WINTER fashion was on show at the stunning Palm Lakes Resort on Sunday 23 May raising over $1500 for Variety, The Children’s Charity. Supported by volunteers from the Tea Gardens Hawks Nest Lions Club, the event was a huge success with over 120 people attending to see the fashion on the floor. The show was choreographed and hosted by Lions Director, Carole Richards, to the fantastic tunes of John and Julian from the band ‘Old Spice’. The fabulous clothes were provided by Marina from Little Faith Boutique in Tea Gardens. Carole Richards shared a story about the origins of the popular boutique.

MidCoast Council is partnering with the PCYC to host the awards for the first time ever, recognising the positive contributions that young people make to the MidCoast community. Nominations are invited across seven categories to recognise a person aged 1224 years, across a wide range of achievements. The categories are Arts,

Leadership, Community Service, Sports, Wellbeing, Resilience and Entrepreneur. “Each category will recognise two young people – one from the 12-17 age bracket and one aged 18-24 years,” explained MidCoast Council’s Coordinator of Community Development, Lyndie Hepple. “Winners of the awards will receive a $250 cash prize, with each category being sponsored by a local service,

group or organisation.” Nominations open on Monday 7 June, but be quick to nominate – they will close on Sunday 4 July. The Fair Work Act 2009 ("FWA") contains a number of "general protection" provisions which can provide useful protections for people in the workplace in circumstances where they are subject to adverse action because they have exercised a workplace right. The Federal Circuit Court of Australia in the recent case, AlAttar v Consulate General of the Republic of Iraq, Sydney [2021] FCCA 500 made a finding an employer breached the general protections provisions of the FWA by declining to renew an employee's fixed term contract. The applicant was employed by the respondent as a translator pursuant to two successive fixed term contracts, the last of which was renewed for the period of 1 May 2018 – 31 December 2018. Prior to November 2018, the applicant exercised the following workplace rights:• Lodged an application under the FWA seeking a stop bullying order; • Emailed the Australian Taxation Office regarding nonpayment of superannuation

and failure to provide payslips by the respondent; and • Enquired with the Fair Work Ombudsman regarding underpayment of entitlements. On 27 November 2018, the applicant was notified that his contract would not be renewed and that he would be paid in lieu of working the remainder of his fixed term contract, which expired on 31 December 2018. The respondent argued that the decision not to renew the applicant's contract was made because the respondent had been mandated not to employ unqualified translators and that the decision was not related to the workplace rights exercised by the applicant. The Court did not accept this argument, as the respondent continued to employ other unqualified translators. The Court determined that by not renewing the applicant's contract, the respondent took adverse action against him, and it did so because he had exercised his workplace rights. Fashion Show Sponsors Variety, The Children’s Charity FUNDS raised at the annual fashion event held at Palm Lakes Resort, Tea Gardens on Sunday 23 May were 100% donated to Variety, the Children’s Charity. Lions Director and show choreographer, Carole Richards, shared why the charity is so important in her opening speech at the Fashion Show. “Its 1928 and 11 show businessmen had enjoyed an evening in the Variety Club, and as they ventured out into the cold, they found little Catherine in a blanket on the doorstep. “A note from her mother was pinned to her wrap asking that they take care of her baby.

“These men informally adopted her, named her Catherine Variety Sheridan, and undertook to educate and care for her. “The Club then started raising funds to help other children like Catherine and what we now know as Variety, The Children’s Charity, was formed. “Nearly 50 years later Variety comes to Sydney and spreads across Australia. “Sick, disabled, financially challenged, disadvantaged by these and/or distance Variety raises money for them all. “In 2020, despite COVID restrictions, Variety touched the lives of over 85,000 children.” There are many ways Variety raises

money but one of the most successful is The Bash. “As founder Dick Smith describes it, it is not a race or a rally, just a drive in the country with your mates,” Carole said. “The organisers find the most roundabout route between two places along the most challenging roads and tracks they can find. Red dirt, mud, stone roads, bull dust - and all in an unmodified, 2-wheel drive that is at least 30 years old.” Matt Tulk from Woody’s Nursery in Tea Gardens has just completed his first Newcastle Bash. “He joined a team of NRL cars. Matt’s car’s entry fee was a minimum of $4,000 and Lions decided that funds raised from today’s Fashion Show would go to Variety by supporting Matt’s fundraising efforts,” said Carole.

153 New Lots: Final Chance To Comment On DA By Marian SAMPSON

THERE is a proposal for a three precinct subdivision, bulk earthworks with multiple construction stages and lot releases in Tea Gardens, resulting in 226 residential lots and public reserves.

The developer states that, “There will be no adverse environmental, social, or economic impacts”.

