LETTER FROM THE PRESIDENT
Back to BUSINESS AS USUAL 2020 has been nothing short of a whirlwind of change for our members. Some of us experienced shutdowns we were not at all prepared for while others had to manage an entirely different way of doing business. For many, the last 3 months were a very trying time and I am willing to bet that everyone is looking forward to getting back to business as usual. As we know the construction industry and all the trades were deemed essential during the Stay at Home order that our governor issued. But with that came many restrictions that our members had to scramble to put into place to ensure their employees and customers remained safe. I am very proud of how our members handled these restrictions and guidelines and how everyone stepped up to help out as they could. I am very excited to see things are starting to get back to normal. After much discussion we have decided we will be holding our annual member cookout this June! Typically, this event is held on a Friday afternoon in the middle of the day for a nice cookout lunch. After consulting the membership committee and board members we have decided to move this event to Wednesday June 24th starting at 5pm. This event is outside at Pogie’s Clubhouse in Amherst so we have no doubt that we will be able to maintain the social distancing that the governor is still requiring. With the move in date and time we feel that more of our members will be able to attend an afterhours event as many of us have ramped up since most of the economy has started to open back up.

Mick Mackert, owner of Mick Mackert General Contractor was a longtime member of the NCBIA joining in 1987. He served on the Board of Directors from 1989 through 1999 and a state director from 1991 through 1997. In 1994 he started in the chairs to the presidency which he held in 1996. While serving as Chairman of the Remodelers Council from 1990 to 1992, Mick helped start and co-hosted a weekly NCBIA radio show on WOBL. The Lorain County JVS recognized Mick for his time and dedication as a member of the advisory committee that helped create the curriculum for their Building Trades Academy. He had key involvement in the Remodelers Council Fire Safety House and the construction of the West Falls Observation Deck at Cascade Park in Elyria. Mick was inducted into the NCBIA Hall of Fame in 2004. Mick served and chaired many committees including: Home Show, Installation Banquet, Programs and Education, Long Range Planning Chair Codes and two Habitat for Humanity Projects. Mick touched many people’s lives and there are memories that will be treasured. He will be dearly missed!

We are certainly going through an unprecedented time that has drastically affected the worldwide economy, including the residential construction industry. The NCBIA has been working together with those at the state and national levels to help companies like yours to keep your doors open. NAHB took the lead in getting the Department of Homeland Security to designate single-family and multifamily construction as an Essential Infrastructure Business. NAHB and OHBA made staff expertise available that provided clarity on tax relief provisions and health and safety issues. Tracking the situation and providing the most relevant information was overwhelming at times however I wanted to pass onto members as soon as received. Updates have slowed down but rest assured that the latest news and resources for your business will continue to be at your fingertips. Demand for Home Offices, Exercise Rooms Could Grow in Wake of Pandemic
A
recent Eye on Housing blog post examines how lockdown orders implemented across the United States to fight the spread of the coronavirus have given rise to more people working from home and engaging in other activities indoors that they would normally do in public spaces. With the major shift in where people spend their time, it is important to examine the data currently available on home buyers’ preferences for home offices and exercise rooms, as demand for these specialty rooms may grow. NAHB’s consumer preference study, What Home Buyers Really Want, surveys recent and prospective home buyers about the features they want in a home and community. The most recent survey, conducted in 2018, shows that a majority of home buyers — 65% — want a home office. This share has remained fairly stable in the 60-plus percent range since 2007 (Figure 1). In contrast to home offices, fewer than half of all home buyers are interested in having an exercise room at home, at least prior to the COVID-19 pandemic. In 2018, 40% reported wanting a room dedicated for exercise. That number, however, has been rising slowly over the years, from 27% in 2003, to 35% in 2012, and then 40% in 2018 (Figure 2). Although the lockdown orders may be eased in the near future, the fact that millions of people were compelled to spend unprecedented amounts of time inside their homes may have a longer-term effect on people’s preferences for home offices, exercise rooms and other specialty rooms. NAHB will continue this research in the months and years to come.

