LETTER FROM THE PRESIDENT

2022: NEW YEAR, Same Great Association! Here we are at the end of another January! It's cold and grey out, but this is the time of year that business is heating up. We are past the holidays and the spring housing market is fast approaching. The North Coast Building Industry Association is here to help you any way that we can! I am grateful and excited to be taking on the role as president for a second term. We have a phenomenal group of leaders in the association this year and I firmly believe that we have put all of the right people in the right seats and we are going to kick ass this year. Last year there were lots of big ideas that came to fruition and those ideas are moving full speed ahead this year! The first is the mentorship partnership with the Lorain County JVS. Tim King from K. Hovnanian Homes and John Toth from Floor Coverings International have been working tirelessly on getting this program off the ground and I am very excited to see that our kickoff meeting with the students takes place at the beginning of next month! We all know that growing our workforce is one of our BIGGEST goals at the NCBIA and this program is setting out to do just that!

On the same topic of workforce, I am extremely excited to announce that at our March General Membership meeting we will have Ed Brady who is the head of NAHB’s HBI (Home Builders Institute) program. Our goal is to invite all of the superintendents, high school principals, and guidance counselors that are in our footprint to this meeting as well so that Ed can explain to them the benefits of the HBI/Home Depot program and how it can help the schools. If you are not familiar with HBI, the Home Depot Grant or any other of NAHB's workforce development initiatives, I STRONGLY suggest you attend this meeting. It will be one you cannot afford to miss! Lastly our biggest consumer event of the year is coming up at the end of February! Our Home & Remodeling Show is now a 2-day event and takes place on February 26th and 27th at Emerald Event Center in Avon. We are almost sold out of booths, so if you have not turned in your exhibitors contract be sure to get that in ASAP. You do not want to miss your chance at talking to over 2000 people! The committee is hard at work making sure this will be an excellent event for our vendors this year and we hope that even if you don’t have a booth that you stop by the show and check it out and say "hi" to your fellow members! We have had some awesome forward momentum the past few years, despite what has been going on in the world around us. I cannot wait to see how we can blow 2022 out of the water! #TeamNCBIA

As you know, membership in the North Coast Building Industry Association offers numerous benefits and helps keep business owners on top of important, ever-changing issues, trends, and legislation within their marketplace. We ask for your help to recruit new members because there are clear benefits for them, and it will also strengthen our organization and the relationships within it. Some business owners might say their schedule is demanding enough now, and the thought of adding one more activity to their busy calendar is unbearable. So why should they try to cram another commitment into their already-hectic schedules to join an industry association? I think if you ask them - what do they need help with? who do they want to meet? what do they want to learn? - we can help them. The benefits are many, including: opportunities in leadership roles, education, hundreds of discounts, valuable networking opportunities, and even raise your reputation in the community by being a part of a professional association. Membership can also benefit employees of your company; it projects a positive image of your firm to your customers. CONSUMER CONFIDENCE Improved in December

onsumer confidence continued to improve in December as inflation concerns eased after hitting a 13year high last month. Spending intentions for homes, cars, and major appliances all increased. However, consumer spending will continue to face headwinds from higher prices, Omicron surge and reduced fiscal stimulus in 2022. The Consumer Confidence Index, reported by the Conference Board, rose 3.9 points from 111.9 to 115.8 in December, the highest level since July. The Present Situation Index slightly decreased 0.3 points from 144.4 to 144.1, and the Expectation Situation Index increased 6.7 points from 90.2 to 96.9. Consumers’ assessment of current business conditions improved in December. The shares of respondents rating business conditions “good” rose by 2.0 percentage points to 19.9%, while those claiming business conditions “bad” fell by 0.5 percentage points to 26.8%. Meanwhile, consumers’ assessment of the labor market was less favorable. The share of respondents reporting that jobs were “plentiful” decreased by 0.4 percentage points, while those saw jobs as “hard to get” rose by 1.7 percentage points. Consumers were more optimistic about the short-term outlook. The share of respondents expecting business conditions to improve increased from 25.6% to 26.7%, while those expecting business conditions to deteriorate declined from 19.6% to 17.9%. Similarly, expectations of employment over the next six months were more favorable. The share of respondents expecting “more jobs” rose by 2.3 percentage points to 25.1%, while those anticipating “fewer jobs” fell by 4.2 percentage points to 14.8%. The Conference Board also reported the share of respondents planning to buy a home within six months. The share of respondents planning to buy a home climbed to 7.5% in December thanks to low mortgage rates. The share of respondents planning to buy a newly constructed home and for those who planning to buy an existing home rose to 0.9% and 2.7%. However, surging home prices and lack of inventory could further harm affordability and hinder ownership opportunities.

