ASSOCIATE APPRECIATION Month Since 1981, September has been designated as NAHB’s Associate Member Appreciation Month — an annual celebration of Associate member contributions to the NAHB Federation and the home building industry. Designating September as Associate Appreciation Month is just one way of providing the much-deserved visibility and recognition to our invaluable Associate members. The next time you come to a NCBIA event, look around at your fellow members. Most of them will be Associate members. Associates are essential to the home building industry and help enable our industry to provide Americans with the dream of home ownership. Associate members are not only essential to our local association but to OHBA and NAHB as well, offering sponsorships, devoting countless hours at committee meetings, and volunteering at special events which strengthen our industry in the process. Most importantly, our associate members help broaden our perspective so that we can access issues more objectively in the context of our entire industry. I urge all NCBIA members to get to know one another better, learn about each other’s businesses whenever possible, and to do business with other members. EXECUTIVE OFFICER’S REPORT

NCBIA HISTORY The 1980’s As we continue our 75th anniversary celebration for the North Coast Building Industry Association, we are now into the 2000’s a decade of boom to bust. Well we survived Y2K and made it into the new millennium. In March of 2000 we had 665 members, six staff and our first website! 2001 We had a brand-new event “The Contractors Showdown.” This event included sub-trades, builders and developers vying for the Best of the Best! It was truly an awe-inspiring sight – 20-plus acres full of backhoes, excavators and trucks which 100 people participated in various contests of skill and experience witnessed by approximately 500 attendees. We became part of the Smart Growth Educational Foundation formed by the Home Builders of Northeast Ohio. Together we provided education on a commonsense approach to the future development of our communities and building livable communities through creative land planning that meets housing demand while preserving the environment. 2002 NCBIA newly formed Home Builders Care – About Kids helped to build four baseball fields and picnic pavilion at Little League North in Elyria.

The Dream – Efforts of the NCBIA, Lorain County JVS and Lorain Metro Parks. The Dream was many events in one. It started with the JVS students designing a house that they built with oversight by NCBIA members. The house was built on a lot within a half-mile of the Metro Parks Carlisle Visitors Center. The house was “green built” using recycled materials with support from the Lorain County Commissions, the Solid Waste Management Corp., the Lorain County Chamber of Commerce and many more. 2006 Our first Annual Elected Officials Reception where our members took advantage of this great opportunity to network and discuss issues with elected leaders.

From Bare Lot to New Home in Only 3 Days -2006 Project House in Lorain. It was amazing to see so many different crews from different companies working as one team. A donation of $5,000 was presented to Genesis House for battered women and children. 2007 Good news – we now have one building code for the State of Ohio effective May 27th. 2008 Bad News – starts lag and job creation poor. overcapacity. Demand, as expressed in number of homes sales, remained resilient in 2006 and the first half of 2007. Demand for new homes comes under stress in 2008 as mortgage availability tightens and economic slowdown emerges. NAHB’s legislative conference helped to move forward a sweeping housing stimulus package. 2009 Our website wins a NAHB Award! Despite all the happenings around us, we are still the same association as before. We remain committed to our role serving the industry. We are an industry of tough folks who are committed to improving the quality of life for those in the communities we serve. Now, more than ever the efforts of our association are needed. BILLIONS; The New Normal We have seen a lot of change in the political landscape through the years. We have a bit of everything; contrasting personalities, bizarre characters and extremists. While peculiar characters make it fun, the billions of dollars needed to attain office is not. I am a regular reader of The Kiplinger Letter. Through the years I have found it a good and reasoned source of news and trends. In their a recent letter, they peg possible spending next year on political campaigns at a whopping 7 billion dollars. That is no joke. During the last presidential race Hillary Clinton spent 763 million. As you know, she lost. Many Ohio statewide campaigns find dollars spent in the 10s of millions of dollars. Even small state legislative races find a number of million-dollar campaigns. It is not difficult to find ways to spend the cash. Political campaigning has become a growth industry. It’s not just buying TV time any more. For the most part, it’s like the entertainment and marketing industry. Always seeking the positive spin, appearances at the right events, creating news stories and in some cases just being outrageous. And last but not least, continuous polling. There will always be a pol professional there to take your money. There are new and innovative ways to raise it and spend it. The candidates are told by their handlers they can only win if they spend the dough. Naturally, this all begs the question; does it breed corrupt office holders? I am not ready to say it does, but is it a concern. What is the tipping point? How strong is the candidate to resist too much compromise of their true beliefs? The questions could be difficult when faced with a barrage of nastiness coming your way. Is it fair to strike back? The question for us in the advocacy is do you want a friend in office or the other guy. As you guessed, the other guy says the same. It’s almost a no-win predicament; it’s a tough call. All candidates know who supports them, they know who supports their opponents. In a recent high-profile legislative battle in Ohio, an impacted Corporation with a PAC contributed just under one million dollars to legislators. That is just one contributing entity. There are many PACs, both corporate and otherwise. The numbers add up quickly. Thus, it’s easy to see how money in the system is in every nook and cranny. I remember when a $100 contribution was a lot. The stakes and the requests go higher each campaign season (which is endless). Both major parties are urging more. It’s just how business is done in the political arena. The message here is millions will soon be billions. I see nothing that can stem the tide. You are not without a good defense. OHBA along with our local and national affiliates work each day to represent your interests. No matter how big the Goliath, we are here for you. We can battle big money with brainpower. Its sounds a bit naïve, but that has served us well in the past.