Ronnie Nichols of Tea Gardens told News Of The Area, “Council

had previously approved a large lot 78 residential subdivision over Precinct 1 of this proposal, being DA 236/2014. “Notwithstanding, the previously approved subdivision has been determined to be economically unviable, having significant uncertainty for MidCoast Water Services with regard to ultimate lot layout and yield within the location.” The new Precinct 1 if approved will create one hundred and fiftythree 450 sq. metre lots. The site will be connected to a MidCoast Water Services reticulated water and sewer system. All of the proposed new

residential lots are zoned R2, allowing for as low as 450 square metres. Necessary infrastructure will be made available to the proposed development. “There are, however, first and second order streams within the site. “With regard to drainage lines, discussions have been undertaken with Council and also DPI Water and it is intended to fill both first order stream drainage lines within Precinct 1,” she said. She also has concerns that have been raised with Midcoast Water Services in relation to their strategic planning forecasts and

requirements for the provision of water and sewer services for North Shearwater, the provision of 153 residential lots in accordance with LEP residential densities is required to enable financial viability. The NSW State Planning Panel will meet to determine the development application: PPS‐2019HCC014 – MidCoast Council – DA 100/2019 ‐ 90 VineyCreek Road (E), Tea Gardens – 226 lot subdivision on Wednesday, 16 June 2021 at 3pm. Despite best efforts, many took to social media to express their frustration about the ongoing issues. “If you are repeating the same process for a number of years now and it’s not working, try something that would give a more permanent result,” one user commented. Unfortunately, with severe storms and weather events, systems and other solutions in the past have quickly washed away, leading to the beach being classified as one of the NSW’s 15 coastal hotspots where impact of hazards and risks to assets is particularly high. “Every year we work to provide sand buffers along the pinch point in preparation for east coast lows that severely impact our beaches in winter. “Thanks to an extensive dredging operation of the eastern channel of the Myall River last year, we have a great stockpile at Winda Woppa to work with, allowing us to make the most of the sand transfer system for our first major sand transfer campaign since the system was commissioned,” Mr Scott said. For over 40 years, solutions to the erosion

Coastal Erosion EROSION at Jimmys Beach has been an ongoing issue for many years. MidCoast Council contractors, CCB Envico have begun a sand transfer program to create a sand buffer along the beach, ideally preparing for winter weather events. After recent severe weather warnings issued by the Bureau of Meteorology on Friday, MidCoast Council heavily monitored the local erosion hotspot, discovering that, although not finished, part of the buffer that had been established through the work of the contractors was lost. MidCoast Council’s Director of Infrastructure and Engineering, Rob Scott spoke about the event. “While Jimmys beach is concerning, the beginning of the Sand Transfer System campaign has been timely. “We are back to square one now and the system will continue operating until completion of this renourishment campaign in about three weeks’ time,” Mr Scott said.

New Safer Connection Through Hexham By Marian SAMPSON FOR many motorists getting to and from Port Stephens or the Mid North Coast is quite a headache - they get stuck in the Hexham bottleneck. The connection between the end of the M1 at the New England Highway through Hexham to the junction at the Pacific Highway is often queued with traffic in both directions. Creating a significant bank up to Raymond Terrace or through Cabbage Tree Road to Nelson Bay Road.

Add to the mix a holiday weekend and a long delay on Nelson Bay Road and the trip can have hours added to its length. The planned extension of the M1 to Raymond Terrace is still a long way off with the NSW Government’s infrastructure website stating the project is under planning and due for completion mid 2029. When it is delivered there will be a 15km dual carriageway extension of the M1 Pacific Motorway connecting the motorway at Black Hill to the Pacific Highway at Raymond Terrace.

In the interim, the NSW State Government has announced additional safety measures for the connection between the New England Highway and the Pacific Highway with works on safety signage to commence next week. Parliamentary Secretary for the Hunter Taylor Martin said the NSW Government is providing almost $1 million through the Safer Roads Program to help reduce the risk of crashes on this key route linking Newcastle with the New England and Pacific highways. “These improvements will help the 65,000 motorists travelling daily on this route through Hexham to complete their journeys safely and return to their loved ones,” Mr Martin said. “The project will also generate work for about 15 local workers, providing a much-

Photo: Marian Sampson. needed boost to the local economy as we continue to recover from COVID-19.” Mr Martin said Transport for NSW will be carrying out work on a 6.5 kilometre section of the Pacific Highway, between Ferry Road and the Hexham Bridge. “This will involve installing four advanced warning signs with flashing lights to warn motorists to prepare to stop, together with two vehicle-activated signs with flashing lights to detect the speed of vehicles and warn drivers to slow down when traffic is queuing ahead,” Mr Martin said. “These signs and some additional static signs will help to improve safety along the route, especially when traffic is heavy. Work will also involve tree trimming to improve sight distance, trenching and electrical work and concreting to install the new signs. Crews started work on Monday 7 June and are expected to complete the project by the end of June, weather permitting. To reduce the impact to motorists, work will be carried between 7pm and 5am from Sunday to Thursday. Lane closures and a reduced speed limit will be in place during work hours for the safety of workers and road users. Motorists are advised to allow up to five minutes extra travel time, drive to the conditions and follow the directions of signs and traffic control. Getting to and from Port Stephens for holidays and work is just about to become safer.

