LETTER FROM THE PRESIDENT

WHAT A YEAR it has Been! 2021 is coming to a close and I am sure many of us are giving a sigh of relief. While we are still in the throes of the pandemic, this year brought new and different challenges than we have faced in previous years. From lumber pricing to labor shortages and everything in between, there was not a single company in this industry that these issues did not impact. But we made it through and 2022 is looking brighter and better than ever!

There are quite a few people that I need to thank for making 2021 such a successful year for the North Coast Building Industry Association. First off, the NCBIA staff who make our events run smoothly and keep us up to date on what is going on in the industry around the country; Judie, Maria, Labreeska & Ashlyn thank you for all you do to keep the association afloat. Secondly I need to thank my board of directors; thank you for your dedication to the association as well as volunteering your time, energy and most importantly your knowledge to help guide us through this year. To my executive committee which is made up of Tim King, John Toth, Jeremy Vorndran, Mike Meszes and Melanie Stock, words cannot even begin to express my gratitude to you guys. From the group text messages to the off-site planning sessions, I firmly believe that the NCBIA would not be where it is right now without this stellar group of people. To my committee chairs, you all kicked ass this year! Every single event that we had was well attended, flawlessly executed and really showed our members what it meant to be a part of the NCBIA! I am looking forward to seeing what you all can do in 2022! Lastly I need to thanks the men that I consult as my presidential advisors; Jeff Hensley, Jeremy Vorndran and Chris Majzun Jr. Taking on this role as president was super exciting but also very scary for me. I knew I had HUGE shoes to fill following in the footsteps of these three over the last 5 years and that it was going to be a big task to accomplish. Every step of the way I knew that these 3 had my back and were always there to answer questions and offer guidance and support even if it wasn’t quite what I wanted to hear. I greatly appreciate everything you did for me and I look forward to your support and tough love as we move in to 2022! I look forward to taking on the role as president again for 2022 and I am even more excited that our executive committee as well as our committee chairs will also be staying the same. Safe 2022! Winter can be a tricky time for everyone, but especially for personnel on home building jobsites. Of course, the ongoing pandemic adds another dimension to jobsite safety plans during the cold weather months. Home builders should continue to require their workers and trades partners to follow current guidelines for the Coronavirus. Although there is light at the end of the tunnel for the pandemic, we should continue to practice diligence. But cold weather also brings non-virus dangers to jobsites that require special attention. The use of space heaters inside structures presents an elevated fire risk, so be careful while using them. OSHA also has guidance for workers on jobsites during the winter that includes: Be aware of weather forecasts. Keeping track of the forecast for the day is the first step for keeping your workers warm. A worst-case scenario is that an employer sends workers out to a jobsite the day a blizzard blows into town. Employers should watch the local weather and check the National Weather Service. If possible, schedule work during the warmest part of the day. Limit exposure to the elements. When the wind and snow are blowing and temperatures are dangerously low, schedule outside work in shorter time blocks. Consider breaking up larger projects into smaller tasks or providing short, frequent breaks in a warm environment such as a heated trailer or a tent with portable heaters.

Require proper gear. Working outside during the winter requires the right gear for the job, including boots, heavy coats, gloves, hats and other essentials based on the weather. Employers should require all workers to wear clothing that will keep them warm and dry to prevent hypothermia and frostbite. Review work sites every day. Any kind of debris can pose a risk in work environments; however, it is particularly true for winter construction. Snow and ice on overhangs and rooftops should be regularly cleared to prevent falling to the ground level. Snow can also hide dangerous materials that can fall to a lower level and injure a worker. Remove snow and ice. Before work is started on a site, employers should ensure snow is removed, salt or sand is put down, and large patches of ice are chipped away. And, no matter how time sensitive the construction job is, workers should avoid working on scaffolding in ice and snow. Inspect and prepare vehicles. Before heading into the winter, all work vehicles should be inspected to determine if they are fully functioning. Employers should also add winter emergency kits to work vehicles that include an ice scraper, snow brush, shovel, tow chain, flashlight with extra batteries, emergency flares, a blanket, snacks, and water. Educate workers on the signs of frostbite and hypothermia. Even when employers do everything they can to protect workers, issues can still arise. Supervisors and workers need to know the symptoms of hypothermia and frostbite so that if anyone shows these signs, they can receive immediate medical attention.