NEW HOME SALES Increase in December BY: ROBERT DIETZ

N

ew single-family home sales increased in December as housing demand was lifted by buyers accelerating some contract signings due to anticipated higher mortgage interest rates in 2022. However, for the year as a whole, sales ended 7.3% lower than a supercharged 2020, as builders slowed some sales to manage ongoing building material and labor issues affecting the housing industry. The U.S. Department of Housing and Urban Development and the U.S. Census Bureau estimated sales of newly built, single-family homes in December reached an 811,000 seasonally adjusted annual pace, an 11.9% gain over revised November rate of 725,000. The December 2021 rate is 14.0% below the December 2020 estimate of 943,000, when demand was unsustainably strong due to historically low mortgage rates and a housing-focused covid economic rebound. Nonetheless, the December rates was the strongest since March. As 2022 begins, sales appear to have settled back the post-Great Recession long-run trend. Median sales price fell back in December to $377,700. In December, there was particular strength for sales in the $300,000 to $400,000 range. For the year as a whole, median sales price for 2021 came in at $392,900, a 16.6% gain over the 2020 median of $336,900. Prices have increased as building material and other development costs have increased. Sales-adjusted inventory levels are at a balanced 6 months’ supply in December. The count of completed, ready-to-occupy new homes is just 39,000 homes nationwide. Total inventory (for all stages of construction) increased to 403,000, a 34.8% gain from December 2020. Inventories levels continue to rise due to several factors. First, construction times have increased, leading to more inventory in the pipeline. Second, inventory has increased with higher demand and lower resale inventory. And finally, the components of inventory continue to adjust. As noted above, there are just 39,000 completed homes in inventory, 9.7% of the total. A year ago, completed homes represented 13.7% of inventory. In contrast, homes not started construction were 22.4% of inventory in December 2020 and increased to 25% in December 2021. Regionally and for 2021 as whole, new home sales declined in all four regions; 5.8% in the Northeast, 5.9% in the South, 7.6% in the Midwest, and 10.5% in the West.

HOUSING STARTS End 2021 with Annual Gains BY ROBERT DIETZ

H

ome building ended 2021 with strong annual gains as demand accelerated in the wake of the pandemic. These annual gains were realized despite supply-chain limitations for materials and ongoing access issues for labor and lots. Single-family starts ended 2021 with a 13.4% increase for a total of 1.123 million starts. Multifamily 5+ unit construction ended the year with a 22.1% gain, for a total of 460,100 starts. A component of the missing middle, 2 to 4 unit construction showed a decline for 2021, a 2.8% drop. For the month of December, overall housing starts increased 1.4% to a seasonally adjusted annual rate of 1.7 million units, according to a report from the U.S. Department of Housing and Urban Development and the U.S. Census Bureau. The December reading of 1.7 million starts is the number of housing units builders would begin if development kept this pace for the next 12 months. Within this overall number, single-family starts decreased 2.3% for the month to a 1.17 million seasonally adjusted annual rate. The multifamily sector, which includes apartment buildings and condos, increased 10.6% to an annualized 536,000 pace in December. Due to supply-chain effects, there are 144,000 singlefamily units authorized but not started construction—up 38.5% from a year ago. However, this total is down from a cycle high in October of 154,000. In January, single-family builder confidence decreased one point to a level 83 on strong buyer demand, according to the NAHB/Wells Fargo Housing Market Index (HMI). After peaking at a level of 90 in November 2020, builders have reported ongoing concerns over elevated lumber and other construction costs, as well as delays in obtaining building materials. The NAHB forecast projects growing labor shortages as the overall unemployment rate trends lower in the quarters ahead. While the single-family sector cooled at the start of 2021, off the unsustainable seasonally adjusted pace of last Winter, recent readings, including the HMI, suggest ongoing stabilization. The December read of housing starts is consistent with this analysis. In fact, single-family permits showed strength for the month, rising 2% and up 13.4% for 2021. Multifamily construction continues to expand strongly on declining vacancies and rising rents. For December, 5+ unit production was up 13.7% to a 524,000 annualized rate. This momentum will continue in 2022. page 20

On a regional and year-to-date basis, combined single-family and multifamily starts are 22.2% higher in the Northeast, 10.9% higher in the Midwest, 15.3% higher in the South and 16.9% higher in the West. As an indicator of the economic impact of housing, there are now 769,000 single-family homes under construction. This is 26% higher than a year ago. There are currently 750,000 apartments under construction, up 15% from a year ago. Total housing units now under construction (single-family and multifamily combined) is 20% higher than a year ago. Overall permits increased 9.1% to a 1.87 million unit annualized rate in December. Single-family permits increased 2% to a 1.12 million unit rate. Multifamily 5+ unit permits increased 19.9% to an annualized 675,000 pace. Looking at regional permit data on a year-to-date basis, permits are 22.4% higher in the Northeast, 14.4% higher in the Midwest, 16.3% higher in the South and 19% higher in the West.

REMODELER SENTIMENT Continues to Improve Yearover-Year

T

he NAHB/Royal Building Products Remodeling Market Index (RMI) for the fourth quarter posted a reading of 83, up four points from the fourth quarter of 2020. The finding is a signal of residential remodelers’ confidence in their markets, for projects of all sizes. “Higher home equity provided resources for home owners to improve their existing homes, supporting high demand for remodeling,” said NAHB Remodelers Chair Steve Cunningham, CAPS, CGP, a remodeler from Williamsburg, Va. “Many remodelers are completely booked well into the future, however, supply chain problems continue to delay projects and make it difficult to work off the backlog.” The NAHB/Royal Building Products RMI survey asks remodelers to rate five components of the remodeling market as “good,” “fair” or “poor.” Each question is measured on a scale from 0 to 100, where an index number above 50 indicates that a higher share view conditions as good than poor. The Current Conditions Index is an average of three components: the current market for large remodeling projects, moderatelysized projects and small projects. The Future Indicators Index is an average of two components: the current rate at which leads and inquiries are coming in and the current backlog of remodeling projects. The overall RMI is calculated by averaging the Current Conditions Index and the Future Indicators Index. Any number over 50 indicates that more remodelers view remodeling market conditions as good than poor.

NAHB Chief Economist Robert Dietz. “Going forward, NAHB expects remodeling activity to continue to grow in 2022, although not as fast as it did in 2021.” The NAHB/Royal Building Products RMI was redesigned in 2020 to ease respondent burden and improve its ability to interpret and track industry trends. As a result, readings cannot be compared quarter to quarter until enough data are collected to seasonally adjust the series. To track quarterly trends, the redesigned RMI survey asks remodelers to compare market conditions to three months earlier, using a “better,” “about the same,” “worse” scale. Seventy-two percent of respondents said that the current market was “about the same” as it was three months earlier. For the full RMI tables, please visit nahb.org/rmi.

