London Membership Terms & Conditions
1. INTRODUCTION
NEXUS Club London is the trading name of The NEXUS Club London Ltd, company number 14982367, whose registered office is at 38-42 Harrington Road, London, England, SW7 3ND (‘NEXUS Club London’).
By submitting this application form to join the NEXUS Global Membership, issued by The NEXUS Luxury Collection Management Company Ltd and its various subsidiaries and affiliated companies (“NEXUS”), to you, as the applicant (“Member”), you confirm your acceptance of these terms and conditions for NEXUS Club London (the “Terms”). You also agree to abide by the rules of NEXUS Club London when you are on the premises or at NEXUS Club London affiliated events. A copy of the rules is available on request and on premises.
Your membership to NEXUS Club London is also governed by the accompanying terms and conditions of the Global Membership Agreement terms and conditions (“Global Terms”).
These Terms set out the basis of your membership and how you may use NEXUS Club London, 38- 42 Harrington Road, London, SW7 3ND (the ‘Premises’).
By submitting this application form to join NEXUS Club London, you confirm that you are at least 18 years old and that you have the legal capacity to enter into legally binding contracts under applicable law. If you are entering into this membership on behalf of a company, you are properly authorised to bind the company to the Terms.
These Terms apply to guests of members and any non-members who use the spaces available at the Premises. These Terms also apply to all members, regardless of membership type.
2. MEMBERSHIP COMMENCEMENT
Upon submitting this online application form for membership, you will be deemed to accept these Terms. Acceptance of you as a Member is governed by the Global Terms.
3. MEMBERSHIP STATUS & ACCESS
Your membership allows you to use the Premises in accordance with these Terms and the rights of your membership, as varied from time to time, in accordance with these Terms.
You can access and use the Premises at the times specified by your membership tier or otherwise in writing by NEXUS Club London. If you do not adhere to your specified access time, we reserve the right to change, suspend, or terminate your membership
You cannot use the Premises if your membership expires, is suspended or terminated.
In order to gain entry to the Premises, you must present your credentials at the reception desk.
4. PAYMENT METHODS
You agree to add your credit card details to your member portal/app (or other payment service as directed by NEXUS) from the day your membership commences. These will be held on account and be charged for any in-house expenses related to food and beverage.
You agree to set-up a direct debit mandate as default payment for any other fees that are not related to food and beverage.
Either payment method will be used by NEXUS Club London, in absence or failure of the other one.
5. CONDUCT
NEXUS Club London will issue separate Club Rules to apply to all users of the Premises (including guests of members), which will deal with day-to-day issues such as conduct at the Premises (“Club Rules”). All members and users of the Premises (including guests of members) must comply with the Club Rules.
6. TERMINATION OF MEMBERSHIP
In addition to the right to terminate provided to NEXUS in the Global Terms, NEXUS Club London has the right to terminate your membership immediately if:
you provide NEXUS Club London with details which you know to be false when applying for membership, and the false declaration would have reasonably affected our decision to grant you membership;
• you become insolvent, bankrupt, go into liquidation, or become unable to pay your debts as they fall due; or
• you are in breach of these Terms, and, if such breach is capable of remedy, you fail to remedy such failure to the reasonable satisfaction of NEXUS Club London, within 5 days after being notified of such breach.
Upon termination of membership, members should remove all personal property from the Premises and vacate respectfully.
NEXUS Club London will not be held responsible for any personal property left at the Premises after termination, and any such property may be disposed by NEXUS Club London, without prior notice.
7. TECHNOLOGY & SUPPORT
Wireless internet connection is provided for the benefit of members and their guests and should be used in accordance with all United Kingdom laws, statutes and regulations. Use of the internet connection must not therefore violate any law, be defamatory, offensive, abusive, indecent, obscene, be harmful in anyway, promote or encourage any unacceptable or illegal behaviour, have any fraudulent purpose or effect, result in any misrepresentation, or damage the integrity, reputation, brand or name of NEXUS Club London in any way. Any passwords required for the use of the internet connection must not be divulged to any other party.
Access to NEXUS Club London online members’ portal is offered free of charge to all members. The portal is used to help the Club manage your membership and allow you to order and pay through our third-party payment provider, Nexudus Space (subject to their terms and conditions and privacy policy, which is available on their website www.nexudus.com), for your membership and other chargeable services and facilities which
we make available to you. Your use of the portal will be subject to your acceptance of the portal’s privacy policy, which you will be deemed to accept when using the portal for the first time and then each time there is a change in the policy. NEXUS Club London reserves the right to change its third-party payment provider at any time, and without your consent.
