LETTER FROM THE PRESIDENT

INSTALLATION NIGHT Address I’d like to start with a quote- “Leadership isn’t about being the best. Leadership is about making everyone else better.” Thank you for coming this evening to celebrate the 2019 North Coast Building Industry Association board of directors and officers. Tonight isn’t about me; it’s about all of us and the success of the home building industry. All of us are in some way connected to making the American dream of homeownership a reality. Building a new home is a “dream” for so many. When I joined the association in 2001, I had no idea that one day I’d be leading the association. I had just become a certified builder representative for the company I was working for at the time and I joined at the urging of my mentor. He said to get involved and I did. I wanted to meet builders and network to grow my business. It started with sales and marketing. I volunteered to work the golf outing, chaired Circle of Excellence and the home show, joined the board of directors and the list goes on. I’ve made some great friends along the way and learned so much from all of you. 2019 is the 75th anniversary of the NCBIA. I am excited to lead the association during this time; we’ll look back at where we started, where we’ve been and plan for the future. I am looking forward to working with the experienced veterans of the association and the energetic and enthusiastic Young Professionals. The Young Professionals are our future leaders. We need to mentor them and encourage them to get involved and prepare them to be our leaders of the future. I encourage all the long-time members of the association to go up to a new member and introduce yourself and get to know them. Make them feel welcome. We learn so much by talking less and listening more. The association is fueled by volunteers who give so generously of their time, talents, and financial support. Without them, there’d be no association. I’d like to thank all the volunteers for their hard work. When you attend an event, thank the volunteers that are there working to make the events and our association successful.

The building industry has recovered in the past few years, but it still has its challenges. Builders are facing lot shortages; labor shortage, rising building material costs and competition. All of this is putting pressure on this recovery. The buyers are out there. There is a housing shortage and those buyers want affordable housing and they feel that building isn’t “affordable.” Many buyers experience “sticker shock” when talking to a builder, but that’s the reality. And this is likely to continue as long as we have the pressures that are driving the cost of building a new home upward. We need to educate our clients about the benefits of building a new home; new technology, energy efficiency, products that help with lower maintenance costs, etc. Being a member of the association is really being part of 3 associations: the NAHB and OHBA and the NCBIA. We have lobbyists working on our industry’s behalf in Washington and the state house every day. I urge all of our members to donate to BUILD PAC to help the fight for industry and affordable housing. This will help our businesses and our clients achieve the American dream of homeownership at an affordable price. I’d like to thank Jason Scott for committing to be our BUILD PAC chair for 2019. The association has experienced growth the last few years and I look to work with all of you to bring public awareness of our association. I challenge all members to share information about the NCBIA and what we have to offer with our clients, colleagues, friends, family and neighbors. We are a local trade association and are a great resource to those looking to work in the trades, build a new home or remodel their current home. Finally, I want to thank my husband and our daughter; without your support and incredible patience I couldn’t do all that I do. 2019 is going to be a great year and I look forward to talking with, learning from and working with all the members of the NCBIA. www.ncbia.com

NCBIA HISTORY The 1960’s As we continue our 75th anniversary celebration for the North Coast Building Industry Association, we are now into the 1960’s. The 1960’s saw the beginning of the war babies coming of age and moving away from the core cities and the rapid growth of suburbia. Buyers were becoming more sophisticated and builders had to turn to marketing and promotions to sell their products. The HBA assisted their effort by holding the first Home Show at the new Midway Mall. By 1960, the National Association of Home Builders had become a respected and powerful voice for the industry in Washington D.C. The HBA hired its first part-time executive officer in 1960 to help meet the demands of a growing membership. By 1963, the Association was involved in so many events and providing so many services that the board of directors named Howard Head as their first full-time executive office. Howard served in that capacity from 1963 to 1974.

John F. Kennedy is inaugurated President of the United States. In a memorable address, he urges Americans to “ask not what your country can do for you—ask what you can do for your country.” In a congressional address, President John F. Kennedy pledges to land a man on the moon by the end of the decade.