The Current Conditions Index averaged 89, a four-point increase from the fourth quarter of 2020. All components also posted increases compared to the fourth quarter of last year: large remodeling projects ($50,000 or more) climbed seven points to 85, moderately-sized remodeling projects (at least $20,000 but less than $50,000) rose two points to 90 and small remodeling projects (under $20,000) increased two points to 91. The Future Indicators Index averaged 77, up five points from the fourth quarter of 2020. Both components increased as well: the current rate at which leads and inquiries are coming in rose three points to 74 and the backlog of remodeling jobs climbed increased seven points to 80. “The year-over-year increase in the RMI indicates ongoing strength in the remodeling market, although it is important to note the survey data were collected in late December and early January and do not fully capture recent increases in interest rates,” said page 24

ELEVATED INFLATION and Higher Interest Rates in 2022 BY: ROBERT DIETZ

F

or the first time since the early 1980s, the U.S. economy is experiencing a period of elevated inflation. Because of supplychain issues attributable to the pandemic and a significant rise in government spending, the CPI measure of consumer inflation recorded a 7% year-over-year gain in December 2021— the highest in nearly 40 years. In contrast, during the 2010s, the CPI averaged an annual growth rate of just 1.8%. The Federal Reserve, having retired the call that these inflationary pressures would be “transitory,” is now clearly signaling tighter monetary policy ahead. The NAHB forecast sees the Fed raising the federal funds rate three times in 2022 and accelerating the pace of the taper of asset-backed security purchases. These moves will continue to cause interest rates to rise over the course of 2022. The 10-year Treasury rate already rose from 1.4% at the start of December to higher than 1.7% during the second week of January, and the average 30-year fixed-rate mortgage is expected to increase to 4% near the end of the year. Combined with ongoing home price appreciation, higher rates will place additional pressure on housing affordability. Clearly, these increases highlight the importance of taming building material costs, including lumber prices that are rising yet again and have expanded beyond $1,100 per thousand board feet. New NAHB analysis finds that a key cause behind this price growth is insufficient production. For example, during the third quarter of 2021, domestic sawmill output was 1.3% lower than the third quarter of 2020. Additional signs of inflation include a tighter labor market and growing wages. According to BLS estimates, job growth in December disappointed: The economy added only 199,000 jobs. Although the unemployment rate fell back to 3.9%, there is some evidence that labor market data are not fully accounting for the growing gig economy. Nonetheless, reports of ongoing labor shortages throughout the economy present challenges for businesses. For the construction sector, there are 345,000 open positions needing to be filled, compared to 261,000 a year ago. Wages in the residential construction sector are up 8% year over year, and without productivity gains, this level of wage growth represents an additional inflation risk in the housing sector.

HOME PRICE GROWTH is Slowing BY: ROBERT DIETZ

T

he second half of 2021 has seen a number of housing trends cool. For example, new single-family home sales slowed at the start of the spring as builders worked on a backlog of projects. In fact, sales are now down 4.4% on a year-to-date basis. This is not because of significant weakness in underlying housing demand, but rather an unsustainable pace of sales relative to achievable production levels given the availability of lumber, labor and lots. Home prices appear to have reached a similar inflection point. While still rising, the rate of home price growth is slowing as prospective buyers are increasingly priced out of the market. The September S&P CoreLogic Case-Shiller data indicate that home prices expanded at a 15.1% annualized rate, which was slower than the 18.6% rate recorded in August. We forecast additional declines for home price growth in the quarters ahead, particularly as interest rates rise. Another trend of 2020 also appears to be normalizing: the suburban shift for home construction. The third quarter NAHB Home Building Geography Index found that the relative growth rates for home building converged somewhat over the last year. In the third quarter of 2021, exurbs were growing at a 30.8% rate, while inner suburbs of core metro areas were growing at a 21.1% rate. Although construction continues to expand at a higher rate in the suburbs, the growth gap has narrowed between these market types. In other macro data, the unemployment rate continues to fall, declining to a 4.2% rate in November. However, payroll employment data disappointed, with a gain of just 210,000 for the month. This was the smallest job gain since January. Nonetheless, home builders and remodelers added 10,300 jobs in November, yet more are needed given ongoing growth for residential construction.

A NEW YEAR and New Challenges As we begin a new year we hope for the best. We normally take a glance back at the past year and adjust for the new. Perhaps, so much has happened in the rear-view mirror we have a lot to think about moving forward. It appears a good amount of business activity may continue. Starts are up in Ohio, that is a positive. The past year required the industry to be nimble; and, I suggest we continue that response. The covid/omicron era will play on the minds of many. Despite the health scare, more homes were started and built than in the past few years. Yes, rates may rise but demand should remain. The biggest impact last year was a new government seated of a party which is different that the powers of the previous year. To no surprise, the new administration wants to make major shifts in public policy. Many of the shifts are substantive and could dramatically impact home construction and land development in many major ways. The changes are just beginning to unfold. Let’s start with zero energy home construction. It just sounds expensive not to mention the potential impact on affordability. Tough environmental regs enacted to provide relief, are being replaced with, arguably, more difficult ones. More to factor in your planning there too. A lot of talk about affordable/workforce housing but tariffs on already expensive lumber were doubled. It certainly appears we are hearing things that are not necessarily in the best interest of a healthy home construction climate.

