LETTER FROM THE PRESIDENT
THE HOLIDAYS ARE RIGHT AROUND THE CORNER and so is the Home Show! There are only 2 months left in 2021 and this means we are barreling into the holiday season! We have Halloween this weekend, less than a month to Thanksgiving and less than 2 months to Christmas! But an even more exciting countdown that we have is that there are only 243 days left until the NCBIA Home & Remodeling Show! The planning for this event has already started and there are some exciting new things happening this year with the show. The BIGGEST change this year is that this event is now a 2-day show! The show will run from 9:00 AM to 5:00 PM on Saturday, February 27th and 10:00 AM to 3:00 PM on Sunday the 28th. We always have a great turnout from the public for our vendors at this show so I am very excited to see how this year goes. With the restrictions from last year's event being lifted, we fully believe that we will sell out to vendors faster than ever before. So if you want to be a part of the 2022 show, be sure you get your contract sent in ASAP to secure your spot. A huge thank you to 84 Lumber and MDG Maintenance & Handyman Services for stepping up as the event sponsors again this year and thank you to Floor Coverings International for supplying the bags again for the patrons! The committee is working hard to make the 2022 show the best one yet so I hope to see you there!

EXISTING HOME SALES SURGE in September while First-time Buyers are Priced Out

s inventory improved in recent months, existing home sales surged to 8-month high in September, according to the National Association of Realtors (NAR). Though housing demand remains strong as buyers want to take advantage of low mortgage rates before rates rise further, higher home prices are pricing out first-time and young buyers. Total existing home sales, including single-family homes, townhomes, condominiums and co-ops, rose 7.0% to a seasonally adjusted annual rate of 6.29 million in September, the highest level since January. However, on a year-over-year basis, sales were 2.3% lower than a year ago, the second annual decline since August 2020. The first-time buyer share fell to 28% in September, down from 29% in August and down from 31% a year ago. This is the lowest level since July 2015. The September inventory level declined from 1.28 to 1.27 million units and is still down from 1.46 million units a year ago. At the current sales rate, September unsold inventory sit at a 2.4-month supply, down from 2.6-month in August and from 2.7-month a year ago. This low-level supply of resale homes is good news for home construction. Homes stayed on the market for an average of just 17 days in September, an all-time low, unchanged from August and down from 21 days a year ago. In September, 86% of homes sold were on the market for less than a month. The September all-cash sales share was 23% of transactions, up from 22% last month and from 18% a year ago. Tight supply continues to push up home prices. The September median sales price of all existing homes was $352,800, up 13.3% from a year ago, representing the 115th consecutive month of year-over-year increases. The median existing condominium/co-op price of $297,900 in September was up 9.3% from a year ago. Geographically, all four regions saw an increase in existing home sales in September, ranging from 5.1% in the Midwest to 8.6% in the South. On a year-over-year basis, sales fell 8.3%, 2.7%, and 3.0% in the Northeast, Midwest and West. Sales in the South stayed unchanged. Meanwhile, the Pending Home Sales Index (PHSI), also reported by the NAR, is a forward-looking indicator based on signed contracts. The PHSI increased 8.1% from 110.5 to 119.5 in August. On a year-overyear basis, sales were 8.3% lower than a year ago.