Paramedics Strike By Tara CAMPBELL

HEALTH Services Union paramedics will be taking a state-wide stand in NSW against attempts to cut wages, attending to only urgent emergencies on 10 June. For 24 hours, paramedics will refuse to respond to call-outs as an industrial action over a 1.5 per cent pay increase offer. Health Services Union Secretary, Gerard Hayes spoke of how paramedics are some of the hardest workers, but receive insulting pay.

“NSW Paramedics are at breaking point. “They’re not trying to get rich, they just want a fair pay rise that recognises the cost of living and the intensity of their work,” Mr Hayes said. In 2020, paramedics were awarded a shocking increase of 0.3 per cent, despite working in tough conditions and being exposed to a pandemic. “Our paramedics were required to transport COVID-positive patients, without adequate protective equipment. “They were exposed to a

wild and deadly disease, yet they continued to serve the people of NSW and protect their health,” Mr Hayes explained. The union stated that paramedics would be offered a pay rise much less than the forecast inflation of 2.2 per cent, and in effect a pay cut. “To offer them a pay cut is humiliating and insulting. “NSW paramedics are already the worst paid in the country and personally carry the cost of their professional registration and education. “This pay cut will set them further behind,” Mr

Support for Pool Upgrade By Tara CAMPBELL

HAWKS Nest and Tea Gardens community members have shown overwhelming support for proposed pool plans. After initial consideration at a Hawks Nest Tea Gardens Progress Association meeting, a sub-committee is campaigning for an upgrade of the Tea Gardens’ Pool, to facilitate a multipurpose community hub with something for everyone. Over 80 people attended a recent meeting at the Hawks Nest Golf Club, with

committee member Ann O’Brien addressing that almost 2000 signatures had already been received in support of the upgrade. “It is apparent the community is saying the pool is a valuable asset that needs to be protected and saved,” Ann O’Brien said The meeting was also addressed by Barry Waterman who had been a member of the group established by Council in 2003 to consider use of the pool by various community groups and who was involved in the establishment of

the Peter Sinclair Gardens Nursing Home. Barry Waterman told those who attended, “It is imperative that we support this effort to upgrade the pool because it is clear that there is a desperate need so that all members of the community can have access to the pool throughout the year." Head of the subcommittee, Jim Meehan explained that once a strong enough community support was established, steps would be taken to design and cost the project. “We would like to have

HOW DOES YOUR WINTER GARDEN GROW? “Any tips for creating a winter garden?”

WINTER can be the forgotten season of gardening. North of the equator in snowy climes, it really is a quiet season where gardens and gardeners enjoy rest. But not here! Sure it can becold, but there’s lots to gain from winter gardening. Apart from the beauty, maintenance work will set the stage for a glorious Spring. Start with checking soil health and pruning, not only to get rid of dead stalks/branches, but to see what spaces you might have to fill with winter plants. There are plenty of flowering plants to brighten dull skies. Natives such as grevilleas, wattles, native fuchsias and banksias are terrific. You can’t go wrong with camelias and lavender; lily of the valley and daphne. Come August, jasmines and flowering peach look stunning and the aroma of jasmine…..intoxicating. And don’t forget vegetable plots. Spinach, snap and snow peas, broccolini, garlic and herbs rosemary, thyme and parsley are some of the many that not only flourish in winter; they deliver a bounty for your table and there’s undeniable joy and satisfaction from growing your own. COUNCIL Round-Up

By Cr Len ROBERTS IT was timely that an article by Phil Everitt regarding the local Prostate Cancer Support Group was in a recent edition of News Of The Area. Prostate cancer was the reason the Council Roundup has not appeared in the NOTA recently. I received news in March last year that I had an aggressive form of prostate cancer and had less than six months to live, unless I underwent medical treatment immediately. Last month, I received the ‘all clear’ and my cancer was in remission. The doctors described me as a ‘walking miracle’. The 12-month treatment process would have meant that I would not have been able to attend Council meetings. However, along came Covid-19 and Zoom meetings became mandatory. This meant I didn’t miss Council meetings and I was able to follow up matters for people even whilst in hospital. I received tremendous support from family, friends and church during this difficult time. It was through this support and my faith

