A Letter from the President

It is hard to believe but 2018 is ending and so is my term as your president, but not my membership in our great association, nor in my passion for the industry. The passion of the building industry is the passion of earning a living; establishing a better way of life and having that living to help provide men, women and children with shelter. Food, clothing and shelter are the three main necessities in life. The home building and remodeling industry is a noble industry. It builds quality shelter and improves later on that shelter. Most fond memories come from your home, either growing up or later in life. Not only does building create shelter, it helps provide the structure for memories. If having a career and knowing what you do contributes to providing shelter and the memory-making process doesn’t make you feel like you are doing something special, it should. The only way you can know for sure is by having a little passion for continuing to earn a living in this industry. As I look back on this year our industry continues to improve, and our association continues to grow. The Board of Directors, staff and committees seem to be constantly working on new events, promotions and meetings, all to hopefully provide for your needs as our membership. But what many of you don’t realize is the amount of time spent on keeping up with these items. Without these people our organization would grind to a halt. So, thanks to all who have volunteered their time to make this a great association. The North Coast BIA is committed to each member of our association. You can be proud of the fact that, as a member, you have contributed to the effort that is yielding so many positive results at the national, state and local levels. This organization is great because of you and your fellow members! With the new year comes new leadership and the need for your continued support and guidance. We need you to help build our future. Through our association the voice of one can be heard as the voice of many. I am thankful to you for allowing me the privilege once again to serve as your president this year. My thanks to each of you who helped make 2018 a successful year for our association and I wish you continued success in 2018. I hope to share a farewell toast with you on January 19th at our 2019 Installation Night and welcome in our new president, Liz Schneider and our new Board of Directors.

Settlement Officially Puts an End to “Persuader Rule” The persuader rule would have impacted NAHB in two distinct ways. First, it would have decreased employer access to qualified labor relations attorneys. Second, trade associations like NAHB would have been directly regulated by the persuader rule if they engaged in certain activities, such as holding educational seminars on labor relations topics. Regulations under the rule would have included reporting the identities of NAHB members attending these seminars and other complex filing obligations.

In a victory for NAHB, the Department of Labor (DOL) on Nov. 9 agreed to a settlement that keeps a permanent injunction in place that stops the “persuader rule” from taking effect and prevents a future administration from seeking to revive the rule. The Obama-era persuader rule sought to unfairly require lawyers and consultants to report to the DOL when counseling employers concerning union organizing. The settlement signed by the DOL provides NAHB and its coalition partners peace of mind that the persuader rule cannot be brought again by a future administration, and ends the litigation.

The regulation was issued in 2016. However, before it could be implemented, NAHB scored a major legal victory that November when the U.S. District Court for the Northern District of Texas granted NAHB, the Texas Association of Builders, the National Federation of Independent Business and other Texas business groups a permanent stay of the persuader rule. DOL appealed the permanent injunction to the Court of Appeals for the Fifth Circuit and the agency subsequently moved to initiate a rulemaking to withdraw the persuader rule. That rulemaking was finalized in August 2018. The settlement reached on Nov. 9 ensures that this rule cannot be revived by a future administration. Active Home Buyers are Spending Significant Amounts of Time Looking for the Right Home BY ROSE QUINT

One option that is not in the cards for most of them: giving up. Only 18% will stop trying to find a home. Next Steps if Still Unable to Find Home in Months Ahead (Percent of Prospective Home Buyers Who Have Been Looking for 3+ Months)

In the third quarter of 2018, 13% of adults in NAHB’s Housing Trends Report* poll report planning to purchase a home in the next 12 months. Of that group, 46 percent are not merely planning it, they are already actively engaged in the search for the right home to buy. And they are spending significant amounts of time looking. In fact, 54% of those actively engaged in the process have been trying to find the right home for three months or longer. Why is it taking this long? The number one reason active home buyers gave in the third quarter of 2018 is they can’t find a home at a price they can afford (49%), followed by not being able to find a home with the desired set of features (40%). And finally, a critical question: what are these veteran house hunters, who have already actively looked for at least three months, going to do if their dream house remains elusive in the months ahead?

