Tax-exempt status for biodigester Motion allows bylaw to be drafted which will return to council for approval: Mayor By Mike Williscraft NewsNow While several aldermen questioned exactly what was being passed, Grimsby Council did pass a motion Monday night allowing the biodigester to be tax exempt. The issue was the subject

of an intense debate at Administration and Finance Committee last week. On Monday, Ald. Steve Berry, who chairs AFC did not comment on the motion this time around either as part of his meeting minutes review or after it was lifted from the minutes to allow

for a thorough debate. Resident Rob Hattin gave a detailed presentation as a delegation, citing many reasons he believed the motion should not be passed. He estimated revenue from the biodigester’s generation of electricity under its 20-year FIT agreement

to be about $110,000 per year with about $1.3 million in expenses to create a net loss of more than $1 million annually. Hattin also added many other aspects of operation which would add to the overall cost impact at the site. See COSTS, Page 3

Grimsby Secondary School found itself on top of a list - for a third straight year - to which no high school would want to lay claim. In a report published by Global News, GSS is cited as having its marks inflated, according to findings by University of Waterloo, which assessed how much incoming students’ marks dropped at the university. “First, students with inflated marks risk being placed in programs they’re not prepared for. As well, the university risks being unfair to graduates of schools with more rigorous marking standards,” the article claims. The District School Board of Niagara sees things decidely different. “As you can imagine, we wholeheartedly disagree with the conclusions reached by Global News,” said DSBN communications officer Brett Sweeney in an email. He also provided a letter from GSS Mat Miller which went home to parents on Monday. “The article itself is extremely limited in scope. It only focuses on the success of students in a single program at a single university. Further to that, the adjustment factor in the University of Waterloo’s engineering program is applied to 8% of Ontario’s high schools. This puts Grimsby Secondary in the 8% of Ontario high schools who admit students to this elite program. Our records indicate the Global report is based on fewer than four Grimsby students per year,” the letter reads. “... They also noted that GSS students are regularly accepted to this program and do well over their time there. Based on this, I have every confidence our students will continue to be excellent candidates for any post secondary program of study.” “Our staff truly care about our students and they take their responsibility for preparing them for their future very seriously. Our students are always assessed fairly and accurately. When our students excel, I assure you it is because of their hard work and dedication.”

The tax exemption is financial relief to the corporation, not to the Town,” said Hattin after the meeting. “The biodigester cannot pay until it makes money. The Town loses out until the bio is on its feet.” Hattin, who had many questions for council in his presentation, provided all to the Town last week. CAO Derik Brandt made a presentation in which he attempted to answer the questions. “There were no answers to the big questions,” said Hattin, which he characterized as the viabilty of the project, the level of losses, lack of transparency on hydro financials and why there is such a lack of accountability from council. Brandt’s presentation outlined to council that the Town benefits from keeping the full value of the taxes for the site in the community,

but did not touch on anything relating to the utility’s ability to pay any dividend. “Where Derik Brandt’s analysis ended it needs to be expanded upon to get the whole picture,” said Delight Davoli, who attended both the AFC and council meetings, after Monday’s session. “It’s easy to draw teeter totters and to pull $100 bills out of your wallet. But it’s another thing completely to share those financial statements and reveal how those companies are really doing. I would love to hear Derik explain in detail why the “In-

vestment in subsidiary companies” changes every year and whether the number on the balance sheet for that line is the fair market value of what those companies are worth.” “At the end of fiscal 2016 it’s $21.9 million. Is that the combined worth of GPI, GHI and GEI? No, because that’s not what the account measures. GPI is probably worth $30-35 million and according to our bio directors, they spent $10-12 million so they must think GEI is worth $1012 million. So why isn’t the investment in the sub compa-

nies on the Town’s balance sheet something like $40-47 million? Because that’s not how municipal accounting is done.” There was considerable confusion still with aldermen about what the difference between the utility being a private company with shares being wholly owned by the Town. “It’s the shares that are owned by the Town, not the assets,” Hattin clarified for Ald. John Dunstall. “That is why you don’t want to disclose the financials.”