Existing Home Sales See First YearOver-Year Gain in a Year, Boosted by Lower Mortgage Rates

fter a minor decline in June, existing home sales, released by the National Association of Realtors (NAR), rebounded in July. Total existing home sales, including single-family homes, townhomes, condominiums and co-ops, climbed 2.5% to a seasonally adjusted annual rate of 5.42 million in July. On a year-over-year basis, sales were 0.6% up than a year ago, the first year-over-year gain in seventeen months. The first-time buyer share fell to 32% in July from 35% last month but remained unchanged from a year ago. The July inventory decreased to 1.89 million units from 1.92 million units both in June and a year ago. At the current sales rate, the July unsold inventory represents a 4.2-month supply, down from a 4.4-month supply last month and 4.3-month a year ago. Homes stayed on the market for an average of 29 days in July, up from 27 days both last month and a year ago. In July, 51% of homes sold were on the market for less than a month.

The July median sales price of all existing homes was $280,800, up 4.3% from a year ago, representing the 89th consecutive month of yearover-year increases. The median existing condominium/co-op price of $254,300 in June was up 2.5% from a year ago. Regionally, all regions saw an increase in existing home sales in July except for the Northeast, compared to the previous month. On a yearover-year basis, sales in the Northeast and West declined 4.3% and 0.8%, while sales in the Midwest and South grew 0.8% and 2.7%. Falling mortgage rates should expand affordability and attract more buyers. However, tight inventory, especially of affordable homes, remains a headwind for homebuyers, as it leads to home price appreciation. NAR suggests more inventory is needed. Meanwhile, builder confidence rose one point to 66 in August, but builders continued to struggle with rising construction costs and labor shortages which are hurting affordability and depressing supply.

FED LOWERS RATE as Economy Moderates

conomic growth for the second quarter was noticeably slower

than the start of the year, with the annualized GDP growth rate falling from 3.1% to 2.1%. Combined with muted inflation data, despite tight labor market conditions, these economic data were the reason why the Federal Reserve lowered the key federal funds rate by 25 basis points to a top rate of 2.25%. This was the first cut in more than a decade. Although the Fed’s actions were widely anticipated — with the 10-year Treasury rate hovering under 2.1% in recent weeks and the 30-year fixed-rate mortgage averaging 3.75% — the policy change is good news for housing.

Existing home sales have not fared well either, posting a 2.2% yearover-year decline for June, according to NAR estimates. However, pending home sales showed a pickup of 2.8% in June — the first year-over-year gain in 17 months. This suggests that the Fed’s action, combined with still favorable labor market activity and demographics, will help push new home sales and construction through the second half of 2019.

The NAHB/Wells Fargo Housing Market Index remains solid in terms of builder confidence, at a level of 66 in August.

Large Revision for June New Home Sales BY ROBERT DIETZ The news in today’s newly-built home sales report was found in the estimates for June, rather than July. Contracts for new, single-family home sales decreased in July by 12.8% to a 635,000 seasonally adjusted annual rate according to estimates from the joint release of HUD and the Census Bureau. However, that decline came off an significantly upwardly revised June estimate, which was increased from an initial reading of 646,000 to a new estimate of 728,000. Industry surveys of builders suggested that June sales were stronger than initially estimated, and July sales improved off that base. As a result, we expect a revision to the July Census estimate as well.

a near normal level of 6.4. This marks a somewhat elevated level of inventory. However, the months’ supply measure for June was revised down 5.5. Median new home sales price (price of a home in the middle of the distribution) increased in July to $312,800 compared to $327,500 a year ago. For the first seven months of 2019 (and relative to the first seven months of 2018), new home sales were up 7.2% in the South, 9.5% in the West, and down 12.4% in the Midwest and 15.4% in the Northeast.

