THE HOME STRETCH of 2021 We are in the home stretch for 2021! This year has been a wild and crazy ride for almost everyone in this industry and I am sure that most of us will give a nice little sigh when 2022 starts. But this year has not been all bad. We have lots of great things to look back on! We started off the year with a bang and got our Home & Remodeling Show off the ground even with all of the restrictions in place due to the pandemic. The show was a huge success and I want to give a shout out to that committee! They busted their butts and it was a great show for all of the vendors and consumers that attended. In April we brought back our member mixers and the turnout for these has blown all our expectations out of the water. Our members showed us they wanted to get together, and they wanted to network with their fellow members. Over the next few months, we had more of the member mixers and people showed their support in droves! We will continue the member mixer tradition into 2022, that is for sure! We had our annual softball game and Team Majzun finally brought home the big W! It only took us 5 years but we finally did it. Our softball game and family picnic has become a crowd favorite and every year the turnout for it gets better and better! We only have one month left in 2021. With the holidays quickly approaching, we all know that the month of December flies by. to be Thankful For! What a year we have had thus far! It has a different meaning for all of us. For some it meant staying healthy and avoiding COVID, and we sure were busy. Thank you all who helped us earn three of the five NAHB 2020 Membership Grand Awards for Numerical Increase, Percentage Growth and Affiliate Numerical Increase. As you might know November is Spike Appreciation Month, a time when all HBAs are encouraged to thank the dedicated “Spikes” for their outstanding achievements in member recruitment and retention. Spikes are the backbone of our association. They have found the benefits of membership that they are passionate about and expertly share that information to recruit new members. CONSTRUCTION LOANS Slightly More Available, But at Higher Rates

In the third quarter of 2021, effective interest rates increased on all four categories of loans tracked in NAHB’s Survey on Acquisition, Development & Construction (AD&C). This result reverses a general downward trend that had prevailed since the third quarter of last year. In the third quarter of 2021, the average effective rate (based on rate of return to the lender over the assumed life of the loan taking both the contract interest rate and initial fee into account) increased from 6.15 in the second quarter of 2021 to 6.50 percent in the third quarter of 2021 on loans for land acquisition, from 7.15 to 8.33 percent on loans for land development, from 8.09 to 8.55 percent on loans for pre-sold single-family construction, and from 7.40 to 8.37 percent on loans for speculative single-family construction. Changes in the effective rate may be due to changes in either the contract interest rate, or in the initial points charged on the loan. On three categories of AD&C loans, the average contract rate and average points both increased in the third quarter. On land acquisition loans, the contract rate increased from 4.63 to 4.74 percent while the initial points increased from 0.69 to 0.88. On development loans, the contract rate increased from 4.63 to 4.74 percent while the points increased from 0.64 to 0.89. And on loans for pre-sold single-family construction, the contract rate increased from 4.32 to 4.49 percent while the points increased from 0.54 to 0.77. On the remaining category of AD&C loans (for speculative single-family construction) a reduction in the average contract rate—from 4.94 to 4.85 percent—was more than offset by a substantial increase in the initial points charged—from 0.66 to 0.87 percent. The NAHB survey also produces a net easing index that summarizes the change in credit conditions on AD&C loans, similar to the net easing index constructed from the Federal Reserve’s survey of senior loan officers (SLOOS). In the third quarter of 2021, the NAHB and Fed indices were in close agreement with each other, both indicating a modest easing of credit. The NAHB index stood at 11.0 while the Fed index was 9.4. These results are quite similar to those from the second quarter, when the NAHB index was 9.7 and the Fed index was 7.0. The NAHB net easing index uses information from questions that ask builders and developers if availability of credit has gotten better, worse, or stayed the same since the previous quarter. In the third quarter of 2021, 13 percent of the NAHB builders said availability of credit for land acquisition had gotten better, compared to 6 percent who said it had gotten worse. For land development, 14 percent said credit conditions improved, compared to 7 percent who said it had gotten worse. Finally, 21 percent of builders reported that the availability of credit for singlefamily construction had improved, compared to only two percent who said it had gotten worse.