8. SECURITY
NEXUS Club London operates CCTV cameras for the security of its members and all those who use the Club. You agree that your activities may be monitored within reason and any illegal act recorded may be passed to the police or relevant authorities.
Members are responsible for their possessions at all times. NEXUS Club London’s insurance does not cover loss, damage or theft of members’ possessions.
Any lost and found items will be stored in the club for 30 days, after this time items will be disposed.
Members who leave possessions unattended at any time on the premises do so at their own risk. NEXUS Club London accepts no responsibility or liability for loss or damage to your property at the Premises.
9. ACCESS & MAINTENANCE
NEXUS Club London and its team shall, at all times, have access to all areas of NEXUS Club London, including those being used by members, with or without notice, including but not limited to, for the purposes of maintenance, safety, security.
NEXUS Club London reserves the right to close certain areas of the Premises and will do its best to keep any disruption to a minimum.
10. HEALTH AND SAFETY
NEXUS Club London will endeavour to ensure the wellbeing and safety of all those within the Premises. Members should not do anything that compromises their own safety or that of others whilst in the Premises.
11. LIABILITY
You are liable for any damage caused by you or any of your guests in relation to anything inside the Premises or to the Premises, and you may be asked to repay any costs incurred by NEXUS Club London in rectifying any damage caused.
In no circumstances will NEXUS Club London be liable (whether in contract, tort, negligence, breach of statutory duty or otherwise) to any members or guests for any loss, damage or theft to their property, however caused.
NEXUS Club London’s total liability to a member (whether individual or company, as applicable) or any guest whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection to these Terms shall not exceed the charges and membership fees paid by such member (or in respect of guests of members, the fees paid by the member who has brought in the guest) in the 12 month prior to the first event or occurrence giving rise to liability.
Nothing in these Terms is intended to affect any mandatory rights a member or guest may have under
applicable law that NEXUS Club London cannot legally restrict or exclude (including, for the avoidance of doubt, in respect of death or personal injury to a member or guest caused by the negligence of NEXUS Club London, its employees or agents).
To the fullest extent permitted by law, the terms implied by sections 3 to 5 of the Supply of Goods and Services Act 1982 are excluded for these Terms.
12. COMMUNICATION AND PRIVACY
When you apply for membership and throughout the time you are a member with us, you will provide us with certain personal information about yourself, including a profile photograph, in our membership database. Whether you apply online or use our portal and supply personal information to us through that portal we will use that personal information in accordance with our privacy policy which can be found on the portal. We collect and use your personal information in accordance with our privacy policy described in Annex 1 of these membership terms. By applying for membership with us and providing your personal information in connection with the same, you are consenting to us collecting and using your personal information, in accordance with our privacy policy.
We may use the personal information you provide about you and your guests in accordance with our privacy policy. NEXUS Club London or NEXUS Luxury Collection may contact you to provide notice of any changes to services, fees or other updates by email to the address provided by you, and you agree that such notice transmitted is proper.
You agree to notify NEXUS Club London of any change to your contact information (including but not limited to your telephone and e-mail address).
If you contact any other member who has not consented to such contact, including any spamming, your membership may immediately be terminated by NEXUS Club London.
13. NEXUS CLUB LONDON TRADEMARK RIGHTS
All members and their guests shall not use the names, logos, colours, trademarks, service marks, photographs, trade dress, or other identifying features of NEXUS Club London or its affiliates, in the course of trade without obtaining the specific prior written approval.
14. AMENDMENTS
These Terms may be amended from time to time by NEXUS Club London. Members who do not wish to accept such amendments may terminate their membership, with effect from their next annual renewal date, in accordance with the termination procedure set out in these Terms.
15. FORCE MAJEURE
Neither party shall be in breach of these Terms or liable for delay in performing, or failure to perform, any of its obligations under these Terms (with the exception of any obligations on a member’s part to pay any sum due under these Terms) if such delay or failure results from events, circumstances or causes beyond its reasonable control. In such circumstances, the affected party shall be entitled to a reasonable extension of the time for performing such obligations, provided that the affected party shall use its reasonable endeavours to resume normal performance.
16. SEVERANCE
If any provision of these Terms (or part of any provision) shall be found by any court or competent authority to be invalid or unenforceable, that provision or part provision shall, to the extent required, be deemed to be deleted and the validity and enforceability of the other provisions of these Terms shall not be affected.
