In the world today of information technology- some members feel they don’t need to join a trade association because they can get the information they need from other sources. But I see it differently- there is strength in numbers. The NAHB has over 140,000 members. The NCBIA- your local associationis on the frontlines of protecting our industry by working with the Ohio Home Builders Association (OHBA) and National Association of Home Builders (NAHB), powerful groups that provide advocacy in Columbus and Washington, DC on behalf of all of us who earn a living in the building industry. NCBIA HISTORY The 1980’s As we continue our 75th anniversary celebration for the North Coast Building Industry Association, we are now into the 80’s. It was tough being in the building trades in the early ‘80s. If a deep recession wasn’t enough, all-time high interest rates, as high as 21%, it seemed as if there was a conspiracy to strangle any growth in the housing industry. Literally, all new construction was halted, many builders moved away, went out of business or went into remodeling to survive. The association’s membership dropped from a high of 294 to 164 in 1984. Many builders had gone out of business or simply quit. Foreclosures reached staggering heights. The Remodelers Council was formed to support the many contractors who were turning to remodeling to compensate for the downturn in housing starts.

By the end of 1983, those who were still around could see signs that the economy was firming up as interest rates fell. Builders who had struggled and survived became better builders; more knowledgeable about their industry, more competent business managers and much more professional. To address a membership which had declined, the Association decided to more accurately reflect the business of its membership by changing its name. The name of the association was changed in 1985, from the Home Builders Association to the Building Industries Association (BIA) of Lorain County. Membership was no longer one to just residential builders and sub-trades but was now open to anyone in the building trades and related fields. The association added industry promotions such as an annual Parade of Homes and an annual Homearama to increase sales of new homes and to create additional jobs for our members. The later years of the 1980’s proved to be profitable for our association as our industry again led the way out of a recession. The association began to formulate plans for the construction of its own office building.

OHBA EXECUTIVE VP COLUMN
ADVOCACY; Our Main Purpose Established over 40 years ago, the main purpose of OHBA is to provide state legislative and regulatory advocacy for the industry. This is not news to those who follow us closely. It was good planning then and it is still the right choice now. The number of possible regulatory impacts has grown steadily through the years. As we enter the summer, we are preparing to attend the NAHB Legislative Conference. The arena there is full of challenges. Hopefully, a strong Ohio contingent will attend. The following week, OHBA holds our summer board meeting where many items will be discussed of concern and interest to all on the statewide front too. This is the normal course of business. The HBA federation partners are your advocates and work hard for you. Here in the buckeye state we have regular dialogue on building code issues. There seems to be constant push for increased requirements. Remember California where net zero energy use homes will be the law there in a few years. The state legislature is in the process of resolving similar issues with utility generation providers. Hopefully, we can report later the final state budget will include some lot development property tax incentives as well. About four contractor licensing initiatives for various trades are in the hearing stage. All this advocacy is impinged by term limits and constant challenges to legislative apportionment through litigation. Term limits of state legislators has made swearing in new Ohio lawmakers a weekly event. Challenges to congressional districts keep all incumbents on edge as the threat of having a new district is a major concern to incumbents. Moreover, all states must draw new legislative lines by 2022 to accommodate population changes. Federally, Ohio is expected to lose at least one congressional seat. That means districts composed of more than 800,000. All Ohio House and Senate seats must be redrawn as well.

B
oosted by lower mortgage rates, existing home sales, released by the National Association of Realtors (NAR), rebounded in May. This is the first gain in two months. Total existing home sales, including single-family homes, townhomes, condominiums and co-ops, climbed 2.5% to a seasonally adjusted annual rate of 5.34 million in May. On a year-over-year basis, sales were 1.1% lower than a year ago. Sales have declined on an annualized basis for more than a year. The first-time buyer share remained unchanged at 32% in May from last month and was up from 31% a year ago. The May inventory increased to 1.92 million units from 1.83 million units in April, and rose from 1.87 million units compared to a year ago. At the current sales rate, the May unsold inventory represents a 4.3-month supply, up from a 4.2-month supply both last month and a year ago. Homes stayed on the market for an average of 26 days in May, up from 24 days in April but unchanged compared to a year ago. In May, 53% of homes sold were on the market for less than a month. The May all-cash sales shared 19% of transactions, down from 20% last month and 21% a year ago.