NEW HOME SALES Jump in November on High Consumer Demand

ew single-family home sales rose in November as housing demand was supported by low interest rates and strong consumer demand, despite the ongoing building materials challenges impacting the housing industry. The U.S. Department of Housing and Urban Development and the U.S. Census Bureau estimated sales of newly built, single-family homes in November at a 744,000 seasonally adjusted annual pace, a 12.4% gain over downwardly revised October rate of 662,000 and is 14.0% below the November 2020 estimate of 865,000. The gains for new home sales are consistent with the NAHB/Wells Fargo HMI, which edged up to 84 in December, demonstrating that housing is a leading sector for the economy. Sales-adjusted inventory levels are at a balanced 6.5 months’ supply in November. The count of completed, ready-to-occupy new homes is just 40,000 homes nationwide. Median sales price continues to increase in November at $416,900. This is up 18.8% compared to the November 2020 median sales price of $350,800. Moreover, sales are increasingly coming from homes that have not started construction, with that count up 75.4% year-over-year, not seasonally adjusted (NSA). These measures point to continued gains for single-family construction ahead. Regionally on a year-to-date basis, new home sales declined in all four regions; 1.3% in the Northeast, 4.5% in the South, 5.3% in the Midwest, and 12.5% in the West.

CONSTRUCTION Job Openings Surge BY ROBERT DIETZ

T

he labor market continues to tighten, especially for the construction industry. The count of open construction jobs increased to 410,000 unfilled positions in October, the highest measure in the history of the data series (going back to late 2000). The housing market remains underbuilt and requires additional labor, lots and lumber and building materials to add inventory. Hiring in the construction sector remained solid in October, rising to a 5.0% rate. The post-virus peak rate of hiring occurred in May 2020 (10.3%) as a rebound took hold in home building and remodeling. Hiring slowed in early 2021, with the exception of a weather-related rebound in March 2021. While hiring has been impeded due to a lack of workers, jobs gains have increased during the second half of this year. Construction sector layoffs remained near a 4-year low, at a 1.8% rate in October. In April 2020, the layoff rate was 10.9%. Since that time however, the sector layoff rate has been below 3%, with the exception of February 2021 due to weather effects. The rate has trended lower in 2021 due to the skilled labor shortage. The job openings rate in construction surged to 5.4% in October, with 410,000 open positions in the sector. This is significantly higher than the 253,000 count recorded a year ago. Looking forward, the construction job openings rate is likely to see increased upward pressure as both the residential and nonresidential construction sectors trend higher. HIGHER MORTGAGE RATES Expected Following Fed Policy Pivot

T

he Federal Reserve on Dec. 15 signaled that it will be shifting from an accommodative monetary policy stance that has supported the economic rebound from the 2020 recession toward a tighter policy as a direct result of ongoing, elevated inflation data. For the housing community, this policy pivot means that mortgage interest rates are likely to rise in 2022. This will reduce housing affordability and again emphasizes the need for policymakers to enact solutions to fix the nation’s supply chains that are impeding more robust housing construction. At the conclusion of its December policy meeting, the Fed announced changes to its outlook and projections in response to increased inflation data and inflation expectations that will yield higher interest rates in 2022 because of tighter monetary policy. The announcement makes several changes to both the Fed’s economic outlook and its implied monetary policy path: > > >

Acceleration of tapering of purchases of mortgage-backed securities and Treasuries • The central bank will double the pace of tapering with an anticipated conclusion of bond purchases in March 2022. Retirement of “transitory” inflation expectations • The Fed’s outlook notes that supply-demand imbalances are contributing to “elevated levels of inflation.” • The Fed’s economic projections increased its estimate for 2021 inflation (under the core PCE measure) from 3.7% to 4.4%. • As an indication that inflation will persist well into 2022, the projection for inflation next year increased from 2.3% to 2.7%. Higher interest rates sooner • The Fed did not announce a change in the federal funds target rate. • However, its announcement/outlook suggests three 25 basis point rate hikes in 2022 and three more in 2023.