• 61% will continue looking for the ‘right’ home in the same preferred location, • 37% will expand the search area, • 23% is willing to accept a smaller/older home, • 16% might buy a more expensive home

If you follow politics in the news you keep reading about close races still being decided though election day was a month ago. It seems a large number of races for a variety of offices all across the nation were close. In Ohio, we had a number of razor thin margin outcomes as well. In fact, two races, one in the House and the other in the Senate saw the eventual winner declared weeks after the election results were in. This is the result of provisional ballots that are counted after the regular votes are tabulated. Provisionals have to be verified before included in the final vote.

All elections reveal something about the electorate. While the republican party swept most statewide races, they lost two Supreme Court seats. No good explanation exists. The House republicans lost six seats and picked up a seat held by a democrat. And in a surprise a wellfunded and established representative lost her bid for a Senate seat to a candidate with a criminal record whose own party did not back and she hardly campaigned.

Eye on Housing SOME EASING OF AD&C LENDING, ACCORDING TO BUILDERS AND DEVELOPERS BY PAUL EMRATH In the third quarter of 2018, credit conditions eased somewhat, according to the builders and developers responding to NAHB’s survey on land acquisition, development, and construction (AD&C) loans. The net tightening index constructed from the NAHB survey was -12.0 in the third quarter, compared to -5.0 the previous quarter. The index is constructed so negative numbers indicate easing of credit; positive tightening, so a lower negative index means greater easing. Meanwhile, a similar net tightening index from the Federal Reserve’s survey of senior loan officers was +6.0, indicating slightly tighter credit conditions, up from +1.4 in the second quarter. The NAHB Index is based on questions asking builders and developers if availability of credit has gotten better, worse, or stayed the same

since the previous quarter. In the third quarter of 2018, only 9 percent of NAHB members said availability of credit for land development had gotten worse, compared to 16 percent who said it had gotten better. For single-family construction, 5 percent reported worsening credit conditions, compared to 16 percent who said it got better. Similarly, for land acquisition, the availability of credit was worse for 6 percent, compared to 24 percent who said it was better. The median interest rate for typical AD&C loans in the third quarter was 5.50 for pre-sold construction, and 6.00 percent for acquisition, development, and speculative construction loans. Lenders also charged 0.6 points on acquisition and development loans, and 0.5 points on spec and pre-sold construction loans.

Compared to the second quarter, interest rates reported on acquisition, development and spec construction loans were up, while the points were down. Reported interest rates and points on loans for pre-sold construction were unchanged.

Slight Growth for Custom Home Building BY ROBERT DIETZ NAHB’s analysis of Census Data from the Quarterly Starts and Completions by Purpose and Design survey indicates custom home building posted a small gain on a year-over-year basis. There were 54,000 total custom starts for the third quarter of 2018. This was a slight improvement over the third quarter of 2017 (51,000). Over the last four quarters, ending with the third quarter of 2018, custom housing starts totaled 175,000. This was a 1.2% gain over the prior four quarters. Note that this definition of custom home building does not include homes intended for sale, so the analysis uses a narrow definition of the sector. As measured on a one-year moving average, the market share of custom home building in terms of total single-family starts is now 20%, down from a cycle high of 31.5% set during the second quarter of 2009.

Home Builders Mourn the Passing of President Bush On this national day of mourning for President George H. W. Bush, the nation’s home builders salute his legacy of a lifetime of service to America. NAHB Chairman Randy Noel issued the following statement on the passing of President Bush: “On behalf of all the members of NAHB, I wish to extend my deepest condolences to the Bush family. President Bush was an American war hero, a great statesman and an American patriot who embodied the ideals of our nation. “He was also a true believer in housing. President Bush hosted the NAHB Board of Directors on the South Lawn of the White House to commemorate the association’s 50th anniversary. He said that ‘strong housing can help a strong economy’ and ‘the dream of homeownership keeps the American dream alive.’ “To make these words a reality, President Bush pushed vigorously for policies to ensure that housing would help boost the economy. He championed a $5,000 tax credit for first-time home buyers, called for penalty-free withdrawals from IRAs for the purchase of a first home, urged changes in the passive loss tax rules to spur real estate and housing development, and called for an extension of mortgage revenue bonds and the low-income housing tax credit. “President Bush summed up the importance of a strong housing industry to America when he said: ‘The old adage is coming true: As housing goes, so goes the economy. Owning a home helps America, makes it better, and more caring.’