Builder Confidence Posts Solid Gain After Historic Drop BY ROBERT DIETZ
I
n a signal that the housing market is showing signs of stabilizing and gradually moving forward in the wake of the COVID-19 pandemic, builder confidence in the market for newlybuilt single-family homes increased seven points to 37 in May, according to the latest National Association of Home Builders/ Wells Fargo Housing Market Index (HMI). The rise in builder sentiment follows the largest single monthly decline in the history of the index in April. The designation of home construction as an essential business during the crisis helped keep most residential construction workers on the job, which is reflected in the May HMI. At the same time, builders are showing flexibility in this new business environment by making sure buyers have the knowledge and access to the homes they are seeking through innovative measures such as social media, virtual tours and online closings. Jurisdictions are also adapting to the new environment with third-party and virtual inspection rules. Low interest rates are helping to sustain demand. As many states and localities across the nation lift stay-at-home orders and more furloughed workers return to their jobs, we expect this demand will strengthen. Other indicators that suggest a housing rebound include mortgage application data that has posted four weeks of gains and signs that buyer traffic has improved in housing markets in recent weeks. However, high unemployment and supply-side challenges including builder loan access and building material availability are near-term limiting factors. Derived from a monthly survey that NAHB has been conducting for 30 years, the NAHB/Wells Fargo Housing Market Index gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. All the HMI indices posted gains in May. The HMI index gauging current sales conditions increased six points to 42, the component measuring sales expectations in the next six months jumped 10 points to 46 and the measure charting traffic of prospective buyers rose eight points to 21. Looking at the monthly average regional HMI scores, the Midwest increased seven point to 32, the South rose eight points to 42 and West posted a 12-point gain to 44. The Northeast fell two points to 17.

UPDATE May 2020 Like you, we have been on an adjusted schedule for over a month. Hopefully, some sense of normalcy will return soon. Wish I could tell you that time is now. Just the opposite, things are very much in a state of flux. Many, many are growing weary of all the restrictions in place. Of concern here is that government leaders share in vast disagreement.
There is no clear sign of normalcy for
some time. There will be loosening of some restrictions; some may remain for a lot longer. We are at the mercy of the numbers. Statistics of illness, suffering and death guide future actions. So far, the numbers paint a dreary picture. News stories of overloaded funeral homes and crematories does not help. The governor’s team is just not ready to open things up. Some legislators want everything opened. Others are unsure. Some are loudly demonstrating at the statehouse. Best we can tell you now is that construction is still ok. Safety protocols are a must. We monitor it all daily. We keep in touch with our pals in the legislature, state offices and

Building Materials Prices Post Record Monthly Decline in April

rices paid for goods used in residential construction decreased 4.1% in April (not seasonally adjusted)—the largest monthly decline on record—according to the latest Producer Price Index (PPI) report released by the Bureau of Labor Statistics. The year-to-date decline (-5.4%) in residential construction inputs prices is more than three times larger than the previous record (-1.3% in 2009).
Prices paid for gypsum products decreased 1.3% in April (seasonally adjusted) after climbing 2.2% in March. The price index for gypsum products has decreased 4.4% in 2020 and has fallen 9.5% since its most recent peak in March 2018.
Gypsum product prices have declined 4.4% YTD, the largest Januaryto-April decrease since seasonally adjusted data became available in 2012. Building materials prices have fallen 6.6% since April 2019 by -0.6% per month, on average. In contrast, prices increased 0.2% per month, on average, from April 2018 to April 2019. The index now stands at its lowest level since August 2017.

Although the PPI report shows that softwood lumber prices declined 10.8% (seasonally adjusted) in April, the decrease is at odds with recent prices reported by Random Lengths. According to their weekly data, prices fell a more modest 2.7% over the month.