1962

U.S. Steel announces that its raising prices just weeks after President Kennedy convinced the steel workers union to temper its wage demands. Kennedy’s anger with U.S. Steel is reported in the press and Attorney General Robert Kennedy adds further to business anxieties by convening a grand jury investigation of the steel giant. The stock market will fall in the following weeks, climaxing with a 6% drop on May 28th. President John F. Kennedy issues an executive order establishing the Peace Corps. The Corps aims to disseminate good will and practical knowledge by enlisting volunteers, most under age 30, to two-year terms of service. President John F. Kennedy orders U.S. Marshals to provide protection for “Freedom Riders” attempting to integrate interstate bus travel. President John F. Kennedy signs legislation raising the minimum wage in stages from its current $1 per hour to $1.25 per hour by September 1963. page 10

In a speech before the Economic Club of New York, President John Kennedy unveils a plan for economic recovery that emphasizes large tax cuts and credits for businesses. One of his liberal economic advisors labels it the most “Republican speech since McKinley.”1 These proposals will become part of the Tax Reduction Act signed into law in 1964.

1964 President John F. Kennedy is assassinated in Dallas, Texas. Vice President Lyndon Baines Johnson is sworn in as president the same day. In President Lyndon Johnson’s first inaugural address, a little over a month after assuming the presidency, he declares war on poverty and outlines an ambitious domestic agenda aimed at reducing unemployment, increasing support for education and job training, and expanding public services for the poor. President Lyndon Johnson signs the Tax Reduction Act lowering income tax rates from a range of 20–91% to 14–70%. Corporate rates are reduced from 52% to 48%. President Lyndon Johnson signs the Economic Opportunity Act, one of the centerpieces of his domestic agenda. In order to combat unemployment and poverty, the act allocates funds for job training, adult education, and loans to small businesses. VISTA, the Job Corps, and Head Start are also administered by the Office of Economic Opportunity.

President Lyndon Johnson signs the Higher Education Act creating the first federally funded college scholarships. The minimum wage is raised in stages from its current $1.25 per hour to $1.60 by February 1968.

1968 President Lyndon Johnson signs the Open Housing Act outlawing discrimination in the sale or rental of most privately-owned homes and apartments. President Lyndon Johnson signs into law a housing act allocating more than $5 billion to meet the housing needs of low-income families. The bill finances the construction or renovation of 1.7 million units and provides subsidies for housing purchases and rentals. Republican candidate Richard Nixon is elected President of the United States. In defeating Democrat Hubert Humphrey, Lyndon Johnson’s vice president, Nixon wins 43.4 % of the popular vote and 302 Electoral College votes. Humphrey receives 42.7% of the popular vote and 191 Electoral College votes. Former Alabama Governor George Wallace receives one Electoral College vote.

1969

President Lyndon Johnson signs the Civil Rights Act of 1964. The act outlaw’s discrimination in public facilities, such as parks, and in public accommodations, such as hotels and restaurants, and it prohibits employment discrimination on the basis of race, ethnicity, religion, or gender. President Lyndon Johnson signs the Urban Mass Transit Act allocating $375 million for the construction of urban transit systems. Hundreds of students at the University of California, Berkeley spontaneously surround a police car as it attempts to remove a political activist for engaging in political advocacy on campus. Roughly 3,000 students will join the 32-hour protest marking the beginning of Berkeley’s Free Speech Movement.

1965 President Lyndon Johnson signs the bill creating Medicare, a national health insurance program for the elderly. Companion legislation creates Medicaid, providing health care for people on welfare. Later, Medicaid April 2019