NAHB CALLS FOR ACTION on Canadian Lumber as Biden Eases Tariffs on European Steel
P
resident Biden announced at the G-20 summit in Rome that the U.S. would ease tariffs on European steel and aluminum, prompting NAHB to express concern and disappointment that no action was taken to lift duties on Canadian lumber that continue to harm housing affordability. A report in the Wall Street Journal noted that U.S. Commerce Secretary Gina Raimondo said the deal with the European Union “will provide relief in the supply chain and drive down cost increases. Of course it is also good for the American manufacturers who use steel and aluminum in their products.” This prompted the following statement from NAHB Chairman Chuck Fowke: “U.S. Commerce Secretary Raimondo was quoted as saying the agreement with the European Union will ‘provide relief in the supply chain and drive down cost increases.’ “But what about cost relief for millions of American home buyers and homeowners who have seen the cost of housing rise by tens of thousands of dollars over the past year due in part to unprecedented lumber price volatility fueled by tariffs on Canadian lumber? Until a long-term solution can be reached, the administration needs to suspend duties on all imported building materials and goods, including Canadian lumber, to ease supply chain bottlenecks that are causing project delays and putting upward pressure on home prices.”

COMPLIANCE WITH LAWS: Exhibitors must comply with all federal, state and local laws, regulations and rules that may be in force during the exhibit. DECORATIONS, SIGNS, ETC: All equipment in conjunction with the exhibit must be provided by the Exhibitor. However, only the sign of the firm covered by the Exhibitor’s agreement may be placed in the booth or upon printed list of exhibitors or program. All decorations must conform to fire regulations. No exhibit is permitted that is more than eight feet high, or that obstructs other exhibits due to its design or size or that presents a safety hazard to other exhibitors and/or attendees. PAYMENT DEFAULT: A service charge of 15% per month is applicable on all balances after 30 days. In the event any unpaid amount is placed for collection, client and/or agent agree to pay all collection costs, including reasonable attorney’s fees. REFUND POLICY: A partial refund will only be given with a minimum of 45 days notice prior to the event. HOUSE APPROVES Build Back Better Act; NAHB Opposes Bill BY: DAVID LOGAN
T
he House today narrowly approved the Build Back Better Act, legislation that contains positive housing provisions but also includes other elements detrimental to the residential construction sector that caused NAHB to oppose the overall package. In letter sent to House leaders prior to the vote, NAHB said: “While this bill represents an historic investment in our nation’s housing, NAHB is concerned the tax increases, new building and energy code requirements and increased fines and penalties for OSHA violations would be detrimental to the housing industry during a critical phase in our nation’s economic recovery.”
The Good
Zoning and Education
As noted above, the Build Back Better Act includes several provisions that are good for housing. Of particular benefit to the housing industry is the $150 billion in new funding that will support the creation and renovation of affordable housing across the country. The legislation would:

Address local zoning reform that will encourage the streamlining of new construction; Invest in career and technical education, including programs such as Jobs Corps and YouthBuild;

Establish a new first-time, first-generation down payment assistance program for home buyers; Create a new home loan program to subsidize 20-year mortgages for first-generation home buyers; Fund a new HUD demonstration program to help expand smalldollar lending options for home buyers; and Greatly expand funding for the USDA Section 504 program to help low-income homeowners in rural areas repair, upgrade, and preserve affordable homes.

Provide $10 billion for the Home Investment Partnerships (HOME) program. This grant program has traditionally been used as gap financing in conjunction with other programs like Project Based Section 8 or the Low-Income Housing Tax Credit; Deliver $1 billion for the Project-Based Section 8 program (PBS8) For the first time in years, this will allow for new contracts under PBS8 — which is a big win for the membership; and Earmark $3 billion for the Community Development Block Grant (CDBG) program. This program has traditionally funded needs such as infrastructure, community centers and housing renovation — but not new construction. This package specifically states that new construction is now an approved use of CDBG funds.