U.S. and China Agree to Suspend Proposed Tariff Hike

The onset of the housing crisis and the Great Recession interrupted a 15-year long trend away from homes built on the eventual owner’s land. As housing production slowed in 2006 and 2007, the market share of this not-for-sale new housing increased as the number of singlefamily starts declined. The share increased because the credit crunch made it more difficult for builders to obtain AD&C credit, thus producing relatively greater production declines of for-sale single-family housing. Recent declines in market share are due to an acceleration in overall single-family construction, especially in spec home building. As this part of the market cools due to declining affordability, the market share for custom homes will likely stabilize.

In a positive development for the home building industry and housing affordability, the United States and China announced an agreement to suspend a proposed Jan. 1 tariff boost to 25% on $200 billion worth of Chinese imports, including $10 billion of goods used by the home building industry. Earlier this year, President Trump imposed a 10% tariff on these goods, which represents a $1 billion tax increase on residential construction. This 10% tariff remains in effect while negotiations continue with China. The agreement, brokered at the recent G-20 summit in Buenos Aires, suspends the proposed tariff increase for 90 days to allow the U.S. and China to continue trade negotiations while they work to resolve their differences. However, if an agreement is not reached within 90 days, the tariff on Chinese goods will jump from 10% to 25%, which would be equivalent to a $2.5 billion tax on housing. NAHB has urged the administration to resolve this dispute quickly in a way that won’t hurt American consumers or businesses. Most Homes For-Sale are Unaffordable to Most People BY ROSE QUINT

Affordability continues to be a serious constraint for prospective home buyers. One way to find out buyers’ perception about this issue is to ask them to estimate the share of all homes for-sale in their markets they are able to afford. A strong majority of 79% say they can afford fewer than half of the homes available. This in turn means that only 21% of buyers believe they could buy most any home for-sale in their markets. These findings come from NAHB’s Housing Trends Report (HTR)* for the third quarter of 2018. A substantial majority of Millennial home buyers – 80% – estimate they can afford fewer than half the homes for-sale in their areas. The share is not much better among Gen X’ers (79%) or Boomers (75%). What Share of all Homes Currently For-Sale in Your Market is Affordable to You? (Percent of Prospective Home Buyers)

A Focus on Interest Rates BY NAHB CHIEF ECONOMIST ROBERT DIETZ Federal Reserve officials recently signaled a more data-dependent approach to monetary policy in 2019. NAHB continues to forecast an increase of 25 basis points in the federal funds rate before the end of 2018, followed by an additional rate hike in early 2019. At that time, we anticipate the Fed will pause to examine inflationary pressures and the state of the macroeconomy, before acting one more time later in 2019 to raise the federal funds rate. This is a more dovish path than many others had forecasted earlier this year, when the expectation was for three or four rate increases from the Fed in 2019 alone. The slight change in tone from the Fed, combined with soft business sentiment data and rising concerns regarding the risk of a recession, have led to a decline for the 10-year Treasury rate, which fell from 3.23% in early November to less than 2.9% this week. This will bring down mortgage interest rates and present more opportunities to prospective home buyers. While it is clear that some economic momentum has been lost, as reflected in recent stock market declines, household formations remain healthy and the unemployment rate of 3.7% is near a 50-year low.

Share Who Can Afford Fewer than Half the Homes For-Sale by Generation (Percent of Prospective Home Buyers)

On the supply-side of the residential construction industry, builders and remodelers continue to add workers. In November, 7,900 jobs were added to the industry, while almost 128,000 have been added over the last year. As of October, there were 292,000 unfilled jobs in the construction sector—the second highest tally for this growth cycle. And the stock of residential construction loans for builders has expanded 8% during the past 12 months.