I think we have to take serious notice of the changes. New powers want to increase the supply of housing in, perhaps, ways different than we would suggest. A new paradigm is in the early stages. We must take notice. Just a glance at the news should give us a glimpse at a new direction from the highest levels of federal government officials who will be in control through the end of the year. We cannot underestimate what actions may be enacted in that time. We must be at the table; we must be informed and ready to respond It is imperative the home building industry must not only be strong but become stronger. This will involve increasing membership and participation. All who make a living here must be a part of the solution. Let’s not forget we are an important industry. Also lets always remember to let or public official know of all the workers in this industry who contribute so much to our state, nation and communities. We are important and don’t let them forget it.

Summary of work-related injuries and illnesses due to OSHA by February 1 Employers with eleven or more employees and whose establishments are not classified as a partially exempt industry must record work-related injuries and illnesses using OSHA Forms 300, 300A and 301. Employers who are required to keep Form 300, the Injury and Illness log, must post Form 300A, the Summary of Work-Related Injuries and Illnesses, in a workplace every year from February 1 to April 30. Current and former employees, or their representatives, have the right to access injury and illness records. Employers must give the requester a copy of the relevant record(s) by the end of the next business day. OSHA's definition of work-related injuries, illnesses and fatalities are those in which an event or exposure in the work environment either caused or contributed to the condition. In addition, if an event or exposure in the work environment significantly aggravated a pre-existing injury or illness, this is also considered work-related. If a work-related injury or illness results in medical treatment beyond first aid, you must record it on the OSHA 300 log. Required information includes: •

Completion of both the 300 and 300A

•

Verify that you've classified each case only once on both forms.

•

A case that has one day away and several days restricted would be classified as days away

o

The other recordable case is a case that does not have days away or job transfer or

Ohio Safety Congress & Expo The Ohio Bureau of Workers’ Compensation (BWC) will host their Ohio Safety Congress & Expo March 9-10, 2022, as an online-only event with dozens of learning sessions and a digital expo, allowing participants to chat virtually with vendors about new and existing products and services. By attending the safety congress, you will learn to: •

Keep Ohio’s work force healthy and productive

BWC recently announced its educational offerings for the 2022 Ohio Safety Congress & Expo (OSC22). With the online format, attendees can attend sessions from anywhere. OSC22 online will deliver more than 30 live sessions on March 9 and 10. A dozen on-demand sessions are available to view anytime March 9 through March 31, offering more choice and more convenience than ever before. If you’re an environmental specialist, consider also attending the Ohio EPA’s education day on March 8. OSC22 is the largest free work-safe event in the U.S. Registration is free and available now. Destination Excellence This program encourages an employer’s focus on safety and return-to-work for injured workers, and fosters efficient management of accounts and cost control efforts. The Destination Excellence program includes Administrative rebates, Safety Council rebates, an Industry Specific Safety bonus, a Drug Free Safety incentive program and a Transitional Work Grant program and bonus. Savings options Go Green A rebate (1% of premium, which includes any assessments, up to a maximum of $2,000 per policy period) is granted to employers who elect to utilize the BWC’s website at www.bwc.ohio.gov to conduct business electronically. BWC will apply the rebate automatically; no application is required. Online transactions consist of reporting payroll; payment of premium no later than the due date; and any additional transactions that BWC expands to online account management and communications. Lapse Free A rebate (1% of premium, which includes any assessments, up to a maximum of $2,000 per policy period) is granted to employers with an active policy for at least 5 years and no lapses during that time. “One Time Forgiveness” may be utilized to remove a lapse to become eligible. Predecessor policy lapses do not transfer to successor policy but successor policy must be active for at least 5 years to be eligible. Employers reporting zero payroll in current payroll period, state agencies and self-insured employers are not eligible for this discount. Safety & return-to-work options Industry Specific Safety Program A 3% bonus of the employer’s premium is given at the close of the program year to encourage an employer’s focus on safety in the workplace. Employer must complete an online safety management self assessment and completion of one, two or three loss prevention activities depending on payroll. Loss prevention activities include industry-specific training classes, attendance at BWC’s Ohio Safety Congress & Expo and/or onsite field consulting with a BWC safety and health expert. Drug Free Safety Program A premium bonus is given for the implementation of a program promoting occupational safety and health for workers which addresses the use and misuse of alcohol and drugs in the workplace. An employer may choose between basic (4% bonus) or advanced (7% bonus) level programs to help their organization prevent on-the-job injuries and illness by integrating drug-free efforts. Safety Council This is an incentive program that enables employers to receive a rebate of 2% of their annual workers’ compensation premium through program participation and an additional 2% performance bonus based on the reduction of the frequency or severity of claims (reduction of 10% or more compared to the previous year’s frequency or severity or maintaining both frequency and severity at zero). Regular attendance at meetings (requirement of 10 meetings or events between July 1 - June 30 annually)

Resolving supply chain bottlenecks, higher prices for lumber and other building materials, and rising tariffs on Canadian lumber is NAHB’s top priority. We have taken our concerns to the highest levels of government – including the White House and Congress, but the fight is far from over. NAHB is sharing its concerns with government officials about an emergency temporary standard from OSHA that would force companies with more than 100 employees to mandate COVID-19 vaccinations for their workers or conduct onerous weekly testing of workers who remain unvaccinated. Democrats are hoping to pass President Biden’s Build Back Better bill this month following congressional passage of the $1.2 billion infrastructure package in November. NAHB supports the new infrastructure law, which will make much-needed improvements to the nation’s roads, bridges, broadband and public transportation network. NAHB and Michigan home builders scored an important legal win on Sept. 28 which means that all Paycheck Protection Program loans for members can be forgiven. The Supreme Court struck down the CDC eviction moratorium in late August. What many of you don’t know is that nearly all NAHB members had been exempt from the eviction ban since March 2021. And we continue efforts to ensure that our members have the tools to access any emergency rental assistance funding and assistance that is available. The Environmental Protection Agency has declared that the pre2015 “waters of the U.S.” (WOTUS) regulations are now in effect. The regulated community faces significant regulatory uncertainty in light of this decision and NAHB continues to explore all options to limit this federal overreach.