The discrepancy between the BLS and Random Lengths data stems from known differences in survey timing. We anticipated this in last month’s PPI post, in which we stated that the decline over the last 10 days of March “should be captured in next month’s PPI report.” Prices paid for ready-mix concrete (RMC) decreased 0.4% in April (seasonally adjusted), following a 0.7% increase in March. The RMC index has increased 1.1% year-to-date (YTD), which is close to the historical average YTD price change in April.

Prices were little changed from March to April in the Northeast (unchanged), Midwest (-0.2%), and South (-0.1%), but increased 1.9% in the West region (not seasonally adjusted). Since the beginning of 2020, RMC prices have decreased 3.2% in the Midwest but have climbed 5.0%, 1.1%, and 0.5% in the South, West, and Northeast, respectively.

A
Positive Signs for Housing Despite Staggering Job Losses BY ROBERT DIETZ
pril saw historic declines for the labor market, with a total of 20.5 million jobs lost for the month. The unemployment rate increased to 14.7%, but the broader measures reflect even more extensive losses with 33.5 million jobless claims filed over the last seven weeks. NAHB is expecting even higher unemployment numbers in May. Despite the labor market plunge in April, housing demand showed some recent signs of optimism. Purchase applications for mortgages staged a small but positive set of improvements over the last three weeks as a sign of latent housing demand. This demand will likely increase as lockdowns are eased. And while the total unemployment numbers are staggering, it is important to note that they are due to government-imposed virus mitigation strategies that are in the process of being relaxed. For example, there are now 18 million people on temporary furlough. Hopes for a faster rebound in economic activity lie with this number. While NAHB's forecast is more U-shaped for the overall economy (we see continued economic weakness persisting into the third quarter due to small business issues and elevated unemployment), these temporary layoff totals give a sense of the number of people who believe their job will return as the economy gradually reopens. Residential construction employment and remodeling declined by 415,000 positions in April and now stands at 2.54 million, which is near November 2015 levels. Unlike the Great Recession, housing enters this downturn underbuilt, with a housing deficit of approximately 1 million residences. This potential demand means that housing is a sector that can provide economic momentum in a recovery. It's important to remember that housing held considerable momentum as we began 2020, so any recovery will feature renewed residential construction hiring and economic activity.

SURVIVING A DOWNTURN Now is the Time to Take Action
I
n the business world, knowing when to take action can be the difference between your company’s continual growth or eventual decay. Timing is everything. The coronavirus pandemic has created significant challenges and uncertainty for many, particularly those in the housing industry. While these challenges are substantial, now is not the time to simply stand idle and hope your business is lucky enough to survive. Now is the time to: Be proactive, not reactive. Surveys have shown most successful people want at least 80% of their efforts to be proactive and no more than 20% reactive. In recent months, many business leaders were pressed to be 80% reactive. Functioning this way is neither sustainable or beneficial to a successful business. It is critical now to move back to being predominantly proactive. List the things you can control and adjust your business plan accordingly. This will not only make you productive but also help your mindset. Prepare for some very challenging months ahead. Like with any home building or remodeling project, preparation is very important. When you know a storm is coming, you know what to do to prepare. Similarly, when you know there will be a tough cash-flow quarter, you know you need to shore up as much cash as possible (both spending and collecting). Prioritize. This crisis is unique because what is best for your community (and society as a whole) may not be ideal for your business. Many short-term aspects of your business might need to take the back burner until conditions improve and markets begin to normalize. You need to determine your priorities and identify any potential revenue-generating alternatives that might be needed to keep the doors open.

Know your numbers. For a small business to survive a significant economic downturn, it’s critical to intimately know your numbers. Cash flow forecasts, website traffic, and even staff productivity are things that should be monitored constantly. If you’re “flying blind,” you aren’t likely to arrive safely at your destination. Reconnect with former clients and colleagues. Now is the time to be more connected with other people. This can be personal or professional. While your clients may not be in a position to buy a home or commit to a project, many would welcome a virtual check-in or even a simple email. Make a list of at least 50-100 friends, clients, family members and fellow HBA members, and just chip away a few each day. Think and plan. As the pace of your personal and professional life has page 22