in God that got me through. Now that I have improved, News Of The Area would like Council Roundup to reappear on a fortnightly basis. Perhaps the most significant thing that has occurred this year in regards to Council, was the staff moving to their new headquarters, the former ‘Masters Building’ in Taree, during January. This move was significant for several reasons: 1) Increasing staff morale and productivity by being in one place. Some staff have commented they now don't have to wait for an interoffice email, they can now walk around to their desk and get the information immediately. 2) Cost savings in maintaining multiple buildings with the potential sale/lease of former buildings. On Wednesday, Council approved the sale of the former water building at Forster. At this time the purchaser cannot be disclosed, but its use will be exciting and positive for the community. 3) A $40 million project was delivered at a cost of $20 million. 4) Celebration of Aboriginality, the building reflects Aboriginal themes and artwork. It is known as Yalawanyi Ganya which essentially means welcome to the meeting place house, and is pronounced yalla – one - nee – gun – ya. I will write more about it in the next roundup. I guess some of our Grade 4 bowlers were worn out after their grueling time last weekend and certainly deserved a break. For others, a great opportunity was missed. The winners on 20 points with a 1 end countback were Dennis Wilberforce, Bill

Heylbut and Scott Fitzalan. The lucky losers on 17 points were Bryan McPhie, Nev Vaughan and Bob Weir. The Garden Eatery voucher was won by “lucky” Kev Barbie. At face value, I can see your point. You have given the clothes to your friend out of the goodness of your heart, and you would expect that little Timmy would be happy to receive the Ninja Turtle singlet and Samantha would be thrilled with those faux leather boots, but alas they are now there for the world to see, along with a catchy sales pitch: 'Vintage singlet and vegan boots in great used condition' which is certainly not the description you would have given them. The thing is, Elizabeth, there is actually zero monetary advantage in selling secondhand clothes to social media communities. I tell you, those people are savvier than any nanna at a Garage Sale. They are as cunning as Victor Lustig (Google him). As relentless as rodents. As tight as a fish's . . . you get the idea. I discovered this the hard way when I tried to sell my seven-year-old son's soccer boots. They were in immaculate condition because, let's be honest, he spent half the season on the bench and even when on the field he wasn't too keen on getting his boots scuffed. They cost me $100, so I put them on the local marketplace site for $10, complete with photos from various angles and a detailed sizing chart with European conversions. That probably took me about half an hour, so I was already on slavelabour rates. Well, then the queries started. Would I accept $5? Ah, no. World Environment Day By Marian SAMPSON

IT was World Environment Day on Saturday and there is plenty of work to be done to improve the environment. We all know that we can all make a difference to the future of our planet and World Environment Day shines a light on this. The theme of World Environment Day is Reimagine. Recreate. Restore. There is a focus on the restoration of ecosystems. In Port Stephens and on the Myall we have plenty of people doing their bit to help our environment. Landcare Groups regenerate and weed areas

such as the Bagnalls Beach Bushland and Mambo Wetlands. Individuals collect rubbish as they walk and the Take 3 For The Sea movement has gained significant traction. Sea Shelter volunteers conduct dives and general clean-ups which remove rubbish from Marinas and Mangroves. Clean-up Australia Day is viral throughout the region. Supermarkets like Woolworths have moved from plastic toys in plastic wrappers to seeds in biodegradable packaging. Locals both in Port Stephens and in the Myall

were proactive after the devastation wreaked on our beaches by the YM Efficiency. However we can do more, we need to look at how we use what we use and reimagine how we do this. Plogging is also a thing – it is jogging and walking while collecting litter, it started in Sweden and has taken off around Australia. Plastic Free Port Stephens Founder Alicia Cameron is looking at a raft of options to reimagine how we use things, from creating reusable resources for events to recycling and removing plastic drink bottles by offering reusable aluminium ones.

Skate Park to open BULAHDELAH’S brand new skate park will be officially opened to the community later this month with a special community day for everyone to enjoy. The impressive community facility at Alum Mountain Park has been over three years in the making and was heavily driven by the Bulahdelah Lions Club with assistance from MidCoast Council and the Federal Government. The finished park is the result of extensive community consultation to assist with the design including a local focus group that was established early in the process to work with the designer Trinity Skate. Council unofficially opened the park in time for the 2020/21 Christmas holidays to allow the community to use the facility, despite some landscaping works still to be completed. “The response to the soft

opening was fantastic, the community has loved the skatepark and it was so great to see people travelling from all across the region to enjoy this great new community facility,” said Dan Aldridge, MidCoast Council’s Manager of Community Spaces Recreation and Trades. The official opening is planned for 26 June, from 10.30am to 2pm. It will include an opening ceremony with addresses from MidCoast Council Mayor David West, Member for Lyne Dr David Gillespie and representatives from Bulahdelah Lions Club. This will be followed by beginner and intermediate skate workshops with the team from Totem skateboards, skate demos, a barbecue and lucky door prizes and giveaways throughout the day. “We’ve had a couple of Totem workshops at other skateparks in the region