This implied tightening is consistent with NAHB’s existing forecast of a 2% 10-year Treasury rate near the end of 2022. This higher rate also implies the 30-year mortgage rate rising somewhat higher than 3.6% by the end of next year. HOME BUILDER SENTIMENT Strong at Year's End

D

espite inflation concerns and ongoing production bottlenecks, home builder confidence edged higher for the fourth consecutive month on strong consumer demand and limited existing inventory. Builder sentiment in the market for newly built single-family homes moved one point higher to 84 in December, according to the NAHB/Wells Fargo Housing Market Index (HMI) released today. This ties the highest reading of the year that was posted in February. “While demand remains strong, finding workers, predicting pricing and dealing with material delays remains a challenge,” said NAHB Chairman Chuck Fowke. “Policymakers need to work on supply chain improvements and controlling costly inflation. Addressing lumber tariffs would be a good place to start.” “The most pressing issue for the housing sector remains lack of inventory,” said NAHB Chief Economist Robert Dietz. “Building has increased but the industry faces constraints, namely cost/availability of materials, labor and lots. And while 2021 single-family starts are expected to end the year 24% higher than the pre-Covid 2019 level, we expect higher interest rates in 2022 will put a damper on housing affordability.” Derived from a monthly survey that NAHB has been conducting for 35 years, the NAHB/Wells Fargo HMI gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. The HMI index gauging current sales conditions rose one point to 90 and the gauge charting traffic of prospective buyers also posted a onepoint gain to 70. The component measuring sales expectations in the next six months held steady for the third consecutive month at 84. Looking at the three-month moving averages for regional HMI scores, the Northeast rose four points to 74, the Midwest posted a two-point gain to 74 and the South and West each posted a three-point rise to 87, respectively. F

inancial markets and policymakers are indicating rising risks for the overall economy. Higher inflation is the top near-term concern, after the Consumer Price Index reported a 6.2% year-over-year gain in October — the largest increase in more than 30 years. While most economists, and the NAHB forecast, expect inflation to ease, the key question is how quickly. Our analysis, including effects from higher home construction costs and rising rents and owner costs, indicate that inflation will persist well into 2022 as the economy attempts to deal with increased deficits and ongoing supply-chain issues. How to tame inflation will be the top challenge for Federal Reserve Chair Powell, whom President Biden has selected for a second term as the top monetary policymaker. This responsibility is not just on the Fed however, as increased fiscal discipline by Congress and the administration is required to help reduce inflation risk. Additionally, the Commerce Department’s economically inexplicable decision to double tariff rates on lumber is harmful for housing affordability as well as inflation. The ongoing labor shortage will further complicate this task, given an elevated level of open jobs and, within the residential construction sector specifically, a record number of builders reporting labor shortages. Despite these challenges — and the ongoing economic impacts of COVID and its variants (including the new Omicron strain) — singlefamily builder confidence increased in November to a level of 83, per the NAHB/Wells Fargo HMI. However, some cooling in the market continues because of higher costs and inflation. Single-family starts declined almost 4% to an annual rate of 1.04 million, although starts are up almost 17% in 2021. Because of supply-chain issues, the count of single-family homes permitted but not started construction is up 43% from a year ago. New single-family home inventory is balanced at a 6.3-month supply; however, 28% of that inventory comprises homes that have not started construction. And home prices are up more than 17% from a year ago. This, in turn, has boosted the demand for singlefamily rental construction, which recorded its best quarter on record with 16,000 starts. The multifamily market continues to show strength. The NAHB Multifamily Production Index increased five points to a level of 53, moving solidly into positive territory. Moreover, the occupancy measure of the survey reached its highest level since 2003. If there is a weakness in the multifamily sector right now, it is the production of lower-density housing (2-to-4-unit properties), which is down 8% over the last year amid gains in most other home building segments. Even construction of built-for-sale condos showed some strength, reaching its highest level in the last five years during the third quarter.