Lump Sum Settlements A Lump Sum Settlement (LSS) is an agreement between the employer, injured worker and Ohio Bureau of Workers’ Compensation (BWC) for a lump sum payment to settle one or more workers’ compensation claims. The negotiated settlement amount is paid by BWC to the injured worker in exchange for closure of the claim, or a portion of the claim, as defined by the agreement. The written LSS agreement specifies the terms of the settlement and is the final resolution of all medical, compensation and liability claims, whether known or unknown. BWC will consider if the settlement is fair to all parties and must approve all settlements. Numerous issues should be considered before settling a claim: ● Is the injured worker still employed, working, able to work or disabled? ● Will there be a need for future medical costs? ● Is there a claim reserve still active in the employer’s experience? ● Will the settlement create a positive financial outcome for the employer? Any party involved can submit an LSS application called a Settlement Agreement and Application for Approval of Settlement Agreement (C-240). The injured worker may or may not use legal counsel to represent them with the settlement negotiations and the employer can choose to use legal counsel or, as in most cases, have their Third-Party Administrator (TPA) help with the settlement process. Once BWC evaluates the C-240 and all parties agree to the settlement amount, BWC will send an approval letter to all parties. The approval letter begins a 30-day waiting period during which time any party can reject the agreement. Once the 30-day period expires BWC will pay the settlement to the injured worker. Lump Sum Settlements can financially benefit the injured worker, the BWC and the employer. LSS pays a benefit to the injured worker and helps BWC reduce reserves and other associated administrative costs and is a very effective claim management strategy used to help employers lower their premiums and qualify for group rating programs. While an LSS does not remove a claim from an employer’s experience it does preclude additional claim costs and removes the claim’s reserve costs. It is also important to note that, even though the settlement is paid by BWC, the fixed settlement amount is added to the employer’s claim experience and will be used in determining an employer’s rates. Employers can face many issues when considering an LSS and CareWorksComp recommends that they should always consult with their TPA on all settlement issues.

MEMO To: State and Local Executive Officers From: Rick Burt, CAE, Director, Executive Officers Council Date: November 14, 2018 Subject: Lobbying Tax Deduction for 2019 NAHB Dues In 1993, the U.S. Congress enacted the Omnibus Budget Reconciliation Act that contained provisions affecting trade associations. The Act provided that taxpayers will no longer be able to deduct from their federal income taxes any portion of the association dues attributable to that association’s “lobbying activities” as an ordinary and necessary cost of doing business. For 2019, NAHB estimates that the non-deductible portion of national dues—the portion that is applicable to lobbying - is 20%. Each state affiliate will be making similar calculations with respect to their portion of the dues. If you have not already received notification from them, please look for it in the near future or contact them directly. Associations must inform members of the portion of their membership dues that are spent on lobbying activities. Significant taxes or penalties may be assessed by the IRS against associations that do not comply with this regulation. NAHB recommends that all invoices of member dues contain adequate disclosure. Following is an example of a statement that can be shown on the face of a dues billing invoice: “Dues payments to (association name) are not deductible as charitable contributions for federal income tax purposes. However, dues payments may be deductible as ordinary and necessary business expense, subject to exclusion for lobbying activity. Because a portion of your dues is used for lobbying by NAHB, (state association name) and (local association name, if relevant), XX% of the total dues, or $ XXX, is not deductible for income tax purposes.” For additional information on NAHB lobbying tax deductions, contact Eileen Ramage at 202-266-8243. RULES AND REGULATIONS GOVERNING EXHIBITS MANAGEMENT: The North Coast Building Industry Association (NCBIA) shall be deemed Event Management and shall have all rights thereto assigned. (From here on the North Coast BIA will be referred to as NCBIA). NCBIA reserves the right to increase and/or decrease the size of any event and/or reassign Exhibitor space numbers prior to any event(s). CHARACTER OF EXHIBITS: NCBIA reserves the right to approve all exhibits. The exhibits and the distribution of promotional material shall be limited to the confines of the Exhibitor’s space. Under no circumstances shall any Exhibitor be permitted to attract attention to his/her exhibit in such a way as to distract or interfere with the other exhibitors. REGISTRATION: Exhibitors and their employees at the Event should wear a registration badge and/or tag for proper identification. SET UP/REMOVAL OF EXHIBITS: All exhibits must be placed and ready at the opening of the show and no movement of exhibits will be permitted until after the close of the show. Exhibits must remain intact until after closing of the show and be removed within such time as may be specified by the NCBIA. Strict compliance with move in and move out times is mandatory. A fine for late move in and/or early move out will be assessed at the discretion of the NCBIA. RAFFLES: No exhibitor other than Event Management shall conduct any game, lottery and/or similar activity unless authorized by the NCBIA. CARE OF EXHIBITS/AISLES: The NCBIA will maintain the aisles and exhibit areas in a clean condition. Aisles must be kept clear at all times. Seating for buyers must be confined within the exhibitor’s space. Exhibitors are requested at all times to cooperate with the NCBIA in maintaining all exhibits in perfect condition and to provide supervisory personnel at all times during exhibit hours. *In the event that the Exhibitor does not exhibit as provided herein or fails to comply in any respect with the terms of this agreement, the NCBIA management shall have the right without notice to the Exhibitor, to license the use of said space to any other company, enterprise, person or persons and the Exhibitor agrees to pay any deficiency, loss and/or damage sustained by the NCBIA as a consequence of such failure to occupy space as provided in this agreement. In addition, it is agreed that should the NCBIA be unable to license the use of said space as herein provided, it shall have the right to occupy said space for its own purposes without prejudice to its rights against Exhibitor pursuant to this agreement, including but not limited to the payment of a license fee. *Exhibitor will not sub license any part of the space herein provided for without the express written consent of the NCBIA. In the event the exhibit premises are destroyed or rendered unavailable for any reason whatsoever (whether before or during the scheduled exhibition), the rights of the Exhibitor under this agreement shall be limited to a pro-rated refund of the amount paid for the space licensed.