MORTGAGE RATES RISE, Activity Declines

he last month of mortgage purchasing and refinancing activities, as reflected in the Mortgage Bankers Association’s (MBA) latest weekly application surveys1, shows a rise in purchase applications and a decrease in refinancing as compared to the prior month’s activity. The 30-year fixed-rate mortgage rate increased, averaging close to 3.15 percent for the month, and was 3.2 percent in the latest week. In the latest week, total mortgage applications, as proxied by the MBA’s Market Composite Index, decreased by 6.3% from the prior week, with the decline driven by a drop in refinancing. On an unadjusted basis, purchasing in the latest week was 12 percent lower than what it was one year ago (year-over-year percent change for the same week), and refinancing was 22 percent lower. The changes in mortgage data, particularly at the end of September, owed to investor concerns over disrupted supply chains, reacting to a recently released and widely followed indicator by the Institute for Supply Management. The refinance share of mortgage activity decreased to 63.3 percent of total applications from 63.9 percent the previous week. The adjustable-rate mortgage (ARM) share of activity decreased to 3.3 percent of total applications. HOW SOUND ABATEMENT Helps Create a Healthy Home
I
f Vintage Revivals founder Mandi Gubler has said it once, she’s said it a million times: “One of our biggest frustrations with [our home] is the road it’s on — more specifically, the noise.” Gubler’s new home is one of the most historically significant buildings in her hometown of Santa Clara, Utah. Lovingly referred to as the “Merc,” the Santa Clara Mercantile Co. was built in 1928 as a supply and gas station, providing a much-needed pit stop for travelers on their way westward. For the next 88 years, the Merc served as a warehouse, grocery store and post office, and was set to become an art gallery before the Gublers purchased it for their family home. Home renovations always come with their share of challenges but converting a nearly 100-year-old commercial space into a family home comes with extra quirks. The Gublers knew they needed to focus on sound abatement to help create a healthy, hushed home. While the home’s large commercial windows make for great views, the noise pollution and traffic on the busy street did not add to its charm. Century-old construction coupled with original single-pane windows were not tight enough to protect the Gubler family from chronic noise exposure. While noisy neighbors or environments can just seem annoying, they can also take a physical toll. Reduced productivity, high blood pressure and even ulcers have been linked to chronic exposure to noise at 50 decibels or higher (the sound level you’d easily find in many offices or classrooms). Among industry pros, noise control is increasingly considered a green building tenet.
That’s where smart sound abatement through architecture and materials comes in, including Andersen A-Series windows, which have the option for triple-pane glass to help improve efficiency and noise reduction. A tightly cased, high-quality window can improve interior acoustics as well, making music and movies sound crisp and conversations less apt to travel. “It was very important to me to match the original style of the windows at the Merc,” said Gubler. She chose Andersen for its customization options, sound abatement, ease of shopping and energy efficiency. Gubler selected A-Series windows with Full Divided Light (FDL) grilles for style and function. The black colonial grille patterns were just what she was looking for. Gubler also opted for an Energy Spacer because of Utah’s extreme summers. “It’s really cool technology and looks great,” she added. At the Merc, each type of window type has a purpose. Fixed windows are perfect for flooding the space with natural light, primarily in the mud room and laundry room (and more rooms to come). Casement windows open similarly to doors, with a hinge on one side and latch on the other and complement the fixed windows on the back side of the building. Gubler chose double-hung windows for the east-facing bedrooms and loves the customized noise control of the sliding panes. With tight upgrades like insulation and high-quality windows, Gubler says the Merc “feels like a giant blanket.” It was important to make such an industrial space feel cozy. She encourages other renovators to think about windows first, as they’re often an overlooked detail that make a major impact in creating a happy, healthy space. October 2021

STATE AND LOCAL Property Tax Revenues Eclipse $700 Billion BY: DAVID LOGAN

AHB analysis of the Census Bureau’s quarterly tax data shows that $703.5 billion in taxes were paid by property owners in the four quarters ending Q2 2021.[1] Four-quarter property tax revenues have climbed 13.2% since decreasing 0.2% in Q2 2020 (the first decrease since 2012). Year-over-year growth of four-quarter property tax revenue has accelerated each of the past four quarters. Prior to the most recent three quarters, year-over-year growth had not exceeded 10.0% since 2009. Corporate income tax revenues made up only 5.5% of state and local tax receipts, but increased a record 71.0%, year-over-year, as the comparison quarter was the trough of the pandemic-related economic decline. Individual income (+35.5%), property (+13.2%), and sales taxes (+10.2%) also increased over the year.
Property taxes accounted for 38.2% of state and local tax receipts, a 2.8 percentage point decline over the previous quarter. In terms of the share of total receipts, property taxes were followed by individual income taxes (30.6%), sales taxes (25.7%), and corporate taxes (5.5%).