17. ASSIGNMENT
NEXUS Club London may at times assign, transfer, charge, subcontract, delegate, or deal in any other manner with any or all of its rights and obligations under these Terms.
Members are not permitted to assign, transfer, charge, subcontract, delegate, or deal in any other manner with any or all of its rights and obligations under these Terms.
18. GOVERNING LAW
These Terms are governed by and interpreted under English law.
Club Rules
CLUB CULTURE
At NEXUS Club London, we believe everyone should be treated with respect, and ask that all members and guests abide by that philosophy.
We also respect the privacy of others. At no time are members or guests permitted to photograph or film others without their permission, and no autographs may be requested of anyone not in your immediate party.
ACCESS TO THE PREMISES
All members and guests are asked to respect our nearby residents by being quiet when entering or leaving the Premises.
NEXUS Club London will retain control, possession, and management of all parts of the Premises and members have no right to exclude any of our staff from any part of the Premises at any time or for any reason whatsoever.
NEXUS Club London reserves the right to require members or guests to relocate to another area of the Premises at our absolute discretion.
WORKING CONDUCT
Whilst in the Premises, members may not:
• Reserve tables and chairs in the common areas (e.g., by leaving papers, and personal belongings on them).
• Leave any items on the tables and chairs, in the common areas unattended for more than 20 minutes. Such items may be removed by a member of staff and stored at reception for collection; Dedicated lockers can be purchased on a monthly basis, subject to availability.
Leave personal items in places that might be inconvenient for others. Members may not use the Premises as their registered office address.
• Use the Premises as the business address of the member or direct mail to the Premises.
• Use our staff to collect members’ mail, messages or take members’ calls.
Laptops may be used in The Harrington and on The Terrace until 16.00, and in The Lounge until 21:00. Use of laptops and phones are not permitted in Ronnie’s Bar.
Members may take phone or video calls in The Lounge only, providing such calls do not reasonably disturb other members. Texting is permitted however phones should be in silent mode throughout the rest of the Club. Please be respectful of others in the Club when using your phone.
Members are responsible for ensuring that their guests adhere to our phone policy.
Members may not take pictures of other members without their consent. Members may not use cameras or recording devices (whether on a mobile phone or other medium) at the Premises for any commercial purposes (whether for press, blogs, or otherwise) without the consent of NEXUS Club London.
PROHIBITED ACTIVITIES
Neither members nor guests may use NEXUS Club London, or any service offered to conduct or pursue any activities prohibited by law or for which members or guests are not authorised (including the downloading of music, software, movies or any other activity that violates intellectual property laws). Members and guests agree not to conduct any activity that is generally regarded as offensive to other people, such as involvement in hate groups and/or their ideologies, activities involving pornographic or sexually explicit material, whether written, oral or in any form or medium known to be created. No harassment, sexual or otherwise will be permitted in NEXUS Club London. Any such harassment will be immediately reported to the General Manager of NEXUS Club London. If the General Manager or any other senior NEXUS Club London personnel find that a complaint is justified following an investigation, the offending party’s membership may be immediately terminated in NEXUS Club London’s absolute discretion, without any refund of membership fees.
Members agree not to conduct any activity that may be hazardous to other people in the Premises and agree to refrain from any activities that may be disruptive, including, but not limited to, acts of disorderly nature or excessive noise.
DRESS CODE
NEXUS Club London’s dress code is relaxed. Members are required to dress appropriately and respectfully for the area of the Club and the time of day. Members are responsible for informing their guests of the dress code.
FOOD AND BEVERAGE
Members may not bring any outside food or beverage into the Premises, unless medically necessary. For any special accommodation, please inform the General Manager or manager on duty.
USE OF EQUIPMENT & FACILITIES
Use of any of the gym or fitness equipment, areas or facilities available at the Premises is entirely at the risk of a member. Guests of members are not allowed to access the gym. Members agree to the rules and policies outlined in the gym waiver provided by NEXUS Club London and can attend the induction sessions available at the gym which explain how to safely and properly use the gym and fitness equipment available.
NEXUS Club London does not accept any liability for any loss or injury that members may cause to themselves, other persons or to the equipment or facilities to the extent that it is as a result of such member’s unsafe or improper use of the equipment or facilities (including use whilst under the influence of alcohol or medication) or a member’s failure to advise staff of a medical condition relevant to such member’s use of the equipment or facilities.
