NCBIA 2023 PRESIDENT
THANK YOU Spikes! The NAHB Spike Club is composed of all of the individual members and employees of members in local associations who have attained Spike status. It is a vehicle to recognize these members for their outstanding achievements in member recruitment and retention in their local home builder’s association. Membership development is vital to the future of any association. The continuous influx of new members and the retention of current members are critical for maintaining NAHB’s powerful voice in the homebuilding industry. Tim King, K. Hovnanian Homes Your membership is one of the most valuable resources for building your association. Just as a nail in the home building industry is essential to the development and strength of a building, volunteers who recruit and retain members play a vital role in the growth, development, and stability of an association - they are our “Membership Champions.” It is important to recognize these membership champions. Recognition encourages them and others to continue their efforts, which in turn, further strengthens the association. Back in 1953, in an effort to recognize and reward dedicated members who worked to recruit, involve, and retain members, the NAHB Spike Club was created. Over the years, the number of Spike Club members has grown to more than 16,600 — including Builder, Associate and Affiliate members. The NAHB Spike Club is a tool to encourage members’ involvement in membership development. Spike Club Q & A What are the benefits of becoming a Spike? • The real benefits are intangible: You are recognized for your contributions to the association and regarded as an accomplished and connected member. Additionally, Spikes receive: • A coveted invitation to the biggest party of the year, the Spike Party at the International Builders' Show®* • Increased visibility, recognition, and networking opportunities at industry events • Unique and valuable lapel pins for each level of achievement • Additional VIP treatment throughout the year As always, the recruitment credit may be composed of one full credit received when a new Builder or Associate member is recruited or two ½ credits received when Affiliate or Council members are recruited. How do I become a Spike? Before becoming a Spike, you are a Spike candidate. That means you have earned between one and five and a half credits. Once you earn your sixth credit, you become an official NAHB Spike! Spike credits are earned by recruiting and retaining NAHB and Council members. How do I earn Spike credits? Spikes earn one credit for each new Builder or Associate member they sponsor. When that member renews after his or her first year of membership, the sponsoring member automatically gets one renewal credit. Every year the member renews thereafter, the sponsoring member will receive a ½ renewal credit. Spikes receive a ½ credit for recruitment and a ½ credit for the renewal of Affiliate members.

How can I get tickets to the IBS Spike Party? You must be a Spike in good standing as of October (having at least six credits) and you must have earned at least one new member credit during the previous 12 months. The new member credit can be one full credit earned when a new Builder or Associate member is recruited, or two ½ credits when Affiliate or Council members are recruited. Being a Spike has many rewards, including the opportunity to receive awards and recognition upon reaching new levels on the Spike ladder. To become a Spike, you must achieve six credits. Committees are the glue that hold together an association. We are only as good as our members. As we have continued to grow, we are asking for your support, help and expertise! Check out the following committees; come and participate in one. Discover your strengths while building the committee’s strength. Even without experience ever participating in a committee, we have a seat for you. Call today to discuss your area of interest. Some are short-term; others longer-term.
Ambassador Committee: Outreach to new members welcoming them to the NCBIA and give them a brief recap of what we have to offer, or members who may be on the fence about their time with the association; or they may not have had a full introduction to the benefits and just need a quick “hello.” Helping with retention by calling on members to invite them to an event or just to check in from time to time. This committee is for the person who loves to network and provide support to another. This team is key to maintaining our members. BuildPac Committee: The NCBIA BuildPac Committee is the political action committee for the association. It provides financial support to the political candidates who understand and support the issues of the industry, ensuring the voices of our members are heard on industry-related issues. Help plan an annual event to support this important cause. Clambake Committee: The Clambake Committee plans the annual Clambake and Reverse Raffle event, plus great raffle baskets and a stocked bar cart. If you are looking for a fun event to be a part of - - this is it. Codes/Government Affairs: This committee works to keep an eye on what is happening in the codes and political arena. They deal with local, state, and national issues to keep everyone aware of what is coming up. The dedication of this committee provides for the good of our industry. Education: The Education Committee has oversight and responsibility for development, delivery, management, and evaluation of all NCBIA education programs. Golf Classic Committee: This committee plans the largest attended event of the year - - the NCBIA Golf Classic that takes place the first Thursday in August. This is a business and social event, bring clients, staff, family, and friends to enjoy a day of golf, prizes, and delicious barbecue. It is a great way to get your name out there and bring some creativity to the course. Home Show: The Home Show Committee plans the annual Home Show targeting local area residents for our members to showcase their company and its products and services. Local residents want to work with local companies. The show reaches over 1,000 consumers each year and is continuing to grow.