INFLATION PRESSURE to Continue in 2022

n November, consumer prices were up 6.8% from a year ago — the largest year-over-year gain in almost 40 years, with further inflation expected. Supply-chain constraints and strong consumer demand have contributed to recent price increases in some sectors. For example, building material pricing in the separate Producer Price Index increased 14.1% on a year-to-date basis through November. This is triple the comparable growth rate from last year. Prices are higher for a broad set of materials, including lumber, which is now back above $900 per thousand board feet. Tariffs on Canadian softwood lumber are set to double to 18%, which is inexplicable given the need to reduce inflation pressure on consumer prices, including residential rents. A tighter labor market also warns of wage-based inflation pressure. For example, there are currently 410,000 open positions in the construction industry. NAHB expects this number to rise as the overall unemployment rate declines and the construction industry expands. Indeed, the skilled labor shortage will likely emerge as the top industry challenge as some supply-chain issues ease. Combating rising prices is now the priority for the Federal Reserve, whose leadership have retired the term “transitory” with respect to inflation expectations. At its December meeting, the central bank announced it will double its pace of tapering asset-backed purchases (including mortgage-backed securities). Projections indicate the possibility of three federal funds rate hikes in 2022 and perhaps three more in 2023. This pivot toward a tighter monetary policy is consistent with the NAHB interest rate forecast, which sees a 3.6% average 30year mortgage interest rate in late 2022. Despite ongoing macro challenges, including policymakers’ potential actions in response to the omicron variant, home builders are confident. The NAHB/Wells Fargo Housing Market Index increased one point to a level of 84, the highest reading since February. And home construction posted gains in November: Single-family starts increased 11.3% to an annual rate of 1.17 million, which is up 15.2% year to date. And multifamily production increased 12.9% to an annualized 506,000 pace, as rents rise and vacancy rents decline.

T

he second half of 2021 has seen a number of housing trends cool. For example, new single-family home sales slowed at the start of the spring as builders worked on a backlog of projects. In fact, sales are now down 4.4% on a year-to-date basis. This is not because of significant weakness in underlying housing demand, but rather an unsustainable pace of sales relative to achievable production levels given the availability of lumber, labor and lots. Home prices appear to have reached a similar inflection point. While still rising, the rate of home price growth is slowing as prospective buyers are increasingly priced out of the market. The September S&P CoreLogic Case-Shiller data indicate that home prices expanded at a 15.1% annualized rate, which was slower than the 18.6% rate recorded in August. We forecast additional declines for home price growth in the quarters ahead, particularly as interest rates rise. Another trend of 2020 also appears to be normalizing: the suburban shift for home construction. The third quarter NAHB Home Building Geography Index found that the relative growth rates for home building converged somewhat over the last year. In the third quarter of 2021, exurbs were growing at a 30.8% rate, while inner suburbs of core metro areas were growing at a 21.1% rate. Although construction continues to expand at a higher rate in the suburbs, the growth gap has narrowed between these market types. In other macro data, the unemployment rate continues to fall, declining to a 4.2% rate in November. However, payroll employment data disappointed, with a gain of just 210,000 for the month. This was the smallest job gain since January. Nonetheless, home builders and remodelers added 10,300 jobs in November, yet more are needed given ongoing growth for residential construction.

Last month we celebrated a national day of thanksgiving. It is right and proper we give thanks for the many blessings we enjoy in the USA, as well as for our families and friends. The same thanks are in order for our industry affiliation from which we all receive many benefits. At ohba, we specialize and focus on issues enacted by state government. The picture below was taken at our recent board meeting where we recognized the many fine efforts and accomplishments of the 2019 executive committee. The team, led by Thomas Daniel of Tiffin, continued the decades of fine work expended on your behalf as OHBA advocated for the industry before the many tribunals of Ohio state government. Incident/accident investigation, a tool for prevention When an injury or illness occurs, it may be a symptom that something is wrong in your organization’s safety process. A thorough, well-documented incident/accident investigation will identify this problem and lessen the chance of its recurrence. The principal investigator for all injuries and work-related incidents and accidents is the employee’s supervisor. The supervisor understands the process and knows the injured worker. The safety process coordinator is available to assist the supervisor with the investigation of the incident that led up to the injury or illness. The key to good injury and illness investigations is having qualified investigators. The BWC Division of Safety & Hygiene has resources that can help your supervisors improve their investigative skills. What injuries and illnesses should be investigated? At a minimum, all OSHA recordable injuries and illnesses should be investigated. Some employers also investigate near-miss incidents and frequently occurring first aid cases. A basic injury and illness investigation includes: •

