day’s notice prior to the event. The NCBIA retains the right to use their own discretion when deeming the reason for refund as a viable one to determine whether refund shall be granted. *The NCBIA shall have the right to make such rules and regulations in connection with the Exhibition as it may deem proper and may amend them at any time, and the NCBIA shall have the full power in the matter of interpretation and enforcement thereof. The rules and regulations heretofore referred to are printed on this agreement and are incorporated herein by reference. Exhibitor agrees to abide by said rules and regulations. *It is agreed that this instrument is a license, and not a lease, and that no leasehold or tenancy is intended to be or shall be created hereby. *This agreement cannot be varied, modified or canceled by the Exhibitor without the express written consent of the NCBIA.