The May median sales price of all existing homes was $277,700, up 4.8% from a year ago, representing the 87th consecutive month of yearover-year increases. The median existing condominium/co-op price of $257,100 in May was up 5.4% from a year ago. Regionally, all four major regions saw a growth in existing home sales in May compared to the previous month, ranging from 1.8% in the South and West to 4.7% in the Northeast. On a year-over-year basis, sales were mixed in May. Sales in the South grew 1.3%, while sales in the Midwest and West fell 3.9% and 3.4%. Sales in the Northeast remained unchanged in May. According to the NAR, the May gain is a positive sign showing consumers are eager to take advantage of favorable conditions. This demand was mainly fueled by lower mortgage rates, which declined to recent low rates. Despite falling mortgage rates, solid demand along with inadequate supply of entry-level housing may drive home prices higher and make home-buying more challenging to new buyers. Builder confidence declined two points to 64 in June, but remained at a solid range in the low- to mid-60s for the past five months. Though new home sales improved in March and April, builders continued to grapple with excessive regulations, labor shortages and costly building materials that are hurting affordability and depressing supply.

Not Enough to Solve Affordability Woes

he overall economy recorded a notable 3.2% annualized
GDP growth rate during the first quarter of 2019. However, it was the fifth consecutive quarter of negative contributions to economic growth from residential fixed investment (a measure of single-family building, apartment development and remodeling). Even with lower mortgage interest rates, housing affordability is relatively the same as it was a year ago. The NAHB/Wells Fargo Housing Opportunity Index found only 61% of new and existing homes were affordable to a typical household. Rising construction costs remain a key issue affecting housing affordability; year to date, material costs have increased 3.2%, outpacing inflation. Despite these concerns, builder confidence remains solid. The NAHB/ Wells Fargo Housing Market Index increased three points in May to a level of 66 — the highest reading since October 2018. However, the uptick in builder confidence has not produced substantial gains in residential construction activity — yet. While single-family starts increased 6.2% in April, they remain 4.5% lower than they were at the start of 2018. Single-family permit activity in April was at its lowest pace since October 2016. And while multifamily permit activity is 8.9% higher on a year-to-date basis compared to 2018, multifamily starts have declined thus far in 2019. Individual submarkets reflect this weakness in the housing data. The accelerating townhouse construction market, for example, stalled at the start of 2019, declining by 13% on a year-over-year basis. Singlefamily built-for-rent activity also declined, with its market share falling to less than 5% of single-family starts. Custom home building, challenged by growing inventory of existing homes, was relatively flat at the start of 2019 with a stable 19% market share.

A Nation of Builders BY CARMEL FORD Every year the National Association of Home Builders conducts a member census to better understand the composition and characteristics of the people who belong to its organization. In 2018, 32 percent of NAHB’s members were builders—those whose primary business is single-family home building, multifamily building, residential or commercial remodeling, commercial building, land development, or manufacturing of modular/ panelized/log homes. The remaining 68 percent were associate members—those involved in support industries and professions, such as trade contractors, manufacturers, retailers/distributors, designers, and architects. Of the 38,233 builder members, 61 percent are single-family builders (spec/tract, custom, or general contracting), 22 percent are residential remodelers, 5 percent each are commercial and multifamily builders, and 4 percent are land developers. One percent each are commercial remodelers and manufacturers of modular/panelized log homes (Exhibit 1). Exhibit 1. Company Details NAHB’s builder members reported that they had a median of 5 employees on payroll in 2018. The plurality of builders – 32 percent – had 2 to 4 employees and about a quarter had 5 to 9. The median number of employees on payroll has been 5 since 2015. In 2018, builder members started a median of 6 housing units, up from 5 in 2017. The plurality of builder members – 21 percent – started 2 or 3 units. The median dollar volume of business among builder members was $2.7 million in 2018, unchanged from 2017. The median dollar volume of business essentially plateaued between 2008 and 2011, with levels ranging from $0.9 to $1 million dollars, then rose sharply between 2012 ($1.1 million) and 2015 ($2.5 million). It slipped to $2.4 million in 2016, and increased in 2017 and 2018 to reach its highest level since the inception of the Census ($2.7 million).
Builder Details The median age of NAHB builder members was 57 in 2018, unchanged from 2017. Fifty-three percent of members have either a college or a graduate/professional degree. Builder Confidence Solid in June Amidst Growing Economic Uncertainty BY ROBERT DIETZ Builder confidence in the market for newly-built single-family homes fell two points to 64 in June, according to the latest National Association of Home Builders/Wells Fargo Housing Market Index (HMI). Sentiment levels have held at a solid range in the low- to mid60s for the past five months. While demand for single-family homes remains sound, builders continue to report rising development and construction costs, with some additional concerns over trade issues. Despite lower mortgage rates, home prices remain somewhat high relative to incomes, which is particularly challenging for entry-level buyers. And while new home sales picked up in March and April, builders continue to grapple with excessive regulations, a shortage of lots and lack of skilled labor that are hurting affordability and depressing supply. Derived from a monthly survey that NAHB has been conducting for 30 years, the NAHB/Wells Fargo Housing Market Index gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. All the HMI indices inched lower in June. The index measuring current sales conditions fell one point to 71, the component gauging expectations in the next six months moved two points lower to 70 and the metric charting buyer traffic dropped one point to 48. Looking at the three-month moving averages for regional HMI scores, the Northeast posted a three-point gain to 60 and the Midwest was also up three points to 57. The West held steady at 71 and the South fell a single point to 67.