The ratio of property tax revenue to total tax revenue from the four sources shown above remains slightly above its pre-housing boom average of 37%.
The share of property tax receipts among the four major tax revenue sources naturally changes with fluctuations in non-property tax collections. Non-property tax receipts including individual income, corporate income, and sales tax revenues, by nature, are much more sensitive to fluctuations in the business cycle and the accompanying changes in consumer spending (affecting sales tax revenues) and job availability (affecting aggregate income). In contrast, property tax collections have proven relatively stable, reflecting the long-run stability of tangible property values as well as the smoothing effects of lagging assessments and annual adjustments. [1] Census data for property tax collections include taxes paid for all real estate assets (as well as personal property), including owner-occupied homes, rental housing, commercial real estate, and agriculture. Owner-occupied and rental housing units combine to make housing’s share the largest among these subgroups.

AFFORDABILITY HEADWINDS Will Increase
W
hile the housing market is showing signs of stabilizing after a period of cooling, housing affordability will decrease in the quarters ahead. Home prices are up more than 30%, on average, nationwide since the start of 2020. And interest rates will rise as the Federal Reserve tightens monetary policy. Indeed, the 10-year Treasury rate has increased 37 basis points since the start of August. And consumer confidence has declined to a seven-month low in September because of virus and inflation concerns. The prospect of higher taxes is certainly having a negative impact as well. Recent housing market data, however, have shown stability. The NAHB/Wells Fargo Housing Market Index (HMI) increased one point in September, rising to a level of 76. The index is off a data series high of 90 from last November. Housing starts increased in August because of strength for apartment construction. Multifamily starts are up almost 17% on a year-to-date basis thus far in 2021 as a rebound for the rental market has taken hold. Single-family starts were down 2.8% for the month and seem to have found a sustainable pace of approximately 1.1 million per year. Nonetheless, the surge in single-family construction at the end of last year means that, for the first time since 2013, there are now more single-family homes currently under construction than individual apartments. Existing homes sales, as reported by the National Association of REALTORS, decreased 2% in August. While higher prices have slowed resale housing demand, inventory struggles continue to limit sales volume (and encourage more home construction). Unsold inventory stands at just a 2.6-month supply at the current sales pace. New home sales increased 1.5% in August (effectively unchanged), but are 24% lower than a year ago because of higher construction costs and some limiting of sales. A year ago, 43% of new home sales were priced below $300,000. In August, the share fell to 30%. Inventory is balanced, at a 6.1-months’ supply. Builders will need to watch resale inventory in local markets to gauge how higher prices and rates are affecting available demand. While higher home prices have priced out some buyers, particularly among first-time buyers, home owner equity/wealth has surged to $23.6 trillion. Increased levels of home equity have supported ongoing strength in the remodeling markets. Yet those higher prices, combined with clear signals from the Federal Reserve, point to declining housing affordability ahead. The Federal Reserve is expected to announce tapering mortgage bond purchases at the November Fed meeting. As the Fed reduces these purchases, upward pressure will be placed on interest rates. –NAHB Chief Economist Robert Dietz

STRONG DEMAND Boosts Builder Confidence Despite Supply Chain Disruptions BY: ROBERT DIETZ

