3pm on Saturday, August 14, that the state would go into a sevenday lockdown, starting at 5pm, which Conaghan said left business owners with little time to “get their business affairs in order and inform employees”. “The biggest issue with this current lockdown was the lack of notice given to businesses,” Conaghan said. “The timing wasn’t good, perhaps if they had locked down at midnight, this would have allowed more appropriate time and a bit more understanding from the regional community.” Conaghan said “the general feeling” across the state was that “patience was wearing thin” and that he’d “received a lot of correspondence” about the lockdown from his constituents. “People are asking ‘why did we have to have this lockdown when we’ve had no cases in over 450 days’ and to that I would like to remind people that Western NSW didn’t have any cases 10 days ago and now there are 93 active cases,” Conaghan said, in an interview with News Of The Area on Monday, August 16. “People generally understand the need for a snap lockdown to ensure that we contain these numbers across the state, and if we don’t do that, it’s only a matter of time before it will be in Cowper. “It came as close as Forster in

the neighbouring Lyne electorate, as well as above us in Lismore.” Conaghan acknowledged it was a difficult time for everyone, particularly business owners. “I feel for you, I know you are frustrated and I know you are angry but it needs to be done and hopefully for our community at least, this will be the last time,” he said. “I urge the community to support one another during this difficult time. “Pick up the phone and check in on your family and friends, particularly the most vulnerable. “Shop local and support local business, grab a takeaway from your favourite café or restaurant, consider ordering online from the stores with the ability to deliver, book services for a later date and consider paying ahead. And of course, importantly, get vaccinated.” A spokesperson for the Deputy Premier said the statewide lockdown was announced in response to health advice that was received after midday on Saturday and that social media was used as part of a strategy to spread the information quickly. “The priority was to make regional communities aware as quickly as possible, rather than to spend hours arranging a press conference with journalists in Sydney,” the spokesperson said. “To give the regions as

Update on police response to suspected Covid breaches in the Nambucca Valley By Brooke LEWIS POLICE commenced 22 Covid-related legal actions, including arrests and issuing infringement notices, across the Mid North Coast and responded to 37 Covid-related jobs in the Nambucca Valley in the week leading up to this issue of News of the Area going to print. Nambucca Valley Police Chief Inspector Darren Jameson said police were working to keep the community safe and warned that anyone doing the wrong thing “will get caught and will have to wear the legal action that follows”. “The government has made it abundantly clear we need to do everything we can to stop the spread of this [Delta] strain through the community,” he said. The most commonly reported suspected breaches of Covid restrictions are in relation to failures to comply with maskwearing requirements and people visiting the Nambucca Valley from Greater Sydney, Jameson said, adding that he encourages anyone with concerns to raise them with police. “If people are breaching the health orders, we need to know, because community safety is at the forefront of our response,” he said. Local police priorities in the immediate wake of the snap state-wide lockdown announced on Saturday afternoon included providing a high-visibility presence around supermarkets as shoppers rushed to stores, and ensuring businesses such as hospitality venues were complying with the lockdown orders from 5pm. “Since then, we’ve moved into ongoing community compliance, including monitoring traffic,” Jameson said. In response to questions around whether residents should shop within their local government area even if the closest supermarket is outside of that area, such as for residents of Stuarts Point in the Kempsey Shire, who might be used to shopping in Macksville, Jameson clarified that people should stick to their local government areas, so long as the goods and services needed are available there. “The reason behind that, I would suggest, is that they close areas down by local government area when cases emerge, so they’re trying to keep people inside those areas,” he said.

McKay Brothers launch debut CD By Andrea FERRARI

LAUNCHING their first CD after a lifetime of playing music in pubs, clubs and many a muster, the McKay Brothers will release ‘That Brother Of Mine’ with a live performance at Macksville Ex Services Club on Father’s Day. Brothers Lach (59) and Geoff (68) decided to “bite the bullet,” Lach told News Of The Area. Music runs through the veins of the brothers who grew up on a dairy farm in Simpsons Ridge, west of Bowraville. “After a lifetime of performing and enjoying country music we have finally put ourselves far from our comfort zone, spending the past four months getting songs together and spending time in the studio putting our CD together,” said Lach. “One of the songs on the CD was written by Kelly Dixon; well known in the industry – he’s 94, lives in Queensland, and is still writing songs. “He wrote it for his wife, and it’s called ‘You’re Still Just 22’; he sent us the lyrics and we wrote the music.” Another song, ‘Good Times Will Come’, was written by Geoff years ago, and the boys felt it is fitting for today. Having travelled around Australia performing at

‘You’re Still Just 22’, through CRS, which distributes worldwide, and then we started posting live shows on Facebook which has an international audience. “A radio station owner in the UK, Alan Cole, from Don Valley Country Radio in Doncaster, sent me a message saying his audience was enjoying Australian country music. “We worked from a belief that ‘you’re never too old’ and found ways to share our music when events were being cancelled and the music industry was being hit hard. “We’ve loved doing this and are looking forward to launching the CD in Macksville on Father’s Day.”