Care for the injured

Inspect the scene

•

Interview witnesses and the injured employee

•

Determine the causes of the injury or illness

•

Identify corrective actions to prevent recurrence

•

Complete a supervisor’s accident investigation report

•

Implement recommended corrective actions

•

Follow-up periodically to ensure the problem has not re-surfaced

The safety process coordinator receives a copy of all supervisors’ injury and illness investigation reports and reviews each one for quality and thoroughness. The safety process coordinator follows up to be sure the appropriate corrective action has been taken to prevent this injury or illness from happening again. The safety process coordinator should be familiar with OSHA recordkeeping and injury and illness reporting requirements. These responsibilities can be delegated to a clerical person, but the safety process coordinator should train this person and conduct periodic audits to ensure required procedures are being followed. The Division of Safety & Hygiene’s safety, industrial hygiene and ergonomics specialists can help you develop effective strategies to make your workplace safer and healthier. They can visit your workplace or consult with you by telephone or email. These services are available for any private or public employer. BWC also offers specialized options for certain employers. 1. Resolving supply chain bottlenecks, higher prices for lumber and other building materials, and rising tariffs on Canadian lumber is NAHB’s top priority. We have taken our concerns to the highest levels of government – including the White House and Congress, but the fight is far from over. 2. NAHB is sharing its concerns with government officials about an emergency temporary standard from OSHA that would force companies with more than 100 employees to mandate COVID-19 vaccinations for their workers or conduct onerous weekly testing of workers who remain unvaccinated. 3. Democrats are hoping to pass President Biden’s Build Back Better bill this month following congressional passage of the $1.2 billion infrastructure package last month. NAHB supports the new infrastructure law, which will make much-needed improvements to the nation’s roads, bridges, broadband and public transportation network. 4. NAHB and Michigan home builders scored an important legal win on Sept. 28 which means that all Paycheck Protection Program loans for members can be forgiven. 5. The Supreme Court struck down the CDC eviction moratorium in late August. What many of you don’t know is that nearly all NAHB members had been exempt from the eviction ban since March 2021. And we continue efforts to ensure that our members have the tools to access any emergency rental assistance funding and assistance that is available. 6. The Environmental Protection Agency has declared that the pre2015 “waters of the U.S.” (WOTUS) regulations are now in effect. The regulated community faces significant regulatory uncertainty in light of this decision and NAHB continues to explore all options to limit this federal overreach. 7. Recruiting is the lifeblood of the Federation. Please participate in NAHB’s “ONE in 21” campaign to recruit at least one new member this year.

Addressing the Supply Chain Crisis

Resolving lumber and other building material supply chain bottlenecks is the top priority for NAHB and we have taken our concerns to the highest levels of government. NAHB Chairman Chuck Fowke recently testified before Congress on how widespread disruptions in the building materials supply chain are hindering housing affordability and the broader economy. Fowke called on the Biden administration and Congress to take immediate action by: o Temporarily removing tariffs on Canadian lumber and other imported building materials, including steel and aluminum from China; o Alleviating bottlenecks at seaports that are preventing goods and materials from getting to market; and o Seeking solutions to persistent delays in truck and rail transportation to ease mass shortages that are putting upward pressure on material and home prices. NAHB sent a similar strong message in a recent letter to President Biden calling on the White House to take action on this critical issue. We told the president that he can “make substantial progress on housing affordability by working to reduce the cost of lumber and other building materials.” Since the early days of the Biden administration, NAHB has been actively engaged with the White House on this issue. We held several meetings with top administration officials, Commerce Secretary Gina Raimondo and HUD Secretary Marcia Fudge. This ongoing dialogue culminated with a White House building materials summit in July that was organized by NAHB. And while lumber prices have fallen sharply since peaking in midMay, prices have been moving upward in recent weeks. The price hikes are not limited to just lumber: According to the Bureau of Labor Statistics Producer Price Index, the average price of goods used as inputs to residential construction has risen three times faster than the rate of core inflation throughout 2021. From steel mill products and plastic piping to copper pipe and wood windows and doors, prices are up dramatically year-to-date and are exacerbating the growing housing affordability crisis. Small home building firms are particularly threatened by the current situation.