trong consumer demand helped push builder confidence higher in October despite growing affordability challenges stemming from rising material prices and shortages. Builder sentiment in the market for newly built single-family homes moved four points higher to 80 in October, according to the National Association of Home Builders (NAHB)/Wells Fargo Housing Market Index. Despite the increase, builders are getting increasingly concerned about affordability hurdles ahead for most buyers. Building material price increases and bottlenecks persist and interest rates are expected to rise in coming months as the Fed begins to taper its purchase of U.S. Treasuries and mortgage-backed debt. Policymakers must focus on fixing the broken supply chain. This will spur more construction and help ease upward pressure on home prices. Derived from a monthly survey that NAHB has been conducting for 35 years, the NAHB/Wells Fargo HMI gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. All three major HMI indices posted gains in October. The index gauging current sales conditions rose five points to 87, the component measuring sales expectations in the next six months posted a three-point gain to 84 and the gauge charting traffic of prospective buyers moved four points higher to 65. Looking at the three-month moving averages for regional HMI scores, the Midwest rose one point to 69, the Northeast held steady at 72, the South and West each remained unchanged at 80 and 83, respectively. GOOD AND BAD Housing Provisions in $3.5 Trillion Reconciliation Plan

s NAHBNow reported previously, House Democrats are working to draft a $3.5 trillion Build Back Better plan that includes onerous tax hikes of $2 trillion and aggressive energy efficiency requirements in model building energy codes that would harm housing affordability. This ambitious plan, which focuses on what the White House refers to as “human infrastructure,” also contains several other elements of interest to the housing community.

$300 billion in affordable housing funding, including $34.77 billion for the HOME Investment Partnerships Program, $75 billion for Housing Choice Vouchers and $15 billion for new Project Based Section 8 contracts. $4.8 billion for rural multifamily housing. $8.5 billion for the Community Development Block Grant (CDBG) program. $4.5 billion for NAHB-supported CDBG competitive grants that would require local jurisdictions to eliminate impact fees and restrictive zoning requirements. $200 million in grant funding through the Department of Agriculture’s Sections 502, 504 and 523 programs to help low-income homeowners in rural areas purchase, repair, upgrade and preserve modest, affordable homes, including manufactured homes. $50 million to support sweat equity and volunteer-based homeownership programs for low-income households. $770 million for fair housing initiatives.
The chairwoman’s legislation would also forgive the National Flood Insurance Program’s (NFIP) debt and includes $3 billion for flood mapping and risk analysis. It also provides $1 billion to launch a subsidy program to help low- and moderate-income households buy flood insurance and close the coverage gap that leaves poorer households and communities more vulnerable to flood damage. The package also provides first-time, first-generation home buyers with the greater of $20,000 or 10% of the purchase price of an eligible home, including down payment costs, closing costs and costs to reduce the

rates of interest. The Waters bill also provides $500 million to subsidize 20-year mortgages for first-generation home buyers in order to accelerate home equity. It also includes $100 million for HUD to carry out a pilot program to expand small-dollar lending options to everyday home buyers. View the fact sheet for the Housing is Infrastructure Act of 2021.
Labor/Immigration Provisions The House Education and Labor Committee is proposing dramatic increases in monetary penalties for employers who violate the National Labor Relations Act with unfair labor practices. These proposed fine increases are so large that NAHB believes businesses facing fines may be forced to close. For example, the civil fees for each willful violation would go from a maximum of $7,000 to $70,000, and the minimum fee would jump from $5,000 to $50,000. As proposed, these civil penalties are excessive. NAHB is urging Congress to reassess these penalties. On a positive note, the bill also includes funding investments for career technical education as well as funding for JobCorps and Youthbuild. NAHB supports efforts to provide additional funding for these programs because such support will help provide good jobs for new workers and help address labor shortages in various industries including residential construction. The House Judiciary Committee’s proposed reconciliation legislation could allow four groups of immigrants to become permanent U.S.