AMENDMENTS TO THE NAMBUCCA LOCAL ENVIRONMENTAL PLAN 2010 Nambucca Valley Council is presently seeking public comment on proposed amendments to the Nambucca Local Environmental Plan 2010 (LEP). The proposed amendments are as follows: Item 1: Include ‘Residential Accommodation’ as a land use that is permissible with development consent in the RU1, RU2, R5, E2, E3, E4 zones so that manufactured homes are permitted to be installed within these zones with development consent. Item 2: Alter the wording of Clause 4.2A (3) so that it applies to lots on which a manufactured home is proposed to be installed and to lots on which dwellings have been constructed/installed without development consent. Item 3: Include ‘Vehicle Sales or Hire Premises’ as a land use that is permissible with development consent within the B7 Business Park Zone. The Minister of Planning has chosen to delegate the making of the LEP to Nambucca Valley Council. The draft LEP may be viewed and downloaded from Council’s website www.nambucca.nsw.gov.au. It is also displayed at Council's Administration Centre at 44 Princess Street, Macksville during business hours. Remote Learning Returns

“I’M hoping we don’t have to do this online learning because it’ll put a lot of stress on people.” That was the message from HSC student Bryce Pike, echoing the thoughts of many Nambucca Valley students who endured remote learning in 2020. But after roughly a year and a half, COVID-19 has forced local students into remote learning again, as the state of NSW was pushed into a state-wide lockdown on Saturday afternoon. However, it's not all doom and gloom for all students. “I much prefer remote learning as I can do work when I want,” said Nambucca Valley student Kate Payne. While some HSC students see this type of learning as beneficial, others see it in a negative way and simply struggle with it. “As a HSC student, I don't really like how we are going into remote learning again because the HSC is just

around the corner,” remarked Tracy Nguyen. “There is still a lot of content to learn for most of my subjects and not a lot of time to do it. “I find it better to learn face-to-face in class, although, due to this lockdown and the spread of the coronavirus, it is safer for us to do remote learning. “A lot of my plans have been cancelled due to the lockdown, so I'm trying to find myself other things to do at home during this time. “The only problem I have with lockdown is coping to stay at home for long periods of time without getting anxious or bored.” The experience has certainly made some local students appreciate the school environment. “I think with the first lockdown last year I really was able to knuckle down and study, however with being in Year 12 and the fast approaching HSC exams, I’m finding it a lot more

stressful and difficult,” said Nambucca Valley HSC student Lillah Hoffman. “I prefer learning from school as I’m able to access teachers immediately, books from the library, computers and even the school internet without having to wait.

“The recent lockdown’s pushed back my exams and prevented me from finishing some of my coursework required for the HSC.” In addition to issues with study, students are reporting mental health impacts from the lockdown.

emergency.” At the same time, Council didn’t want to invest in a piece of equipment that would sit around in a shed for most of the year. “An important factor to Council’s purchase of this truck is that it is flexible and can be used for other purposes. “It can be used in road maintenance and construction, working to damp down dust while grading or hose in water for concreting. “The fact that the truck is multifunctional means the community will get a lot of ‘bang for its buck’, great value for the money spent. “Not only will the truck support

our emergency services during disaster, but it will be a key tool in Council’s core duties, namely looking after our roads.” It’s also a valuable resource for the odd job here and there.

Bushfire Recovery funding buys dog water tanker NAMBUCCA Valley Council’s Bushfire Recovery funding has recently bought a new dog water tanker which will assist with firefighting as well as road maintenance. “When Council was notified it would receive funding from the Federal Government due to the Kian Road fire disaster, it immediately decided to put forward a program of works for public submission,” Rhiannon Treasure-Brand, Community Recovery Coordinator, Nambucca Valley Council told News Of The Area. The program was developed

By Karen GRIBBIN THE Home Interaction Program for Parents and Youngsters (Hippy) is a two-year, home-based early childhood learning and parenting program designed to empower parents and carers as their children’s first teacher. Hippy helps children make a successful transition to school and beyond. The program in Australia is federally funded by the Department of Social Services (DSS), with 100 sites across Australia. News Of The Area spoke with Nadia Farah, Hippy coordinator for the Nambucca Valley, about service delivery in the region. Nadia said Hippy is a twoyear program for parents of children pre-kinder to first year school. “Children and parents are visited in their home with resource packs designed to empower parents in getting their children school ready. “Many parents and

children get very anxious about entering school, Hippy provides problem solving skills to meet those anxieties.” Hippy also offers a chance for parents to train as Hippy tutors and provides support for parents to access programs for upskilling. Each year Hippy has two placements for those parents interested in work as Hippy tutors. These placements are taken from the current parent group already registered in the program. Tutors will be trained to deliver the program to other families in the group, and provide upskilling for employment opportunities in the future.