North Vietnamese and Viet Cong forces launch a massive assault on South Vietnamese towns and American outposts on the Lunar New Year or Tet. American and South Vietnamese forces eventually repel the attack and recapture most territories lost. The Tet Offensive, however, reveals that the communist forces are still strong and, thus, American administration claims that the war is nearing conclusion are discredited. Astronaut Neil Armstrong sets foot on the moon, fulfilling President John Kennedy’s pledge to land a man on the moon by the end of the decade. Woodstock music festival held on a dairy farm in the Catskill Mountains, northwest of New York City, between August 15-18, which attracted an audience of more than 400,000. THE GIFT That Keeps on Giving Maybe better to say the value that endures. That sums up a big part of what OHBA is all about. As you know, our major mission and dedication is to represent the needs and concerns of the industry before state government tribunals. We all are aware of the need to be near the statehouse, lest suffer the consequences. A recent value reminder recently occurred at the Ohio Supreme Court. At issue was a section of state law that imposed a 30-day limit within which a local planning commission must act a properly submitted plat for development. This has long been an area of concern. In a recent case, an Ohio municipality acknowledged the law but argued it does not apply to them; in their opinion they can do as they wish with land development. The affected property owner asked OHBA to provide a supportive brief before the court. We gladly agreed. Unfortunately, the original party for the property owner failed to meet a deadline to submit their brief. Thus, the only party left was OHBA. OHBA Director of Legislative Affairs Kris Klaus Sours appeared and presented compelling testimony for land developers across Ohio. For those who have had the unfortunate luck of being in court, you know the aggravation and great expense. But on your behalf (and many others) OHBA WAS THERE. Also, the Ohio law in play was written and supported by OHBA in the past century, (1985). Working with OHBA Past President Jay Buchert, we argued for and won this key development language clearly stating that a planning commission must approve a submitted plat that is in accordance with local rules. This is the gift that continues to positively influence the ground rules favoring land developer’s property owners in Ohio.

Lift New Homes Sales

ixed housing data over the last two weeks reveal a

market struggling with an ongoing housing affordability challenge. Low unemployment, solid household formations, and accelerating income growth are supporting for-sale and for-rent housing demand. But despite lower mortgage interest rates (currently averaging 4.2% on a 30-year fixed-rate mortgage), high housing prices have held back sales volume growth, especially in the resale market. For example, existing home sales declined 4.9% in March and were 5.4% lower than the number of sales recorded a year ago. For new home construction, single-family builders reported slightly more positive conditions in April, according to the NAHB/Wells Fargo Housing Market Index. However, Census Bureau data indicate that single-family starts for the first quarter of 2019 were 5.3% lower than the year prior, and below what NAHB had forecast. All regions of the United States recorded declines — except the South, which improved by 5%. Additionally, multifamily construction was down 19% at the start of the year, compared to the first quarter of 2018. Running counter to the existing home sales and construction reports, new single-family home sales improved in March, up nearly 5% from the previous month. Inventory fell back to a six-month supply, down from December’s high point of a 7.4-month supply. Sales growth was recorded at the lower end of the market, with 50% of new home sales priced below $300,000, compared to 39% a year ago. Median prices fell from $335,400 in March 2018 to $302,700 in March 2019. The combination of product shift and price incentives, in tandem with lower rates, caused the pace of sales for the month to increase. Although this is promising news, it raises concerns for builders’ future profit margins, given the ongoing growth in construction and regulatory costs.

May 1st: BWC mailing 2019 Notice of Estimated Annual Premium for 2019 Policy Year to employers On or about May 1, 2019, the Ohio BWC will be mailing your Annual Notice of Estimated Premium to you for the upcoming 2019 Policy Year that starts on July 1, 2019 and ends on June 30, 2020. When you receive this Notice, we highly suggest that you review it in detail and confirm if the estimated payroll numbers that the BWC is projecting match what you are projecting for your company.

20% Reduction in BWC Rates for Private Employers Ohio private employers will receive a 20 percent reduction in the average premium rates beginning July 1, 2019. BWC Administrator/CEO Stephanie McCloud said several factors make the reduction possible, including safer workplaces, fewer and less costly workplace injury claims and low medical cost inflation. Claims have fallen 18 percent since 2010 to 85,136 in 2018. “We’re pleased to continue the trend of falling rates with a reduction that will save Ohio private employers more than $200 million next year,” said McCloud. Governor Mike DeWine praised the move to reduce the rates. “Thanks to this substantial rate decrease, Ohio’s private employers will see significant cost-savings that they can reinvest in their products and employees,” said Governor DeWine. “This is a positive step toward helping to ensure that Ohio’s economy continues to thrive.” The 20 percent rate cut represents an average statewide change. The actual total premium paid by individual private employers depends on a number of factors, including the expected future claims costs in their industry, their company’s recent claims history, participation in various BWC rebate programs and assessments collected to fund the operations of the system.