NAHB Actions to Address the Supply Chain Crisis • • •

Resolving lumber and other building material supply chain bottlenecks that are raising construction costs and harming housing affordability is the top priority for NAHB. And with lumber prices rising rapidly over the past four months following a period of moderating price reductons in the late spring and summer, NAHB has taken the following actions: At the behest of NAHB, 84 members of Congress sent a joint letter to Commerce Secretary Gina Raimondo in late December expressing urgent concern regarding the Commerce Department’s recent decision to double tariffs on softwood lumber products from Canada. The letter also calls on the United States to resume talks with Canada to negotiate a new softwood lumber trade agreement. In early December, NAHB leaders met with top Canadian officials at the Canadian embassy in Washington to discuss key softwood lumber issues, including the urgent need to restart negotiations on a new softwood lumber agreement that would end tariffs. NAHB sent a letter to President Biden on Dec. 3 calling on the White House to combat high lumber prices by engaging with Canada on a new softwood lumber agreement and increasing domestic lumber production. Through BuilderLink, NAHB engaged its grassroots over the holiday season by having our members call or write their members of Congress and urge their lawmakers to tell President Biden to negotiate an updated softwood lumber agreement with Canada and increase U.S. lumber production by harvesting more timber from U.S. forest lands. With NAHB stressing that historically high lumber prices and building material prices continue to serve as headwinds to the U.S. housing sector, Sens. Jeanne Shaheen (D-N.H.) and Jerry Moran (R-Kan.) sent a letter to Commerce Secretary Gina Raimondo in late November to oppose the Commerce action to double tariffs on Canadian lumber imports into the United States. On Oct. 20, NAHB Chairman Chuck Fowke testified before Congress on building material supply chain disruptions and called on the Biden administration and lawmakers to take immediate action by: o Temporarily removing tariffs on Canadian lumber and other imported building materials, including steel and aluminum from China; o Alleviating bottlenecks at seaports that are preventing goods and materials from getting to market; and o Seeking solutions to persistent delays in truck and rail transportation to ease mass shortages that are putting upward pressure on material and home prices. NAHB sent a similar strong message in a letter to President Biden on Oct. 6 calling on the White House to take action on this critical issue. We told the president that he can “make substantial progress on housing affordability by working to reduce the cost of lumber and other building materials.” The price hikes are not limited to just lumber: According to the Bureau of Labor Statistics Producer Price Index, the average price of goods used as inputs to residential construction has risen three times faster than the rate of core inflation throughout 2021. From steel mill products and plastic piping to copper pipe and wood windows and doors, prices are up dramatically over the past year and are exacerbating the growing housing affordability crisis. Small home building firms are particularly threatened by the current situation.

Vaccine Mandate

The unprecedented price volatility in the lumber market dates back to April 2020 when the COVID-19 pandemic took hold and sawmills curtailed production in anticipation of reduced demand. When it became clear in the ensuing months that housing weathered the storm much better than predicted and demand remained strong, lumber mills did not ramp up production accordingly. The slow reaction by sawmills, combined with massive uptick in demand from do-it-yourselfers and big box retailers during the pandemic resulted in lumber prices peaking at a record-shattering $1,500 per thousand board feet in May 2021, before beginning a gradual decline through late August. This most recent lumber price upsurge is due to a number of factors, including: o Ongoing supply chain disruptions o A doubling of tariffs on Canadian lumber imports into the U.S. market that increased price volatility o An unusually strong summer wildfire season in the western United States and British Columbia

Moving Forward

Latest Lumber Price Wave Adds $18,600 to the Price of a Home Over the past four months, lumber prices have nearly tripled, causing real hardship for home builders and home buyers alike

As a result of this latest surge, the price of an average new single-family home has increased by more than $18,600 since late August, according to NAHB standard estimates of lumber used to build the average home. This lumber price hike has also added nearly $7,300 to the market value of the average new multifamily home, which translates into households paying $67 a month more to rent a new apartment.

On September 9, President Joe Biden announced a sweeping vaccine and testing mandate. Central to the administration’s plan is a requirement that every employer with more than 100 employees require the vaccine for its workforce. The OSHA rule DOES allow for weekly testing in lieu of vaccination. The mandate will be instituted and enforced through a new emergency temporary standard (ETS) from OSHA. The U.S. Supreme Court will hear oral arguments on the mandate beginning on Jan. 7 after a lower court ruled that the mandate may move forward. OSHA will not issue citations for any requirements of the ETS before Jan. 10. The agency will also not issue citations for noncompliance with the standard’s testing requirements before Feb. 9, so long as an employer is exercising good faith efforts to come into compliance with the standard. The vast majority of home builders in the United States have fewer than 100 employees, so the mandate should not directly affect most NAHB members. NAHB has been in contact with rulemaking officials and we have aired our concerns about the proposal.

NAHB noted that the residential construction industry is at a very low risk for COVID-19 transmission. Most work is performed outdoors, and the nature of indoor tasks allow workers to remain at least six feet apart. NAHB also noted the voluntary industrywide campaigns in the construction industry to encourage vaccinations, such as Vaccine Awareness Week in Construction. NAHB and its partners in the Construction Industry Safety Coalition (CISC) questioned the legal authority of OSHA to issue an ETS that requires vaccine mandates for workers. NAHB and CISC asked that the construction industry be exempt from the final ETS and that OSHA open the rulemaking to formal public comment. At NAHB, we’re telling our members that they should remain flexible and ready to act when the ETS is issued and be prepared for change even after the rule is in place.