Members may utilize the services of NEXUS Club London personal trainers and are responsible for any charges associated with the services. No outside personal trainers are permitted.
Members and their guests agree to observe the rules and any signs published or displayed at the Premises at all times, and to take reasonable precautions when using the facilities at the Premises.
If a member or guest of a member has an accident or suffers any injury whilst at the Premises, please report this as soon as possible to a member of staff, no later than 24 hours after the incident.

Personal training bookings can be made at reception or via the NEXUS Club London online member portal or mobile app. By placing a booking, members agree to pay any fees notified to the member at the time of the booking.
2. Members must pay any fees notified to them at the time of the booking, and will be charged unless: at least 24 hours’ notice is given.
ACCESS TO TREATMENTS
1. Members may access the treatment room only with a member of staff.
2. Members must complete a health questionnaire prior to treatment.
3. Subject to availability, members may book treatments at the Premises. Treatment bookings can be made at reception or via the NEXUS Club London online member portal or mobile app. By placing a booking, members agree to pay any fees notified to the member at the time of the booking.
4. Members must pay any fees notified to them at the time of the booking, and will be charged unless at least 24 hours’ notice is given.
5. Members may utilize the services of NEXUS Club London therapists and are responsible for any charges associated with the services.
6. No guests of members are permitted to use the treatment room.
GAMING LOUNGE RULES
1. We ask members and their children to respect others and not occupy one piece of equipment for more than 2hrs.
2. No food is permitted in the gaming lounge.
3. Children of 0-7 years old are not permitted in The Gaming Lounge.
4. Children of 8-13 years old must accompanied by an adult at all times when using The Gaming Lounge.
5. The E-Gaming Lounge may be booked and used independently by junior members ages 14+.
SPORTS SIMULATORS RULES
1. Subject to availability, members may book the sports simulators at the Premises. Simulator bookings can be made at reception or via the NEXUS Club London online member portal or mobile app. By placing a booking, members agree to pay any fees notified to the member at the time of the booking.
2. Should members want to extend the period of hire, they may do so by seeking permission at -reception.
3. If members use the simulator without making a prior booking, they may be asked to vacate the simulator if there are confirmed reservations. Additionally, if simulator usage fees apply based on your membership tier, members agree to be charged for any time spent using the simulator without a reservation.
4. Members will be charged a cancelation fee of £25 unless at least 24 hours’ notice is given.
5. Members can order food and drink from the available menu.
6. Children of 0-7 years old are not permitted in The Sports Simulators.

9. For adults, members must not exceed the capacity limit of 4 per simulator.
10.For children, members must not exceed the capacity limit of 3 per simulator.
SMOKING POLICY
We ask that members respect other members and guests. Smoking and vaping are strictly prohibited anywhere within the Club except on the designated outside area of The Terrace. We ask members to be considerate of other members when smoking on the terrace.
GUESTS AT NEXUS CLUB LONDON
Adult members are permitted to invite up to 5 guests at any one time. One same guest can visit an unlimited number of times.
Junior members (8-17) are permitted to invite one junior guest at a time. One same junior guest can only visit the club up to four times a year.
There are no fees levied for guest access throughout the year except for special events. The General Manager reserves the right to make exceptions on a case-by-case basis. At no time may any guest use the gym facilities or treatment facilities.
The Club may restrict guest access during special Club events. The Club reserves the right to change these guest policies. All guests must be registered via the app prior to their arrival.
Guests must always be accompanied by the inviting member.
All guests must be signed in upon arrival at the members’ reception at the Premises.
NEXUS Club London requires the contact information of all its members and guests while they are at the Premises. A list of all members and such guests shall be maintained at reception and NEXUS Club London will be free to allow any regulator, public authority or law enforcement party to inspect this list, upon reasonable request.
Members are responsible for receiving their guests from reception unless a meeting room has been booked, in which case a team member of NEXUS Club London shall direct the guest to the meeting room. You must be with your guests at all times while they are in the Premises and you cannot leave your guests in the Premises after you depart.
GUEST FEES
There shall be no guest fees for general access. From time to time guests may be required to pay an entrance fee for special events.
DOG POLICY
Dogs are not permitted in NEXUS Club London, with the exception of certified assistance dogs.
CHILDREN
Members are responsible for their children when they are using the Facilities.
Members are entirely responsible for their children’s behaviour and any damage caused by them whilst on the Premises.