“I love the sense of achievement parents get from being tutors in the program, self-esteem, acknowledging the chance to propel themselves into a career.” Hippy works with children on the spectrum, specialists, and liaise with parents and other service referrals. The program has outcomes that stretch beyond the family unit and into the community. Hippy delivers programs to the greater educational community, kindergartens, schools and community groups. “I get amazing positive feedback from kindergartens, and schools. “Local educators tell me they can spot Hippy kids as

work in.” The new office is located in Cooper Street under the Chinese restaurant. Dianne Wall, Chief Operations Officer, has been busy since May setting up the office for effective operation and project delivery. “Di has done a wonderful job getting the office set up in readiness for staff operations,” said Kerry. RDAMNC brings eight staff members to Macksville. Working with the Local Jobs Program are Stephen Saunders, Employment Facilitator, and Sara Runciman, Support Officer. RDAMNC has a ninemember board headed by Chairman Kieren Dell who has been with the organisation since 2017, and has a

strong regional economic understanding. “Our team and committee are all local people, developing local solutions for the Mid North Coast region,” said Kerry. The staff of RDA Mid North Coast have a variety of specialist skills to implement core services and manage key projects. The governing committee is comprised of members from a variety of industries and interests across the Mid North Coast. The Mid North Coast is home to an array of vibrant, modern and sometimes eclectic townships that attract 4.9 million visitors each year. However, the ‘Impact of Covid-19 Report’ that came out in August states a

Financial protection for tenants and landlords By Rachel MCGREGORALLEN THE National Cabinet’s Mandatory Code of Conduct for Commercial Leasing has been re-introduced by the NSW Government. This mandates rent relief for eligible tenants impacted by COVID-19. Alongside this is the new Hardship Fund, providing a monthly grant of up to $3 000 for small commercial or retail landlords who provide rental waivers to at least the value of the grant plus any land tax relief they are eligible for. Regulation 2021 Minister for Finance and Small Business Damien Tudehope advised that protection for small businesses will be provided for six months

Minister Tudehope said, “We have always encouraged landlords and tenants to come to the table and negotiate, but now we are going one step further by mandating the minimum relief that landlords need to provide impacted tenants. “It has been very tough for small businesses across NSW and we want to deliver more certainty for business owners who have bills continuing to pile up. “We have ensured small landlords who rely primarily on rental income from commercial properties will also be able to access a monthly $3,000 grant to help ease the burden and ensure they pass

on rental relief to tenants.” The National Cabinet’s Code of Conduct requires landlords to adjust rent and provide relief in proportion to the decline in turnover in businesses in the rented premises. At least 50% must be in the form of a waiver, the balance a deferral. The Retail and Other Commercial Leases Regulation (COVID-19) Regulation 2021 will require landlords to renegotiate rent in line with the above National Cabinet’s Code of Conduct. This Regulation is applicable to commercial and retail tenants with a turnover of up to $50 million who are able to apply for the COVID-19 Microbusiness grant, COVID-19 Business Grant or JobSaver Payment. Jenny’s record-making 500 blood donations MACKSVILLE’S Jenny Horton has set the blood donation record for the Mid North Coast with her 500th donation. Lifesaver Jenny has achieved the highest number of donations made by a female on the Mid North Coast, and is one of only a handful of women in NSW to reach the milestone. She started her blood donation career many decades ago as a student nurse in Armidale. With every donation having the power to save up to three lives, Jenny has potentially helped save 1500 Australian patients. Travelling all over the world with her work with Rotary and the World Health Organisation, Jenny has even donated blood in Pakistan for a friend who was dying of Dengue fever. Setting off from her home in Macksville once a fortnight, Jenny makes the two-hour round trip to Coffs Donor Centre. “I am very happy to have reached 500 donations and grateful for all the people I have helped along the way,” said Jenny.