Go Green for 1% rebate with BWC In order to receive your 1% rebate (up to $2,000 annually) from the Ohio BWC by paying your premiums online via the website www.bwc.ohio. gov, your company or organization must now be enrolled to receive all policy notifications from the BWC electronically via email. To enroll, employers must update their electronic notifications on their “My Policy” page of their account at www.bwc.ohio.gov. This must be completed prior to the annual True-Up this August in order for the 1% Go Green Rebate to be received.

Housing Affordability Reducing Housing Share of GDP BY ROBERT DIETZ With the release of the first estimate of first quarter 2019 GDP growth (3.2% growth rate), housing’s share of gross domestic product (GDP) continued a downward trend, more evidence of the lack of housing supply caused and affected by ongoing housing affordability issues. Housing’s share of GDP fell to 14.7%. The home building and remodeling component – residential fixed investment – made a fifth consecutive negative contribution to GDP growth and declined to just under 3.2% of GDP. Housing-related activities contribute to GDP in two basic ways. The first is through residential fixed investment (RFI). RFI is effectively the measure of the home building, multifamily development, and remodeling contributions to GDP. It includes construction of new single-family and multifamily structures, residential remodeling, production of manufactured homes and brokers’ fees. For the first quarter of 2019 RFI was 3.2% of the economy, reaching a $596 billion seasonally adjusted annual pace (measured in inflation adjusted 2012 dollars). The second impact of housing on GDP is the measure of housing services, which includes gross rents (including utilities) paid by renters, and owners’ imputed rent (an estimate of how much it would cost to rent owner-occupied units) and utility payments. The inclusion of owners’ imputed rent is necessary from a national income accounting approach, because without this measure, increases in homeownership would result in declines for GDP. For the first quarter, housing services was 11.5% of the economy or $2.18 trillion on seasonally adjusted annual basis. Taken together, housing’s share of GDP was 14.7% for the quarter. Historically, RFI has averaged roughly 5% of GDP while housing services have averaged between 12% and 13%, for a combined 17% to 18% of GDP. These shares tend to vary over the business cycle.

New Homes Sales Rise in March with Lower Rates BY ROBERT DIETZ Contracts for new, single-family home sales increased almost 5% on a monthly basis to a 692,000 seasonally adjusted annual rate according to estimates from the joint release of HUD and the Census Bureau. The months’ supply number improved to 6.0, which indicates the market is stabilizing after the fall off in sales last Fall due to higher interest rates. The return to the long-run trend for sales and recent declines in mortgage interest rates (now around 4.2%) suggest demand is available when housing affordability conditions improve. For the first quarter of 2019, new home sales are running 1.7% higher than the first quarter of 2018. However, while sales were up 9.6% for the quarter in the South (the largest region), sales were down 5.9% in the West, 8.1% in the Midwest and 17.6% in the Northeast. The March data reveal the challenge of housing affordability, however. March sales grew at lower price points. For example, 50% of March 2019 new home sales were priced under $300,000. In March of 2018, only 39% of sales were priced under $300,000. The median new home sales price in March was estimated to be $302,700. This is down from a year ago when the median was $335,400. After increasing from August to December, new home inventory has stabilized between 340,000 and 350,000 in recent months. This does mark a gain on a year-over-year basis from March 2018 when inventory stood at 297,000. The current months’ supply number has fallen from 7.4 in December 2018 to a more normalized 6.0 in March.

