As you probably know St. Jude Children’s Research Hospital is a pediatric treatment and research facility focused on children’s catastrophic diseases. The hospital cost about two million dollars a day to run and no family ever pays for their child to go to St. Jude. Since St. Jude was established, the survival rate for acute lymphoblastic leukemia (the most common type of childhood cancer) has increased from 4% to 94% today and the overall survival rate for childhood cancers has risen from 20% to 80%. St. Jude’s International Outreach Program transfers knowledge, technology and organizational skills to doctors across the world. Essentially, St. Jude Children’s Research Hospital gives peace of mind to children with cancer by removing, completely, the financial burden from their family so that all a family must focus on is helping their child live. The North Coast BIA is very proud of one of our builder members, Cleveland Custom Homes who has stepped up yet again for a second year to build the St. Jude Dream Home. Many of our associate members have also contributed to this worthy cause: MPW, Cambria, 84 Lumber, Caruso’s Cabinets, Mason Structural Steel, Pella Windows, Sherwin Williams and Wm. Dauch Concrete. Jeff Crawford, President, Cleveland Custom Homes states “they are committed to giving St. Jude Research Hospital at no cost. Every year St. Jude provides funds to build the home, however, we are dedicated to using all our resources and relationships to help eliminate the cost to build so that money can go directly to the cause. We went as far as creating an Advisory Board with people that have reach and influence and identified our goal - - “Net Zero.” This year’s home is a two-story home with a more modern meets classic look. The theme...modern farmhouse style. The floor plan is a wide-open concept with vaulted ceilings in the family room. The stone fireplace extends all the way up to the family room ceiling. There is a nice mix of modern clean lines, wood and metal elements to stay true to our modern farmhouse style. The first-floor master bedroom is spectacular! There are three additional bedrooms and 4.5 baths, bonus room on the second floor and a finished basement. To keep the exterior in-line with their blend of contemporary clean lines and classic farmhouse style there is a nice blend of vertical board, batten siding and stone mixed in for variety. The American Craftsman style entry door and garage doors will accent the home beautifully. There are many other companies that have donated to this worthy cause beside those mentioned above. A good portion of the costs have been covered through these very generous partners, but they still need help. There is a website that St. Jude created specifically for the Cleveland Dream Home. The goal is to raise $100,000 which will fill-in some of the voids as there are still uncovered cost. To date they are at 13% of page 4

We must always remember the ground beneath us is always shifting. Just consider the number of folks already running for a host of political offices more than a year and a half away. Most currently hold an office yet are aiming for another. Same for legislative leadership posts, jockeying already afoot. Whether it is federal or state, the winds are swirling. Even the minority party is looking for demise and failure of the majority party so to present some opportunity for a chance to capture the leadership flag. This all leads to a major case of attention deficit disorder. It is hard to get someone’s attention on complicated issues when the mind is wandering far afield. In the era of term limits, this is now the norm. Not that all are off gazing into the future but many are and trying to position themselves to strike at the best moment. Fortunately for us economic development and job creation is currently high on everyone’s list.

An issue we need to continue to focus on is housing affordability. Many do not recognize the many benefits of a strong residential building industry. For OHBA we believe the issue is best addressed through regulatory reform and sanity. Others believe in raising fees and using the proceeds to make housing affordable without any regulatory reform as the best option. As you can see, even within the housing industry some difference of opinion exists. There is always a lot at stake. The legislature is currently reviewing the state two year budget with issues of vital concern in the mix. 2016 OHBA Year in Review RESIDENTIAL CONSTRUCTION ADVISORY COMMITTEE (RCAC) OPERATING AS INTENDED - After years of effort to establish and educate stakeholders on the role of the RCAC, OHBA continues to make the operation of the RCAC a priority. Throughout the year, OHBA attended meetings, monitored the code review process, encouraged use of code interpretations, and brought builders in to provide their practical insight on the impacts of more stringent codes. CHANGES IN THE CONSUMER SALES PRACTICES ACT (CSPA) WERE SUCCESSFULLY UPHELD - OHBA’ s language creating the Home Construction Services Act, and providing builders with relief from the CSPA survived its first real court challenge. A court partially granted a motion to dismiss the OCSPA claim. The court found the builder had met all the requirements necessary to be exempt from the CSPA and the contract would be governed by the Home Construction Services Act. OHBA’s efforts in the new law were reaffirmed in the court’s opinion finding, “when statutory language is plain and unambiguous, and conveys a clear and definite meaning, we must rely on what the General Assembly has said. The court must give effect to the words used, making neither additions nor deletions from words chosen by the General Assembly... While the OCSPA affects a wide range of business, it specifically excludes “transactions involving a home construction service contract as defined in section 4722.01 of the Revised Code” (as part of the Home Construction Service Suppliers Act, R.C. 4722.01, et seq.).