Democrats Scramble to Pass Build Back Better Bill • •

Democrats hope to pass President Biden’s Build Back Better bill in the coming weeks, but the legislative timeline and outlook still remains unclear. Meanwhile, NAHB supports the $1.2 trillion bipartisan infrastructure bill signed into law by Biden in mid-November. This package will make much-need improvements to the nation’s roads, bridges, broadband and public transportation network. In contrast, the $1.75 trillion Build Back Better legislative framework focuses more on social spending. It includes: o Provisions to fight climate change, o Provides universal pre-school for three- and fouryear-olds, o Extends the child tax credit, o Expands Medicare, and o Has other housing, health care and immigration provisions. The infrastructure bill, titled the Infrastructure Investment and Jobs Act, will help connect more Americans from their homes to their places of work and within their communities. It contains several provisions that will boost housing affordability: o By including Sen. Manchin’s Energy Infrastructure Act, this legislation advances efforts to increase energy efficiency and reduce greenhouse gas emissions without stringent energy code mandates that will increase housing prices. o The measure restores an exemption for water and sewer contributions in aid of construction that will save some developers as much as 40% on water and sewer costs. o The bill also streamlines the federal permitting process, which will minimize uncertainty in the housing approval process and make the homes that are built more affordable. Meanwhile, just before Thanksgiving, the House narrowly approved the Build Back Better Act. The measure contains positive housing provisions but also includes tax and code provisions detrimental to the residential construction sector that caused NAHB to oppose the overall package. The Senate is expected to make modifications to the measure, and NAHB will advocate for changes beneficial to the housing industry.

NAHB Legal Win Means All PPP Loans for Members Can Be Forgiven • • •

NAHB and Michigan builders last fall scored an important legal victory that will enable all NAHB members who received Paycheck Protection Program (PPP) loans to have their loans forgiven. The court’s opinion also provides several important procedural wins that will benefit NAHB in a wide range of cases. At the height of the pandemic-induced economic downturn, Treasury and the Small Business Administration (SBA) imposed

rules on the PPP that would exclude certain home building firms from receiving PPP loans or having them forgiven. Those left out in the cold included spec home builders, multifamily property owners and land developers. NAHB, along with the HBA of Michigan and HBA of Southeastern Michigan, filed a lawsuit so that all NAHB members could access PPP funds to help keep their business afloat. On Sept. 28, the U.S. District Court for the Eastern District of Michigan ruled in our favor, stating that the SBA wrongly applied eligibility criteria to the PPP. The victory ensures that NAHB members who received PPP loans will have their loans forgiven. The court’s opinion will have a direct and tangible benefit for builders, developers, and property owners who are awaiting loan forgiveness. The court also ruled against the government’s claim that NAHB lacks “standing” – which means that NAHB has a right to have our case heard in federal court. This decision effectively establishes favorable case law on procedural issues that the government and others often use to try and keep NAHB and its members out of court.

NAHB Members Exempt from CDC Eviction Moratorium Since March 2021 •

NAHB also registered another important legal win for the Federation last year when a federal court in the Northern District of Ohio ruled in March that Congress did not provide the Centers for Disease Control and Prevention (CDC) with the authority to issue an eviction moratorium. NAHB had filed the lawsuit on behalf of our members. The legal victory meant that the CDC eviction moratorium has not applied to all NAHB members since March 2021 – but all other landlords nationwide had to comply with the CDC’s eviction ban until the Supreme Court overturned it on Aug. 26. These legal victories clearly illustrate the clout of NAHB and the value of membership.

Evictions Should be a Last Resort • •

•

•

•

•

• •

And while NAHB members are not bound by the eviction moratorium, it doesn’t mean they should or will be engaging in mass evictions. NAHB’s multifamily members did not engage in mass eviction proceedings in March and today they understand that the eviction process is clearly the last option. Landlords are working diligently with tenants to help them apply for rental assistance and to offer payment plans. NAHB has actively advocated for emergency rental assistance to help renters and landlords impacted by the COVID-19 pandemic and to protect the viability and stability of the rental housing industry. Federal funds are available to assist renters. NAHB continues to urge members to seek access to the Emergency Rental Assistance Program (ERAP) through their local government and state housing finance agencies. While a large portion of the $46 billion that Congress appropriated for emergency rental aid has not been disbursed, Treasury has announced new steps to help state and local governments to expedite aid to renters and landlords in need. However, the Treasury is now required by law to consider reallocating unused funds from ERAP that was passed by Congress in December 2020 to help renters and landlords who were affected by the COVID-19 pandemic. NAHB continues to advocate for effective solutions to expedite ERAP assistance to renters and housing providers. We strongly urge the Treasury Department and ERAP grantees to

ensure this policy does not further delay ERAP applications in the pipeline and create new confusion about where to apply for ERAP assistance.

Tools to Work with Tenants •

Meanwhile, NAHB has provided our multifamily members a sample script that landlords can use to contact tenants and walk them through the steps to apply for assistance and/or request permission to apply on their behalf. The script, and other multifamily COVID resources, can be found on the Multifamily and Affordable Housing Resources for COVID-19 page on nahb.org. The bottom line is that property owners understand that evictions should only be made as a matter of last recourse and will continue to do everything in their power to help their tenants to access rental assistance and/or to enter into a reasonable payment agreement.