Membership Committee: This team works on recruiting and retaining members by creating opportunities for new and existing members. Extroverts love this team. Recruiting consists of gaining new contact information from fellow members, lead generators and other links and approaching that potential member to discuss the return on their investment of becoming a member of the NCBIA. Recruiting takes a little effort, but the rewards are big. Help the NCBIA continue to grow and flourish. Sales & Marketing Committee: The Sales & Marketing Committee provides networking and recognition for our members as well as public awareness of the NCBIA. They assist in coordination of our four free member mixers each year which are a casual event where our members get to know each other better and invite potential members to see what we are all about. This committee also assists in our annual Circle of Excellence awards that highlight our members’ products and achievements which give recognition and celebrate success within the industry. Workforce Development: The Workforce Development committee provides input and opportunities to local schools and school-to-work programs. The committee works to provide further education and training to provide a welltrained workforce to our industry. New Events for 2024 Economic Forecast Night at the Races Product Night Committees are a simple way to volunteer your time, make a difference in the association, and get to know other members. Look over the committees and decide which is best suited to your time and talents. We rely on member volunteers to lead our different events, functions, and goals. Being on a committee is mutually beneficial; giving you the opportunity to give back to your association and get to know each other better, all by spreading awareness of your own business! MORTGAGE ACTIVITY INCREASES Despite Rise in Interest Rates BY: JESSE WADE

er the Mortgage Bankers Association’s (MBA) survey through the week ending October 6th, total mortgage activity increased 0.6% from the previous week and the average 30year fixed-rate mortgage (FRM) rate rose 14 basis points to 7.67%. The FRM rate has increased 40 basis points over the past month to its highest level since 2000. The Market Composite Index, a measure of mortgage loan application volume, rose by 0.6% on a seasonally adjusted (SA) basis from one week earlier. Purchasing activity increased 0.6%, while refinancing activity increased 0.3% week-over-week. Interest rates remained above seven and a half percent for the second consecutive week. The combination of increased rates and low existing for-sale inventory have continued to dismay potential buyers as the purchase index remained historically low. The seasonally adjusted purchase index was 19.4% lower than one year ago while the seasonally adjusted refinancing index was 8.8% lower than one year ago. The refinance share of mortgage activity fell from 31.7% to 31.6% over the week. The adjustable-rate mortgage (ARM) share of activity rose to 9.2% from 8%, the highest share since November 2022. The average loan size for purchases was $421,600 at the start of October, down from $414,200 over the month of September. The average loan size for refinancing decreased from $254,700 over the month of September to $245,100. The average loan size for an ARM was down at start of October to $817,100 while the average loan size for a FRM fell to $320,200.

espite mortgage rates topping 7%, Americans
persist in their desire to buy a home. According to the latest Housing Trends Report*, the share of adults with plans to purchase a home within a year edged up to 17% in the third quarter of 2023, up from 15% a quarter earlier. The share has fluctuated up and down without a clear trend for over a year, likely due to the push-pull between two opposing forces: higher interest rates/home prices and persistent demand stemming from demographic growth. Meanwhile, interest for newly built homes continues to rise as the collapse of existing home inventory leaves new homes as the only option in many areas. In the third quarter of 2023, 27% of prospective buyers were looking to buy new construction, up for a third consecutive quarter after falling to 20% in the final quarter of 2022. * The Housing Trends Report (HTR) is being discontinued due to changing budget and research priorities. This post represents its final edition. For the third quarter of 2023, the HTR only included the two series shown above.

