General Information CONDITIONS OF SALE: The sale is held subject to the NBA terms and conditions for use in Private Sales of Pedigree Cattle (copy at the end of the catalogue) in conjunction with the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Association for England and Wales both of which are available. In the event of any discrepancy between the two sets of conditions, the NBA conditions prevail. Both parties (vendor & purchaser) will be subject to a NBA charge of £3 per lot sold for the use of the NBA rules INSURANCE: We recommend that all purchasers and vendors take Insurance to cover their respective risk. Payment will be due in full at the final bid in respect of the lot sold plus all associated costs, buyers premium, Including VAT (value added tax) if applicable. Lincoln Red: There will be a minimum selling price of 1800gns for Bulls, 1000gns for In-Calf Heifers and 750gns for Maiden Heifers SOCIETY LEVY CHARGED TO THE VENDOR: British Blue There will be a minimum selling price of 1800gns on each bull presented for sale. Lincoln Red: There will be a minimum selling price of 1800gns for Bulls, SOCIETY SALE LEVY: BRITISH BLUE: The British Blue Cattle Society’s Sale levy, amounting to 1% of sale price, will be deducted by the Auctioneers from the proceeds of sale. LINCOLN RED: A levy of 2% will be charged to the vendor and paid to the Lincoln Red Cattle Society. SALERS: A levy of 2% will be charged to the vendor and paid to the Salers Cattle Society. REGISTRATIONS: All stock in the Sale are registered with the relevant Breed Society. PEDIGREE TRANSFERS: BRITISH BLUE: Official Pedigree Transfer will be effected by the Auctioneers and the British Blue Cattle Society as soon as possible after the Sale. Full Pedigrees will be transferred at a fee of £13.90 (plus VAT) payable by the vendor. HEREFORD: A fee of £24+VAT per lot will be charged to the vendor. LINCOLN RED: A fee of £10 + VAT per lot will be charged to the purchaser. SALERS: All pedigree animals are eligible for transfer at the purchasers cost. SETTLEMENT OF STOCK: The Purchaser must be registered with H&H Ltd prior to bidding (preregistered) and pay for all Lot(s) purchased immediately at the close of sale. No Lot or Lots shall be moved from the vendors holding until payment has been received. The liability will remain with the vendor until the purchaser receives the lot(s), at this point title of the goods will be transferred to them.

Scanning is not accepted as proof of diagnosis less than 12 weeks. 15. Arbitration Any disputes, other than those determined by the Veterinary Surgeon in accordance with Clause 12 hereof, between Vendor and Purchaser shall be referred in accordance with the provisions of the Arbitration Act 1996 and all statutory modifications or re-enactments thereof for the time being in force to a single arbitrator to be appointed by agreement between Vendor and Purchaser or in default of agreement by the President for the time being of the Central Association of Agricultural Valuers. In the case of veterinary disputes the President of the BVA or in the case of an expenses dispute by the President of the CAAV or IAAS or arbitrator nominated by them. 16. Notices Any notice required to be served on any person shall be deemed to have been duly served if left at or sent by prepaid first-class post to that person at his last known abode or principal place of business and shall if sent by post to that person at his last known abode or principal place of business be deemed to have been received on the fourth day after the date on which it was sent. 17. Guidelines for the Standards of Good Husbandry and Management In respect of bulls purchased at Sales Taking care to settle a newly purchased bull properly will assist in ensuring that you have many years of good service from him. Under the National Beef Association’s Terms and Conditions of Sale the Purchaser is required to maintain the animal in normal breeding condition, in accordance with the rules and practice of Good Animal Husbandry and Management, as referred to in clauses 6.2 and 8.1.4 and 10.1.4.2. Following Purchase, the National Beef Association would require a purchaser to adhere to the following points to fulfil the requirement of Good Husbandry and Management: 1)
The bull is not used within two weeks of the date of purchase/arrival at Purchaser’s premises whichever is the latter.
2)
The Purchaser should ensure that the bull is in normal breeding condition before use.
3)
In consultation with the Vendor, the Purchaser should maintain the bull on its current diet and only introduce any new feed gradually.
4)
When the bull is first used, try it with 1 or 2 smaller females first, in a yard on a non-slip surface, so he is introduced to service gradually and safely. Observe him closely to ensure that he is serving the female properly.
5)
Once the Purchaser is satisfied that these females are not returning then he should put the bull out with more females. 20 to 25 females should be a maximum in the first year.
These are guidelines only. Purchasers should be aware that should they choose not to follow them they might invalidate the Breeding Warranty Terms. In addition, you may refer to the relevant Breed Society’s guidelines

No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur. 11. The sale is held subject to the NBA terms and conditions for use in Private Sales of Pedigree Cattle (copy attached) in conjunction with the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Association for England and Wales both of which are available. In the event of any discrepancy between the two sets of conditions, the NBA conditions prevail except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock when the latter Conditions shall prevail. Both parties (vendor & purchaser) will be subject to a NBA charge of £3 per lot sold for the use of the NBA rules 12. No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions. 13. In as much as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or vendors and the remedy shall be against them only and not against the Auctioneers.