EPA Reverts Back to Pre-2015 WOTUS Regulations •

• •

•

The U.S. Environmental Protection Agency and the U.S. Army Corps of Engineers announced that as of Sept. 3, the agencies have “halted implementation of the Navigable Waters Protection Rule (NWPR) and are interpreting ‘waters of the United States’ (WOTUS) consistent with the pre-2015 regulatory regime until further notice.” The action came after the U.S. District Court for the District of Arizona ruled in late August to remand and vacate the NWPR. This unilateral decision by the agencies -- without public input -- means that landowners must immediately follow the federal definition of WOTUS that existed prior to both the Trump and Obama administration’s WOTUS rules. While the agencies reiterated their commitment to change the regulatory definition of WOTUS under the Clean Water Act (CWA) announced in June, that effort is expected to take more than a

year to complete. NAHB Senior Officers, members and HBA staff testified at a series of hearings throughout August to voice their support for retaining the NWPR and thereby avoid having the agencies revert back to asserting federal control over non-navigable and isolated wetlands, ephemeral streams, and roadside drainage ditches. NAHB Senior Officers will again provide the builder and business community perspective on the proposed WOTUS rule in a series of virtual hearings by EPA and the Corps during the week of Jan. 10. The regulated community faces significant regulatory uncertainty in light of the agencies’ decision, as sections of the pre-2015 rules have been found unlawful by the courts, and the guidance documents provided by the agencies have been superseded by more current guidance. NAHB is exploring all options to limit this federal overreach, as well as the challenges this reversion to the old rules will create. We will continue to keep members updated on further developments and provide additional guidance once it becomes available. Meanwhile, builders who have received, or are in the process of applying for federal wetlands permits or jurisdictional determinations, are encouraged to log onto nahb.org/wotus where they can access NAHB’s guidance to frequently asked questions to help navigate the current landscape.


LEGISLATIVE REVIEW

2021 OHBA YEAR IN REVIEW LT. GOVERNOR JON HUSTED ATTENDED AND SPOKE AT THE OHBA SUMMER MEETING Lt. Governor Jon Husted traveled to Wooster, Ohio to speak to OHBA members at its summer board meeting. OHBA members gave Lt. Governor Husted valuable insight into the current challenges of the industry.

OHBA KEPT UP TO DATE ON THE DEVELOPING REGULATIONS RESULTING FROM COVID-19 From vaccine mandates to liability insurance claims, OHBA kept up with legislative and legal action resulting from COVID-19.

SUPPORTED PROPERTY TAX CHALLENGE REVISIONS IN HB 126 OHBA joined business groups, including the Ohio Chamber and Ohio Association of Realtors, in support of HB 126 to help curb abuses in both commercial and residential property tax assessment challenges by local school boards.

OHBA REPRESENTED INDUSTRY IN ONGOING ENVIRONMENTAL REVIEW APPEALS COMMISSION NEGOTIATIONS As the new navigable waters rule removed “ephemeral streams” from its definition of Waters of the United States, the OEPA issued a draft general permit to regulate as a water of the state. OHBA has been negotiating a settlement on behalf of the industry in front of ERAC since the notice of appeal was filed in 2020.

MONITORED ALL ACTION RELATED TO REGULATION OF WATERS OF THE US (WOTUS) AND STATE EPHEMERAL STREAM LEGISLATION In addition to both testimony in house and senate committees, OHBA met with the House Committee Chairman over the summer to help explain the impact of HB 175. Even with the most recent Arizona Court ruling reinstating the pre-2015 WOTUS rules and definitions, bringing ‘ephemeral streams’ back under the jurisdiction of the Army Corp of Engineers, HB 175 remained an important vehicle in a very fluid, and uncertain future of how these and other water features will be defined and regulated. OHBA has monitored any and all action at the federal agency, state agency, and judicial levels.

GOVERNOR ACCEPTS OHBA RECOMMENDATION FOR HOUSING STUDY COMMITTEE APPOINTMENT After Senate budget language proposing changes statute dealing with the valuation of subsidized residential rental property was removed, it was replaced by the formation of a Study Committee. The original amendment would have required county auditors to value Low Income Housing Tax Credit (LIHTC) properties and other properties receiving federal subsidies to be valued as market rate properties without regard to governmental use restrictions. OHBA was one of several groups to have an appointment on the Study Committee.

OHBA HELD MEETINGS WITH TOWNSHIPS ON ZONING REFERENDUM As development after development was subjected, and likely, defeated by zoning referenda, OHBA met with the Township Association and began contemplating potential changes to the process. page 46

OHBA OPPOSED LOCAL BANS ON NATURAL GAS OHBA testified in support of HB 201 to prevent local governments from limiting use of natural gas. As one of several groups coming together to oppose the local bans on the use of natural gas, OHBA helped get HB 201 signed into law, providing valuable insight into the potential impacts to existing and new housing stock. .

OHBA MEMBERS CONTINUED IN LEADERSHIP ROLES FOR OHIO COMMERCIAL AND RESIDENTIAL CODE AUTHORITIES While over the years OHBA members served active and valuable roles on both the Residential Construction Advisory Committee (RCAC) and the Board of Building Standards (BBS), in 2021, OHBA members continued to serve as the Chair of the RCAC, as well as, Vice-Chair of the BBS. OHBA continues to help to maintain reasonable codes and ensure proper review.

NEW MEMBER APPOINTED TO THE RCAC With Bill Kaufholz moving to fill a vacancy in the architect spot on the Residential Construction Advisory Committee (RCAC), Andre Frazier, of Frazier Homes, was named the newest homebuilder member of the RCAC in 2021..

MEETINGS WITH SPEAKER OF THE HOUSE AND PRESIDENT OF THE SENATE ON IMPORTANCE OF HOUSING AND LAND DEVELOPMENT Throughout 2021, OHBA reached out and spoke with both Leaders on issues impacting the homebuilding and residential development industry. As many began to finally realize there is a shortage of housing in Ohio, OHBA was contacted by various office holders on what could be done about housing.