Allows Property Rights Plaintiffs to Go Directly to Federal Court
I
n a huge victory for NAHB and its members, the U.S. Supreme Court today reversed a long-standing land use decision that made it nearly impossible for property owners to bring a Fifth Amendment takings claim in federal court. In 1985, the Supreme Court issued a decision, referred to as the Williamson County decision, that forced land use plaintiffs to first go through years of expensive state administrative and/or court proceedings prior to bringing a “takings” claim in federal court. Local governments would often use the decision to their advantage to tire out property owners. In addition, once a property owner finally filed a case in federal court, government defendants would use the prior state court decision as leverage to throw out the federal case. Today, in Knick v. Township of Scott, the Supreme Court ruled that “the state-litigation requirement [in Williamson] imposes an unjustifiable burden on takings plaintiffs, conflicts with the rest of [the Court’s] jurisprudence, and must be overruled. A property owner has an actionable Fifth Amendment takings claim when the government takes his property without paying for it.” This means that rather than going through expensive and drawn-out state court proceedings, a land use plaintiff can bring a takings claim in federal court as soon as the taking occurs. Over the past 34 years, NAHB has pursued multiple avenues to overturn Williamson County, in the form of litigation, amicus briefs and efforts to find a congressional fix. NAHB wrote legislation that passed the House on two occasions and has filed briefs in countless lawsuits on this issue . In fact, NAHB submitted one of just three amicus briefs encouraging the Supreme Court to take the Knick case. JUNE 18, 2019 REPORT #9 2019 RESIDENTIAL CODE OF OHIO AVAILABLE The updated Residential Code of Ohio (RCO), effective July 1, 2019, is available for purchase, to be shipped at the end of the week. The online version, both the free and upgrade option, is available now. LEGISLATIVE UPDATE SB 136 DESIGN PROFESSIONALS (Hottinger, J., Sykes, V.)
To establish a payment assurance program for registered design professionals. SB 136 received sponsor testimony in the Senate Government and Oversight Committee. The sponsors explained the provisions would be identical for each of the design professionals and would not be included in Ohio’s mechanics’ lien law. In order to avoid any conflict, mechanics’ liens will always take precedence over a design professional’s lien, regardless of filing date. The liens would apply only to commercial property and private construction and be subordinate to any real estate mortgage previously filed.
HB 163 WATER/SEWER SERVICE (BRINKMAN, T.)
To create a process for withholding local government funds and state water and sewer assistance from municipal corporations that engage in certain water and sewer practices with respect to extraterritorial service. HB 163 received its fourth hearing today in the House Public Utilities Committee. While the issue initially blamed for the bill’s introduction has been remedied, the Committee members appear engaged on HB 163 as hearings continue. OHBA continues to watch HB 163 and any potential impact on the extension of water and sewer.
HB 271 SMOKE DETECTORS (BALDRIDGE, B.)
To amend the law regarding smoke detectors in residential premises. HB 271 has been referred to the House Commerce and Labor Committee. OHBA is scheduled to meet with the sponsor for clarification on his intentions and express concern over the way HB 271 is currently drafted.
JUNE 21, 2019 REPORT #10 HB 166 BUDGET BILL GOES TO CONFERENCE COMMITTEE Ohio’s biennial budget bill passed the Senate last week with unanimous support, setting up conference committee negotiations between the legislative chambers over the next week. While the Senate removed language from HB 149 exemption of residential development property tax from its version of the budget, it remains one of numerous differences to be considered during conference committee deliberations. Members of the conference committee have been named and are listed below. OHBA continues to make contact and urge both the House and Senate members to include the residential development language in its final version of HB 166. Attached is a brief summary and reference page for the property tax language found in the comparison document to be used by the conference committee when discussing what is in and what is out. If you are a constituent of any of the conference committee members, contact would be helpful, urging them to include the attached amendment in the final version of HB 166. The conference committee includes Sen. Dolan, Sen. Dave Burke (R-Marysville) and Sen. Sean O’Brien (D-Bazetta), and Rep. Scott Oelslager (R-Canton), Rep. Jim Butler (R-Oakwood) and Rep. Jack Cera (D-Bellaire).