Share of Buyers Expecting Housing Availability to Improve Rises to Highest 1st Quarter Reading in Three Years BY: ROSE QUINT
A
ccording to the latest Housing Trends Report (HTR), the share of prospective home buyers expecting their house search to get easier in the months ahead rose to 25% in the first quarter of 2020, up from 16% and 22%, respectively, in the first quarters of 2018 and 2019. This rise marks the third consecutive year-overyear increase in the share of buyers expecting housing availability to improve. Conversely, the share of buyers who think availability will worsen (or stay the same) has dropped to 62%, compared to 73% and 67% in the first quarters of 2018 and 2019. The timing of the data collection for this report is highly consequential. The online survey was in the field from March 17 through March 28, the early stage of the COVID-19 crisis in the US. About 12 million people filed for unemployment benefits in the two weeks immediately after data collection closed. For this reason, we assess that responses in this quarter’s report mostly reflect people’s views prior to the full impact of stay-at-home orders and social distancing restrictions imposed by local and state governments. Across generations, expectations that housing availability will improve are highest among Gen X buyers (27%) and lowest among Boomers (20%). Geographically, 20% to 27% of buyers in every region expect that finding a home will become easier in the months ahead.

Along with this slight uptick in expectations for easier availability in the months ahead, results also show the share of buyers who actually see more homes for-sale (that they like and can afford) holding steady at 31%, compared to 30% in the first quarter of 2019. At the same time, the share of buyers who report less inventory (fewer or the same number) of such homes on the market is 55%, down from 60% a year earlier. Across generations, over 30% of Gen Z and Millennial buyers report seeing more homes they like and can afford for-sale than three months earlier, compared to 24% of Boomers. Regionally, buyers in the West are the most likely to report seeing more homes for-sale (33%), while those in the Midwest are the least likely (25%).

NEW HOME SALES Overperform in April

A
fter weakening in March, the volume of new home sales came in much better than expected in April. Due to economic challenges associated with COVID-19, NAHB was forecasting an additional sales decline in April. However, new home sales estimates from the Census Bureau reveal relatively flat conditions compared to March. The Census estimates reported a 623,000 seasonally adjusted annual rate in April, after a slightly revised 619,000 pace in March. The April rate is down approximately 20% from the peak rate in January. It is reasonable to expect a downward revision for the April data next month given persistent weakness in the labor market. Nonetheless, mortgage application data and anecdotal reporting from builders indicates that housing demand picked up in recent weeks. Overall, the data lend evidence to the NAHB forecast that housing will be a leading sector in an eventual economic recovery. Consider that despite the recent weakness, new home sales are reported to be 1.4% higher through April than the first four months of 2019. Sales were likely supported by price incentive use in April, with NAHB data indicating that two out of ten builders used such business strategies. Indeed, median new home pricing fell to $309,900 in April, which was 8.6% lower than a year ago. And months’ supply is at a reasonable level of 6.4 despite the ongoing recession. The count of completed, ready-tooccupy new homes is 78,000 homes nationwide. While March home sales were drawn more from completed, ready to occupy homes (40%), this share actually declined in April to 35%. The share of not started homes sold increased to 30%, which is a positive indicator for future housing starts. It is likely the April data will be downwardly revised given other economic data. However, given the momentum housing construction held at the start of 2020, the housing industry will help lead the economy in the eventual recovery and the April data is broadly consistent with that conclusion.