In the spring, OHBA agreed to file another Amicus in support of action in prohibition and mandamus with the Supreme Court of Ohio. In the original election matter, the Supreme Court ruled in favor of the Relators’, finding the Board of Elections abused its discretion in denying relators protest to referendum petition. The finding prevented the issue from being placed on a November ballot. Continued on page 8

OHBA OFFERED SUPPORT FOR LEGISLATION TO INCLUDE VARIETY OF PIPING OPTIONS - OHBA offered support of legislation to ensure that all suitable piping materials be included in bids for water and wastewater utility service improvement projects. OHBA supported making common sense improvements to ensure Ohioans have access to broad range of products when constructing this crucial infrastructure in the most cost effective manner. LEGISLATIVE LEADERS ASKED FOR OHBA SUPPORT FOR UNEMPLOYMENT COMPENSATION DEBT PAYOFF PROVISIONS - Legislative leaders asked OHBA and other business groups to meet and sign off on changes to be made which included authority for the Kasich Administration to completely pay off the state’s unemployment compensation debt to the federal government estimated to total $225$240 million. SUCCESS IN BOTH OHIO SUPREME COURTAND FEDERAL DISTRICT COURT CASES WHERE OHBA FILED AMICUS BRIEFS Throughout the year, OHBA agreed to file Amicus briefs in multiple cases. First, in federal district court, OHBA filed an amicus brief in the major election case regarding an initiative to rewrite a city’s comprehensive plan and potentially retroactively invalidate permits. The Court issued its opinion finding, as a matter of law, that the developer is entitled to permanent injunctive relief on its due process claim that the Charter Amendment contains an unlawful delegation of legislative power and on its state constitutional. claim that citizens of a municipality may not exercise the power of referendum, by means of a charter amendment, to nullify City Council’s administrative action of approving the development plan. april 2017

MONITORED LEGISLATION Throughout the year, OHBA tracked and monitored numerous other items receiving attention by the legislature. Some of these included HB 12 TIF Creation, HB 149 Attorney’s Fees, SB 235 Property Taxes, SB 333 Environmental protection laws.

Every Thursday morning at 6:30 you will find me opening the office for the Profit-With-Us Chapter of BNI. For those who don’t know what BNI is and does – BNI (Business Network International is a networking organization with approximately 200,000 members in 7,500 local chapters worldwide.

Members meet regularly to discuss business and support each other’s businesses by sharing referrals. It claims to be the world’s leading ‘referral organization.’ The organization says its members generated referrals resulting in over $9.3 billion in closed business worldwide in 2015.

Being involved with BNI has had a big impact on the NCBIA’s membership. We currently have 27 members because of being involved with BNI and many are very active members. If you are or know someone that is interested in growing their business there will be a visitor’s day on Thursday, May 18th at 7:00 a.m. at the NCIBA office.

• Chapters track the monetary amount of passed business in order to prove the value of the financial and time commitment. In 2014, BNI Ohio passed almost 127,000 referrals in the 146 chapters resulting in over $103 million in profits for 3,400 members! When members meet someone who could use your products or services they hand your card out and recommend your services. It’s as simple as that! It’s simple because it’s based on the proven concept of “what goes around, comes around.” If I help you, you’ll help me and we will both benefit as a result. Would you like to increase your business by 20%, 30%, 50% or as much as 100%? You can see results can see results like this!. If you can’t make visitor’s day – join us any visit any of our Thursday morning meetings which start at 7:00 a.m. We are usually done with our meetings by 8:20. The meetings are full of fellowship and a sincere desire to help each other grow their business. There is a nice mixture of professions, but we would like to add several more.