Moreover, in a move strongly opposed by NAHB, the U.S. Commerce Department recently doubled the tariffs on Canadian lumber shipments into the U.S. from 9% to 18%. This will further exacerbate market volatility, put upward pressure on lumber prices and make housing more expensive. This latest salvo in the U.S.-Canada lumber trade war began during the Trump administration and the administrative review process on this case has moved forward into the Biden administration. NAHB continues to take the same tact with the Biden administration as it did with the Trump administration: To call on the U.S. to return immediately to the negotiating table with Canada to hammer out a long-term trade agreement that will put an end to harmful tariffs and ensure that American home builders and home buyers have access to a steady of supply of lumber at an affordable price. NAHB sent a letter to President Biden on Dec. 2 hammering home that same message and stressing that the move to double tariffs threatens housing affordability. And we continue to call on the administration and Congress to make it an important priority to address broader lumber and building material supply chain issues that are contributing to price volatility and harming housing affordability.

Looking ahead, the NAHB advocacy team – Government Affairs, Communications, Economics and Legal – will continue to work doggedly to keep pressure on policymakers and industry stakeholders to ease production bottlenecks and protect housing affordability. We will explore all avenues in order to find solutions that will ensure a lasting and stable supply of lumber and other building materials for the home building industry at competitive prices. On September 9, President Joe Biden announced a sweeping vaccine mandate. Central to the administration’s plan is a requirement that every employer with more than 100 employees require the vaccine for its workforce. The OSHA rule DOES allow for weekly testing in lieu of vaccination. The mandate will be instituted and enforced through a new emergency temporary standard (ETS) from OSHA. The vast majority of home builders in the United States have fewer than 100 employees, so the mandate should not directly affect most NAHB members. NAHB has been in contact with rulemaking officials and we have aired our concerns about the proposal. NAHB noted that the residential construction industry is at a very low risk for COVID-19 transmission. Most work is performed outdoors, and the nature of indoor tasks allow workers to remain at least six feet apart. NAHB also noted the voluntary industrywide campaigns in the construction industry to encourage vaccinations, such as Vaccine Awareness Week in Construction. NAHB and its partners in the Construction Industry Safety Coalition (CISC) questioned the legal authority of OSHA to issue an ETS that requires vaccine mandates for workers. A federal court has temporarily blocked implementation of the OSHA ETS involving vaccines and testing. Barring a long-lasting injunction, employers will have to comply with many parts of the rule by Dec. 6, including developing a written vaccination policy, determining employee vaccination status, offering paid time off for vaccinations and requiring unvaccinated workers to wear masks. NAHB and CISC asked that the construction industry be exempt from the final ETS and that OSHA open the rulemaking to formal public comment. At NAHB, we’re telling our members that they should remain flexible and ready to act when the ETS is issued and be prepared for change even after the rule is in place.

Democrats Scramble to Pass Build Back Better Bill • •

•

Democrats hope to pass President Biden’s Build Back Better bill before the end of the year, but the legislative timeline still remains unclear. Meanwhile, NAHB supports the $1.2 trillion bipartisan infrastructure bill signed into law by Biden last month. This package will make much-need improvements to the nation’s roads, bridges, broadband and public transportation network. In contrast, the $1.75 trillion Build Back Better legislative framework focuses more on social spending. It includes: o Provisions to fight climate change, o Provides universal pre-school for three- and fouryear-olds,

o Extends the child tax credit, o Expands Medicare, and o Has other housing, health care and immigration provisions. The infrastructure bill, titled the Infrastructure Investment and Jobs Act, will help connect more Americans from their homes to their places of work and within their communities. It contains several provisions that will boost housing affordability: o By including Sen. Manchin’s Energy Infrastructure Act, this legislation advances efforts to increase energy efficiency and reduce greenhouse gas emissions without stringent energy code mandates that will increase housing prices. o The measure restores an exemption for water and sewer contributions in aid of construction that will save some developers as much as 40% on water and sewer costs. o The bill also streamlines the federal permitting process, which will minimize uncertainty in the housing approval process and make the homes that are built more affordable. Meanwhile, the House last month narrowly approved the Build Back Better Act. The measure contains positive housing provisions but also includes tax and code provisions detrimental to the residential construction sector that caused NAHB to oppose the overall package. The Senate is expected to make modifications to the measure, and NAHB will advocate for changes beneficial to the housing industry.