Where will the proceeds from the sale of the Old Macksville Hospital Sale go to? By Rachel MCGREGOR-ALLEN

MR John Mills, an active Nambucca Valley resident, business owner, and Lions Club member, feels very strongly about the funds that have been raised from the selling of the Old Macksville Hospital land. “The 1.6 million should go towards equipping and beautifying the new Macksville Hospital. “If the $1.65 million made from the sale of the old hospital was directed to equipment and improvements to the new building we could have a facility providing services comparable to a large provincial NSW hospital.” Mr Mills said the land that the hospital was built on was land that was bequeathed by Macksville resident Harry Wall, who passed away in 1925. Mr Wall bequeathed both money and land for the purposes of building a hospital at Macksville. The old hospital was

opened in 1958. Local GP Dr Danny Ryan said this donation of money and land “started a tradition of the community, contributing enormously to Macksville Hospital over the years”. “A good example of this is the contribution by the Nambucca Valley Cancer Support group of over $400,000 to the new hospital,” Dr Ryan said. “The Hospital Auxiliary and other community groups have also contributed very generously to provide equipment that other hospitals may take for granted. “In this sense the Local Health District owes this community a significant debt.” The new hospital, costing $73 million to build, is missing equipment to ensure that it can service the community fully. This $73 million, Dr Ryan told News Of The Area, was contributed by NSW Health. According to Mr Mills, “What is of top priority as indicated by the local area medicos is a CT scanner.

THE stresses of exams and the added uncertainty of Covid-19 continue to loom over Nambucca Valley Year 12 students in the build-up to their graduations in mid September. “My HSC trials were difficult to work with because I had an exam everyday on the first week of trials, making it hard for me to organise my studying schedule and to fit my revision in before the next exam the day after,” said Nambucca Valley HSC student Tracy Nguyen. “Although, I feel like this was a good experience to prepare for my HSC in October. “After my trial exams were over, I was relieved and most of my stress disappeared. “I'm glad I made it through the two weeks.” HSC Trials have been spread across the Nambucca Valley’s high schools over multiple weeks, some finishing recently while others are yet to sit them.

“At the moment Nambucca Valley community members who need a CT Scan have to go to Coffs Harbour. “This is putting increasing pressure on radiology facilities in Coffs Harbour, and it is not an easy transit for many to make.” Dr Ryan agrees, “Currently all patients requiring CT scanning have to travel by ambulance or hospital transport to Coffs Harbour for CT scans. “This causes delays in diagnosis, delays in treatment and delays in discharge. “The patients, often sick and frail, are on an ambulance trolley for half a day while they wait for their scan, then wait for a report and transport back. “This sometimes causes significant suffering. “CT scanning has become an essential diagnostic tool. “As clinicians, we believe that a CT scanner in Macksville would not only relieve suffering but be cost effective, with earlier diagnosis, treatment and earlier discharge. “There would also be a huge saving in transport costs. “Ambulances would not be

For this region, however, HSC students have had the opportunity to sit their exams in person at school in recent weeks. Local HSC student Ellie Spain said that developing a strong study routine is key for success. “When I had my trials, I’ve been making sure I prioritised my study time and got myself into a good routine, which also ensured balance,” Ellie said. “Finishing the trials was a massive weight off the shoulders and it also motivated me to keep going for the HSC.” After the trial exams come the official HSC exams. As of recently, those exams were delayed a week from October 12 to October 19 due to the continuing outbreak of COVID-19 in Sydney and other NSW regions. The NSW Education Standards Authority (NESA) came to the decision to push the exams back a week, but exam dates could change again depending on the spread of Covid-19 in the regions.

FINALS footy kicked off last weekend with this year's Tooheys New Group 2 Rugby League finals series getting underway in a big day of elimination games at South Grafton. The fourth and fifth placed teams of the home and away season played off in their elimination semi-finals as they looked to keep their seasons alive. The South Grafton Rebels used their home ground advantage to full effect beating the Bellingen Valley/Dorrigo Magpies 42-24 in their first-grade semi-final. The Rebels led 16-12 at half-time, before a dominant second half saw the home side progress to the minor semi-final. A 24-4 second half saw the Coffs Harbour Comets beat the Bellingen Valley/Dorrigo Magpies 30-20 in their reserve grade

Now we are socially isolated, the only time I communicate with people is on my daily walk. Sometimes, though, I say hello and the person walking towards me doesn’t reply. It is quite depressing.