Year-over-year, the July estimate of 635,000 is 4.3% higher compared to July 2018. On a more stable, year-to-date basis, new home sales are running 4.1% higher thus far in 2019, compared to the comparable 2018 data. New home sales are performing better than single-family permits (-4.7% year-to-date change), as lower rates and price incentives boosted demand in recent months. The general rising trend for new home sales, after the housing affordability crunch of 2018, suggests additional permit growth in the second half of 2019.

We expect the volume of new home sales to continue to expand along the current modest pace, subject to monthly volatility and supply-side cost concerns. Inventory increased 7.3% from a year ago to a level of 337,000 singlefamily homes for sale in July. The current months’ supply stands at page 24

Final ESA Rules will Streamline the Permitting Process In a victory for NAHB, the Trump administration today released final rules updating the Endangered Species Act (ESA) Section 7 Consultation requirements and new regulations governing the designation of critical habitat that will improve the overall efficiency of the ESA’s permitting process and make compliance less onerous for home builders and developers. “These regulatory changes will streamline the cumbersome and bureaucratic permitting process and allow federal regulators to spend more time on species preservation rather than creating red tape,” said NAHB Chairman Greg Ugalde.

The other significant rule change concerns the regulatory definition of “destruction or adverse modification” of critical habitat. Here, the administration removed the controversial language that held developers and builders responsible if federal regulators determined their construction activities could delay the development of habitat features that species need — even if those habitat features were not found on their property. This change will better ensure that any habitat that is protected is actually of use to the species. For additional information, contact Michael Mittelholzer at 800-3685242, x 8660.

Builders and developers whose projects may affect endangered species or designated critical habitat for those species and that also require a federal permit (typically for working in wetlands) trigger the ESA’s Section 7 consultation process, which means they must first consult with the U.S. Fish and Wildlife Service (FWS) or the National Oceanographic and Atmospheric Administration (NOAA) before they start construction. This process usually results in permitting delays, project reconfiguration, and possibly the loss of buildable lots. The final rules announced today will streamline the consultation process by encouraging FWS and NOAA to agree upon a set of general requirements that permittees must meet when the impacts on species will be minimal rather than requiring the federal agencies to perform an individual analysis for each proposed activity, thus shortening the wait for approvals. The rule also requires FWS and NOAA to clearly specify what information the developer or builder must supply so the agencies can complete their review. These regulatory changes should help eliminate some of the uncertainties and time-consuming and often unnecessary permitting delays that have plagued the Section 7 consultation process since its inception.

LEGISLATIVE REVIEW

AUGUST 12, 2019 REPORT #12 SUMMER CONTINUES TO BE BUSY WITH AGENCY AND LEGISLATIVE FOLLOW UP HB 149 Tax Exemption (Merrin, D.) Before leaving, the biennial budget bill (HB 166) passed the House and Senate, which included language from HB 149 Exemption on Residential Development Property. Unfortunately, before Governor DeWine signed the bill, he line item vetoed the property tax language. OHBA has been following up with both the bill’s sponsor, Governor’s office and other legislators to prepare the next steps for HB 149 when the legislature returns. SB 176 Construction Specialty Contractor Licensing (Schaffer, T.) A bill to license residential specialty contractors has been reintroduced. OHBA met with the Senate sponsor, and has spoken with stakeholders on the practical impacts of extending the liscensure to residential work. OHBA is drafting several amendments to address concerns with the current language and clarify application of the license. OEPA NPDES/SWPPP Enforcement After hearing questions from members in Northwest Ohio on local enforcement of SWPPP requirements, OHBA organized a meeting with OEPA to further discuss potential inconsistent enforcement. Additional follow up is being done within the agency, and OHBA continues to monitor the issue both locally and around the state. Electric Service Lines 400AMP Requirement After talking to various members from around the state, it appears there are varying practices by electric utilities in requirements for construction requirements and installation of service cables. OHBA continues to get insight from members and utilities on where, what and why electric utilities may be requiring different types of service lines around the state.