Nearly 700 Members Shine a Spotlight on Housing Affordability in Hill Visits Nearly 700 NAHB members from across the nation converged on Capitol Hill today for NAHB’s 2019 Legislative Conference to urge their lawmakers to support policies that will increase the production of quality, affordable housing and keep the housing recovery moving forward. “With housing affordability near a 10-year low, we are sending a loud and clear message to members of Congress that there is an urgent need to implement innovative solutions to ease the nation’s affordability woes and enable more families to achieve homeownership or have access to suitable rental housing,” said NAHB Chairman Greg Ugalde. In nearly 300 individual meetings with their representatives and senators, builders discussed the following key housing issues: •

Workforce and immigration. A chronic labor shortage in the housing industry is resulting in higher construction costs, increased home prices and lower economic growth. NAHB urged lawmakers to create a new, market-based guest worker program for the construction sector that will complement ongoing vocational training efforts and help fill labor gaps. Lawmakers were also encouraged to increase funding for job training programs to prepare individuals for careers in home building. Trade policy. Builders asked their lawmakers to call on the administration to end tariffs on imports of softwood lumber, steel, aluminum and a wide variety of other goods used by the home building industry that are needlessly raising housing costs. NAHB also called on Congress to ensure swift ratification of the United States-Mexico-Canada Agreement, which holds the potential to lift the housing economy. Housing finance reform. Uncertainty about the housing finance system stymies investment and slows the housing market. NAHB called on Congress to pass bipartisan housing finance legislation that would reform the current system and provide certainty to the marketplace, while maintaining an appropriate level of government support for housing in all economic and financial conditions. Low-Income Housing Tax Credit. To help spur the production of badly needed affordable rental housing, NAHB urged lawmakers to pass the Affordable Housing Credit Improvement Act. Introduced in the House and Senate earlier this week, the bipartisan legislation would improve the Low-Income Housing Tax Credit by establishing a permanent minimum 4 percent credit floor for acquisition and bond-financed projects. This would provide more flexibility in financing projects and significantly increase unit production. National Flood Insurance Program. To continue the stability and growth of the housing market, it is essential that the National Flood Insurance Program (NFIP) remains available, affordable and financially stable. NAHB called on lawmakers to pass a long-term

NFIP reauthorization. Building energy codes. NAHB urged Congress to require any code or proposal supported by the Department of Energy to have a payback period of 10 years or less. Cluster mailboxes. The U.S. Postal Service (USPS) has instituted a de facto mandate requiring mail delivery to cluster mailbox units in new residential developments. NAHB believes any reform effort for the USPS should not be funded by home builders and home owners. NAHB urged House lawmakers to co-sponsor a sense of the House resolution (H. Res. 23) that calls on the USPS to preserve delivery of mail to the home or business.

John Barrasso (R-Wyo.) addressed builders before their Hill visits and cited the need to reduce regulatory burdens and taxes to help the residential construction industry. “I want you to be able to build faster, cheaper and smarter by getting rid of regulations and red tape,” said Barrasso. “If we want to grow the economy, we need to lower taxes and get rid of punishing regulations.” The senator also expressed support for two other NAHB priorities: ratification of the United States-Mexico-Canada Agreement and a longterm reauthorization of NFIP.