Possible release of hydro financials discussed As part of debate on tax-exempt status for Grimsby’s biodigester, the possiblity of releasing related hydro financials was raised. While Ald. Joanne Johnston noted it is a private business but Town-owned, financials should be made public. “If the Town owns it, why can’t the financials be disclosed,” Johnston said, to an outburst of sustained applause from the near capacity gallery on hand for the meeting. While CAO Derik Brandt gave an outline of the legislative reasons why financials don’t

have to be released, Mayor Bob Bentley noted that competitive reasons are also part of the reasoning. Ald. Dave Wilson picked up on a point many citizens have commented on in recent years in that council, as the corporate shareholder, has a choice if financials are released or not. “Shafee told us that if the Town tells the corporation to release it (financials), hydro can release the financial information,” noted Wilson.

Much of council’s discussion centred around a pending MPAC assessment as both the use and overall tax impact will be determined with that report. On the motion itself to bring the biodigester into the municipal capital facility agreement, alderman seemed uncertain as to what the motion actually meant as it reads, in part, “That the Town of Grimsby exempt from property tax all of the property at 424 Sobie Road...” and “That the municipal capital facility agreement between the Corporation of the Town of Grimsby Energy Inc. be amended,” and “That by-law 15-61 be amended authorizing same.” Despite this wording, Mayor Bob Bentley was very specific when questioned by Ald. Michelle Seaborn that approving the motion meant staff will be authorized to send the matter to lawyers for a review and a formal bylaw will be brought back to council for approval at a later date.

GBF to add convenience to donations in new food drive Grimsby Benevolent Fund will host its inaugural drive-thru food drive at its Elm Street location on Saturday, Sept. 29 from 10 a.m.-1 p.m. “The idea is for community members to drive through our receiving area and volunteers will collect donations right from their vehicle window,” says food bank coordinator Alyssa Zandwyk. Currently, GBF Community Services Foodbank is servicing 5,573 individual visits; 2,092 of which are child visits. “Community members are encouraged to ‘drive-thru’ GBF’s receiving area of the building (located at 40 Elm St. at the back of the building) with donations of non-perishable food items, and volunteers will be collecting right from your car!” said Zandwyk. ‘Dust Storm’ settles at Station One Todd Pyper may not be at the CD release party on Saturday for his long-time friend, John Restas, but he will be there in spirit. Restas will release his third CD, Dust Storm Coming, at Station One Coffee House from 5-7 p.m. this Saturday, Sept. 22. Pyper, who died just over one year ago, helped on recording and produced the new CD – his last such effort. Restas characterizes the CD as “true relationship songs” which were worked on and developed over many years. “A good portion of the songs on the CD are true relationship songs from over the years and ones like, “It’s Not Over” and “Dark Clouds” were from situations where the basic songs were written years ago,” said Restas. “It’s not over was started on piano, then evolved lyrically and arrangement-wise into the finished versions

There are also songs like track 2, “Only Me”, which is about no person or relationship in particular but just a general fictitious kind of love song.” Other tracks started with a riff as opposed to a life experience which generated lyrics. “Track 6, “Porcupine”, just started out with me noodling on the guitar and coming

up with a blues/rock chord/riff and singing the word porcupine as I was warming up before a gig. Then the song evolved into a kind of anti-war rocker but, once again, about no particular event,” said Restas. Regardless of the songs’ origins whether melody or lyrically generated, a constant baseline for his CD is the mastery provided by Pyper.

