General Information The Complete Dispersal of the Glenmore Organic Dairy Herd Location: On Farm at An Grianan Estate, Inch Level, Speenoge, Burt Co Donegal F93DP6X. Directions: From Londonderry follow the A515 after the Foyle Bridge and continue to the N13. The sale will be on your right. Travelling from the west follow the signs to Letterkenny and follow the N13 the sale will be on your left approximately (40km from Letterkenny). From the south east follow the signs for Omagh and Strabane and join the N13 and the sale will be on your left. For Sat Nav systems please use F93DP6X. The sale will be signposted. Method and Order of Sale: All animals will be sold in Euro (₏) and a 1% buyers commission will be added to the Hammer price on each individual lot. The animals will be sold strictly in catalogue order unless any alteration is authorised and announced by the Auctioneer. Registration: ALL BUYERS MUST REGISTER AND HAVE A BIDDERS NUMBER. Please register at the Sale Office prior to the commencement of the auction. Need to be registered before sale day as it will not be practical on morning of sales as all details will have to be logged into the system and VAT numbers checked Conditions of Sale: Conditions of Sale and Special Conditions of Sale are printed on pages 26 & 27. Settlement and Clearance of Stock: Settlement in full is due to the Auctioneers immediately at the conclusion of the Sale. No animal may leave the Sale Premises without an official PASS, obtainable only from the Auctioneers upon settlement and all stock should be cleared from the sale premises on the day of sale. Terms: Cash, Debit/VISA Card or Advised Cheque to Ulster Bank, Main Street, Ballybofey, Co. Donegal. See PSRA details re cash and money laundering separate documents’ Commissions: The Auctioneers will faithfully execute commissions to purchase on behalf of buyers unable to attend the sale in person, upon receipt of written notice and instructions received in their office not later than 48 hours before commencement of sale. Given the same notice telephone bids can be accommodated. Viewing & Inspection: All animals are available for inspection on the day of sale, however if you wish to view any of the stock prior to sale day, then please contact any of the Key Contacts on page 2, as viewing is strictly by appointment only. Health Status: All Animals are tested for direct export following the sale. The herd is vaccinated for IBR, BVD, Lepto and Rota Virus. All of the youngstock are treated with Huskvac. There has never been a case of TB within this herd and the last TB test was in January 2020. Milk Recording: The milk yields have been taken direct from the on-farm computer and the cell counts were sampled on the 17th January 2020.

Special Conditions of Sale
1. Each Purchaser shall be deemed to have inspected and to be thoroughly acquainted with the contents and conditions of the Lot or Lots purchased by them, and to have purchased same subject to all faults, deficiencies whatsoever shall be made in respect of any such faults, imperfection or error. Each lot is sold on the basis of ‘as is, where is, how is’. 2. The Description, Service Dates, Service Sires and Scanning information set out in the catalogue, are believed to be correct, but no guarantee or warranty is given or is to be implied as to the correctness of such descriptions dates & information or the genuineness or authenticity of any lot or its fitness for any particular purpose. 3. FROM THE FALL OF THE HAMMER EACH LOT SHALL BE THE SOLE RISK OF THE PURCAHSER (SUBJECT TO FULL PAYMENT), and must be cleared and removed without fail, at the Purchaser’s expense, in such order as the Auctioneer or their representatives shall direct NOT LATER THAN 5pm on Wednesday 12th February, after which time any Lot, or Lots remaining on the premises will be liable for rent, rates, taxes, personal wages and expenses, and will be liable to be removed from the premises and left outside at the Purchasers risk in all respect. 4. The Auctioneer reserve the right to alter, divide, group or withdraw any Lot or Lots either before or at any time during the sale, or give options on any Lot or Lots at any time during the Sale. 5. If any damage be done to the buildings or any other lot or removal of any such Lot, such damage shall be made good by, or at the expense of the person or persons committing such damage or his or their employer. 6. NO LIABILITY WILL BE ACCEPTED BY THE VENDOR OR THE AUCTIONEER FOR PERSONAL INJURIES OF ANY DESCRIPTION AND FROM WHATSOEVER CAUSE ARISING FROM OR SUSTAINED BY ANY PERSON WHILST ON THE PROPERTY OF THE VENDOR FOR THE PURPOSE OF INSPECTION, OR DURING THE SALE, OR WHILST REMOVING ITEMS FOLLOWING THE SALE, OR ON THE PREMISES OF THE AUCTIONEER IN CONNECTION WITH THE SALE. 7. Each Purchaser shall be responsible for and will release and indemnify the Vendor, their servants and agents from and against all liability for (a) personal injury (a) (whether fatal or otherwise) (b) loss or damage to property and (c) any other loss, damage, costs and expenses however caused or incurred (except when proved to have been caused solely by the negligence of the Vendor or their servants or agents) 8. Each Purchaser shall provide all vehicles, equipment and labour necessary for the removal of Lots purchased by him. 9. Neither the Vendor nor the Auctioneer will hold themselves responsible of any Lots while on the premises. NO LOTS SHALL BE DELIVERED OUTSIDE THE DATES AND HOURS SET OUT HEREUNDER, NOR WILL THE AUCTIONEER TRANSFER LOTS FROM ONE BUYER TO ANOTHER. 10. IF ANY DISPUTE OR DIFFERENCE ARISES IN RELATION TO ANY LOT OR THE INTERPRETATION OF THESE CONDITIONS, THE SAME SHALL BE SETTLED BY THE AUCTIONEER AND THEIR DECISION SHALL BE FINAL AND BINDING ON ALL PARTIES CONCERNED.
AUCTIONEER’S TERMS & CONDITIONS OF SALE

(Incorporating the Auctioneer’s Terms and Conditions)
1.
The biddings to be regulated by the Auctioneers and the highest bidder subject to the Vendor’s reserve (if any) to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders the Lot in dispute to be put up again and resold or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.

The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.

Purchasers paying by cheque must be prepared if required to produce a banker’s reference. As a result of the Criminal Justice Act 2010 (Money Laundering and Terrorist Funding) the auctioneers are unable to accept cash payments in excess of €500.00 for any any single or linked purchase transaction.
4.
All statements in the catalogue or made by the Auctioneers at the time of sale also the correct identification of the animals are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.
5.
All statements in the catalogue or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.
6.
All stock is sold subject to the Conditions of Sale recommended for use at markets by the Property Services (Regulation) Act 2011 except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock when the latter Conditions shall prevail.
7.
Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property through fire or any other cause whatsoever nor for any damage by animals prior to during or after the sale.
8.
No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.
9.
Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.
10.
If these conditions are unfulfilled the Vendors or Auctioneers shall have the power to resell the Lots retaining any surplus and charging any deficiency and expense to the defaulter.
11.

We and other members of the group may contact you by telephone e-mail post or fax to inform you of products or services available.