residents — Deferred Action for Childhood Arrivals (DACA) also known as “Dreamers” (undocumented immigrants who were brought to the U.S. illegally as children and who grew up knowing America as their only home); essential workers; temporary protected status (TPS) individuals (nationals of specifically designated countries that are confronting an ongoing armed conflict, environmental disaster, or extraordinary and temporary conditions); and deferred enforcement departure (DED) individuals. Immigrants are an essential part of the construction industry workforce. TPS beneficiaries and DACA participants with legal work authorization
have helped to fill part of the construction industry’s growing labor gap. As construction was designated as an essential industry by the U.S. Department of Homeland Security, our industry will also benefit from essential workers becoming permanent U.S. residents. Separately, the reconciliation package would also provide additional funds for forestry management/wildfire prevention efforts. It also includes investments in core and traditional transportation and infrastructure programs that NAHB supports because thriving real estate markets depend on high-quality, accessible and efficient infrastructure.
WHAT DOES THE RECENT WOTUS RULE Mean for your Projects?
A
s NAHBNow previously reported, the U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (the agencies) recently halted implementation of the “waters of the U.S.” (WOTUS) regulatory definition as finalized under the Trump administration’s Navigable Waters Protection Rule (NWPR), reverting back to a pre-2015 WOTUS regulatory definition. The Sept. 3 announcement was an abrupt reversal because the agencies had previously committed to a series of public hearings, followed by a two-step federal rulemaking process, during which time the WOTUS regulatory definition as finalized under the NWPR was to remain in effect nationwide. To help builders and developers understand how to move forward with ongoing or planned projects, NAHB developed FAQs to provide interim (unofficial) guidance based upon the Clean Water Act (CWA) statute, existing regulatory guidance documents, and past practices by the agencies during previous instances of changing interpretations of the WOTUS regulatory definition. NAHB will continue to press the agencies for additional guidance concerning the status of the ruling by the U.S. District Court for the District of Arizona to vacate the NWPR, timing of expected field hearings by the agencies on a new WOTUS definition, and a timeframe for when the Biden administration will propose a new WOTUS regulatory definition under the CWA. MORE HOUSING Needed We’re hearing this more and more recently. While it took rapidly escalating prices to bring that fact home, at least it has woken some up. According to most sources, the cause of the problem is the lack of supply. In elementary economics, when demand outstrips supply, prices increase. What is unfortunate though is that affordability has taken a big hit. Whatever the term used, ‘workforce’ or ‘affordable’ housing, prices are out of reach for many. The outlook appears to continue on this path. It is encouraging that many state legislators now realize more housing is needed. We now need to prop up local government officials to face the facts, as well. It will take some hard work to reverse the trend. I rarely get enthused about development issues when I read the New York Times. However, they are all over the situation in California where the state is bulldozing over local zoning regulations to encourage increasing the housing stock. That state is home to exorbitant impact fees, restrictions on energy sources and tough building codes. Perhaps past actions contributed to the current crisis (doh). We’ll see. One section of the recent story is quizzical though:

My guess is California HBA’s resisted most of the craziness in the past which led to the shortage. A key issue here for me is we need to listen more to developers and builders as to ways to increase our housing stock. I recall when government officials in California were celebrating all their forward thinking. Look where it got them. We continue to draw attention to housing needs in Ohio. Fortunately, other statewide groups are starting to join in. Naturally, there are those who continue to oppose reasonable development actions. In any event, we know our mission here with builders and developers in the lead.

CONSTRUCTION JOBS Plentiful, but Where are the Workers?

AHB Chief Economist Robert Dietz recently provided this housing industry overview in the bi-weekly e-newsletter Eye on the Economy. Economic growth for 2021 is expected to post the best GDP expansion rate since 1984. However, forecasters have been revising down their estimates. A combination of factors has diminished the bloom of the economic rose: the delta variant wave (although that wave is now easing), concerns over government spending and higher taxes, and ongoing supply-side challenges that are contributing to inflation and point to higher interest rates. As a result, consumer confidence fell to a seven-month low in September. The Bureau of Labor Statistics employment report for September registered a gain of only 194,000 jobs. Forecasters, including NAHB, were looking for a gain closer to 500,000. As the unemployment rate fell below 5% for the first time since the recession of 2020, the ongoing labor shortage will grow tighter unless the labor force participation rate recovers, and more individuals look for work. Indeed, the number of open, unfilled jobs in the construction sector now totals 344,000. As of September, residential construction workers totaled 3.1 million, broken down as 882,000 builders and 2.2 million residential specialty trade contractors. Over the last 12 months, home builders and remodelers added 136,300 jobs on a net basis. Since the low point following the Great Recession, residential construction has gained nearly 1.1 million positions. And more will be needed as the sector continues expanding to meet demand.