OHBA REITERATED IMPACT OF REGULATION AND LAND DEVELOPMENT DURING ROUNDTABLE DISCUSSION WITH LEGISLATORS AND MAYORS LOOKING FOR WORKFORCE HOUSING In response to the lack of adequate housing supply, a State Representative from Northwest Ohio put together a roundtable with a local mayor, the realtors, homebuilders, along with a few others to discuss the need for housing in the area and around the state.

OHBA ASKED TO DRAFT LANGUAGE FOR NEW HOME CONSTRUCTION EXEMPTION TO RESIDENTIAL ROOFING REGISTRATION BILL As the insurance companies put together legislation to register residential roofers, OHBA was the resource for the exemption for new home construction. Both the proponents and sponsors of the bill reached out to OHBA for crucial insight on the impact of registration.

OHBA FILED AMICUS IN ZONING APPEALS CASE IN SUPPORT OF JURISDICTION OHBA was again asked to file an amicus brief submitting a memorandum in support of jurisdiction to the Supreme Court of Ohio. The proposition of law being, where the text in a zoning code contains a table of requirements including a caption above each column that limits or defines the scope of the requirements in such column, those limitations are substantive and must be followed in the application of the requirements contained in the column below the caption.

IMPORTANCE OF ALL TYPES OF RESIDENTIAL HOUSING DEFENDED TO GOVERNOR AND LEGISLATURE OHBA worked closely in 2019 to help secure an amendment providing some property tax relief to encourage lot development in the budget before the Governor ultimately vetoed the language. Following the veto, OHBA has continuously cleared up misunderstandings, answered questions and defended the industry and the economic development it provides. In pushing for some relief in property tax assessments on undeveloped residential lots, OHBA firmly expressed the need for equity when considering such types of relief and provided members of the legislature and the Governor with facts and data on the potential impact of new development, as well as, the current state of the housing industry in Ohio. As more officials take note of the housing crisis, OHBA is there to educate them on the practical issues and potential remedies to consider.

OHBA ENGAGED IN NUMEROUS PIECES OF LICENSING LEGISLATION UNDER CONSIDERATION The legislature again gave OHBA plenty of licensing legislation to monitor in 2021. Ranging from commercial roofing to elevator contractors, there were quite a few bills under review dealing with the topic of licensing. OHBA closely watched and engaged in discussions on each and every one. OHBA was able to offer amendments to be included in several of the proposed pieces of legislation.

REVIEW AND ADOPTION OF MINIMUM QUANTIFIABLE STANDARDS UPDATES As the adopting body of the workmanlike standards for the industry, OHBA reviewed and adopted the Fourth Edition of the Minimum Quantifiable Standards. (VIEW UPDATED STANDARDS ON NCBIA.COM)

CONTINUING AGENCY AND LEGISLATIVE FOLLOW UP While agency issues are always ongoing, many of the legislative issues from 2021 will likely continue into the new year. Throughout the year, OHBA received questions from around the state on enforcement of multiple regulations, and we provided valuable insight and contacts to help mitigate issues brought to OHBA’s attention.

MONITORED LEGISLATION Throughout the year, OHBA tracked and monitored numerous other items receiving attention by the legislature. Some of these included SB 61 Planned Communities, SB 142 Occupational Regulation, HB 68 Contractor Payments, HB 107 Elevator Law, HB 126 Property Values, HB 304 Smoke Alarms

JANUARY 14, 2022 REPORT #1 NUMEROUS GROUPS JOIN OHBA IN SUPPORT OF HB 175 As you may know, the Ohio General Assembly will begin the second year of the current assembly. 2022 is an election year where all 99 members and 17 of the 33 senators must run for election to the next assembly which begins (hopefully) January 1, 2023. The process to be elected begins by taking out petitions with the corresponding board of elections with the intent to run, and have your name placed on the ballot. This is a process which has taken place for decades. But wait. In its January 12th opinion, the Ohio Supreme Court just nullified the proposed districts for which Ohioans may declare to be a candidate. So, a few weeks before the filing deadline there are essentially no districts to be a candidate in. The court, in its ruling, gave the apportionment committee 10 days within which to submit a new map. Never mind, the apportionment committee took months to approve the maps tossed by the court. So, where does that leave us? Not to be too concerned, but no one really knows. The constitution was rewritten on the subject a few years ago, so there is little, if any, law on the subject. It appears the old ‘seat of the pants’ standard applies. Joking aside, the relations between the parties and the court are not amicable at this point. If the apportionment committee makes changes to the map and sends it back, the Court could send it back again, as not to their liking. We believe the best and brightest are expending their brain cells as to how their party can benefit the most and gain approval by the court. Exactly how the commission will accomplish that aim in such a tight timeframe, or even who is on the commission, remain questions with which attorneys are now wrestling. Both the House and Senate, previously scheduled to return January 19th, have canceled their sessions for next week. Stay tuned.

JANUARY 14, 2022 REPORT #2 SUPREME COURT ALSO SENDS BACK CONGRESSIONAL MAP Minutes after legislative review # 1 was sent out, breaking news came through with the Ohio Supreme Court going the same direction on the Congressional Map. The Court ordered lawmakers to resume the congressional redistricting process after ruling 4-3 the Republican-led legislature's four-year map failed to meet constitutional requirements. The General Assembly now has 30 days to rectify the legal defects in the map identified by the court. Should lawmakers fail, the Ohio Redistricting Commission would be reconstituted and granted its own 30-day window to craft a final map. Stay Tuned.