Workers Comp Updates - Mark Down These Dates “The most rewarding things you do in life are often the ones that look like they cannot be done.” ~Arnold Palmer During many years of working in an office environment, we have noticed something that still amazes us; it only takes one person to influence the mood and attitude of everyone else around them, whether positively or negatively. If one person arrives to work in the morning cheerful (presumably, full of coffee!) and with an enthusiastic demeanor, it is so infectious. The same principle applies in risk management, we believe. If the attitude and culture that employees bring with them has a goal toward safety and sensibility, it impacts the whole team. We are here to help give you the inspiration to pass on to your team of employees so that more often than not, their attitudes are constructive and safetyminded. The CareWorksComp seminars taking place later this month will offer you valuable insight into our workers’ compensation system and how you can work along with your TPA to lessen the impact of claims and premium cost. We are also offering the seminar content as a video/webinar option; identical materials will be provided and both will satisfy the BWC’s Two-Hour Group Safety Training requirement for 2016. The seminar schedule is: May 2, 2017: Columbus / May 3, 2017: Cincinnati 2017 Premium Installment Notifications: The BWC will issue 2017 estimated annual premium notices on May 1, and you should receive your updated premium installment schedule at that time. We recommend using that schedule to keep track of your payments all year, as sometimes BWC monthly invoices have different due dates listed and it can be confusing to know which date to use. Please note these upcoming dates and deadlines in May (none for April!):  May 1, 2017 is the date the BWC will send out notices of estimated annual premium for the 2017 policy year.  May 15, 2017 is the last day you can change your premium installment plan for the 2017 policy year.  May 31, 2017 o Drug-Free Safety Program (DFSP) application deadline for a 7/1 start date.

o Application deadline for the Transitional Work Bonus (TWB) for a 7/1 start date. Billion Back Rebate: You may have heard this good news…BWC is proposing to once again return over $1 billion dollars to private and public employers! If the rebate is approved at the end of the month by the BWC Board of Directors, the rebates will begin to be given in July*. Young Adults & the Construction Trades

Reprinted from NAHB...by Rose Quint NAHB conducted a national poll of young adults ages 18 to 25 to find out how this age group feels about a career in the construction trades. The majority of young adults (74%) say they know the field in which they want to have a career. Of these, only 3% are interested in the construction trades.

to take got a follow-up question about the chance they might consider a number of fields (construction trades being one of them) using a scale from 1 to 5, where 1 meant ‘no chance no matter the pay’ and 5 meant ‘very good chance if the pay is high.’ Construction trades got an average rating of 2.1, with 63% of undecided young adults rating it 1 or 2 (no or little chance regardless of pay) and 18% a 4 or 5 (good to very good chance if pay is high).

Most of the young people interested in the trades say the two most important benefits of this career choice are good pay (80%) and the attainment of useful skills (74%). Less than half cite as benefits that the work is seasonal (15%) or that it does not require a college degree (37%).

The 26% of respondents who do not yet know the career path they want

The 63% of undecided young adults who indicated there was no or little chance they would consider a career in the trades no matter the pay were prodded about the reasons for their resoluteness. The two most common reasons are wanting a less physically-demanding job (48%) and the belief that construction work is difficult (32%). They were then asked if there was any compensation level that might entice them to reconsider a career in the trades. For slightly more than 20%, that number is either $75,000 or $100,000, but for the plurality (43%), there is no amount of money that could make them give the trades a second thought.

Claim Residential Energy Tax Credits

How Not to Lose the Trades You Have

It’s never too late to remind your customers about the residential energy tax credits available to both new-home buyers and those who made efficiency improvements to existing homes in 2016. Since most of the tax credits expired at the end of last year, April 18 is the last chance for builders and home owners to claim these valuable incentives on their 2016 taxes.

Finding skilled tradesmen has become increasingly difficult. So the last thing a builder wants to do is anything that might damage relations with the trades they currently do business with. “Consistent, detailed communication is key,” says Scott Paige, vice president of operations for Mattamy Homes’ U.S. Group. “Our trades manage their workflow based on the communication we have with them, and at the end of the day if we aren’t communicating with them on the [same] level of how we communicate with our internal employees, we’re doing [those trades] a huge disservice.” To find areas where it could improve, Mattamy Homes recently created a trades council within each of its seven divisions across the U.S. Each of the councils has as many as seven members representing the various trades whom Mattamy works with on a regular basis. The councils hold monthly meetings to discuss their various projects — what’s going well and what, if anything, Mattamy should improve. Council presidents then share that feedback with their Mattamy representative each quarter.