Junior members ages 14+ may check into NEXUS Club London on their own from 16:00 on weekdays and anytime on weekends.
Junior members ages 8–13 must be accompanied by an adult into NEXUS Club London unless attending a supervised class or workshop.
Junior members ages 0 -7 must be accompanied by an adult into NEXUS Club London and are only permitted in The Lounge.
The Lounge
The Lounge is open for junior member ages 14+ to enjoy on their own from 16:00 on weekdays and anytime on weekends.
The Harrington
The Harrington is open for junior members ages 14+ to enjoy if they enter and are accompanied by an adult or a parent.
Ronnie’s Bar
Ronnie’s Bar & The Terrace is strictly for ages 18+ only.
The Gym
The Gym is open to junior members ages 14+. They may book and access the supervised Teen Gym sessions after completing the required Gym Orientation and Evaluation.
BILLS
Members must settle all bills in full before leaving the Premises. Members are responsible for any unpaid bills of guests. If any bills are not settled promptly the membership of such member may be suspended.
DISCIPLINARY ACTION
Violation of applicable rules of conduct may result in NEXUS Club London reporting such conduct to appropriate law-enforcement agencies.
Every member agrees to abide by the rules, by laws and regulations of NEXUS Club London at all times upon acceptance as a member. If NEXUS Club London considers that any member’s (or member’s guests) conduct either inside or outside of the Premises is, at its absolute discretion, contrary to the interests and ethos of NEXUS Club London, NEXUS Club London may expel the member from the Premises and/or suspend or terminate their membership without having to give any reason.
LIABILITY OF NEXUS CLUB LONDON
NEXUS Club London accepts no responsibility or liability for loss or damage to property of members or guests at the Premises.
Any lost and found items will be stored in the club for 30 days, after this time items will be disposed.
NEXUS Club London’s total liability to a member (whether individual or company, as applicable) or any guest of a member whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with a member or guest’s use of NEXUS Club London shall not exceed the charges and membership fees paid by such member (or in respect of guests of members, the fees paid by the member who has brought in the guest) under the Terms in the 12 months prior to the first event or occurrence giving rise to liability. This is not intended to affect any mandatory rights that a member or guest may have under local law that NEXUS Club London cannot legally restrict or exclude (including, for the avoidance of doubt, in respect of death or personal injury to a member or guest caused by the negligence of NEXUS Club London, its employees or agents).
These Club Rules shall be governed and construed in accordance with English law and each member and guest agrees to submit to the exclusive jurisdiction of the courts of England.
AMENDMENTS TO THE CLUB RULES
NEXUS Club London may change these rules, at its sole discretion, at any given time. The Club Rules, if and as amended from time to time, will be published in the member portal on nexusclublondon.com.
MEETING ROOMS
Subject to availability, members may book the private meeting room at the Premises. Meeting room bookings can be made at reception or via the NEXUS Club London online member portal or mobile app. By placing a booking, members agree to pay any fees notified to the member at the time of the booking.
Room-hire fees cover the period of initial hire only. If members want to extend the period of hire, they may do so by seeking permission at reception, and subject to payment of the relevant extra fee.
Members must not exceed the capacity limit for the meeting room.
If members have not booked the meeting room but have been using it, they may be charged, and/ or may be asked to vacate the meeting room. If members wish to continue using the meeting room they will be charged accordingly.
Technical assistance will be available for the use of the AV equipment in the meeting room, if required, and any special technology needs can be requested at the time of booking.
Members must pay any fees notified to them at the time of the booking and will be charged unless at least 24 hours’ notice is given.
Refunds may not be available for any additional services provided via third parties or suppliers such as catering or additional AV requirements which have been booked and confirmed in advance.
Members and their guests must not bring or consume any food, drink or other catering purchased externally in the meeting room or within the Premises.
PRIVATE HIRE AND HOUSE MAINTENANCE
We may at times close part of the Premises to members and their guests for private events or for maintenance, repair or redecoration work.
Where areas of the Premises are closed for private events, please honour and respect the privacy of private events occurring at NEXUS Club London.
Where all or part of the Premises is closed for maintenance, repair or redecoration work, or where we need to withdraw facilities or services because we consider that they may pose a risk to the health or safety or our members, guests or staff, or that they are detrimental to the business, we will seek to ensure that any such area, facility or service is reinstated as soon as practical and that any disruption is kept to a minimum.