Demystifying executorial responsibilities JOHN is named as executor in his late father’s will. He seeks legal advice regarding his role and is advised that an executor has the right to make the funeral arrangements. The funeral account can be paid from his father’s savings account and after the payment is made, the account will be frozen. The power of attorney that John held prior to his father’s death is invalid after the date of death. If there is a substantial amount remaining in the savings account, the bank may require a grant of probate to release the funds. A grant of probate will also be necessary to deal with real estate and other large assets. Otherwise, there is no requirement that a grant of probate is obtained. The solicitor advises John that the costs of the solicitor acting on his behalf in relation to obtaining a grant of probate are regulated with reference to the sliding scale, based on the value of the net assets of the estate at the date of death. Any assets that are held jointly with another person are not included. The probate costs are a liability of the estate and can be paid once sufficient funds are realised to do so. John is advised that as executor, he is responsible to finalise his father’s tax affairs and that if he does not do so, and tax is in fact outstanding, he may be personally liable. To be protected from other creditors, the solicitor must advertise his intention to distribute the estate and the estate cannot be distributed before the expiry of six months from the date of death. John is advised that he has a duty to keep accounting records and that the solicitor’s trust account can be used to ensure proper records are kept. John is advised of his duty to insure the assets of the estate until distribution. OPINION Rubbish in Nambucca State Forest DEAR News Of The Area,

AS a horse rider, I spend a fair bit of time in state forests in our area, and have been constantly appalled by the amount of dumped rubbish that litters our beautiful environment. I’m pleased to read in your 6 August 2021 edition, that the Forestry Corporation of NSW has undertaken to clear up at least some of this rubbish. However, I wonder how much refuse would be there to collect, if there were no fees for residents to visit the council tip. Having lived in Pine Rivers Shire in Brisbane in recent years, where there is no tip fee for local residents, I can say the bush there

is all but rubbish free. Has Council calculated the economic benefits of charging residents to tip, versus cleaning up the resulting mess from those who won’t, or can’t, pay the fee? Do they not care because it is left to others to clean up the mess? The economic assessment should be made in addition to considering the environmental, aesthetic and safety impacts to our community. I’m certainly not condoning illegal rubbish dumping, but it might be time for Nambucca Shire Council to rethink their approach.

Now we live on the beautiful, much warmer, midnorth coast. We have our cafe, our house, and beaches (when you have lived without, that fills a big void). Now COVID restrictions have hit our cafe again, and our children are home from school again. We endured months of this in VIC, and it ended. And this time, when it does, we will all emerge wiser from the experience as a community. Happy, healthy and hopefully in line with the rest of Australia emerging to a COVID normal.

The ladies enjoyed a great morning and a lot of laughs in the sunshine. The first round of the Triples Championship was full of drama, with terrific bowling and, sadly one team forfeiting during the match due to a team member’s injury- bowlers really have a lot of trouble with their knees.

By David WIGLEY THE Macksville Stingers were in high spirits last Saturday as the community football season drew to a close for the under 11s non-competitive age groups. Macksville’s under 11s coach Dylan Creaser reflected on a season of personal growth from the juniors. “It’s been a great season for my U11s. “We might not have won lots of games, but the kids have had loads of fun. “To see the development in the team and personal growth in the kids is really fantastic, we have lots of new players learning and making new friends. “Whilst I look forward to a few weekends off, by next season myself, the club and the kids will be chomping at the bit to get back into it, thanks to all of the parents for their time and support,” said Dylan. Club President Gayle Murray branded 2021 as a great season with record registrations for the football club. “Another great season for Macksville Soccer Club has nearly come to an end, which is awesome considering the problems at the start with fields out of play due to the floods and now at the end with the COVID lockdown. “We had our largest number of registrations ever and hope to build on that for next year. “Each Saturday our home games were full of fun, ups and downs but always lots of energy, we had large numbers of parents and other spectators, not only for the Juniors but the Seniors as well, not to mention heaps of volunteers to help run everything, the club atmosphere was excellent all season,” said Gayle. The Macksville Stingers have players in all age groups ranging from 5-years-old and upwards where the common denominator is having fun. “The Mini Roos aged 5 to 7 years showed up with great enthusiasm every Saturday, as well as Tuesday training.

“Our junior noncompetitive teams really enjoyed their season, the 10s and 11s struggled at times but enjoyed their battles on the field and improved each week, the 8s and 9s had fun every week with excellent play and great results. “This year we had four competitive teams, the 13s team was a mix of 12 and 13-year-old players, many of them first time players, they had a hard season against some very experienced teams but they had fun which is the main thing and improved throughout the season. “Our senior women’s team struggled with injuries and numbers but their spirit is amazing, they also had fun and improved each week. “Our 15s and senior men’s teams both had successful seasons and have both made it to the semi-finals. “However with the statewide lockdown the next few weeks are a mystery but we hope that things will resolve so they can both proceed. “Can’t wait for next year,” enthused Gayle.