SB 64 Roofing Contractors (Hottinger, J., Lang, G.) To regulate and require the registration of roofing contractors.
SB 64 is scheduled to be heard in the Senate Government Oversight and Reform Committee on Wednesday. OHBA has worked closely with the insurance industry to clarify intent and exclude new home construction, keep registration simple and tied to insurance claims. HB 126 Property Values (Merrin, D.) To require local governments that contest property values to formally pass an authorizing resolution for each contest and to notify property owners. After strong proponent testimony on September 21st, no further hearings have been scheduled on HB 126. The proponents’ clearly explained Ohio is part of a handful of states that allow local school districts to initiate a real property valuation complaint or review process against a single parcel of land. While this legislation does not end the practice of revaluation by a second local government entity, it does codify a more uniform process of notification for the property owner if a complaint is filed by a third party. OHBA has urged continuing hearings on HB 126 to hear the local governments and school board’s responses to the compelling proponent testimony. Please feel free to contact with any questions

Quick Issues Index – Fall Leadership Meetings 2021 Reconciliation Tax Proposals • Congress is currently debating the $3.5 trillion Build Back Better Act, which is one of the White House’s centerpiece policy proposals, focusing on what they refer to as “human infrastructure.” This plan calls for over $2 trillion in tax increases. • NAHB strongly opposes these tax increases, which risk broad harm to the still fragile economy. • NAHB successfully worked to preserve several key provisions, including 1031 like-kind exchanges, maintains stepped-up basis for estates, and carried interest. • It remains unclear if the Democrats will be able to navigate their own internal politics and deliver a bill to the president, or if the divisions within the party will sink this effort. Energy Tax Incentives • House Democrats have proposed a complete overhaul of the existing energy tax incentives, many of which are slated to expire at the end of the year • Many of these proposed changes are positive, but some would diminish the utility of these credits moving forward. • Of concern is the proposal to shift qualification of the Section 45L tax credit to participation in the Energy Star Program, which is a niche program.

Low Income Housing Tax Credit • The Build Back Better Act includes a historic investment of new resources into LHTC—more than $30 billion over 10 years. • Key provisions include a 50% increase in credits allocated to the states; making all rural areas eligible for a basis boost; and allowing bond deals to also qualify for a basis boost based on the financial needs of that project. Preferred Stock Purchase Agreements (FHFA/Treasury) • Federal Housing Finance Agency (FHFA) and the U.S. Department of the Treasury (Treasury) announced amendments to the Preferred Stock Purchase Agreements (PSPAs). • These PSPAs govern support for the GSE’s conservatorship. • The provisions allowed the GSEs to build capital, but included limits to the activities of the GSEs. • NAHB pushed back, joined with other associations. • Treasury Secretary Janet Yellen and FHFA Acting Director Sandra Thompson recommending changes to or elimination of the provisions. • Less than a week later, on September 14, Treasury and FHFA announced they would suspend these problematic policy provisions. OSHA COVID-19 Emergency Temporary Standard • On June 29, 2021, the federal Occupational Safety and Health Administration (OSHA) issued the highly anticipated Emergency Temporary Standard (ETS) to address workplace safety issues involving COVID-19.