NAHB Legal Win Means All PPP Loans for Members Can Be Forgiven • • •

• • • • • •

NAHB and Michigan builders scored an important legal victory that will enable all NAHB members who received Paycheck Protection Program (PPP) loans to have their loans forgiven. The court’s opinion also provides several important procedural wins that will benefit NAHB in a wide range of cases. At the height of the pandemic-induced economic downturn, Treasury and the Small Business Administration (SBA) imposed rules on the PPP that would exclude certain home building firms from receiving PPP loans or having them forgiven. Those left out in the cold included spec home builders, multifamily property owners and land developers. NAHB, along with the HBA of Michigan and HBA of Southeastern Michigan, filed a lawsuit so that all NAHB members could access PPP funds to help keep their business afloat. On Sept. 28, the U.S. District Court for the Eastern District of Michigan ruled in our favor, stating that the SBA wrongly applied eligibility criteria to the PPP. The victory ensures that NAHB members who received PPP loans will have their loans forgiven. The court’s opinion will have a direct and tangible benefit for builders, developers, and property owners who are awaiting loan forgiveness. The court also ruled against the government’s claim that NAHB lacks “standing” – which means that NAHB has a right to have our case heard in federal court. This decision effectively establishes favorable case law on procedural issues that the government and others often use to try and keep NAHB and its members out of court.

NAHB also registered another important legal win for the Federation earlier this year when a federal court in the Northern District of Ohio ruled in March that Congress did not provide the Centers for Disease Control and Prevention (CDC) with the authority to issue an eviction moratorium. NAHB had filed the lawsuit on behalf of our members. The legal victory meant that the CDC eviction moratorium has not applied

And while NAHB members are not bound by the eviction moratorium, it doesn’t mean they should or will be engaging in mass evictions. NAHB’s multifamily members did not engage in mass eviction proceedings in March and today they understand that the eviction process is clearly the last option. Landlords are working diligently with tenants to help them apply for rental assistance and to offer payment plans. NAHB has actively advocated for emergency rental assistance to help renters and landlords impacted by the COVID-19 pandemic and to protect the viability and stability of the rental housing industry. Federal funds are available to assist renters. NAHB continues to urge members to seek access to the Emergency Rental Assistance Program (ERAP) through their local government and state housing finance agencies. While a large portion of the $46 billion that Congress appropriated for emergency rental aid has not been disbursed, Treasury has announced new steps to help state and local governments to expedite aid to renters and landlords in need. However, the Treasury is now required by law to consider reallocating unused funds from ERAP that was passed by Congress in December 2020 to help renters and landlords who were affected by the COVID-19 pandemic. NAHB continues to advocate for effective solutions to expedite ERAP assistance to renters and housing providers. We strongly urge the Treasury Department and ERAP grantees to ensure this policy does not further delay ERAP applications in the pipeline and create new confusion about where to apply for ERAP assistance.

Meanwhile, NAHB has provided our multifamily members a sample script that landlords can use to contact tenants and walk them through the steps to apply for assistance and/or request permission to apply on their behalf. The script, and other multifamily COVID resources, can be found on the Multifamily and Affordable Housing Resources for COVID-19 page on nahb.org. The bottom line is that property owners understand that evictions should only be made as a matter of last recourse and will continue to do everything in their power to help their tenants to access rental assistance and/or to enter into a reasonable payment agreement.

EPA Reverts Back to Pre-2015 WOTUS Regulations •

to all NAHB members since March 2021 – but all other landlords nationwide had to comply with the CDC’s eviction ban until the Supreme Court overturned it on Aug. 26. These legal victories clearly illustrate the clout of NAHB and the value of membership.