MAY 15, 2020 REPORT #7 OEPA PROPOSES GENERAL PERMIT IN RESPONSE TO NEW WOTUS DEFINITION As the new federal definition of “Waters of the United States” is to go into effect at the end of June, Ohio EPA has put forth its response for stakeholder comments. OHBA has been involved in multiple phone calls with the agency, as well as, other industry stakeholders. The agency is proposing a new general permit to address impacts to ephemeral streams now that the agency considers these ‘waters of the state’. OHBA continues to discuss this proposal and plans on submitting comments raising numerous questions and concern. The links to the draft general permit and webinar are detailed below. Ohio EPA issued a public notice for a new Draft General Permit for Impacts to Ephemeral Streams and Isolated Wetlands to address the recently finalized Navigable Waters Protection Federal Rule that will be effective on June 22, 2020. The comment period ends on June 17, 2020. The Draft General Permit can be accessed here. Ohio EPA held a stakeholder webinar on May 7, 2020 to propose options to address the new federal rule including the new Draft General Permit. A complete recording of the webinar can be accessed here. HB 163 WATER/SEWER SERVICE LEGISLATION VOTED OUT OF COMMITTEE The House Public Utilities Committee favorably reported HB 163 to create a process for withholding local government funds and state water and sewer assistance from municipal corporations that engage in certain water and sewer practices with respect to extraterritorial service. The vote was split on party lines with the Democratic members opposing the measure. The bill will now have to be voted on by the full House before it is referred to the Senate.
GOVERNOR DEWINE CONTINUES TO ANNOUNCE MORE REOPENINGS WEEKLY Governor DeWine has made several recent announcements as he allows more and more businesses to reopen with proper protocols. Outdoor seating in restaurants are set for May 15th, and just announced yesterday, BMV, childcare centers, day camps, gyms, campgrounds, and swimming pools dates have been set. MAINTAINING SAFETY PROTOCOLS CONTINUES TO BE CRUCIAL A consistent message from the very beginning of essential business operation to weekly reopenings by Governor DeWine are proper safety protocols. Task forces have been put together for various industries prior to announcing a date of reopening charging the members to produce guidelines for proper safety protocols. As an essential business, construction has had to put these in place from the beginning, and in the coming weeks and months, maintaining these protocols continues to be crucial. OHIO LEGISLATURE WILL CONTINUE INTERMITTED SESSIONS THROUGH SUMMER MONTHS Both House and Senate committees have resumed hearings, as well as, full sessions of both chambers over the past weeks. Tension is apparent, as they continue to address new legislation introduced in response to COVID-19, each chamber is also moving other pieces of legislation, picking up where it left off. OHBA continues to monitor both newly introduced and remaining bills as the legislature continues to meet.