The rule contains new enforceable requirements for employers to protect workers from COVID-19 for healthcare workers. NAHB and other partners in the Construction Industry Safety Coalition (CISC) to ensure the views of the residential construction industry were included when considering ETS. The construction industry argued that an ETS is not needed given the declining case counts, the low-risk nature of construction work, the increase in vaccinations in the adult population in the U.S., and the ever-changing nature of the pandemic. Ultimately, OSHA decided to apply the ETS only to healthcare settings. This was an advocacy victory for NAHB because the unions and other stakeholders pushed for a much broader ETS that would have been applicable to all workplaces, including the construction industry.
OSHA Emergency Temporary Standard – Vaccine Mandate • On September 9, 2021, President Biden issued the Path Out of the Pandemic, a national strategy to combat COVID-19. • One prong of the six-prong plan would require all employers with 100+ employees to ensure their workers are vaccinated or tested weekly. • OSHA is working to develop a plan to require these measures. • There is still a lot unknown, including plans for testing costs and enforcement. Arizona District Court vacates WOTUS Definition • On August 31, 2021, a Federal District Court in Arizona issued a ruling vacating the WOTUS definition as established under the Trump administration’s Navigable Waters Protection Rule (NWPR). • Immediately following the Arizona Court’s ruling, the agencies released a joint statement that they have halted implementation of the NWPR’s WOTUS definition and instead are implementing a pre-2015 WOTUS regulatory definition until further notice. • NAHB and other trade associations are working to support the intervenors in the Arizona case to seek a stay of the ruling. NAHB posts WOTUS FAQ on nahb.org • Following the August 31, 2021 announcement by the agencies halting implementation of the NWPR’s regulatory definition of WOTUS, NAHB prepared a FAQ for NAHB members. • This FAQ includes interim guidance, and explains the differences between the pre-2015 definition and the post-2015 definition. Senior Officers and NAHB members participate in WOTUS hearings • In late August, NAHB Chairman Chuck Fowke attended a roundtable in Iowa on the WOTUS situation. • Over the following weeks, various NAHB Senior Officers and members attended meetings to advocate for NAHB’s position on the rule change. FEMA Risk Rating 2.0 • On April 1, 2021, the Federal Emergency Management Agency (FEMA) released details outlining an implementation schedule for Risk Rating 2.0. • The new Risk Rating 2.0, framework changes the way FEMA rates a property’s flood risk and prices flood insurance. • Builders will be able to impact the cost of flood insurance for the homes they build based on choices made around certain building practices. ICC Group A Public Comment Hearings • The ICC Group A Public Comment Hearings were recently held in Pittsburgh from September 21-26. • NAHB took a position on 63 proposals and were successful on 46 (72%). For the high priority proposals we opposed, NAHB was

14-3 (82%). The final outcome for this year’s proposals have not been determined. The last step in the process is the ICC Online Vote which begins on (or around) October 15th and will be open for 2 weeks.
One and Done • NAHB is asking its members to become part of their grassroots efforts to improve the building codes. • Participants are asked to reach out a local code official from an NAHB supplied list and provide them a list of proposals important to the building industry. Lumber and Building Materials • Over the course of the pandemic, NAHB members have faced widely varying lumber prices due in part to shortages in supply, increased demand from both residential construction professionals as well as homeowners working on improving their homes individually (DIY-ers). • Lumber prices have come down from highs observed in May 2021, but over the last several weeks, prices have increased. • We expect lumber prices will remain volatile. • U.S.-Canada softwood lumber dispute remains ongoing with no long-term resolution in sight. • NAHB has increased advocacy efforts and outreach to legislators and policymakers.