AN EMAIL FROM NAHB LEGAL ACTION TO YOU TO: Ohio Home Builder Association Members and Local Executive Officers FROM: Laura MacGregor Comek, Esq., NAHB Legal Action Committee Chairman & OHBA Development Co-Chair October 3, 2023 OHBA Friends and Colleagues, This email is a brief summary of the activities at NAHB’s Fall Meetings, held September 18 through 21, 2023. LEGAL ACTION Legal Action Committee (LAC) heard and recommended 3 applications for funding: 1. Desert Valley HBA - $10,000 to assist with trial costs. This case was a legal challenge to MANY YEARS of impact fees collected but not properly retained, accounted for or used by the City of Coachella. Desert Valley HBA sued to get that money back. Desert Valley HBA has already been awarded $25,000 and finally has a trial date set. 2. Oregon State HBA - Oregon's Agency for Climate Friendly and Equitable Communities Rulemaking Committee did a BAIT AND SWITCH of rules. They published one version but adopted another. Oregon State HBA has filed a lawsuit to challenge these legal shenanegans. Oregon State HBA was awarded $10,000, if they need to appeal, as they are already past briefs and arguments. 3. New York State HBA - LAC voted to support the NY State HBA with $25,000 for their lawsuit against the State of New York for Gas Stove and appliance bans. LAC had previously (earlier in September) recommended to JOIN the NY State HBA’s lawsuit as a named Plaintiff, along with a coalition of other industry and commercial parties. Additionally, LAC has retained a fantastic lawyer from California with a Nation-wide legal practice addressing utilities issues. In particular we heard about the push to eliminate natural gas service and appliances - on a much larger scale that originally thought. LAC will continue to challenge and pursue avenues to keep extreme issues from negatively impacting the home building and development industry. CROSSOVER COMMITTEE The CrossOver Committee met for the 2nd time. This committee is PUSHING THE CURRENT BOUNDARIES OF COMMUNICATION and STRATEGY POLICY for NAHB and its Committees. The June meeting convened in Washington DC at LegCon. Each committee chair from SLIF, LAC and Land Development shared their agenda items. CrossOver participants were educated to learn that ALL 3 committees were addressing the climate/gas ban/electrification issues for members NATION-WIDE. At the Fall Meeting in September, the CrossOver included the Environmental Issues Committee, Chair and various members. The discussion was THE MOST OPEN AND EXPANSIVE DISCUSSION I have ever experienced at NAHB. Bottom line - NAHB could challenge the WOTUS issue in several way: (1) litigation, (2) rule making/offer our own definitions, and (3) with grass roots efforts to push OEPA and USACE offices to address applications in a more timely manner. RULES AND REGULATIONS GOVERNING EXHIBITS MANAGEMENT: The North Coast Building Industry Association (NCBIA) shall be deemed Event Management and shall have all rights thereto assigned. (From here on the North Coast Building Industry Association will be referred to as NCBIA). CHARACTER OF EXHIBITS: NCBIA reserves the right to approve all exhibits. The exhibits and the distribution of promotional material shall be limited to the confines of the Exhibitor’s space. Under no circumstances shall any Exhibitor be permitted to attract attention to his/her exhibit in such a way as to distract or interfere with the other exhibitors. REGISTRATION: Exhibitors and their employees at the Event should wear a registration badge and/or tag for proper identification. SET UP/REMOVAL OF EXHIBITS: All exhibits must be placed and ready at the opening of the show and no movement of exhibits will be permitted until after the close of the show. Exhibits must remain intact until after closing of the show and be removed within such time as may be specified by the NCBIA. Strict compliance with move in and move out times is mandatory. A fine for late move in and/or early move out will be assessed at the discretion of the NCBIA. RAFFLES: Exhibitors are encouraged to conduct games, lotteries and/or similar activities to increase patron participation, so long as it does not interfere with the other exhibitors. CARE OF EXHIBITS/AISLES: Aisles must be kept clear at all times. Seating for buyers must be confined within the exhibitor’s space. Exhibitors are requested at all times to cooperate with the NCBIA in maintaining all exhibits in appropriate condition. *In the event that the Exhibitor does not exhibit as provided herein or fails to comply in any respect with the terms of this agreement, the NCBIA management shall have the right without notice to the Exhibitor, to license the use of said space to any other company, enterprise, person or persons and the Exhibitor agrees to pay any deficiency, loss and/or damage sustained by the NCBIA as a consequence of such failure to occupy space as provided in this agreement. In addition, it is agreed that should the NCBIA be unable to license the use of said space as herein provided, it shall have the right to occupy said space for its own purposes without prejudice to its rights against Exhibitor pursuant to this agreement, including but not limited to the payment of a license fee. *Exhibitor will not sub license any part of the space herein provided for without the express written consent of the NCBIA. In the event the exhibit premises are destroyed or rendered unavailable for any reason whatsoever (whether before or during the scheduled exhibition), the rights of the Exhibitor under this agreement shall be limited to a pro-rated refund of the amount paid for the space licensed. DIRECT SALES: All direct sales vendors must make the payment for their space in full at the time of registration.