Increase funding for the Low-Income Housing Tax Credit (LIHTC), although the bill fails to take full advantage of this historic opportunity to further strengthen the program by leaving out many of the LIHTC provisions initially included in the House Ways and Means Committee draft; Provide relief for taxpayers affected by the current limit on state and local tax deductions, known as SALT; and Provide long-term extensions many of the existing energy tax incentives, although NAHB opposes the structural changes made to the 45L new energy efficient home tax credit.
The Bad As noted above, there are several provisions in the Build Back Better Act that NAHB opposes, including onerous tax and code requirements that would hurt small business owners and worsen housing affordability: Taxes •

housing, an activity Congress should seek to encourage—or increasing taxes on rental income via the expansion of the NIIT, is difficult to justify at a time when we face a serious housing shortage. Congress should carefully consider how these tax hikes may exacerbate the ongoing housing affordability crisis facing the United States.” Retroactive tax changes to qualified contracts, which could affect the LIHTC program. Requiring the use of Energy Star for new residential construction as the sole means to qualify for the 45L tax credit. In opposing this provision, NAHB noted that Energy Star is a niche market — less than 10% of single-family and multifamily units were certified in 2020 — and while the program has its merits it will never be adopted widely.
Codes
NAHB members save up to 75%
The requirement for use of the “latest published editions of relevant performance-based building codes.” While this provision is intended to incentivize the adoption of the latest published edition of a building code, it is unclear whether states and local governments will continue to have the ability to evaluate and amend updated editions of a consensusbased code prior to adoption. Moreover, provisions requiring the use of “performance-based building codes and standards” does not guarantee that the code or standard is developed through a consensus process. It is critical that codes and standards are developed in a transparent process to ensure code development fully reflects the public interest. NAHB is also concerned with grant programs that promote adoption of ‘net-zero’ provisions, as included in the appendix to the 2021 edition of the International Energy Conservation Code (IECC). These targets are not appropriate or cost-effective for many jurisdictions; rather, the Department of Energy should help states advance the codes in a manner that that best fits the needs of state and local governments.

FED ACTS ON INFLATION as Housing Affordability Weakens
T
he combination of higher home prices, rising construction costs and moderately higher interest rates will exacerbate housing affordability conditions and increasingly push many prospective buyers out of the market in the coming months. Although economic growth is going to post the best year since 1984, that expansion has come about because of significant monetary and fiscal policy stimulus. As supply-chain issues persist while the economy attempts to build on the post-2020 rebound, the expansion will become increasingly uneven. The first example of this variability was seen in the third quarter GDP data. Real GDP expanded by only 2% — noticeably less than what was forecasted earlier in the year and largely because of the rise of the delta variant. The labor market is showing signs of overheating as well. There are more open jobs than there are unemployed workers available because of declines in the labor force participation rate. Jobs gains were solid in October, as payroll employment increased by 531,000. The unemployment rate fell to 4.6%, and further declines are expected. With clear signs of rising material prices and expected wage gains from a hot labor market, the Federal Reserve is reducing its accommodative monetary policy stance. While the federal funds rate is being held near 0%, the Fed has announced the beginning of tapering, or reducing, its purchases of mortgage-backed securities and Treasuries. This process is expected to end by mid-2022, during which time interest rates should gradually increase. Inflation data show why the Fed is pulling back on stimulus: Year-overyear consumer inflation in October was up 6.8% — the strongest reading in 30 years. Moreover, the October Producer Price Index recorded its fastest pace in 11 years with an 8.6% year-over-year gain for wholesale prices. Additional PPI data revealed that the prices of all inputs, including energy, used for residential construction purposes has increased 14.5% year to date in 2021 — eight times faster than they did in 2020. –NAHB Chief Economist Robert Dietz