Safety starts at the top Successful organizations establish safety as a core value of their operations. Senior leadership, including the top executive on site, must be role models to all employees for creating a safe work environment. Active leadership includes, at a minimum: •
Authorizing the necessary resources for accident prevention.
•
Discussing safety processes and improvements regularly during staff or employee meetings.
•
Ensuring that all members of management are held accountable for accident prevention activities and processes.
•
Annually assessing the success of the safety process by utilizing perception surveys, personal interviews, and behavior sampling strategies.
•
Encouraging employees to take an active part in maintaining a safe workplace.
Implementation Senior leadership must assume the leadership role in establishing the importance of safety in all operations. By taking the lead, leadership can effectively use its safety process to contribute to the bottom line and better service to customers by reducing losses due to accidents. The full support and active commitment of senior management is vitally important because it encourages supervisors at all levels to make the safety process a success through accountability. This requires measuring actual performance against pre-established objectives and goals through the organization’s performance appraisal system. There are many ways senior leadership can participate to show active leadership in safety processes: •
Issue a written Safety Policy, affirming safety as a core value to the organization.
•
Establish both annual and long-term safety goals.
•
Establish safety responsibilities and a system of accountability for all levels.
•
Regularly include safety topics in meetings.
•
Regularly review progress of the safety process with department heads, supervisors, and employees.
•
Accompany supervisors or safety team members during their periodic safety inspections.
•
Review copies of all completed accident investigation reports.
•
Openly discuss safety with employees during periodic tours.
•
Participate, as a student, in employee safety training programs, such as first-aid training.
•
Participate in meetings with loss control consultants.
•
Use accident loss reports to analyze and develop solutions.
•
Review minutes of safety team meetings.
•
Review safety survey reports.
As noted above, a written safety policy is a sign of your organization’s commitment to providing a safe working environment. Essentially, this policy should be a mission statement to foster a culture conducive to a safe work environment. The requirements include: •

Manager, supervisor, team facilitator and employees’ responsibilities regarding the organization’s commitment to workplace safety.
•
Commitment to returning injured or ill employees to work at the earliest and safest opportunity.

Signed and dated by the top executive.
•
Communicate to new and existing employees verbally, on bulletin board(s), and in employee handbook.
•
Review the policy on an annual basis with all employees.
Although this seems like a minor step, it is the foundational step in implementing an effective safety process. It expresses the commitment of your organization, its ownership, management, and employees to maintaining a safe work environment for all employees. This communication of intent should be just as important as the organization’s statement of quality of product or service. Please Read Carefully: FleetCor Technologies Operating Company, LLC (“FleetCor”) operates the SuperFleet Mastercard product. This application is made to FleetCor. By signing this application, Customer authorizes FleetCor to check Customer’s credit references and the information on this application and to obtain consumer or commercial credit reports to check Customer’s credit standing, both for this application and for the updates of Customer’s credit file and renewals of Customer’s SuperFleet Mastercard card(s). Customer acknowledges that this application is subject to approval and acceptance of Customer by FleetCor in Louisiana. If this application is approved, then Customer will be notified of its available credit/spend limit, and Customer will not allow its unpaid account balance to exceed its credit limit. Customer agrees that Louisiana law governs the terms and conditions of the SuperFleet Mastercard card(s), which terms and conditions will accompany the card(s) if this application is approved ("Card Terms"). Customer’s accepting, signing, or using any SuperFleet Mastercard card(s) will constitute Customer’s acceptance of those terms and conditions including, without limitation, Customer’s unconditional obligation to pay for all use of SuperFleet Mastercard cards provided to Customer and all use of Customer’s account each billing cycle, as well as all interest, fees and costs associated with such cards and account. The account is not a revolving credit account. Customer agrees that any liability arising or resulting from the misuse, unauthorized use, loss or theft of any one or more of the cards issued or of Customer’s account shall be fully borne, assumed and paid by Customer except as provided by applicable law and the Card Terms. Customer also agrees that Customer will exclusively use the SuperFleet Mastercard card(s) for commercial purposes and understands that Customer’s card(s) may be canceled if Customer uses them for personal, family, or household purposes. In the event that Customer’s account is turned over to a collection agency or an attorney for collection, Customer agrees to pay all such costs, fees and expenses of such agency or attorney, including, without limitation, court costs and out-of-pocket expenses. By signing below, Customer confirms that everything it has stated in this application is correct and that the signing authorized representative is duly authorized to enter this relationship on behalf of customer.