The U.S. Environmental Protection Agency and the U.S. Army Corps of Engineers announced that as of Sept. 3, the agencies have “halted implementation of the Navigable Waters Protection Rule (NWPR) and are interpreting ‘waters of the United States’ (WOTUS) consistent with the pre-2015 regulatory regime until further notice.” The action came after the U.S. District Court for the District of Arizona ruled in late August to remand and vacate the NWPR. This unilateral decision by the agencies -- without public input -- means that landowners must immediately follow the federal definition of WOTUS that existed prior to both the Trump and

Obama administration’s WOTUS rules. While the agencies reiterated their commitment to change the regulatory definition of WOTUS under the Clean Water Act (CWA) announced in June, that effort is expected to take more than a year to complete. NAHB Senior Officers, members and HBA staff testified at a series of hearings throughout August to voice their support for retaining the NWPR and thereby avoid having the agencies revert back to asserting federal control over non-navigable and isolated wetlands, ephemeral streams, and roadside drainage ditches. The regulated community faces significant regulatory uncertainty in light of the agencies’ decision, as sections of the pre-2015 rules have been found unlawful by the courts, and the guidance documents provided by the agencies have been superseded by more current guidance. NAHB is exploring all options to limit this federal overreach, as well as the challenges this reversion to the old rules will create. We will continue to keep members updated on further developments and provide additional guidance once it becomes available. Meanwhile, builders who have received, or are in the process of applying for federal wetlands permits or jurisdictional determinations, are encouraged to log onto nahb.org/wotus where they can access NAHB’s guidance to frequently asked questions to help navigate the current landscape.

DECEMBER 1, 2021 REPORT #11 NUMEROUS GROUPS JOIN OHBA IN SUPPORT OF HB 175 HB 175 had its second hearing for proponents in the Senate Agriculture and Natural Resources Committee. HB 175 would remove ‘ephemeral features’ from the definition of ‘waters of the state’. OHBA’s Executive Vice President, Vince Squillace, offered testimony focused on both the shortage of housing and developed lots in Ohio. In addition to OHBA, numerous groups also offered support including, The Ohio Chamber of Commerce, Ohio Realtors, Ohio Oil and Gas Association, Aggregates, Coal Association, Associated General Contractors, and the Municipal League, among others. OHBA welcomes the array of proponents coming out for HB 175. Yesterday’s hearing can be viewed at the link below. https://ohiochannel.org/video/ohio-senate-agriculture-and-natural-resources-committee-11-30-2021 Even with the most recent Arizona Court ruling reinstating the pre-2015 WOTUS rules and definitions, bringing ‘ephemeral streams’ back under the jurisdiction of the Army Corp of Engineers, HB 175 remains an important vehicle in a very fluid, and uncertain future of how these and other water features will be defined and regulated. OHBA continues to work with the sponsor, industry groups, and the Senate Committee. Please Read Carefully: FleetCor Technologies Operating Company, LLC (“FleetCor”) operates the SuperFleet Mastercard product. This application is made to FleetCor. By signing this application, Customer authorizes FleetCor to check Customer’s credit references and the information on this application and to obtain consumer or commercial credit reports to check Customer’s credit standing, both for this application and for the updates of Customer’s credit file and renewals of Customer’s SuperFleet Mastercard card(s). Customer acknowledges that this application is subject to approval and acceptance of Customer by FleetCor in Louisiana. If this application is approved, then Customer will be notified of its available credit/spend limit, and Customer will not allow its unpaid account balance to exceed its credit limit. Customer agrees that Louisiana law governs the terms and conditions of the SuperFleet Mastercard card(s), which terms and conditions will accompany the card(s) if this application is approved ("Card Terms"). Customer’s accepting, signing, or using any SuperFleet Mastercard card(s) will constitute Customer’s acceptance of those terms and conditions including, without limitation, Customer’s unconditional obligation to pay for all use of SuperFleet Mastercard cards provided to Customer and all use of Customer’s account each billing cycle, as well as all interest, fees and costs associated with such cards and account. The account is not a revolving credit account. Customer agrees that any liability arising or resulting from the misuse, unauthorized use, loss or theft of any one or more of the cards issued or of Customer’s account shall be fully borne, assumed and paid by Customer except as provided by applicable law and the Card Terms. Customer also agrees that Customer will exclusively use the SuperFleet Mastercard card(s) for commercial purposes and understands that Customer’s card(s) may be canceled if Customer uses them for personal, family, or household purposes. In the event that Customer’s account is turned over to a collection agency or an attorney for collection, Customer agrees to pay all such costs, fees and expenses of such agency or attorney, including, without limitation, court costs and out-of-pocket expenses.