NAHB FILES PETITION for Review on OSHA Vaccine and Testing Standard BY: ROBERT DIETZ
N
AHB today filed a petition for review in the U.S. Court of Appeals for the D.C. Circuit asking the court to examine OSHA’s emergency temporary standard (ETS) requiring companies with more than 100 employees to mandate COVID-19 vaccinations or weekly testing. NAHB believes that OSHA does not have the authority to issue an ETS on this matter. Among other things, NAHB believes that: • •
OSHA has failed to demonstrate that there is a grave danger from exposure to COVID-19 in the construction work environment. OSHA failed to demonstrate that the ETS is reasonably necessary and appropriate to protect construction workers.
Last Friday, the U.S. Court of Appeals for the Fifth Circuit blocked implementation of the OSHA ETS involving vaccines and testing. The injunction is temporary and will be taken up again beginning Nov. 16. There are also many other legal challenges across the United States. But it is very important to note that barring a long-lasting injunction, employers will have to comply with many parts of the rule by Dec. 6, including developing a written vaccination policy, determining employee vaccination status, offering paid time off for vaccinations, and requiring unvaccinated workers to wear masks. NAHB recently published guidance for members to ready themselves for compliance. This issue is continuing to develop and will be top of mind for NAHB staff in the weeks ahead. NAHB MEMBER SAVES $100K on Infrastructure Measure NAHB Championed
I
n a great example of the value of NAHB membership, President Biden today signed infrastructure legislation into law that includes a key provision fought for by NAHB that will save many members thousands of dollars and one member at least $100,000. Of importance to the housing community, the Infrastructure Investment and Jobs Act contains one provision that NAHB has been fighting to enact for the past three years that restores an exemption for water and sewer contributions in aid of construction (CIAC). This provision will save some developers as much as 40% on water and sewer costs and one Tennessee builder and developer said it will save his business $100,000 on one development alone. The background of CIAC can be traced to the Tax Cuts and Jobs Act enacted in 2017, when Congress eliminated an exemption for water and sewer CIAC, making such contributions taxable if the utility is a privately-owned, for-profit entity. As a result, in areas served by a corporate, for-profit water utility, when a builder installs new water or sewer infrastructure to support additional housing — at no cost to the existing residents — that infrastructure is taxed by the federal government. In some states, affected utilities were required to pass this tax liability to the developer, resulting in CIAC surcharges as high as 40%. The new law, which is effective for CIAC contributions made after Dec. 31, 2020, ends this tax liability, and could not come soon enough for James Carbine, a residential builder/developer in the Nashville area . “The taxes alone on a sewer system by a private utility that we are starting to develop were $100,000,” said Carbine. “This subdivision is 50 lots and that’s $2,000 per lot. And if a lot cost goes up by $2,000, the house sales price goes up five times that to $10,000. This new law that NAHB fought for not only saves the developer money, it also promotes housing affordability.” Carbine has been an NAHB member for 35 years and says the investment is well worth it. “My annual dues are $700. This year alone I have saved $100,000 because of NAHB’s efforts. That’s a pretty good return,” he said. Sewer systems with private utilities in the Nashville area very prevalent, so Carbine noted the new law “will save builders a lot of money.” “This is something our members need to be aware of,” he added. “This is just one item that NAHB has done this year and there’s a long list of things that are sometimes difficult to equate to dollars that help our industry nationwide. I know NAHB has worked on this issue since it went into effect. It took three years and it’s a big win.”

OHBA Has it All We just completed our annual meeting of the board of trustees. The meeting began with a dinner for our past presidents. 20 former leaders of the association attended. In attendance were leaders from the 80’s, 90’s and into 2020. All share continuing strong support and appreciation of how the association has grown and continues as a strong, viable and effective advocate for the industry We also elected officers to oversee the activities of the association through next year. We will be led by Charles Ruma of Columbus. Our Vice President is Richard Bancroft of Akron, the newest officer is Enzo Perfetto of Cleveland. Ric Johnson of Lima will be an Area Vice President as well as our representative to our national affiliate, the NAHB. The remaining Area Vice Presidents are Merle Stutzman of Wayne County, Robi Simms of Dayton and Brad Olinger of Cincinnati. Immediate Past President Mark Zollinger continues as an officer as well. Just a brief review of our leaders and their backgrounds depicts a great composite of the members of the industry. Urban and rural. Land developer and builder. Market builders and custom builders. Young and old. Sons of past presidents (even a grandson too). We are well prepared to work with seasoned as well as the young professionals entering and continuing to serve the association and the industry as a whole.