“Todd’s input, arrangement-wise, was huge as was his input on lyrics,” said Restas. “Lines like ‘beer and bad choices’ and ‘vintage red wine West End Tavern’ were his as well as other lines on the CD. Todd never took writing credit, though, only publishing.” Standouts on the performance side included Todd’s guitar solo and Wurlitzer organ part on “Something Had to Change”; his Dobro slide work on “Alabama One Desire”; his drum track on “It’s Not Over”, and; his harmony vocal on “Don’t Leave Me Lonely”. The evening will include performances from others who worked on the CD: Chuck Jacklin, Sara Weiss and One Guy and a Guitar. “An old bandmate, Rob Birmingham will also perform,” said Restas. Copies of the CD will be available for $10 each, including taxes.

CAO uses magical thinking: reader

Dear Editor, At last night’s council meeting all were treated to a magic act performed by CAO Derik Brandt to explain the need to exempt the biodigester from paying property taxes. Mr. Brandt shifted a prop $100 bill from his right pants pocket to his left pocket, and back again, to show this maneuver would be a zero sum proposition for the town and would also work to stiff the regional and educational portion of their fair share of the municipal levy. Ta-Dah; a big win for the Town. The unseen part of the act was when he simultaneously reached around and pulled bad logic out of his......backside. We’ve been assured the biodigester has been, and will continue to be, an incredible success for the Town (without insight by the public into the books of this so-called private corporation). The enterprise seems to require a lifetime tax holiday to prop up its bottom line. Mr. Brandt claimed the money the biodigester contributes to the town’s coffers is the same, whether it is turned over in the form of a tax payment or a dividend. But that is not a measure of the cost of this accounting trick. The biodigester is likely to be municipally taxed as an industrial ratepayer (the highest bracket). According to Mr. Brandt the division of the pie stays the same no matter who are the contributors. All this financial sleight of hand is done to make an allegedly profitable enterprise appear profitable. The present Council needs to immediately open the biodigester books. Simply changing tax status of the biodigester will not make Grimsby better. What will make Grimsby truly better is a wholesale change in the makeup of Council. It’s up to you to get informed, and for heaven’s (and Grimsby’s) sake get out and vote. Stacy McNeill

More questions than answers Monday’s meeting of Grimsby council had a little bit of everything, but nothing of what some may have expected. Lots of pre-election preening, some significant debate and deafening silence to pointed questions were the orders of the day. But first, interesting timing with public works director Brent Julian bailing from the good ship West Lincoln in favour of joining his former running buddy and recent Niagara Region addition Chris Carter, who was the township’s CAO. Grimsby had peculiar timing when the town hall project went horribly over budget and next thing one knew town manager Gary Shay retired. The Southward Park had major issues – two unbudgeted staff hires and cost overrun issues - and next thing one knew rec services director Bruce Atkinson retired. Now up in West Lincoln, Julian was one of the keys in the MURS process, as was Carter – Carter was the one you may recall who had a highly selective memory regarding the structure of the tender process which ultimately backed council into a corner. Carter left immediately after the project’s passing and, now, Julian departs, also for Region. I hope what materialized for Grimsby’s projects does not follow in West Lincoln. A cost overrun there is the last thing West Lincoln residents need. But back to Monday’s Grimsby soiree....a packed house was on hand. Mayor Bob Bentley was 100 per cent correct in establishing ground rules and calling for best behaviour. Except for one outburst of sustained applause after Ald. Joanne Johnston could

MIKE WILLISCRAFT not help herself from some gratuitous grandstanding on the biodigester - and I call it grandstanding because to say you don’t understand why the financials for the project cannot be released to the public at this point in the race is just not helpful. That ship sailed two-plus years ago, if not three or four. Resident Rob Hattin provided a detailed overview of his beliefs on the bio - ranging from extensive losses, limited revenues from hydro generation and how Town officials’ contentions that a tax-exempt status for the bio was a good thing was wholly inaccurate. Let’s just say council agreed to disagree with Hattin on that last one. Regarding anything significant on the biodigester in terms of operating cost projections and revenue from hydro generation – which would be seriously capped if what staff told Hattin is accurate, that the generator is only running about five hours per day, five days per week... crickets. The meeting mirrored virtually all of the biodigester discussions to date: serious points of concern raised, both by the public and Aldermen Johnston and Dave Kadwell, little or no informative response coming back.