COMPLIANCE WITH LAWS: Exhibitors must comply with all federal, state and local laws, regulations and rules that may be in force during the exhibit. INSURANCE: Exhibitors who desire insurance on their exhibits must procure same at their own expense. The NCBIA will not be responsible for any losses incurred by the Exhibitor or its employees because of theft, damage or for any cause whatsoever nor to any property of employee(s) or Exhibitor(s) while en route to or from exhibit. The Exhibitor agrees to make no claim for any reason whatsoever, including negligence, against the NCBIA or NCBIA management, its agents or employees while in the show quarters. Exhibitor agrees to indemnify and hold harmless the NCBIA against any loss, damage or expense (including reasonable attorney’s fees) act or omission of Exhibitor or its agents connected in any way with its exhibits. DECORATIONS, SIGNS, ETC: All equipment in conjunction with the exhibit must be provided by the Exhibitor. However, only the sign of the firm covered by the Exhibitor’s agreement may be placed in the booth or upon printed list of exhibitors or program. All decorations must conform to fire regulations. No exhibit is permitted that is more than eight feet high, or that obstructs other exhibits due to its design or size or that presents a safety hazard to other exhibitors and/or attendees. PAYMENT DEFAULT: A service charge of 15% per month is applicable on all balances after 30 days. In the event any unpaid amount is placed for collection, client and/or agent agree to pay all collection costs, including reasonable attorney’s fees. REFUND POLICY: A partial refund will only be given with a minimum of 45 days notice prior to the event. The NCBIA retains the right to use their own discretion when deeming the reason for refund as a viable one to determine whether refund shall be granted. *The NCBIA shall have the right to make such rules and regulations in connection with the Exhibition as it may deem proper and may amend them at any time, and the NCBIA shall have the full power in the matter of interpretation and enforcement thereof. The rules and regulations heretofore referred to are printed on this agreement and are incorporated herein by reference. FED POLICY CONTINUES TO SLOW the Housing Market
ight monetary policy from the Federal Reserve continues to push interest rates higher. The 10-year Treasury rate increased from 4.1% to around 4.5% over the last month. These higher yields have increased the average 30-year fixed-rate mortgage to approximately 7.2%, per Freddie Mac, with higher rates expected later this week. While the Fed held the federal funds rate steady at the conclusion of its September meeting, commentary from Fed Chair Powell and other members of the monetary policy committee have staked out a decidedly hawkish bias. Whether the Fed increases rates again from its current top rate of 5.5% in November is an open question. (The current NAHB forecast includes a November rate hike.) However, most economists think the Fed is finished raising rates — or will be soon. But the hawkish bias of the central bank has convinced investors and the bond market that the Fed will hold these rates “higher for longer.” NAHB’s forecast does not foresee actual rate cuts until mid-2024. And quantitative tightening, which is also responsible for upward pressure on long-term rates, will continue its reduction of the Fed’s balance sheet for the time being.

In the meantime, these higher interest rates are taking a toll on the housing market. Existing home sales in August were 15% lower than a year ago, with ongoing tight inventory conditions. New home sales in August were down almost 9% on higher interest rates, declining to a 675,000 annual rate, the lowest rate since March. And home builder sentiment on the NAHB/Wells Fargo Housing Market Index declined in September, falling for the second month in a row to a reading of 45 — the first time below the breakeven 50 level in five months. Single-family starts declined 4.3% to a 941,000 seasonally adjusted annual rate in August and are down 15% on a year-to-date basis. And tighter financial conditions are weighing on apartment construction, with multifamily starts down 26.3% to an annualized 342,000 pace in August. Multifamily construction will continue to weaken because of building costs, access to financing and an already-elevated count of apartments in the construction pipeline.