ORGANISED EVENTS
Whilst you are a member or a guest at NEXUS Club London, we may ask you to give your views of, and experiences at, NEXUS Club London. We may also film, video or photograph our member events and activities at our Club for use in our membership programmes, as well as advertising, promotions, public relations, and other commercial/business purposes. If you take part in these interviews or events, you agree to us using your name, image and limited other information. You also consent to us publishing any materials produced by, or for, us for any purpose without your further consent, and you waive your right to receive any payment from us in connection with such publication.
CCTV
NEXUS Club London operates CCTV cameras for the safety and security of its members and all those who use the Premises. Members agree that their activities may be monitored within reason, and any illegal act recorded may be passed to the police or relevant authorities.
The Gym Waiver & Disclaimer
IMPORTANT NOTICE: ASSUMPTION OF RISK, WAIVER, RELEASE OF LIABILITY AND INDEMNITY
By signing up as a member and/or using any of our premises, facilities or services, you hereby agree to the terms of this agreement with The Nexus Club London Limited (“us”, “our” or “we”), which will apply for the duration of your membership with us and for any other period in which you use or access any of our premises, facilities or services. If you do not agree to the terms of this agreement then you must not use any of our premises, facilities or services.
The use of our premises, facilities or services is physically challenging and carries with it risks that we cannot entirely eliminate. These include the risk of personal injury, including injury or damage sustained while (and/ or resulting from) using any premises or facility, or using any equipment, whether provided to you by us or otherwise.
Assumption of Risk
You are responsible for using equipment safely and in accordance with any instructions or guidance that we may provide to you from time to time. You must behave sensibly and follow any safety instructions so as not to hurt or injure yourself or others.
In the absence of any negligence or other breach of duty by us, the use of our machinery, equipment or facility is entirely at your own risk. You agree that if you engage in any physical exercise or activity, including personal training, or enter our premises or use any facility or equipment on our premises for any purpose, you do so at your own risk and assume the risk of any and all injury and/or damage you may suffer, whether while engaging in physical exercise or not. Your assumption of risk includes, but is not limited to, your use of any equipment (mechanical or otherwise), internal other areas, car park, stairs, reception, ablutions or other general areas of any facilities, or any equipment.
Rules
You must act responsibly and sensibly at all times.
• You must not participate if you are pregnant or under the influence of alcohol or non-prescription drugs.
• You must follow any safety warnings or instructions displayed or given to you by a member of staff. Ask a member of staff if you are unclear. We are not qualified to express an opinion that you are fit to safely participate. You must obtain professional or specialist advice from your doctor before participating.
Disclaimer for Loss or Damage to Property
In the absence of any negligence or other breach of duty by us, we are not responsible for any theft, damage, destruction or loss of your property or belongings while using our facilities.

You hereby agree that you are fully aware of the risks and dangers connected with the use of our machinery, equipment or facilities and/or participating in any physical activity and you agree on behalf of yourself (and all your personal representatives, heirs, executors, administrators, agents, and assigns) to waive, release and discharge us (and our affiliates, related entities, employees, agents, representatives, successors, and assigns) from any right to claim, sue, demand or bring any kind of legal action in connection with any losses, damages or accidents (including those bringing about injuries or death) which you may incur or suffer in connection with the use of any of our premises, facilities or services.
Indemnity
By signing up as a member and/or using any of our premises, facilities or services, you hereby agree to indemnify and hold harmless us and any of our affiliates, related entities, employees, agents, representatives, successors, and assigns from and against any liabilities, losses, damages, costs or expenses incurred in connection with: (i) any claims or action that may be brought on your behalf or on behalf of your heirs, executors, administrators, and other personal representatives (including agents and attorneys), or by any third parties, arising from or in connection with your use of our premises, facilities, machinery, equipment or services; (ii) any damage caused by you to any of our machinery, equipment or facilities; and (iii) any injuries to any other persons or third parties that are caused by or arise out of your negligence or breach of any of the rules or obligations contained in this agreement.
Governing Law
This agreement and any disputes or conflicts arising out of it shall be governed by and construed in accordance with the laws of England and Wales. You expressly agree that this agreement is intended to be as broad and inclusive as permitted by the laws of England and Wales and that if any provision of this agreement is held or declared to be illegal, invalid or unenforceable, it is agreed that only that provision shall be given no effect and shall be deemed to not be included within the terms of this agreement without invalidating any of the remaining provisions of this agreement which shall continue in full legal force and effect.