MAY 21, 2020 REPORT #8 OHIOANS PROTECTING OHIOANS URGENT HEALTH ADVISORY: Governor DeWine released details of the new "Ohioans Protecting Ohioans Urgent Health Advisory" which replaces the Stay Safe Ohio order that was issued by the Ohio Department of Health on April 30, 2020. The health order replaces language requiring Ohioans to stay at home with limited exceptions with language that strongly recommends that citizens, especially those who are high-risk, stay at home as much as possible. The order does not change the mass gathering restrictions, which remain at a 10-person limit. The new health advisory also lifts overall travel restrictions and the requirement to quarantine if someone travels to or returns to Ohio. Unnecessary travel within or outside of Ohio is not encouraged. In addition, those who have tested positive for COVID-19 and have not recovered, those who are presumptively diagnosed with COVID-19, and those who are exhibiting the symptoms identified in the screening guidance available from the CDC and the Ohio Department of Health, remain prohibited from entering the state of Ohio unless they are doing so under medical orders for purposes of medical care, are being transported by emergency medical services EMS, are driving or being driven directly to a medical provider for the purposes of initial care, or are a permanent resident of Ohio.
SB 212 RECEIVES SPONSOR TESTIMONY IN HOUSE WAYS AND MEANS COMMITTEE SB 212 PROPERTY TAXATION (Schuring, K.) To authorize townships and municipal corporations to designate areas within which new homes and improvements to existing homes are wholly or partially exempted from property taxation.
On Tuesday, sponsor, Kirk Schuring (R-Canton) said his plan grants permissive authority to townships and municipalities to create Neighborhood Development Areas if they will serve the public purpose of encouraging affordable housing development. Chair of the Ways and Means Committee Rep. Derek Merrin (R-Monclova) said he shares the sponsor's passion about the lack of affordable housing and applauded the goal of granting municipalities more flexibility to address the issue. The sponsor remains in constant contact with OHBA, as SB 212 moves through the process, and has been an ongoing proponent of housing and previous tax legislation (HB 149). It is likely OHBA will offer proponent testimony when it is scheduled. CONSTRUCTION PAYMENT LEGISLATION THOUGHT TO BOOST ECONOMY HB 380 (2019-2020) CONSTRUCTION PAYMENTS (Cross, J., Sweeney, B.) To require owners of construction projects to pay a contractor within thirty-five days of receiving a request for payment. Am. 4113.61 OHBA has been monitoring HB 380 which would apply payment provisions similar to current public construction law to private commercial construction. Although 1,2,3 family construction is already exempt, OHBA received questions and possible concerns at its Spring meeting, which it passed along to the sponsor prior to the COVID shutdowns. Recently, testimony has been offered and further hearings on the bill continue, touting HB 380 as part of the economic recovery. MCO Open Enrollment: MOVED to May 2021 Due to the impact of the COVID-19 on Ohio’s business community, the Ohio Bureau of Workers' Compensation is postponing this year’s enrollment period for employers to select a managed care organization (MCO). The next official enrollment period is scheduled for May 3 - May 28, 2021.
BWC $1.6 Billion Dividend Sent to Ohio Employers The Ohio BWC Board of Directors approved a $1.6 Billion Dividend to ease the economic impact of the coronavirus pandemic on Ohio’s economy and business community. Of the $1.6 billion dividend, approximately $1.4 billion will go to private employers and approximately $200 million will go to local government taxing districts, such as counties, cities, townships, and schools. Thanks also to strong investment returns, the dividend equals approximately 100% of the premiums employers paid in policy year 2018 (7/1/2018-6/30/2019). BWC will apply the dividend to any outstanding balances employers may have first, including the recent installment deferrals. Any amounts exceeding outstanding balances will be sent to the employer. The BWC will not rebate any premium savings you had from the Go Green rebate, Lapse Free rebate, Drug Free Safety Program rebate, ISSP rebate, Safety Council rebate or the Early Payment discount.
What if your organization was in a Group Retrospective Rating Program during the 2018 policy year? Private employers will receive 100% of their experience-rated premium as of April 4, 2020. the 2018 12-, 24-, and 36-month evaluations will occur to capture the performance of the groups, but no further financial transactions impacting the 2018 policy will post to the employers’ policies.

Still able to Adjust Estimated 2019 Policy Year Payroll Did you know that employers can still change their 2019 payroll? Employers have until 5/29/2020 to make the change. This helps private employers in two ways: if they did have layoffs it will reduce or possibly eliminate the deferred installment payments.
Also, it may reduce their
2020 installments as well because the Ohio BWC will be using 2019 estimated payroll to determine a company’s 2020 installments.
2-hour Green Period Claim Safety Training Waiver Normally the Ohio BWC would require Group Experience and Group Retrospective rating participants with a claim occurring in the green period to complete a two-hour training class by June 30, 2020 for private employers, or by December 31, 2020 for public employers. However, due to the COVID-19 pandemic, the Ohio BWC is waiving the program’s safety activity requirements for the 2019/2020 program year. Although the BWC has waived the safety training requirement, the BWC is encouraging employers to take advantage of the online training that they provide. Update: BWC Safety Council Attendance Credits for 2019 Policy Year The Ohio BWC has determined how to proceed with the 7/1/19-6/30/20 Safety Council Rebate Program in the midst of COVID-19. Safety council sponsors have been directed to cancel March, April, May, and June safety council meetings. Therefore, the BWC will provide the FY20 rebate to safety council members who, as of February 29, 2020, had attended at least FOUR safety council meetings. This determination was based on crediting each member with one meeting credit for each cancelled meeting, the maximum of two external training credits and waiving the CEO attendance and calendar year 2019 semi-annual report requirements. Although the BWC realizes a small number of safety councils host more than one meeting a month late in the program year, they are granting relief for only one safety council meeting credit per month in March, April, May, and June. This resolution reinforces the program’s goal of active participation for the purpose of education, networking and resource sharing and, unfortunately, members who condense participation to the latter part of the program year will not appreciate relief from this solution. Ultimately, employers that the BWC determines have earned the rebate under the revised guidelines will receive the maximum percentage rebate allowed per their BWC group-rating status: •
2% for Group-Retrospective-Rated employers eligible for the participation rebate.
•
2% for employers Group-Experience-Rating employers eligible for the performance bonus - there will be no claims data measurement calculation.
•
4% for employers not enrolled in a BWC Group-Rating Program.
Your safety council sponsor will submit July 1, 2019 through February 29, 2020 attendance records to the Ohio BWC when normal business operations resume. The timeline for the processing of these rebates is yet to be determined but the BWC will continue to update safety council page 40