According to the Fed, this hawkish policy is in response to ongoing elevated readings for inflation. In August, the Consumer Price Index (CPI) was up 3.7% year over year. This was the second month in a row for an increase in the year-over-year rate, brought on by a rise in energy prices. However, the bulk of inflation is now due to elevated shelter inflation, which was responsible for 90% of the headline inflation rate in July and August. Regardless of the Fed’s intent, taming housing inflation will be accomplished not by raising interest rates, but by building more attainable, affordable housing.

SHA Update
Expanded requirements for online recordkeeping data submission The Occupational Safety and Health Administration (OSHA) announced it will be requiring certain industries to submit additional information regarding workplace injuries and illnesses. OSHA believes this information will help identify establishments with specific hazards, enabling the agency to interact through outreach programs and/or enforcement. Included in the submission are establishments with 100 or more employees in the designated high hazard industries listed in Appendix B to Subpart E of 29 CFR Part 1904. Employers can determine if this new requirement is applicable by going to OSHA’s “ITA Coverage Application” by clicking here. These changes are now going to require applicable facilities to electronically submit certain information from their OSHA 301 “Injury and Illness Incident Report Forms” including the date of injury, physical location, severity of the injury or illness, details about the worker who was injured, details about how the injury or illness occurred, etc. Employers can start submitting their reports online on January 2, 2024, but must have them submitted by March 2, 2024, for the 2023 calendar year. The new guideline still requires all establishments with 250 or more employees in industries that must routinely keep records to submit the OSHA Form 300A Annual Summary. All the establishments required to submit information from their OSHA 300 Log and OSHA 301 Incident Report under this rule are already required to collect and retain this information and are currently required to electronically submit to OSHA information from their OSHA 300A Annual Summary. sales are mostly a thing of the past, thanks largely due to the internet. Even so, the Home Solicitation Sales Act (Ohio Revised Code 1345.21, the “HSSA”) is very much still effective in Ohio, and very much a risk to home construction contractors. And the risks include having to refund ALL the money paid by the homeowner -even after the requested work is completed- if the contractor does not follow the HSSA.
This law was originally passed to protect consumers from high-pressure sales tactics that are sometimes employed during in-home solicitations for goods and services. This would include home improvement services. Generally, the HSSA covers home construction contracts that are reached either at a homeowner’s residence or a location other than the contractor’s office, even if the homeowner initiates the contact. (There are limited exceptions to the HSSA, like agreements reached entirely by mail or telephone.) The HSSA requires a written contract, signed and dated by the owner, which identifies the contractor’s name and address. Most significantly, the contract must include— (1) specific language regarding the owner’s right to cancel within 3 business days of signing the contract, printed immediately above the homeowner’s signature line, and (2) a separate “Notice of Cancellation” form that follows the statute and serves as the homeowner’s cancellation form if they choose to cancel. If the contract does not meet these requirements, the homeowner’s time to cancel hasn’t started. In other words, the homeowner can cancel the contract (and demand a refund of any money paid) until the contractor provides a contract that includes the key language and the notice of cancellation form. Under the HSSA, the seller (e.g., the contractor) shall not commence services during the time that the buyer can cancel. Indeed, there are some horror stories in the case law when contractors don’t comply with the HSSA. For example, in Clemens v. Duwel (Montgomery County, 1995), the contractor was required to refund all payments made well after the job started, even where the goods provided included drywall, plaster and flooring that were already installed in the customer’s home. In Garber v. STS Concrete (Cuyahoga County, 2013), the contractor installed a driveway, sidewalk and steps. But the homeowner was permitted to cancel and obtain a full refund 10 months after completion of the work. Failure to comply with the HSSA can also constitute a deceptive act in violation of the Consumer Sales Practices Act – which could result in treble (e.g., triple) damages, $5,000 in non-economic damages, and repayment of the homeowner’s legal fees. For contractors performing residential work, there are many requirements that Ohio law imposes for the contracts, and for what happens during and after the work. Making sure your contract complies with the HSSA is as important as any of them. If it does not, your business may be in for a hard, expensive, and frustrating lesson.