COMPLIANCE WITH LAWS: Exhibitors must comply with all federal, state and local laws, regulations and rules that may be in force during the exhibit. The Exhibitor agrees to make no claim for any reason whatsoever, including negligence, against the NCBIA or NCBIA management, its agents or employees while in the show quarters. Exhibitor agrees to indemnify and hold harmless the NCBIA against any loss, damage or expense (including reasonable attorney’s fees) act or omission of Exhibitor or its agents connected in any way with its exhibits. DECORATIONS, SIGNS, ETC: All equipment in conjunction with the exhibit must be provided by the Exhibitor. However, only the sign of the firm covered by the Exhibitor’s agreement may be placed in the booth or upon printed list of exhibitors or program. All decorations must conform to fire regulations. No exhibit is permitted that is more than eight feet high, or that obstructs other exhibits due to its design or size. PAYMENT DEFAULT: A service charge of 15% per month is applicable on all balances after 30 days. In the event any unpaid amount is placed for collection, client and/or agent agree to pay all collection costs, including reasonable attorney’s fees. REFUND POLICY: A partial refund will only be given with a minimum of 45 day’s notice prior to the event. The NCBIA retains the right to use their own discretion when deeming the reason for refund as a viable one to determine whether refund shall be granted. *The NCBIA shall have the right to make such rules and regulations in connection with the Exhibition as it may deem proper and may amend them at any time, and the NCBIA shall have the full power in the matter of interpretation and enforcement thereof. The rules and regulations heretofore referred to are printed on this agreement and are incorporated herein by reference. Exhibitor agrees to abide by said rules and regulations. *It is agreed that this instrument is a license, and not a lease, and that no leasehold or tenancy is intended to be or shall be created hereby. *This agreement cannot be varied, modified or canceled by the Exhibitor without the express written consent of the NCBIA.

2019 Virtual Parade of Homes Under Construction! What a year – it flew by at the NCBIA office. Another year of networking, seminars, education,and fun social events. It has probably had a different meaning for all of us. For some it meant good health, being busy, some successful and others growing a business, and for some I am sure there were struggles. It was a year of change with a new staff and I believe we have made significant strides. I would like to thank Maria and Deb for all their hard work. I would be remiss if I did not thank our dedicated and active members who give of their time and energy to make this a great association. I would like to recognize two of these members who went above and beyond. These two young and passionate ladies are Sara MajzunGarwood and Ashley Caruso-Noe. Both are on our Board of Directors and Sara is our Associate Vice President. Sara chairs our Membership Committee who took 6th place in our association size category for NAHB, and has grown our Young Professionals sub-committee of Membership to a standalone committee. In addition, they co-chaired two committees, the Home Show and Clambake which were both very successful events. And maybe a group that never gets thanked – your board of directors, the driving force behind the association. The policy makers and the members who lead us in order to make this the best association it can be - Thank you! I wish you all a prosperous 2019!
