Two Courts issued decisions striking down the IEEPA-based tariffs imposed by President Trump; Entry Deadline for Exclusion from Reciprocal Tariffs
Extended; USTR Extends Section 301 Exclusions
In late May, two courts issued pivotal rulings on the legality of tariffs imposed by President Trump under the International Emergency Economic Powers Act (IEEPA), shaping the ongoing discussion on executive authority in trade policy These decisions present contrasting interpretations of presidential power under IEEPA, with significant implications for industries affected by these tariffs. Businesses should closely monitor how these rulings may influence future enforcement and regulatory actions.
Additionally, CBP has extended the entry deadline for exclusions on reciprocal tariffs for goods in transit at the time of imposition, and the USTR has prolonged the remaining exclusions from the Section 301 China tariffs that were set to expire on May 31. Further, President Trump announced the Section 232 tariffs on steel and aluminum will double to 50% effective June 4

Section 232 Tariffs on Steel and Aluminum and their Derivatives Double to 50% Effective June 4; Carveout for UK Imports
As detailed in the below memorandum, on June 3, 2025, President Trump issued the Proclamation titled “Adjusting Imports of Aluminum and Steel into the United States.” The Proclamation increases the ad valorem tariffs on imported steel articles, aluminum articles, and all their derivatives, from a previously set rate of 25% to 50%, for all countries. This heightened tariff rate applies to all goods entered for consumption or withdrawn from a warehouse for consumption on or after 12:01 a.m. EDT on June 4, 2025, with no exemption for in-transit merchandise. However, it is important to note that United Kingdom–origin goods will remain subject to the 25% tariff at least until July 9, 2025