The ETS does not require employers to pay for any costs associated with testing. However, employer payment for testing may be required by other laws, regulations, or collective bargaining agreements or other collectively negotiated agreements. In addition, nothing prohibits employers from voluntarily assuming the costs associated with testing. Employee notification to employer of a positive COVID-19 test and removal - The ETS requires employers to: (1) require employees to promptly provide notice when they receive a positive COVID19 test or are diagnosed with COVID-19; (2) immediately remove any employee from the workplace, regardless of vaccination status, who received a positive COVID-19 test or is diagnosed with COVID-19 by a licensed healthcare provider; (3) keep removed employees out of the workplace until they meet criteria for returning to work. Face coverings - The ETS requires employers to ensure that each employee who is not fully vaccinated wears a face covering when indoors or when occupying a vehicle with another person for work purposes, except in certain limited circumstances. Employers must not prevent any employee, regardless of vaccination status, from voluntarily wearing a face covering unless it creates a serious workplace hazard (e.g., interfering with the safe operation of equipment). Information provided to employees - The ETS requires employers to provide employees the following in a language and at a literacy level the employees understand: (1) information about the requirements of the ETS and workplace policies and procedures established to implement the ETS; (2) the CDC document “Key Things to Know About COVID-19 Vaccines”; (3) information about protections against retaliation and

discrimination; and (4) information about laws that provide for criminal penalties for knowingly supplying false statements or documentation. Reporting COVID-19 fatalities and hospitalizations to OSHA - The ETS requires employers to report work-related COVID-19 fatalities to OSHA within 8 hours of learning about them, and work-related COVID-19 in-patient hospitalizations within 24 hours of the employer learning about the hospitalization. Availability of records - The ETS requires employers to make available for examination and copying an employee’s COVID-19 vaccine documentation and any COVID-19 test results to that employee and to anyone having written authorized consent of that employee. Employers are also required to make available to an employee, or an employee representative, the aggregate number of fully vaccinated employees at a workplace along with the total number of employees at that workplace. Even when someone says they can do the job or have had prior experience that may not be true. Common sense does not necessarily help your employee understand the true requirements of a job task. Guidance for employees in the form of written safe work practices is important for a clear understanding of job requirements and responsibilities. The objective is to communicate safe work practices so that employees have a clear understanding of how to safely accomplish their job requirements. Both general and job-specific safe work practices must be identified, documented, and made available. Have all employees sign a statement to indicate they have read, understood, and will follow all safe work practices. Examples of general safe work practice knowledge expected of most employees include: • Good housekeeping • Personal protective equipment • First aid procedures • Ergonomic principles • Hazard recognition and abatement • Emergency Action Plan

Job-specific safe work practices apply to operations and tasks that involve recognized hazards and risks associated with those specific tasks. Job-specific safe work practices must be posted or made readily available in the work area. Examples of job-specific safe work practices include: • Respiratory protection • Lockout/tagout procedures • Confined space entry • Hazard communication • Powered industrial truck operation • Bloodborne pathogens, if applicable • Personal protective equipment (PPE) • Machine/equipment operation • Material handling procedures Implementation After the general safety orientation, the supervisor provides new employees with job-specific safety training. Employees should not be allowed to start a job until they have received instructions on how to perform the job properly and safely. If an employee will perform a hazardous job, the supervisor should complete a Job Safety Analysis (JSA) on that job and incorporates the JSA into the job-specific safety training. JSAs emphasize the identification and control of the potential hazards associated with each step of the job. Safe work practices are essential for any organization because they prescribe the accepted behavior that is expected from all employees. The safety team may be involved in the development of the employee safety handbook. The handbook includes general safe work practices and specific safe work practices that apply to each job.

Safe work practices usually are printed in an employee safety handbook. The first page of this handbook should include a Safety Policy from senior management. When providing employees with a safety handbook, review the material with them annually and ask questions to ensure their comprehension. Training should thoroughly support all content. Have employees sign a statement certifying that they understand the safety rules and policies and agree to abide by them. Maintain this signed statement in the employee’s personnel file.

AHB’s analysis of Census Data from the Quarterly Starts and Completions by Purpose and Design survey indicates custom home building matched the best quarter for construction starts since the spring of 2008 during the third quarter of 2021. There were 56,000 total custom building starts during the third quarter of the year. This marks a 5.7% gain from the third quarter of 2020. Over the last four quarters, custom housing starts totaled 190,000 units, an 8% gain from the prior four-quarter total. Despite these gains, the market share for custom home building has declined as other forms of home building have expanded more rapidly. As measured on a one-year moving average, the market share of custom home building, in terms of total single-family starts, held steady at 16.6%. This is down from a cycle high of 31.5% set during the second quarter of 2009. Note that this definition of custom home building does not include homes intended for sale, so the analysis in this post uses a narrow definition of the sector.