LEGISLATIVE REVIEW

MARCH 28, 2019 REPORT #4 OHBA’S SUPREME EFFORT - THE BUCHERT RULE OHBA’s Director of Legislative Affairs, attorney Kris Klaus Sours, presented compelling testimony in an effort to protect all Ohio builders and developers this week. In Wesolowski vs. Broadview Heights Planning Commission; an issue before the court would have nullified a critical time element and mandate regarding approval of plats. The City argued such limitations do not apply to municipalities and they may do as they wish when reviewing development plats. Current law, Ohio RC 711.05, states plats must be acted on within 30 days. OHBA, working with OHBA Past President Jay Buchert, further amended the statute in the late 80’s to require if a plat is submitted in accordance with existing regulations; the plat must be approved. The current dispute began in the Cleveland suburb where the city failed to meet the statutorily imposed limit to act on a plat. The city objected and took the issue to court. The property owner prevailed at the Common Plea and Appeal court levels. The Supreme Court took the case. Counsel for the property owner missed a filing deadline and their brief was rejected. Prior to the rejection, property owner’s counsel, aware of our interest in such issues and reputation, requested we file an amicus. We agreed and timely filed our brief. As we have done in other cases affecting the industry, we urged the Court to rule for the property owner. Our brief and oral arguments center on the importance of a predictable and reasonable regulatory framework in the law, as stated, which should be upheld. Our petition to appear was approved. Had we not filed an amicus; no other person would be able to provide arguments in this case. Kris gave compelling arguments in the case which can be seen here https://www.ohiochannel.org. OHBA’s main mission is to advocate on behalf of the industry before all levels of state government. We are the only association to do so on a full-time basis for builders, remodelers and land developers. Please note, that no other industry or professional association asserted themselves in this important case. The law in question impacts all land development; whether residential, commercial and industrial. Once again, we responded, as needed.

APRIL 4, 2019 REPORT #5 HOUSE COMMITTEE HOLDS FIRST HEARING ON PROPERTY TAX LEGISLATION The House Economic and Workforce Development Committee held its first hearing on HB 149 Tax Exemption (Merrin, D.), the Affordable Homebuilding and Housing Act. The bill sponsor, Representative Derek Merrin gave very thorough fact-based testimony, laying out for the committee members details on the state of the homebuilding industry in Ohio, and the potential impact HB 149 could have on land development. He addressed numerous questions from the both Republicans and Democrats on the committee, as to how the property tax exemption would work. Rep. Merrin’s testimony is attached. It is likely the Chairman will schedule proponent testimony for HB 149 Wednesday, April 10th at 10:00am. OHBA plans to give testimony in support, and has heard from several members who also plan to offer testimony.

The House Economic and Workforce Development Committee held its second hearing on HB 149 Tax Exemption (Merrin, D.), the Affordable Homebuilding and Housing Act. As a strong proponent of the bill, both OHBA’s Area VP Richard Bancroft, as well as, OHBA Executive Vice President, Vince Squillace, gave detailed testimony on the state of housing in Ohio, and benefits of HB 149. Testifying first, Richard Bancroft, told the committee members the bill is more about fairness and equity to the way that development is taxed, rather than providing a tax break to developers. The current system in which new properties are taxed result in higher prices for developers and homebuyers because land is taxed at a higher value even before construction begins. Any effort that reduces home prices can result in an increase in sales and help more people afford homes. Instead of local governments seeing the bill as a tax revenue loss, they should recognize that it would help spur development and get lots into construction sooner, Mr. Bancroft said. That result, he added, would increase the assessed property values sooner. Vince Squillace further detailed Ohio’s low housing start numbers in recent years, explaining, home development in the state has been lower due to demographic shifts and other factors. As a result, lot development has declined, and is almost non-existent in some places. He went on to say land development is a difficult, lengthy, risky and expensive endeavor. The current tax system further discourages those efforts. Both Richard and Vince responded to several questions ranging from impact on CAUV valuations, to ‘lot flipping’. Also testifying in favor of HB 149 was Dan Acton, government affairs director for the Ohio Real Estate Investors Association, as well as, written testimony submitted by Parkview Homes. All testimony is available on the committee website under April 10. OHBA is waiting to hear from the Chairman’s office on whether the committee will have opponent testimony next week, or wait until after the Spring break. Given the opposing testimony last General Assembly, it could be an entertaining hearing. Feel free to contact OHBA with any questions.