The good news is that the tax credits for solar energy systems, in both new and existing homes, remain in place through 2021. That means home owners can receive a 30% tax credit for solar water heaters and solar panels through 2019, with the credit decreasing to 26% for tax year 2020, and then dropping to 22% for tax year 2021. Home builders can qualify for tax credits if the homes they built in 2016 meet certain efficiency requirements. Find out the requirements in ENERGY STAR’s Tax Credits for Home Builders. Home owners can learn what qualifies for these expiring tax credits with ENERGY STAR’s helpful guide. NAHB economist David Logan recently took a look at how these tax credits are being used by consumers, using new data released by the IRS. Interestingly, only claims for solar electric, solar water heating and small wind energy property costs increased in 2014. Home owners are using the credits less frequently in other areas of efficiency, such as new windows, insulation and heat pumps. This decrease could be attributed to Congress gradually scaling back the credits beginning at the end of 2010. Learn more about how these tax credits are used in Logan’s Eye on Housing blog post.

“We know there’s always room for improvement, and there’s no better way to find out how than to ask our trades directly,” Paige says. “Sure, we already know about many of the things they tell us, but it shows the trades that we’re listening and want to continually improve. We’ll follow up with them later on to tell them about the changes we’re making, and we think that goes a long way.” Strong two-way communication is just one of the key areas to focus on. Paige also notes a few others to help strengthen ties with trades: • Pay them on time, every time. That one should be obvious. If, for example, you are continually delayed in adjusting purchase orders when changes occur, the time it takes to re-issue a corrected purchase order is costing both parties money. Over time, those little things can add up to real dollars. • Understand your trades’ work capacity. They need to know as early as possible which jobs and how many will be coming up. And you need to know realistically what can be accomplished within a specified time frame. Together, you are creating a mini business plan because each of you depends upon the other to succeed. • Above all, focus on job readiness. Consistently having the jobsite prepped and the materials ready in advance will give your trades the confidence to send their best crews. Having the site ready allows them to do their job more efficiently, and helps to ensure the project — and the others that are currently or soon to be underway — stay on schedule. OSHA Further Delays Silica Rule Enforcement Strong Showings for Starts, Permits and Sales

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) yesterday announced it will further delay the enforcement of the crystalline silica standard that applies to the construction industry.

Tight inventory of existing homes and solid job creation are sustaining growth for home building. New single-family starts increased in February to the fastest annual pace since fall 2007. Permits were also up in February, registering the highest rate in almost 10 years. While unseasonably warm weather accelerated construction activity in some regions, underlying demand conditions remain strong. Thus far in 2017, rising interest rates have had little impact on the new homes market. In February, new home sales were up 6.1% from the prior month, and 12.8% above the pace set a year earlier. Inventory is also on the rise, increasing to approximately 266,000 as of February. As is typical during periods of tight inventory, the largest increase in new home inventory has been in the not-yet-started category of homes listed for sale. –NAHB Chief Economist Robert Dietz

House Approves NAHB-Supported Association Health Plan Bill

The House approved the Small Business Health Fairness Act (H.R. 1101), association health plan legislation that would put small businesses on an equal footing with large employers and unions when it comes to negotiating lower insurance costs.

passage of this bill as a “key vote” due to its importance to the housing industry. The letter stated that association health plans would grant small businesses access to better and more affordable health care plans. By providing the ability to create pooling arrangements across state lines, the bill would ensure a level playing field for smaller firms that want to help their workers and their families with their health care needs.

NAHB has been a long-time proponent of association health plans and continues to work with Congress to ensure that this market-based health care option remains a viable alternative for small businesses and their employees. Of note to the home building community, the bill includes an amendment which clarifies that small businesses that have already established and administer association health plans, including some HBAs, can continue to operate under existing state and federal law.

With passage of the Small Business Health Fairness Act, the House could vote as early as tomorrow on the American Health Care Act, a comprehensive bill that would repeal and replace much of the Affordable Care Act, also commonly referred to as Obamacare.