Some attendees actually thought there may be some movement on the information front given that an election is a month away and little on the project has made sense so far. No chance. Bio supporters are going to go down with that ship and part of that is by design. With many having served on hydro’s different boards, they have signed confidentiality agreements and can’t talk if they wanted to...that is unless council votes to take the muzzles off. This point, raised by Ald. Dave Wilson, was the first sign of life from any member of council other than Johnston or Kadwell. Wilson correctly noted that council can, indeed, order Grimsby Energy to release financials relating to the biodigestor or any other aspect of the Town-owned facility. It has been noted repeatedly over the last couple of years that hydro’s wish to keep all matters secret - because it is a private company - is completely by choice. Bentley and other hydro officials have contended this is for competitive reasons. To some degree that would be accurate, but if nobody else has a commercial grade biodigester on the go - certainly not successfully - it is hard to see where any competition on that front could be coming from. It is also important to note that Niagara-on-the-Lake also has a similarly structured hydro and they have no issue not only making their financials public but they also post all online. It is logical to believe they would have the same competitive field to play on as Grimsby, so, what gives? In the end, more questions than answers remain.

Dear Editor, I read the letter from Delight Davoli with great interest (NewsNow Sept. 13, Page 14). In it she detailed how Steve Berry “attempted to ridicule me as I sat quietly in the audience”. This happened during a Finance Committee meeting of which Mr. Berry was chair. Mr. Berry has shown a reluctance to be open and forthcoming with information about the biodigester fiasco for quite some time so this is nothing new. I applaud Dave Kadwell’s attempts to get answers to important questions about this project, rather than the defensiveness that Mr. Berry regularly demonstrates. The biodigester appears to be an ill-conceived and poorly executed project. One that is in need of some very serious public debate, based on a full and open public disclosure. Perhaps the concept of public accountability is a novel concept

Letter to Mr. Berry. A bad decision isn’t magically made good by throwing more money at it, or by eliminating property taxes paid by the biodigester, in a not-so-veiled attempt to make its financial situation look better. Hmm…I guess if we waive the taxes on the project then all of the taxpayers in Grimsby would need to take up the slack and pay more. I totally disagree with that decision. Perhaps the time has come to do an impartial cost/benefit analysis on the project, as well as an ROI assessment. After all of the real facts come out, one option that may need to be considered is to simply shut down the biodigester project and be done with it. I concur with Delight Davoli - I also will not be voting for Steve Berry. My decision for mayor was made some

time ago. As soon as I found out that Jeff Jordan was running for mayor, he had my vote. If Dave Kadwell was representing my ward he’d also have my vote. No other current member of the council would. We need to replace most of Grimsby council. We need people who will make sound financial decisions. We need people who will conduct themselves in a respectful manner with all members of the public, including those like Delight Davoli who was “sitting quietly in the audience”. And, above all else, we need people who will be truly open and transparent…and not just claim to be. We certainly don’t need anyone that exhibits the defensiveness of Mr. Berry. It is an outrage, and an insult to voters, that we have some candidates running for elected office who have decided not to take part in public debates. Apparently this

is a ‘fluid’ situation and some candidates who had previously declined, have since changed their minds (perhaps due to public pressure). Apparently at the time of writing this letter, there were still some holdouts. I encourage all voters to do their homework. Find out which candidates did not originally plan to participate in public debates, and those that still will not be. Do they really deserve your support? As taxpayers we should all ask ourselves a very simple question: “If candidates are not proactively willing to debate issues in an organized, public forum during an election, then why should I vote for any of them?” My viewpoint is simple – we shouldn’t. Each and every one of them should be boycotted on the ballot. They are an insult to our democracy. Grimsby deserves better. Much better. Tom Stirr Grimsby