Advanced and Basic Level DFSP Annual Report Reminder If your company or organization is enrolled in the Ohio BWC’s Advanced or Basic Level Drug Free Safety Program, don’t forget to complete the online annual report by June 1, 2020. This report also serves as an application for the next program year. This report is available online at www. bwc.ohio.gov. IMPORTANT: In addition to the report and supplemental documentation, please provide an explanation of all program requirements that could not be completed as a result of limitations imposed due to the COVID-19 pandemic. These requirements may be waived as a result of the pandemic. To retain your bonus eligibility and/or remain approved on the state contractor list, you must complete your annual report and provide all required documentation no later than June 1, 2020.
Is COVID-19 a Compensable Workers’ Compensation Claim? Ohio BWC (as of 3/21/2020) It depends on how you contract it and the nature of your occupation. Generally, communicable diseases like COVID-19 are not workers’ compensation claims because people are exposed in a variety of ways, and few jobs have a hazard or risk of getting the diseases in a greater degree or a different manner than the general public. However, if you work in a job that poses a special hazard or risk and contract COVID-19 from the work exposure, BWC could allow your claim. Industrial Commission Suspending In-Person Hearings The Ohio Industrial Commission announced that beginning Wednesday, March 18, the Commission will begin conducting hearings by telephone for the following issues: permanent total disability, temporary total disability or the termination of temporary total disability, wage loss, allowance and additional allowance. All other hearing issues will be continued. CareWorks Comp will keep you updated on the status of hearings as the Ohio Industrial Commission makes them available.

Changes to Payroll Reporting as a Result of COVID-19 The BWC-Employer Services Division will implement two changes in payroll reporting requirements as a result of the COVID-19 pandemic and state of emergency. Please refer to the details below regarding the Families First Coronavirus Response Act and reportable wages associated with teleworking staff. Since these changes may impact how employers will report payroll for the upcoming policy year 2019 true-up period, we want to distribute this information immediately to allow employers time to prepare for any changes in the way they track or record employee wages. This information will also be included in the BWC COVID-19 Frequently Asked Questions (FAQ) available on the BWC web. Q: Is emergency sick leave and expanded FMLA paid to employees under the Families First Coronavirus Response Act reportable when submitting true-up payroll? A: No. Emergency sick leave and expanded FMLA paid to employees under the Families First Coronavirus Response Act will not be reportable to BWC for premium purposes. While regular paid sick leave (including third party sick pay) is reportable to BWC, emergency sick leave and expanded FMLA paid under this act is not reportable. Effective 4/1/20 through 12/31/20, wages paid by companies under the Families First Coronavirus Response Act for sick leave related to COVID-19 and leave time to care for a child whose school or childcare provider is closed or unavailable for COVID-19 related reasons are not reportable to BWC. Employers must follow the eligibility and documentation guidelines established by the Federal Government to exclude these wages from their reportable payroll and premium calculation at true-up. Wages reported to BWC for premium calculation purposes is subject to verification by a premium audit. Q: How will employers report wages at true-up for operational employees who are teleworking as a result of Governor DeWine’s “Stay at home” order while receiving wages from the employer? A: Employers are permitted to report operational staff currently teleworking to class code 8871- Clerical Telecommuter during a declared state of emergency. This will ease the economic impact of the COVID-19 state of emergency on the Ohio Business Community. •
The employer must contact BWC to request classification code 8871-Clerical Telecommuter Employees to be added to their policy. This will allow the employer to report wages to class code 8871 during the True-up period.
•
The Employer is responsible for recording, tracking and documenting the wages associated with the operational employers now teleworking for premium audit purposes.
•
If the operational staff continues to perform the same duties from home while teleworking, the employer will continue to report those wages to the appropriate operational classification code, not to class code 8871.
•
For example: the employer manufactures surgical masks. The employees have been sent home with the equipment and materials to continue to sew these masks to meet customer demands. These employees are not 8871 Clerical teleworking employees. The classification assigned to these employees remain 2501-Cloth, canvas and related products manufacturing. The exposures for the employees do not change.
•
This temporary revision to the class code assignment rule only applies during the time of Governor DeWine’s “Stay at home” order, which was initiated on March 15, 2020.
•
The employer is to cease reporting operational employees’ wages to class code 8871 once the state of emergency has ended or if the operational employee(s) return to performing their previous job duties.
•
To request the addition of class code 8871- Clerical Telecommuter Employees to your policy, contact 1-800-644-6292 or send an email to RTSclass@ohiobwc.com. Please include your policy number in your email request.
Q: Will employers who have suspended operations due to the COVID-19 who are paying employees while they are idle at home need to report the payments as payroll? A: No. Employers are not required to report to BWC the wages paid to employees who are idle at home because of the COVID-19 pandemic. We encourage employers to keep track of such payments, however, for purposes that might surface during potential audits.

2020 Policy Year Notice of Estimated Annual Premiums Mailed to Ohio Employers Right now, the BWC is mailing out the Annual Notices of Estimated Premiums for the upcoming 2020 policy year that starts on July 1, 2020 and ends on June 30, 2021. Important item to note: The Ohio BWC will utilize the 2018 policy year payroll/exposure and reduce this amount by 20% due to assumed COVID-19 business challenges for the 2020 policy year estimate. This could impact what employers could owe when completing the Annual True Up (due 8/15/2021). Therefore, when you receive this Notice, we highly suggest that you review it in detail and confirm if the estimated payroll numbers that the BWC is projecting match what you are projecting for your company. If you are expecting your payroll to change significantly for the 2020 Policy Year (either up or down) we suggest you contact the Ohio BWC to adjust those numbers accordingly. This will ensure a more manageable True Up in the summer of 2021. If you would like to change your Premium Installment Plan (Monthly, Bi-Monthly, Quarterly, Semi-Annual, Annual) for the upcoming 7/1/206/30/21 Policy Year, you can do so by May 15, 2020 by going online to www.bwc.ohio.gov or by calling the Ohio BWC at 1.800.644.6292.

Completion of the temporary authorization provides a third-party administrator (TPA) limited authority to view an employer's payroll and loss experience. By signing the AC-3, the employer grants permission to the BWC to release information to the employer's authorized representative(s). The form allows a TPA to view an employer's information regarding payroll, claims and experience modification. Attention group rating prospects Employers may complete the AC-3 for as many TPAs or group-rating sponsors they feel are necessary to obtain quotes for a group-rating program. Group sponsors must notify all current group members if they will not accept them for the next group-rating year. The deadline for this notification is prior to the last business day in October for private employers and prior to the last business day in April for public employers. All potential group-rating prospects must have: Active BWC coverage status as of the application deadline; Active coverage from the application deadline through the group rating year; No outstanding balances; Operations similar in nature to the other members of their group. Any changes to a group member's policy will affect the group policy. Changes can result in either debits or credits to each of the members. Note: For complete information on rules for group rating, see Rules 4123-17-61 through 4123-17-68 of the Ohio Administrative Code or your TPA.
